CIRCULAR
Issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam

Pursuant to the Law on Quality of Products and Commodities dated November 21, 2007;
Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/ND-CP amending Article 3 of Decree No. 01/2008/ND-CP of the Government;
Pursuant to Decree No. 113/2003/ND-CP dated October 7, 2003 of the Government on management of fertilizer production and business; Decree No. 191/2007/ND-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/ND-CP dated October 7, 2003 of the Government on management of fertilizer production and business;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality and Goods;
The Ministry of Agriculture and Rural Development issues the Supplementary List of fertilizers permitted for production, business, and use in Vietnam,
Article 1. Issued together with this Circular
1. The Supplementary List of fertilizers permitted for production, business, and use in Vietnam (Annex 01 issued together with this Circular) includes 262 types, divided into:
a) Single mineral fertilizers: 01 type;
b) Organic fertilizers: 03 types;
c) Bio-fertilizers: 04 types;
d) Combined organic and bio-fertilizers: 22 types;
đ) Biological organic fertilizers: 12 types;
e) Combined organic and mineral fertilizers: 37 types;
g) Foliar fertilizers: 182 types;
h) Fertilizers supplemented with substances enhancing fertilizer efficiency: 01 type.
2. The list of fertilizer types already included in the List of fertilizers permitted for production, business, and use in Vietnam but with changes in name or registration organization/person (Annex 02 issued together with this Circular) includes 78 types, divided into:
a) Organic fertilizers: 02 types;
b) Bio-fertilizers: 04 types;
c) Combined organic and bio-fertilizers: 03 types;
d) Biological organic fertilizers: 17 types;
đ) Combined organic and mineral fertilizers: 09 types;
e) Foliar fertilizers: 41 types;
g) Rare earth fertilizers: 02 types.
Article 2. Organizations and individuals permitted to produce, trade, and use the types of fertilizers listed in this Supplementary List must meet the conditions stipulated in Article 5 of Decree No. 113/2003/ND-CP dated October 7, 2003 of the Government on management of fertilizer production and business; stipulated in Clause 4, Article 1 of Decree No. 191/2007/ND-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/ND-CP dated October 7, 2003 of the Government on management of fertilizer production and business.
Article 3. This Circular takes effect forty-five days from the date of issuance. This Circular replaces Decision No. 55/2006/QĐ-BNN dated July 7, 2006 of the Minister of Agriculture and Rural Development on issuing the "Supplementary List of fertilizers permitted for production, business, and use in Vietnam."
Article 4. The Director of the Ministry's Office, the Director of the Crop Cultivation Department, the Director of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, and the heads of related units are responsible for implementing this Circular./.
