DECREE
Amending and supplementing certain provisions on the system and policies for officers and non-commissioned officers of the People's Public Security who have retired, died, or passed away, as stipulated in Decree No. 43/2007/NĐ-CP dated March 26, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on the People's Public Security
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Public Security Law dated November 29, 2005;
Considering the proposal of the Minister of Public Security,
DECREE:

Article 1. Amending and supplementing certain provisions on the system and policies for officers and non-commissioned officers of the People's Public Security who have retired, died, or passed away, as stipulated in Decree No. 43/2007/NĐ-CP dated March 26, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on the People's Public Security, as follows:

1. Supplement Clause 3 to Article 17 as follows:

"Article 17. System and policies for officers of the People's Public Security who have retired
3. Officers who retire before the maximum service age specified in Clause 1, Article 28 of the Law on the People's Public Security due to changes in organization and staffing as decided by the competent authority shall be entitled to a one-time allowance including:
a) They shall receive a one-time allowance of three months' salary for each year retired before the age limit;
b) An allowance equivalent to five months' salary for the first twenty years of service. For each year of service from the twenty-first year onwards, an allowance equivalent to half a month's salary will be provided."

2. Supplement Article 19a following Article 19 as follows:

"Article 19a. System and policies for officers and non-commissioned officers of the People's Public Security who have received salaries and died, passed away
1. Officers and non-commissioned officers who have received salaries and died and are recognized as martyrs, their relatives shall enjoy benefits according to the laws on preferential treatment for persons with meritorious service to the revolution, laws on social insurance, and a one-time allowance, with each year of service entitling them to an allowance equivalent to one month's salary of the officer or non-commissioned officer prior to death. 2. Officers and non-commissioned officers who have received salaries and passed away, their relatives shall enjoy benefits according to the laws on social insurance and a one-time allowance, with each year of service entitling them to an allowance equivalent to one month's salary of the officer or non-commissioned officer prior to passing away."

3. Article 20 is amended and supplemented as follows:

"Article 20. Conversion of time for calculating benefits when officers and non-commissioned officers of the People's Public Security who have received salaries retire, change careers, or cease serving in the People's Public Security
1. Officers and non-commissioned officers who have received salaries and have time directly engaged in combat, serving in combat, or working in areas or professions with special characteristics shall be eligible for conversion of time for calculating one-time allowances when ceasing service in the People's Public Security. Specifically, as follows:
a) Officers and non-commissioned officers who have received salaries and have time directly engaged in combat or serving in combat shall have that time converted at a rate of one year equal to one year and six months;
b) Officers and non-commissioned officers who have received salaries and have time working in areas with a 100% special area allowance or jobs classified as particularly arduous, toxic, or dangerous work shall have that time converted at a rate of one year equal to one year and four months;
c) Officers and non-commissioned officers who have received salaries and have time working in areas with a special area allowance of 0.7 or higher or jobs classified as arduous, toxic, or dangerous work shall have that time converted at a rate of one year equal to one year and two months. In cases where within the same period of work, officers and non-commissioned officers meet two or three of the above conditions, they shall be entitled to the highest conversion rate. In cases where the time worked is not continuous, it can be accumulated to determine the total time eligible for benefits.
2. The additional time resulting from the conversion under Clause 1 of this Article shall be calculated for one-time allowances at a rate of one year entitling to one month's salary."

Article 2. Funding for Implementation

The State budget shall ensure the funding for implementing the subsistence allowances prescribed in this Decree in accordance with the State Budget Law.

Article 3. Effectiveness

This Decree takes effect from July 20, 2010.

Article 4. Responsibilities for Implementation

1. The Ministry of Public Security shall take the lead and coordinate with the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Finance, and the Ministry of Home Affairs to be responsible for guiding the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree./.
