DECREE

On the organization of funerals for officials, civil servants, and public employees

 

Decree No. 105/2012/ND-CP dated December 17, 2012 of the Government on the organization of funerals for officials, civil servants, and public employees, which took effect from February 1, 2013, has been amended and supplemented by:

Decree No. 237/2025/ND-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/ND-CP dated December 17, 2012 of the Government on the organization of funerals for officials, civil servants, and public employees, which took effect from August 29, 2025.

Based on the Law on the Organization of the Government dated December 25, 2001;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates the Decree on the organization of funerals for officials, civil servants, and public employees[1].

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation and Applicability

This Decree stipulates the organization of funerals for officials, civil servants, and public employees who are working or retired at the time of their death (hereinafter referred to collectively as the deceased).

Article 2. Principles of funeral organization

1. The organization of funerals for the deceased reflects the respect of the Party, State, and people, agencies, and units for the contributions of officials, civil servants, and public employees during their work and revolutionary activities, construction, and defense of the country.

2. The organization of funerals for the deceased must be solemn, civilized, inheriting the beautiful cultural traditions of the nation, economical in accordance with the economic and social conditions of the country and each region; limiting and gradually eliminating backward customs, superstitions, ostentation, and waste. Encouraging the organization of burials through cremation, electric cremation, and burial in hometowns.

Article 3. Funeral rituals[2]

1. Officials, civil servants, and public employees who are working or retired at the time of their death shall have their funerals organized according to one of the following rituals:

a) National Funeral.

b) State Funeral.

c) High-Level Funeral.

d) Funeral for officials, civil servants, and public employees.

2. Changing funeral rituals outside the cases specified in this Decree shall be carried out according to the regulations of the competent authority.

Article 4. Other Provisions

1. The wake shall be held at the funeral home, and the funeral procession and burial ceremony shall take place on the same day (except for the National Funeral).

2.[3] In case the wake is held at the family's residence, it shall be conducted according to local customs and the family's practices, with the body of the deceased being placed in a coffin and ensuring hygiene, especially for those with infectious diseases. The period from when the body is placed in the coffin until the burial ceremony takes place shall comply with the provisions of the law on preventing and controlling infectious diseases.

3.[4] When placing the coffin, depending on the condition of the body, customs, practices, circumstances, and conditions of each family, appropriate types of coffins shall be used to ensure no environmental pollution or disease outbreaks occur.

4.[5] It is prohibited to scatter or spread domestic currency issued by the State Bank of Vietnam and foreign currencies during the funeral procession from the funeral home or family to the burial site; it is also prohibited to burn paper offerings at the burial site.

Limit the scattering or spreading of paper money in funerals.

5. Only members of the National Funeral Committee and the Funeral Organizing Committee may wear black mourning bands (7 cm wide) on their left arm.

6.[6] Encourage organizations and individuals to use rotating wreaths during the wake.

The Funeral Organizing Committee prepares rotating wreaths; in the announcement of condolences, it should state: Delegations attending the wake do not bring wreaths, only bring black ribbons measuring 1.2 m x 0.2 m, with white letters "In Condolence" below which is a smaller line indicating the name of the agency or organization to be attached to the wreath prepared by the Funeral Organizing Committee.

Chapter II

NATIONAL FUNERAL

 

Article 5. Titles for which State Funeral Ceremonies are held

1. Officials holding or having held any of the following positions at the time of their death shall have a State Funeral Ceremony organized:

a) General Secretary of the Central Committee of the Communist Party of Vietnam;

b) President of the Socialist Republic of Vietnam;

c) Prime Minister of the Socialist Republic of Vietnam;

d) Chairman of the National Assembly of the Socialist Republic of Vietnam.

2.[7] The organization of a State Funeral Ceremony for other high-ranking officials who have made significant contributions and great achievements to the revolutionary cause of the Party, State, and people, and who enjoy high prestige both domestically and internationally, shall be carried out according to the decision of the Politburo.

3.[8] In cases where the deceased held one of the positions specified in Clause 1 of this Article and was relieved of duty, retired early, or retired due to violation or shortcoming before the retirement age, the funeral will be organized according to the high-level funeral protocol.

Article 6. Announcement of the State Funeral Ceremony

The following agencies shall jointly issue the announcement regarding the State Funeral Ceremony:

1. The Central Committee of the Communist Party of Vietnam;

2. The National Assembly of the Socialist Republic of Vietnam;

3. The President of the Socialist Republic of Vietnam;

4. The Government of the Socialist Republic of Vietnam;

5. The Central Committee of the Vietnam Fatherland Front.

Article 7. National Funeral Committee and Funeral Organization Committee

1.[9] The establishment of the National Funeral Committee shall be implemented according to the decision of the Politburo, consisting of at least 25 members representing the Politburo, the Secretariat, the Central Committee, the National Assembly, the President, the Government, the Central Committee of the Vietnam Fatherland Front, central mass organizations, the agency where the deceased worked or worked at, and representatives of the leadership of the province or centrally-administered city where the deceased's hometown or place of birth is located.

a) The National Funeral Committee has the responsibility to direct the organization of the State Funeral Ceremony in accordance with this Decree;

b)[10] The National Funeral Committee shall be headed by the General Secretary of the Central Committee of the Communist Party of Vietnam or the President of the Socialist Republic of Vietnam.

2.[11] The establishment of the Funeral Organization Committee shall be implemented according to the decision of the Politburo, consisting of at least 15 members representing central ministries, sectors, localities where the deceased's hometown or place of birth is located, and representatives of the deceased's family.

a) The Funeral Organization Committee has the responsibility to assist the National Funeral Committee in managing the agencies that are members of the Funeral Organization Committee and those participating in organizing the State Funeral Ceremony as stipulated in this Decree;

b)[12] Head of the Funeral Organization Committee:

In cases where the deceased held one of the positions specified in Clause 1 of Article 5 of this Decree had retired, the Head of the Funeral Organization Committee is the Deputy Prime Minister in charge of routine work.

In cases where the deceased held one of the positions specified in Clause 1 of Article 5 of this Decree was still working, depending on the deceased's position, the Head of the Funeral Organization Committee is one of the members of the Standing Secretariat; Vice President; Deputy Prime Minister in charge of routine work; Vice Chairman in charge of routine work of the National Assembly.

In cases specified in Clause 2 of Article 5 of this Decree or not falling under the aforementioned cases, the Head of the Funeral Organization Committee shall be determined according to the decision of the Politburo.

Article 8. Documents on the State Funeral Ceremony[13]

1. The drafting of documents on the State Funeral Ceremony (the press release on the State Funeral Ceremony; the list of the National Funeral Committee, the Funeral Organization Committee, the biography of the deceased person; the announcement on the visitation ceremony, the funeral ceremony, and the burial ceremony) shall be chaired by the Central Organization Committee, coordinated with the Central Propaganda and Mass Mobilization Committee, the Central Party Office, the management agency of the deceased person, and relevant agencies, and approved by the National Funeral Committee.

2. The drafting of the Eulogy and the Thanking Speech shall be chaired by the Central Propaganda and Mass Mobilization Committee, coordinated with the Central Organization Committee, the Central Party Office, and the management agency of the deceased person; it must obtain the opinion of the family of the deceased person before being approved by the National Funeral Committee.

Article 9. Announcing and Publishing Information on the State Funeral Ceremony on Communication Media

1. Announcing Sad News

Prior to the official announcement by the Funeral Organization Committee, mass communication media may only publish brief news about the death. After the establishment of the Funeral Organization Committee and the official announcement of the funeral arrangements, mass communication media may announce sad news and publish articles introducing the deceased person.

2. Publishing Information on Communication Media

a) The People's Newspaper and central and local press agencies shall publish information on the State Funeral Ceremony, including: the press release, the list of the National Funeral Committee, the Funeral Organization Committee; the biography, photograph of the deceased person; the mourning rituals nationwide; announcements on the visitation ceremony, the funeral ceremony, the burial ceremony, and the Thanking Speech of the National Funeral Committee;

b)[14] The Central Documentary and Scientific Film Studio will film documentary footage of the funeral. Vietnam Radio, Vietnam News Agency will report and broadcast; Vietnam Television will broadcast live the main content of the visitation ceremony, the entire funeral ceremony, the procession (in case of non-aircraft transportation), and the burial ceremony.

Article 10. Duration and Mourning Rituals

The duration of the State Funeral Ceremony is two days. During this period, all agencies and offices throughout the country and Vietnamese representative offices abroad shall fly flags at half-mast with mourning bands (with dimensions equal to 1/10 the width of the flag, length along the length of the flag, and only flown up to 2/3 the height of the flagpole, using black cloth tied without allowing the flag to flutter), and shall not organize public entertainment activities.

Article 11. Location for the State Funeral Ceremony and Burial Site

1.[15] The State Funeral Ceremony shall be held at the National Funeral House No. 5 Tran Thanh Tong Street, Hanoi (if held in Hanoi); the Southern National Funeral House or the Ho Chi Minh City Funeral House (if held in Ho Chi Minh City).

2. Burial shall take place at Mai Dich Cemetery, Hanoi; Ho Chi Minh City Cemetery or cremation, incineration, and burial at the hometown or other local cemetery according to the wishes of the family.

Article 12. Decorations of the Altar and Guarding the Coffin

1. The altar shall be decorated with a black background, featuring the national flag with a mourning band, the photograph of the deceased person, and white letters reading "Deeply Mourned Comrade...".

2. The altar table shall be placed centrally in the room, below the altar, with an incense burner and a cushion for medals.

3. The coffin shall be covered with the national flag, placed centrally on the altar platform, with the head facing the altar table.

4. The Funeral Organization Committee shall assign members of the Funeral Organization Committee to stand guard when high-level delegations from the Central Party, National Assembly, President, Government, and Central Vietnam Fatherland Front come to pay respects.

5. During the visitation and funeral ceremonies, two honor guards shall stand at the entrance of the funeral hall; four military officers in ceremonial uniform shall stand guard at each corner of the coffin, and six honor guards shall stand guard around the coffin and serve the funeral music for the visitation, funeral, and procession ceremonies.

Article 13. Wreaths at the Funeral Ceremony[16]

The Funeral Organization prepares six wreaths of the same size, with red ribbons bearing gold letters from the Central Committee of the Communist Party of Vietnam, the National Assembly, the State President, the Government, the Central Committee of the Vietnam Fatherland Front, and the family. After the delegations have paid their respects, these wreaths are placed permanently on both sides of the altar.

Article 14. Visitation Ceremony[17]

1. Visitation at the Funeral Hall

a) The Funeral Organization arranges the delegations to pay their respects in the following formation: two soldiers carrying wreaths lead the way, followed by the Head of the Delegation, with an officer leading the visitation on the right side behind the Head of the Delegation, and the members of the delegation walking in two columns.

b) The Funeral Organization organizes the reception and arrangement of foreign delegations, diplomatic missions, consular offices, representative offices of international organizations in Vietnam, and other foreign agencies and individuals who wish to pay their respects and sign the condolence book.

c) After paying respects, the Head of the Delegation signs the condolence book.

d) During the visitation, military musicians play the "Soul of the Martyr" music.

2. Simultaneously with the National Funeral Ceremony, the organization of the visitation ceremony at the hometown or another location of the deceased is carried out according to the decision of the State Funeral Committee.

Article 15. Organization of the Visitation Ceremony Abroad

1. Simultaneously with the National Funeral Ceremony in Vietnam, the Ministry of Foreign Affairs guides Vietnamese representative offices abroad to welcome organizations and individuals, both Vietnamese and foreigners, to pay their respects and sign the condolence book at Vietnamese representative offices abroad.

2. Decorations for the memorial platform:

a) The memorial platform is decorated with a black background, the National Flag hanging above with a mourning ribbon, a photo of the deceased, and white letters reading "Deeply Mourned Comrade...";

b) The altar is placed in the center of the room, below the memorial platform with an incense urn; two fixed wreaths are placed on both sides of the altar;

c) A table for signing the condolence book.

Article 16. Memorial Service

1. Participants in the Memorial Service include: the State Funeral Committee; the Funeral Organization; the family and relatives; representatives of the agencies, units, and localities of the deceased.

2. Positions of the delegations attending the Memorial Service

a) The family stands on the left side of the funeral hall (facing towards the memorial platform);

b) Party and State leaders stand on the right side of the funeral hall (facing towards the memorial platform);

c) Delegations of ministries, departments, other entities, standing forces, and the military band stand according to the arrangement of the Funeral Organization.

3. Program of the Memorial Service

a) The Head of the Funeral Organization announces the commencement of the Memorial Service;

b)[18] Military musicians play the National Anthem of Vietnam;

c) The Head of the State Funeral Committee reads the eulogy and declares a moment of silence;

d) During the moment of silence, military musicians play the "Soul of the Martyr" music;

đ) The Head of the Funeral Organization announces the conclusion of the Memorial Service.

4. Simultaneously with the Memorial Service at the central level, local leaders from the hometown or birthplace of the deceased organize a Memorial Service locally.

Article 17. Burial Ceremony

1. Participants in the Burial Ceremony include: the State Funeral Committee; the Funeral Organization; the family and relatives; representatives of the agencies, units, and localities of the deceased.

2.[1When transferring the coffin from the funeral hall to the hearse and from the hearse to the grave site, there will be one officer carrying the photo, one officer carrying the cushion with medals, and one officer carrying the flag leading the way in front of the coffin; the working team consists of one officer and twelve or more soldiers transferring the coffin from the funeral hall to the hearse, and from the hearse to the grave site; the Head and Deputy Head of the State Funeral Committee jointly carry the coffin (at the head of the coffin); the family and other members follow behind the coffin.

Article 18. Forces and Means Serving Funeral Services

1. The forces serving funeral services are prepared by the Ministry of National Defense, including:

a) Forces serving the Wake Service: four officers on duty at a distance of 1.5 meters from the coffin; six soldiers with bayoneted SKS rifles on duty standing outside at a distance of 0.7 meters from the officers on duty; two soldiers as honor guards standing in front of the funeral house; flower-carrying forces; leading officers for the wake service; military band forces serving the Wake Service;

b) Forces serving the Memorial Service: four officers on duty at each corner at a distance of 1.5 meters from the coffin; six soldiers with bayoneted SKS rifles on duty standing outside at a distance of 0.7 meters from the officers on duty; two soldiers as honor guards standing in front of the funeral house; one group of National Flag; one group of Military Flag; honor guard forces of three Military Branches (127 officers and soldiers); military band forces serving the Memorial Service;

c) Forces serving the Burial Procession: one officer carrying the portrait, one officer carrying the cushion of Medals, one officer wrapping the flag; a working team consisting of one officer and twelve soldiers carrying the coffin; seven soldiers preparing the funeral vehicle; honor guard forces of three Military Branches;

d) Forces serving the Interment Service: twenty-seven soldiers performing the role of honor guards at the cemetery gate; a burial detail force of thirteen soldiers; honor guard forces of three Military Branches; military band forces serving the Interment Service.

2. The means serving funeral services are prepared by the Ministry of National Defense, including: one command vehicle; one vehicle carrying the National Flag, portrait, and cushion of Medals; one vehicle carrying the Military Flag; six vehicles carrying the honor guard formation; one flower vehicle; one vehicle pulling the funeral vehicle (with a 122mm howitzer at the rear of the funeral vehicle); one spare vehicle; two communication vehicles; one ambulance.

3. The coffin is covered with the National Flag and placed inside a glass case on top of the funeral vehicle.

Article 19. Burial Ceremony

1. After the working team moves the coffin to its burial position, the Head of the Funeral Organization Committee announces the start of the Burial Ceremony.

2. The working team performs the task of lowering the coffin into the grave.

3. The Head of the Funeral Organization Committee invites Party and State leaders, family members to throw the first handful of soil and walk around the grave to bid farewell.

4. The working team continues to complete the grave.

5. During the Burial Ceremony and the filling of the grave, the military band plays the "Funeral March."

6. After the grave is filled, the Funeral Organization Committee observes a minute of silence to bid farewell to the deceased. The military band plays "The Soul of the Fallen Soldier."

Article 20. Building the Tomb and Costs

1. The tomb is built of granite, with dimensions according to current regulations.

2. The costs for building the tomb or cremation, incineration, and serving funeral services are funded by the state budget.

Chapter III

STATE FUNERAL SERVICES

 

Article 21. Positions Entitled to State Funeral Services

1. Officials currently holding or having held one of the following positions upon their death shall be entitled to State Funeral Services:

a) Member of the Politburo, Secretary of the Central Committee of the Communist Party of Vietnam;

b) Vice President of the Socialist Republic of Vietnam;

c) Deputy Prime Minister of the Socialist Republic of Vietnam;

d) Vice Chairman of the National Assembly of the Socialist Republic of Vietnam;

đ) Chairman of the Central Committee of the Vietnam Fatherland Front;

e) Chief Justice of the Supreme People's Court;

g) Procurator General of the Supreme People's Procuracy;

h) Senior General of the People's Armed Forces;

i)[20] Senior General of the People's Armed Forces who were revolutionary cadres before August 1945.

2.[21] In cases where the deceased held one of the positions specified in Clause 1 of this Article and was relieved of duties, retired early, or retired due to disciplinary actions or shortcomings, the funeral will be organized according to high-level funeral rituals; if they were dismissed from office or had their status revoked due to disciplinary actions, the funeral will be organized according to the funeral rituals for officials, civil servants, and public employees.

Article 22. Announcing Bereavement Notice

Depending on the position of the deceased, the bereavement notice shall be announced under the name of all or some of the following agencies and the family:

1. The Central Committee of the Communist Party of Vietnam.

2. The National Assembly of the Socialist Republic of Vietnam.

3. The President of the Socialist Republic of Vietnam.

4. The Government of the Socialist Republic of Vietnam.

5. The Central Committee of the Vietnam Fatherland Front.

Article 23. State Funeral Committee and Funeral Organization Committee

1.[22] The establishment of the State Funeral Committee shall be carried out according to the decision of the Central Secretariat of the Party, consisting of at least twenty members representing the Politburo, the Central Committee, the National Assembly, the President, the Government, the Central Committee of the Vietnam Fatherland Front, the agency where the deceased worked or was working, and the locality of origin or place of birth of the deceased.

a) The State Funeral Committee has the responsibility to direct the organization of the state funeral in accordance with this Decree;

b) The Head of the State Funeral Committee is a member of the Politburo; Vice President, Deputy Prime Minister, or Vice Chairman of the National Assembly.

2.[23] The establishment of the Funeral Organization Committee shall be carried out according to the decision of the Central Secretariat of the Party, consisting of at least fifteen members representing central ministries, departments, the locality of origin or place of birth of the deceased, and representatives of the family.

a) The Funeral Organization Committee has the responsibility to assist the State Funeral Committee in managing the agencies that are members of the Funeral Organization Committee and the agencies participating in organizing the state funeral in accordance with this Decree;

b) Depending on the position of the deceased, the Head of the Funeral Organization Committee is one of the leaders such as the Director of the Central Party Office; Director of the Presidential Office; Minister, Director of the Government Office; Director of the National Assembly Office or Director of the offices specified in Article 21 of this Decree.

Article 24. Documents on State Funeral[24]

1. The drafting of documents on the state funeral (Press Release on the State Funeral; list of the State Funeral Committee, Funeral Organization Committee, biography of the deceased; announcement of the mourning ceremony, funeral ceremony, burial ceremony) shall be chaired by the Central Organization Department, in coordination with the Central Propaganda and Mass Mobilization Department, the Central Party Office, the main management agency of the deceased, and relevant agencies before being approved by the State Funeral Committee.

2. The drafting of the Eulogy and Thank You Speech shall be chaired by the main management agency of the deceased's workplace, in coordination with the Central Propaganda and Mass Mobilization Department, the Central Organization Department, and the Central Party Office; it must have the opinion of the family of the deceased before being approved by the State Funeral Committee.

Article 25. Reporting and Publishing Information on State Funeral on Media

1. Announcing Sad News

Before receiving an official announcement from the Funeral Organization Committee, mass media may only report briefly about the deceased. After the establishment of the Funeral Organization Committee and the formal announcement of the funeral arrangements, mass media may report and publish articles about the deceased.

2. Publishing Information on Communication Media

a) The People's Newspaper and central and local press agencies report the bereavement notice; biography and photo of the deceased; announcement of the mourning ceremony, funeral ceremony, burial ceremony, and thank you speech of the State Funeral Committee;

b) Voice of Vietnam Radio and Television, Vietnam News Agency broadcast and televise the mourning ceremony and funeral ceremony.

Article 26. Place for Funeral Ceremony and Burial Site

1.[25] The State Funeral Ceremony shall be held at the National Funeral House No. 5 Tran Thanh Tong Street, Hanoi (if held in Hanoi); Southern National Funeral House or Ho Chi Minh City Funeral House (if held in Ho Chi Minh City).

2. Burial shall take place at Mai Dich Cemetery in Hanoi; Ho Chi Minh City Cemetery or cremation; burial at the hometown or another local cemetery according to the family's wishes.

Article 27. Decoration of the Altar and Guarding the Coffin

1. The altar shall be decorated with a black background banner, on which the photo of the deceased and the white text "Deeply Mourned Comrade..." shall be affixed.

2. A table shall be placed before and centrally under the banner, below the altar there shall be a censer and a cushion for medals; two flower wreaths shall be placed on both sides of the table.

3. The coffin shall be covered with the National Flag, placed on a pedestal in the center, with the head facing the altar.

4. A small table shall be placed below, containing a censer for the leaders of visiting delegations to light incense.

5. The Funeral Organization Committee shall assign officers from the main agency where the deceased worked to stand guard beside the coffin when high-level delegations from the Central Party, National Assembly, President, Government, and Vietnam Fatherland Front Central Committee come to pay respects.

6. The family shall stand on the left side of the funeral hall (facing the altar).

7. During the mourning ceremony, two soldiers shall stand at the entrance of the funeral hall; four military officers in ceremonial uniform and four soldiers shall stand guard around the coffin and the military band serving the mourning ceremony, funeral procession, and burial ceremony.

Article 28. Flower Wreaths for Mourning[26]

The flower wreaths for mourning shall be organized by the Funeral Organization Committee in accordance with the provisions of Clause 13 of this Decree.

Article 29. Mourning Ceremony

1. The Funeral Organization Committee shall arrange the visiting delegations to pay respects in the following formation: Two soldiers carrying flower wreaths leading, followed by the Head of Delegation, on the right side of the Head of Delegation shall be the guide officer, members of the delegation shall follow in two columns.

2. After paying respects, the Head of Delegation shall sign the condolence book.

3. During the mourning ceremony, the military band shall play the "Soul of the Fallen Soldier" music.

Article 30. Arrangement for Foreign Delegations to Pay Respects

1. The arrangement for foreign delegations to pay respects shall be carried out in accordance with the provisions of Clause 2, Article 14 of this Decree.

2. The representative offices of Vietnam abroad shall not organize the mourning ceremony, funeral service.

Article 31. Memorial Service, Funeral Procession, and Burial Ceremony

The organization of the memorial service, funeral procession, and burial ceremony shall be carried out in accordance with the provisions of Clause 1, 2, and 3 of Articles 16, 17, and 19 of this Decree.

Article 32. Forces and Means Serving the Funeral Procession

1. The forces serving the funeral procession shall be prepared by the Ministry of Defense, including: The Military Flag Team, Honor Guard of Three Services; forces transferring the coffin and flowers.

2. The vehicle team serving the funeral procession shall be prepared by the Ministry of Defense, including: One command vehicle; one towing vehicle for the hearse (at the rear of the hearse, there is a platform with the inscription "The State Commemorates"); one vehicle for transporting the Military Flag, photos, and medal cushions; three vehicles for the honor guard of three services and one flower vehicle, one spare vehicle, two communication vehicles, and one ambulance.

3. The coffin covered with the National Flag shall be placed in a glass case on the towing vehicle with the inscription "The State Commemorates".

Article 33. Burial and Funeral Expenses

1. The tomb is built of granite, with dimensions according to current regulations.

2. The costs for building the tomb or cremation, incineration, and serving funeral services are funded by the state budget.

Chapter IV

FUNERAL OF HIGH RANK

 

Article 34. Titles for High-Rank Funeral Organization

1.[27] Current officials and those who have retired from positions under the management of the Politburo and the Secretariat of the Central Committee of the Communist Party of Vietnam (excluding titles for National Mourning Ceremony and State-Level Funeral); cadres who were engaged in revolutionary activities before January 1, 1945 (revolutionary veterans) awarded the Independence Order of Merit, First Class or higher; cadres who were active in the South during the period of resistance against America (1954-1975) awarded the Independence Order of Merit, First Class or higher; outstanding social, cultural, and scientific figures (awarded the Ho Chi Minh Award - individual award) and awarded the Independence Order of Merit, First Class or higher; outstanding social, cultural, and scientific figures (awarded the Ho Chi Minh Award - individual award) who are People's Armed Forces Hero, Labor Hero while working or retired at the time of death shall be organized with a high-rank funeral ceremony.

2.[28] In cases where the deceased held one of the titles specified in Clause 1 of this Article and was disciplined with dismissal or removal of position title, the funeral shall be organized according to the protocol for civil servant funerals.

3.[29] In cases where the deceased was a member of the Central Committee of the Communist Party (excluding titles for National Mourning Ceremony and State-Level Funeral) and was relieved of duties, retired early, or retired according to regulations due to violations or shortcomings, the funeral shall be organized according to the protocol for civil servant funerals.

Article 35. Announcing the Death Notice

1. The Central Committee of the Communist Party and the agency that directly managed the deceased, either currently or previously, shall announce the death notice for the titles of Central Committee members.

2. For other titles, the agency that directly managed the deceased, either currently or previously; the local party committee and administrative authority of the hometown or place of residence of the deceased shall announce the death notice.

3. The death notice shall be published on the front page of the People's Army Newspaper, the People's Public Security Newspaper, the People's Daily, the industry newspaper, and the local newspaper of the hometown or birthplace of the deceased.

The Vietnam Television, Voice of Vietnam Radio, and Vietnam News Agency shall broadcast the death notice.

Article 36. Funeral Organizing Committee

1. The Funeral Organizing Committee shall be established by the leadership of the main managing agency; the local administrative authority where the deceased worked or was working, consisting of from ten to fifteen members representing political organizations and political-social organizations within the main managing agency and the locality.

2. The Head of the Funeral Organizing Committee shall be a leader of the main managing agency or the local party committee and administrative authority.

Article 37. Funeral Organization and Eulogy Preparation

The organization of the funeral and preparation of the eulogy shall be carried out by the main managing agency or the local party committee and administrative authority where the deceased worked or was working, together with the family.

Article 38. Location of Funeral[30]

The funeral shall be held at the National Funeral House No. 5 Tran Thanh Tong Street, Hanoi (if held in Hanoi); the Southern National Funeral House or the Ho Chi Minh City Funeral House (if held in Ho Chi Minh City). If the death occurs in another locality, it shall be implemented according to the regulations of that locality.

Article 39. Place of Burial

1.[31] Burial at Mai Dich Cemetery in Hanoi or Ho Chi Minh City Cemetery shall be applicable to the following cases:

a) Cadres under the management of the Politburo;

b)[32] Cadres who participated in revolutionary activities before January 1, 1945 (revolutionary veterans) awarded the Independence Order of Merit, First Class or higher; cadres who worked in the South throughout the period of resistance against America (1954-1975) awarded the Independence Order of Merit, First Class or higher; outstanding social, cultural, and scientific figures (awarded the Ho Chi Minh Prize - individual award) and awarded the Independence Order of Merit, First Class or higher;

c) Outstanding social, cultural, and scientific figures (awarded the Ho Chi Minh Prize - individual award) who are National Hero of the Armed Forces, National Labor Hero.

2. For other positions, burial shall take place at local cemeteries or according to the wishes of the family.

3. In cases where the family wishes for cremation, incineration, or burial at their hometown, the Funeral Committee shall organize a high-level funeral ceremony in accordance with the provisions of this Decree.

Article 40. Decoration of the Funeral Platform and Guarding the Coffin

1. The funeral platform shall be decorated with a black background, on which the photo of the deceased and white letters "With deep sorrow..." shall be displayed.

2. The altar shall be placed in front and in the center of the background, two wreaths from the main managing agency and the family shall be fixed on both sides of the altar, and there shall be an incense urn under the funeral platform.

3. The coffin shall be placed in the center of the funeral platform, with the head facing towards the altar.

4. A small table shall be placed below, containing a censer for the leaders of visiting delegations to light incense.

5. Leading cadres and key officials of the main managing agency or local authorities shall stand on the right side of the funeral hall (facing the funeral platform) when high-ranking delegations from the Central Committee of the Communist Party of Vietnam, the National Assembly, the President, the Government, and the Vietnam Fatherland Front enter to pay respects.

6. The family shall stand on the left side of the funeral hall (facing the altar).

Article 41. Wreaths for Condolence[33]

The Funeral Committee shall prepare two identical wreaths with black bands bearing white letters from the main managing agency and the family, to be fixed on both sides of the altar.

Article 42. Condolence Ceremony

1. The Funeral Committee shall arrange the condolence delegations to enter in the following formation: two soldiers carrying wreaths leading the way, followed by the Head of the Delegation and other members of the delegation walking in two rows.

2. After paying respects, the Head of Delegation shall sign the condolence book.

3. During the mourning ceremony, the military band shall play the "Soul of the Fallen Soldier" music.

Article 43. Memorial Service

1. Participants in the Memorial Service include: the Funeral Committee, representatives of agencies and organizations where the deceased worked or was working; the home province or place of residence of the deceased and the family, relatives.

2. Positions of delegations attending the Memorial Service (viewed from the direction of the memorial platform):

a) The family shall stand on the left side of the funeral hall;

b) Leaders of the agency and local authorities shall stand on the right side of the funeral hall;

c) Other delegations shall stand according to the arrangement of the Funeral Committee.

3. Program of the Memorial Service:

a) A representative of the Funeral Committee shall declare the opening of the Memorial Service;

b) The Head of the Funeral Committee shall read the eulogy, announce the moment of silence, and conclude the Memorial Service;

c) During the Memorial Service, military music shall play the "Soul of the Martyr" song.

Article 44. Funeral Procession and Funeral Vehicles

1. Participants in the Funeral Procession shall be the same as those in the Memorial Service.

2. When transferring the coffin onto the funeral vehicle and from the funeral vehicle to the grave site, members of the Funeral Committee, delegations, and the family shall follow behind the coffin.

The service staff of the funeral home and the agency or local authority where the deceased worked or was working shall perform the duty of moving the coffin and wreaths onto the funeral vehicle and from the funeral vehicle to the grave site.

3. Funeral vehicles shall be prepared by the main managing agency or local authority where the deceased worked or was working.

Article 45. Burial Ceremony

1. After the coffin is moved to its burial site, the Head of the Funeral Organization Committee announces the start of the Burial Ceremony.

2. The working team performs the task of lowering the coffin into the grave.

3. The Funeral Organization Committee, delegations, and family members place the first handful of soil and walk around the grave to bid farewell.

4. The working team continues to complete the grave.

5. During the Burial Ceremony, the Military Band plays the "Soul of the Fallen Soldier" music.

Article 46. Building the Tomb and Costs

1. The tomb is built of granite, with dimensions according to current regulations.

2. The costs for building the tomb, cremation, electric cremation, and funeral services are taken from the burial fee source according to the regulations on social insurance; any remaining funds are provided by the state budget.

Chapter V

FUNERAL OF STATE EMPLOYEES, CIVIL SERVANTS, AND PUBLIC OFFICIALS

 

Article 47. Titles for Organizing the Funeral of State Employees, Civil Servants, and Public Officials

1. State employees, civil servants, and public officials who are working or retired at the time of their death shall have their funerals organized as those of state employees, civil servants, and public officials (excluding titles for which a National Funeral, State-Level Funeral, or High-Level Funeral is organized).

2.[34] In cases where state employees, civil servants, or public officials are disciplined with dismissal, the funeral will not be organized according to the formalities of the funeral for state employees, civil servants, and public officials.

Article 48. Announcing the Bereavement Notice

1. The agency that directly manages the deceased person, or the local party committee and administrative authority of the hometown or place of residence of the deceased person, shall announce the funeral notice in local newspapers and media outlets where the deceased person was working or retired.

2. For the following cases, the bereavement notice shall be published on page 8 of the People's Army Newspaper:

a) Revolutionary cadres active before August 1945 recognized by competent authorities;

b) Heroes of the Armed Forces, Labor Heroes, People's Artists, People's Teachers, People's Doctors, People's Artisans, recipients of the Ho Chi Minh Award for Literature and Arts and Science and Technology, Party members awarded the 30-year Party Membership Badge or higher.

Article 49. Funeral Organization Committee

1. For deceased persons still employed:

a) The Funeral Organization Committee is decided by the agency directly managing the deceased person, consisting of representatives from units and organizations within the agency where the deceased person worked, family representatives, and local government representatives where the deceased person resided;

b) The Head of the Funeral Organization Committee is the leader of the unit, organization, or agency directly managing the deceased person.

2. For deceased persons who have retired:

[35] (Repealed).

a) The Funeral Organization Committee is decided by the local party committee, political-social organizations, and local government (commune, ward, town, street) where the deceased person retired and resides, in coordination with the agency, organization, or military force unit that managed the deceased person prior to retirement, consisting of representatives from organizations, local government, family representatives, and representatives from the agency or military force unit that managed the deceased person prior to retirement;

b) The Head of the Funeral Organization Committee is the head of the local party committee, political-social organization, or local government (commune, ward, town, street) where the deceased person retired and resides.

Article 50. Eulogy

The preparation of the eulogy is carried out by the main managing agency where the deceased person worked or the local party committee and administrative authority (commune, ward, town, street) where the deceased person retired and resides, together with the family.

Article 51. Place for Funeral Ceremony and Burial Site

1. Depending on the conditions of each agency, organization, locality and the wishes of the deceased's family, the Funeral Ceremony may be organized at a funeral home or at the family residence.

2. Burial shall take place at a local cemetery, another cemetery, or through cremation or electric cremation according to the wishes of the deceased's family.

Article 52. Decorations for the Funeral Altar[36]

1. For the Funeral Ceremony of officials, civil servants, and public employees organized at a funeral home:

a) The altar shall be decorated with a black background, on which the photo of the deceased and white letters reading "Deeply Mourned..." shall be affixed;

b) A memorial table shall be placed before and centrally in front of the background, two fixed wreaths from the agency and the family shall be placed on both sides of the memorial table, and an incense urn shall be placed under the altar;

c) The coffin shall be placed centrally, with its head facing towards the altar;

d) A small memorial table shall be placed below, containing an incense burner;

đ) The family shall stand on the left side of the funeral hall (viewing from the direction of the altar).

2. For the Funeral Ceremony of officials, civil servants, and public employees organized at the family residence:

The altar shall be decorated according to the customs, traditions, conditions, and circumstances of the deceased's family.

Article 53. Condolence Wreaths[37]

The Funeral Organizing Committee shall prepare two wreaths of the same size from the managing agency and the family, which shall be fixed on both sides of the memorial table.

Article 54. Condolence Visits

1. Depending on the conditions at the funeral home or at the family residence, the Funeral Ceremony shall be organized in accordance with the local customs, traditions, religion, and the circumstances of the deceased's family.

2. During the time of organizing condolence visits at the family residence, music shall not be played before 6:00 AM and after 10:00 PM; sound levels must comply with permitted noise levels as stipulated; inappropriate music shall not be used during the funeral.

Article 55. Memorial Service, Funeral Procession, and Burial Ceremony[38]

The memorial service, funeral procession, and burial ceremony shall be carried out in accordance with the provisions set forth in Article 43, Article 44, and Article 45 of this Decree or conducted in accordance with local customs, traditions, conditions, and circumstances of the deceased's family.

Article 56. Funeral Allowance

The funeral allowance shall be implemented in accordance with the laws on social insurance.

Chapter VI

IMPLEMENTING PROVISIONS

 

Article 57. Organization and Implementation

1. The Ministry of Culture, Sports and Tourism shall lead and coordinate with relevant ministries and sectors to guide, promote, and inspect the implementation of this Decree.

2.[39] The Ministry of National Defense and the Ministry of Public Security shall provide guidance on implementing the provisions of Chapter V of this Decree for those under their management who have passed away.

3. The Ministry of National Defense shall specify regulations regarding honor units, officers on duty, military bands, flower-bearers' teams, ceremonial vehicle formations, and funeral procession formations for State Funerals and National-Level Funerals.

4. The Ministry of Public Security shall establish regulations concerning security and traffic safety for State Funerals and National-Level Funerals.

5. The Ministry of Finance shall specify specific expense items and implement budget allocation and settlement for State Funerals, National-Level Funerals, and High-Level Funerals.

6.[40] (Repealed).

7.[41] The Ministry of Health shall establish regulations concerning hygiene in funeral activities and cremation, electric cremation;

8. Provincial People's Committees and Municipal People's Committees directly under the Central Government shall be responsible for planning, developing, and funding the construction of cemeteries, specifying detailed regulations on grave construction to suit local land resources, customs, and traditions, and encouraging and promoting cremation and electric cremation, and promoting civilized practices in funeral activities in their respective localities.

Article 58[42] (Repealed).

Article 59. Effective Date[43]

This Decree takes effect from February 1, 2013, and replaces Decree No. 62/2001/NĐ-CP dated September 12, 2001 of the Government on the issuance of Rules for Funeral Arrangements for State Officials, Civil Servants, and Public Employees upon their death.

Article 60. Responsibility for Implementation[44]

The Ministers, Heads of Ministries equivalent to Ministries; Heads of Government agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decree.

[29] This clause is added pursuant to Point c, Clause 17, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain provisions of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[30] This provision is amended and supplemented pursuant to Clause 18, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain provisions of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[31] The introductory clause of this clause is amended and supplemented pursuant to Point a, Clause 19, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain provisions of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[32] This point is amended and supplemented pursuant to Point b, Clause 19, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain provisions of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[33] This provision is amended and supplemented pursuant to Clause 20, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain provisions of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[34] The phrase "funeral form for officials, civil servants, and public employees" is replaced with the phrase "funeral ceremony for officials, civil servants, and public employees" pursuant to Clause 1, Article 2 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain provisions of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[35] The introductory clause of this clause is repealed pursuant to Clause 2, Article 2 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain provisions of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[36] This provision is amended and supplemented pursuant to Clause 21, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[37] This provision is amended and supplemented pursuant to Clause 22, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[38] This provision is amended and supplemented pursuant to Clause 23, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[39] This clause is amended and supplemented pursuant to Point a, Clause 24, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[40] This clause is repealed pursuant to Clause 3, Article 2 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[41] This clause is amended and supplemented pursuant to Point b, Clause 24, Article 1 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[42] This provision is repealed pursuant to Clause 3, Article 2 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025.

[43] Article 4 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025, provides as follows:

"Article 4. Implementation Provisions

This Decree takes effect from the date of issuance.

[44] Article 3 of Decree No. 237/2025/NĐ-CP dated August 29, 2025 of the Government amending and supplementing certain articles of Decree No. 105/2012/NĐ-CP dated December 17, 2012 of the Government on organizing funerals for officials, civil servants, and public employees, which takes effect from August 29, 2025, provides as follows:

Article 3. Responsibilities for Implementation

The Minister, Heads of Ministries, Heads of Governmental Agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decree.
