Pursuant to the Medicine Law on June 14, 2005 and Decree No. 79/2006/NĐ-CP dated August 9, 2006 of the Government detailing the implementation of certain provisions of the Medicine Law;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 and Decree No. 24/2006/NĐ-CP dated March 6, 2006 amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Licenses;
Pursuant to Decree No. 103/2003/NĐ-CP dated September 12, 2003 of the Government detailing the implementation of certain provisions of the Ordinance on Private Medical and Pharmaceutical Practice;
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Finance;
After receiving the opinion of the Ministry of Health at Circular No. 3296/BYT-QLD dated May 14, 2008 regarding amending and supplementing the content and fee rates for reviewing drug registration files and issuing import permits for drugs;
At the proposal of the Director of the Policy Department;
DECISION:
Article 1. Issuing with this decision the Table of Fee Rates for Reviewing Conditional Commercial Activities in the Health Sector, Fees for Reviewing Standards and Conditions for Practicing Medicine and Pharmacy, and the Table of License Fee Rates for Exporting and Importing, replacing the Table of Fee Rates issued together with Decision No. 44/2005/QĐ-BTC dated July 12, 2005 of the Minister of Finance on the regime for collecting, remitting, managing, and using fees for reviewing conditional commercial activities in the health sector, fees for reviewing standards and conditions for practicing medicine and pharmacy, and license fees for exporting and importing and issuing practice certificates for medicine and pharmacy (hereinafter referred to as Decision No. 44/2005/QĐ-BTC).
Article 2. Amending and supplementing Clause 1 of Article 4 of Decision No. 44/2005/QĐ-BTC as follows:
"1. The fee and license fee collection agency shall retain 80% (eighty percent) of the total amount collected from fees and license fees to cover expenses for fee and license fee collection according to the expenditure items specified in Clause 8 of Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of legal provisions on fees and license fees and certain specific expenditure items as follows:
a) Expenses for sending domestic experts abroad and inviting foreign experts to Vietnam to inspect mutual recognition of production conditions and product quality for the purpose of performing review work, assessment, and fee collection;
b) Expenses for purchasing office equipment to serve the performance of review work, assessment, and fee collection."
Article 3. This Decision takes effect 15 days after its publication in the Official Gazette.
Article 4. In the course of implementation, if there are any difficulties, it is recommended that agencies, organizations, and individuals promptly reflect them to the Ministry of Finance for study and supplementary guidance./.
