CIRCULAR
Cof the joint ministry of finance - transport Circular No. 58-TT/LB dated December 14, 1989 supplements and amends certain points regarding the implementation of traffic fees for road and river transportation
Implementing Decision No. 211-HĐBT dated November 9, 1987 of the Council of Ministers on the collection of traffic fees for road and river transportation and Circulars No. 66-TT/LB dated December 4, 1987 and No. 56-TT/LB dated December 26, 1988 of the joint Ministry of Finance - Transport guiding the implementation of traffic fee collection for road and river transportation has brought about significant results, creating revenue sources to form repair funds, replacing over 50% of the annual budget allocation from the state budget.
To facilitate the organization of traffic fee collection and to partially meet the capital needs for road repairs, the joint Ministry of Finance - Transport stipulates the following supplementary and amended provisions:
1. Previously, traffic fees for road and river transportation were collected from transport vehicles under two forms: collecting fees based on the number of vehicles and collecting fees based on transport revenue. Now, it is unified to collect fees based on registered vehicles. Specific rates are attached.
2. As of January 1, 1990, the joint Ministry of Finance - Transport unifies the task of organizing the collection of traffic fees for road and river transportation as follows:
Departments of Transportation that have been assigned the task of collecting traffic fees must continue to use tax receipts and stamps issued by the tax and commerce administration agencies and be subject to management by local tax authorities regarding issuance, payment, guidance, and inspection of the use of receipts and stamps according to current regulations.
- Units directly responsible for collecting traffic fees at districts and counties must open a traffic fee collection account at the local bank to deposit collected fees. The Department of Transportation shall specify the period within which units must transfer all collected traffic fees into the "Department of Transportation Traffic Fee Collection Account." All collected traffic fees, after deducting a percentage (from 1 to 3%) for the operation of the collection process as specified by the Department of Finance, must be deposited into a separate traffic fee collection account at the Department of Finance on a bi-monthly basis.
The entire amount of traffic fees collected will be allocated to the local budget to fund the maintenance and repair of road and waterway transportation infrastructure in provinces, cities, and special administrative regions according to the division of management by the Council of Ministers and the guidelines of the Ministry of Transport. For the maintenance and repair of roads directly managed by the Ministry of Transport, funding will be provided from the central budget according to the approved annual budget of the Ministry of Transport.
3. Motorized transport vehicles of units under the Ministry of Defense and the Ministry of Interior used for production and business operations, which operate independently economically, must pay traffic fees according to the current regulations applicable to civilian agencies and enterprises.
4. Departments of Transportation must closely coordinate with traffic police agencies to strictly inspect the compliance with traffic fee collection at the local level. A portion of 10% of the fines collected from vehicle owners who violate traffic fee payment regulations should be used to encourage organizations and individuals who report false declarations and evasion of traffic fees. Adequate rewards should be provided to traffic police forces.
These provisions shall take effect from January 1, 1990. Other regulations concerning the collection of traffic fees for road and river transportation not covered in this Circular shall continue to be implemented according to Decision No. 211-HĐBT dated November 9, 1987 of the Council of Ministers and Circulars No. 66-TT/LB dated December 4, 1987 and No. 56-TT/LB dated December 26, 1988 of the joint Ministry of Finance - Transport regulating and guiding the collection of traffic fees for road and river transportation.
