Supplementary guidance on beneficiaries
entitled to seniority allowances for teachers and lecturers
In Circular No. 2213/KG dated July 8, 1991, the Office of the Council of Ministers announced the decision of the Chairman of the Council of Ministers regarding the application of seniority allowances for teachers and lecturers under the Party school system and mass organizations according to Decision No. 309/CT dated December 9, 1988 of the Chairman of the Council of Ministers. After exchanging opinions with the Ministry of Finance (Circular No. 1189/TC-HCVX dated August 29, 1991) and relevant agencies, the Ministry of Labor, Invalids and Social Affairs provides the following guidance:
I. ELIGIBLE BENEFICIARIES FOR SENIORITY ALLOWANCES
1. Teachers and lecturers at Academies, schools under the Party school system and mass organizations, and state management schools (administrative schools, management cadre schools) established according to the regular school regulations prescribed by competent authorities.
2. The teachers and lecturers mentioned above who have directly taught for five years and were subsequently reassigned to directly engage in educational management and training work at Academies, Party schools, mass organization schools, state management schools, the Central Propaganda Department, the Central Science and Education Department, and local Propaganda Departments.
Teachers and lecturers who do not participate in teaching during the academic year shall not be eligible for seniority allowances.
II. LEVELS OF SENIORITY ALLOWANCES:
1. General levels of allowances for the subjects specified in Part I

2. For National Teachers and Distinguished Teachers, after reaching a 20% allowance level, they will continue to receive an additional 1% per year until reaching 25%.
3. For Excellent Teachers, after reaching a 20% allowance level, they will continue to receive allowances according to the following:

If the conditions of seniority and number of Excellent Teacher titles do not correspond to the same seniority allowance level, then the lower seniority allowance level shall apply.
The title of Excellent Teacher must be recognized by the competent authority according to the regulations of the state school system and the Party school system, with the agreement of the Ministry of Education and Training.
III. PERIOD TO CALCULATE SENIORITY FOR ALLOWANCE PURPOSES:
1. Direct teaching time (including probationary period and contractual period) at Academies, schools under the Party school system and mass organizations, and state management schools established according to the regular school regulations prescribed by competent authorities.
2. Direct time engaged in educational management and training if there were previously five years of direct teaching experience.
3. Time spent studying to improve qualifications and professional training, followed by returning to continue working in educational management and training.
4. Sick leave and maternity leave under one year.
IV. IMPLEMENTATION PROVISIONS
1. This Circular takes effect from August 1, 1991. Previous documents that stipulate seniority allowances for teachers and lecturers under the Party and mass organization systems contrary to Decision No. 309/CT dated December 9, 1988 of the Chairman of the Council of Ministers, Circular No. 5/LĐTBXH-TT dated March 8, 1989 of the Ministry of Labor, Invalids and Social Affairs, and this Circular are all invalid.
2. It is requested that the People's Committees of provinces and centrally-administered cities, the Central Financial Management Board, the Vietnam General Confederation of Labor, the Vietnam Women's Union, and the Communist Youth Union of Ho Chi Minh City instruct and supervise the implementation of this Circular in their respective managed agencies and schools.
Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids and Social Affairs for joint research and resolution./.
