DECREE

On the functions, tasks, powers, and organizational structure of the Committee for Ethnic Minorities and Mountainous Areas

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the opinions of the Standing Committee of the Politburo in Document No. 657/TC-TW dated June 5, 1998, issued by the Central Organization Commission on the tasks of the Committee for Ethnic Minorities and Mountainous Areas;

At the proposal of the Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas, the Minister and Head of the Government's Organization-Cadre Department.

DECREE:

Article 1. The Committee for Ethnic Minorities and Mountainous Areas is an agency of the Government responsible for managing state affairs in the field of ethnic minority and mountainous area work nationwide, and at the same time serves as an advisory body to the Central Party regarding policies towards ethnic minorities and mountainous areas.

Article 2. The Committee for Ethnic Minorities and Mountainous Areas performs the tasks, powers, and responsibilities of managing state affairs of Ministries and agencies equivalent to Ministries as stipulated in Decree No. 15/CP dated March 2, 1993 of the Government, and has the following tasks and powers:

1. Researching and synthesizing issues related to ethnic minorities and mountainous areas. Submitting proposals, policies, laws concerning ethnic minorities and mountainous areas to the Central Party and the Government; issuing legal documents within its authority and organizing their implementation.

Preparing or participating in preparing draft resolutions and directives of the Central Party and the Politburo on policies towards ethnic minorities and mountainous areas.

2. Participating with Ministries, agencies equivalent to Ministries, government agencies, political-social organizations, provincial People's Committees directly under the Central Government on issues related to ethnic minorities and mountainous areas; participating in the review of development strategies, socio-economic plans, science and technology, and foreign-funded projects implemented in ethnic minority and mountainous regions.

3. Directing, inspecting, and auditing the implementation of Party resolutions, State policies, and laws concerning ethnic minorities and mountainous areas nationwide.

4. Implementing tasks related to organizational and cadre work according to the regulations of the Central Party; proposing to the Central Party, the Government, relevant ministries, sectors, and localities on policies, solutions for training, nurturing, and utilizing ethnic minority cadres.

Participating in the training of ethnic minority cadres and organizing the implementation of training and nurturing programs for ethnic cadres and those working in ethnic affairs.

5. Organizing the implementation of international cooperation in the field of ethnic affairs according to the provisions of the law.

6. Leading and coordinating with Party and State agencies, political-social organizations in the dissemination of policies and laws on ethnic affairs.

7. Directing the implementation of certain programs, projects, and pilot models in ethnic and mountainous areas assigned by the Government.

8. Receiving and greeting ethnic communities, understanding their requests and aspirations; leading or coordinating with central ministries, sectors, and localities to resolve legitimate requests of ethnic minority communities.

9. Managing the organization and cadres of the Committee for Ethnic Minorities and Mountainous Areas according to the regulations.

Article 3. The Committee for Ethnic Minorities and Mountainous Areas is led by the Minister and Chairman of the Committee, assisted by Deputy Chairmen appointed by the Prime Minister.

The Minister and Chairman of the Committee is responsible before the Government, the Prime Minister, and the National Assembly for all activities of the Committee. Deputy Chairmen are responsible before the Minister and Chairman for the fields of work assigned by them.

Article 4. The organizational structure of the Committee for Ethnic Minorities and Mountainous Areas includes:

1. Organizations assisting the Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas in performing state management functions:

1. Ethnic Policy Department

2. Mountainous Area Policy Department

3. Synthesis Department

4. International Cooperation Department.

5. Organization-Cadre Department

6. Legal Department

7. Inspectorate

8. Office

9. Specialized agency for ethnic affairs in the South (in Can Tho). The Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas shall define the tasks, powers, and organizational structure of these units as provided in Clause 1 of this Article.

2. Affiliated public service organizations:

1. Institute for Ethnic Minority and Mountainous Area Policy Research

2. Ethnic Minority and Mountainous Area Magazine

3. Ethnic Cadre Training Center

4. Information and Documentation Center

The Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas shall define the functions, tasks, powers, and organizational structures of these public service units as provided in Clause 2 of this Article after consultation with relevant ministries and the Government's Organization-Cadre Department.

3. Enterprises affiliated with the Committee for Ethnic Minorities and Mountainous Areas shall be organized and operated in accordance with the law.

Article 5. The organizational structure assisting local People's Committees in managing state affairs in ethnic minority and mountainous areas shall be established and decided upon by the local People's Committees, the Committee for Ethnic Minorities and Mountainous Areas, and the Government's Organization-Cadre Department.

Article 6. This Decree takes effect 15 days from the date of signature. Decree No. 11/CP dated February 20, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Committee for Ethnic Minorities and Mountainous Areas is hereby repealed.

Article 7. The Minister and Chairman of the Committee for Ethnic Minorities and Mountainous Areas, Ministers, heads of agencies equivalent to Ministries, heads of government agencies, Chairmen of provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
