This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.

Pursuant to Decree No. 85/2012/NĐ-CP dated October 15, 2012 of the Government on the mechanism of operation and financial mechanism for public health service units and prices of medical services provided by public medical facilities;

Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under DECREES:provincial people's committees, centrally governed citiesNo. - Government Portal; Official Gazette;

At the request of the Director of the Department of Maternal and Child Health, the DirectorưởArticle 1. Public service units in the field of education and training established by competent authorities according to Article 2 of Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on establishment, restructuring, and dissolution of public service units (except educational institutions with School Councils established under specialized laws, performing the functions, duties, and powers of School Councils as prescribed by specialized laws and performing the functions of Management Boards as prescribed in Decree No. 120/2020/NĐ-CP).

The Minister of the Ministry of Science and Technology issues this Circular on the issuance of National Technical Regulations on Radioactive Waste Containing Naturally Occurring Radioactive Materials.ưởof the Ministry of Health issues this Circular to prescribe the functions, tasks, powers, and organizational structure of the Reproductive Health Care Centerurights and organizational structure of the Reproductive Health Care Centershallreproductive health care ;of centrally governed cities.

Article 1. Position and Functions

1. The Reproductive Health Care Center of the province, centrally governed city (hereinafter referred to as the Reproductive Health Care Center of the province) is a public health service unit under the Provincial Department of Health, with the function of assisting the Director of the Provincial Department of Health in directing and organizing the implementation of state management tasks and professional technical tasks related to reproductive health care within the province; organizing the provision of public health services according to the provisions of the law.

2. The Reproductive Health Care Center of the province has legal personality, its own seal, bank account, and office location as prescribed by law.

3. The Reproductive Health Care Center of the province is subject to the direction and management of the Provincial Department of Health regarding organizational activities and resources; at the same time, it is subject to the direction, inspection, auditing, and professional guidance of the Ministry of Health.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Develop plans and organize the implementation of professional and technical tasks related to reproductive health throughout the province based on the orientation, policies, strategies, and plans of the Ministry of Health and the actual situation in the locality, to be submitted to the Director of the Provincial Department of Health for approval, including the following contents: women's health care, maternal health; newborn and child health; maternal and child nutrition; adolescent and youth reproductive health; male reproductive health and elderly health; family planning services; safe abortion; prevention and control of reproductive tract infections and cancers; prevention and treatment of infertility.

2. Serve as the coordinating body to direct, guide, and inspect professional and technical activities related to reproductive health care for healthcare facilities within the province in collaboration with relevant units.

3. Collaborate with relevant units to organize and implement information dissemination, education activities related to reproductive health care within the province. Be responsible for the professional content of reproductive health care in communication activities.

4. Develop plans and organize continuous training for staff involved in professional and technical work related to reproductive health care according to the provincial and central plans; participate in training and continuous training on reproductive health care according to the provincial and central plans within the province; serve as a practical base for healthcare training institutions at both provincial and central levels in the field of reproductive health.

5. Conduct research and participate in scientific research and application of technological advancements in the field of reproductive health care.

6. Manage and organize the implementation of programs, projects, and initiatives related to reproductive health care within the province, approved by competent authorities.

7. Organize the provision of reproductive health care services according to the provisions of the law.

8. Organize the implementation of monitoring, evaluation, supervision of activities related to reproductive health care within the province. Participate in specialized inspection teams on reproductive health care when required.

9. Implement personnel management, labor management, and financial management of the unit according to the provisions of the law.

10. Implement statistical and reporting systems as prescribed by law.

11. Perform other tasks and powers assigned by the Director of the Provincial Department of Health and competent authorities.

Article 3. Organizational Structure

1. Leadership of the Center

a) The Reproductive Health Care Center of the province shall have a Director and Deputy Directors as prescribed by law;

b) The Director of the Reproductive Health Care Center of the province is responsible to the Director of the Provincial Department of Health and the law for all activities of the Center;

c) Deputy Directors of the Reproductive Health Care Center of the province assist the Director in managing one or more areas of work assigned by the Director; they are responsible to the Director and the law for the tasks assigned. In the absence of the Director, one Deputy Director may be authorized by the Director to manage the Center's operations;

d) The appointment and removal of the Director and Deputy Directors of the Reproductive Health Care Center of the province shall be carried out in accordance with the law and the cadre management authority of the provincial People's Committee.

2. Functional Departments

b) Planning and Finance Department.

3. Specialized Departments

a) Department of Maternal Health and Family Planning;

b) Department of Child Health and Malnutrition Prevention;

c) Department of Adolescent and Youth Reproductive Health;

d) Assisted Reproductive Technology and Andrology Department;

đ) Obstetrics and Gynecology Outpatient Clinic. For the form of General Outpatient Clinic and Maternity Home, they can only be established when meeting the conditions stipulated by relevant laws, aligning with the national plan for developing the healthcare system in the province, and being approved by the competent authority.

In addition to the departments mentioned above, depending on the specific needs and capabilities of the Center, the competent authority may establish additional departments when conditions permit and in accordance with the law.

(Guidelines for detailed tasks of departments under the Reproductive Health Care Center of the province are set forth in the Appendix attached to this Circular).

Article 4. Job positions and number of staff

1. Job positions, number of staff, and the structure of civil servants according to occupational titles of the Provincial Reproductive Health Care Center shall be determined based on the job position project of the Center which has been reviewed and approved by the competent state agency in accordance with the law. In addition to the assigned human resources, the Director of the Provincial Reproductive Health Care Center may enter into labor contracts to meet the requirements of tasks and workload as stipulated by law.

2. The management and utilization of human resources of the Provincial Reproductive Health Care Center shall be carried out in accordance with the provisions of the law.

Article 5. Effective Date

This Circular takes effect from February 15, 2016.

Decision No. 23/2006/QĐ-BYT dated August 8, 2006 of the Minister of Health regarding the functions, tasks, authorities, and organizational structure of the Provincial Reproductive Health Care Center shall cease to be effective from the date this Circular takes effect.

Article 6. Responsibility for Implementation

1. The Department of Maternal and Child Health, Ministry of Health shall be responsible for organizing, guiding, and inspecting the implementation of this Circular.

2. The Department of Health of the province/city directly under the Central Government shall, based on the provisions of this Circular and the regulations of the People's Committee of the province/city directly under the Central Government (if any), specify the functions, tasks, authorities, and organizational structure of the Provincial Reproductive Health Care Center.

During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly report to the Ministry of Health (Department of Maternal and Child Health) for consideration and resolution within their authority.

ANNEX

Guidelines for detailed tasks of each department/section

belonging to the Provincial Reproductive Health Care Center

(Annexed to Circular No. 59/2015/TT-BYT on 31 the 12  the year 2015 of the Ministryưởof Health)

1. Organization and Administration Section

a) Serve as the focal point assisting the Director of the Center in organizational work, managing cadres, civil servants, employees, and personnel; salary policies, incentive awards, disciplinary measures of the Center in accordance with the law and protecting internal political stability of the Center;

b) Organize the implementation of administrative tasks, management, application of information technology, documentation, and archival services for the operation of the Center;

c) Coordinate with departments and sections in training and continuous education activities;

d) Coordinate with departments and sections to organize seminars, conferences, and training sessions on reproductive health care;

đ) Manage the physical infrastructure and assets of the Center;

e) Implement statistical and reporting systems as prescribed;

g) Perform other tasks and authorities delegated by the Director of the Center.

2. Planning and Finance Section

a) Develop monthly, quarterly, and annual plans; organize mid-term and final reviews of plan implementation;

b) Develop budget estimates and annual financial usage plans; manage and allocate funds for activities serving reproductive health care work according to the approved plan, bear responsibility for consolidating, reporting, settling accounts, and archiving accounting records in accordance with the law;

c) Consolidate needs, forecast, allocate, and manage medicines, chemicals, materials, and equipment serving the activities of the Center and the service delivery network for reproductive health care within the province managed by the Center;

d) Organize the collection and payment of various fees, charges, and medical services of the Center in accordance with the law;

đ) Serve as the focal point for collecting information, analyzing data on reproductive health care throughout the province, implementing statistical and reporting systems as prescribed;

e) Serve as the focal point for consolidating the activities of domestic and international programs, projects of the Center;

g) Serve as the focal point for developing and implementing research and scientific work plans;

h) Coordinate with departments and sections within the Center to monitor and inspect specialized activities and policies related to reproductive health care in the province;

i) Coordinate with relevant departments and sections to develop and implement communication, education, and health promotion activities, and improve maternal and child nutrition;

k) Coordinate with relevant departments and sections to organize seminars, conferences, training, and continuous education sessions on professional and vocational reproductive health care for healthcare workers;

l) Perform other tasks and authorities delegated by the Director of the Center.

3. Women's Health Care and Family Planning Departmenta) Develop and implement specialized technical tasks related to women's health care, maternal health care, family planning services, safe abortion, prevention and control of reproductive tract infections, sexually transmitted infections, early detection and treatment of reproductive cancer, prevention and treatment of infertility, prenatal and newborn screening;

b) Serve as the focal point for implementing related programs and projects concerning women's health care, maternal health care, family planning services, safe abortion, prevention and control of reproductive tract infections, sexually transmitted infections, early detection and treatment of reproductive cancer, prevention and treatment of infertility, prenatal and newborn screening;

c) Guide, inspect, supervise, and provide technical support to lower levels on women's health care, maternal health care, family planning services, safe abortion, prevention and control of reproductive tract infections, sexually transmitted infections, early detection and treatment of reproductive cancer, prevention and treatment of infertility, prenatal and newborn screening;

d) Participate in organizing information dissemination, communication, and health education activities on reproductive health care;

đ) Participate in scientific research and professional training for Center staff and lower levels on women's health care, maternal health care, family planning services, safe abortion, prevention and control of reproductive tract infections, sexually transmitted infections, early detection and treatment of reproductive cancer, prevention and treatment of infertility, prenatal and newborn screening.

d) Participate in scientific research, training and professional development on women's health care, maternal health, family planning services, safe abortion, prevention and control of reproductive tract infections, sexually transmitted infections, early detection and treatment of gynecological cancers, prevention and treatment of infertility, prenatal and newborn screening for staff of the Center and lower levels;

e) Implement statistical and reporting systems as prescribed;

g) Perform other tasks and authorities delegated by the Director of the Center.

4. Department of Child Health Care and Prevention and Control of Malnutrition

a) Develop plans and organize the implementation of specialized and technical tasks related to child health care and improving the nutritional status of mothers and children;

b) Guide, inspect, supervise, and provide professional and technical support to lower levels regarding child health care and improving the nutritional status of mothers and children;

c) Serve as the focal point for implementing programs and projects related to child health care and improving the nutritional status of mothers and children;

d) Participate in scientific research work and training to enhance professional skills related to child health care and improving the nutritional status of mothers and children for Center staff and lower levels;

đ) Participate in information, communication, and health education activities related to child health care and improving the nutritional status of mothers and children;

e) Implement statistical and reporting systems as prescribed;

g) Perform other tasks and authorities delegated by the Director of the Center.

5. Department of Adolescent and Youth Reproductive Health Care

a) Develop plans and organize the implementation of specialized and technical tasks related to adolescent and youth reproductive health care;

b) Guide, inspect, supervise, and provide professional and technical support to lower levels regarding adolescent and youth reproductive health care;

c) Serve as the focal point for implementing programs and projects related to adolescent and youth reproductive health care in accordance with the provisions of the law;

d) Participate in scientific research work and organize the implementation of training to enhance professional skills related to adolescent and youth reproductive health care for Center staff and lower levels;

đ) Participate in information, communication, and health education activities related to adolescent and youth reproductive health care;

e) Implement statistical and reporting systems as prescribed;

g) Perform other tasks and authorities delegated by the Director of the Center.

6. Department of Male Reproductive Health Care and Elderly Health Care age

a) Develop plans and organize the implementation of specialized and technical tasks related to male reproductive health care and elderly health care;

b) Guide, inspect, supervise, and provide professional and technical support to lower levels regarding male reproductive health care and elderly health care;

c) Serve as the focal point for implementing programs and projects related to male reproductive health care and elderly health care;

d) Participate in scientific research work and organize the implementation of training to enhance professional skills related to male reproductive health care and elderly health care for Center staff and lower levels;

đ) Participate in information, communication, and health education activities related to male reproductive health care and elderly health care;

e) Implement statistical and reporting systems as prescribed;

g) Perform other tasks and authorities delegated by the Director of the Center.

7. Obstetrics and Gynecology Outpatient Clinic

The Obstetrics and Gynecology Outpatient Clinic may only operate when it has a Practice Permit for Diagnosis and Treatment and must operate within the scope of specialization and approved technical procedures as determined by the competent authority.
