REGULAR MEETING OF THE COUNCIL OF MINISTERS IN NOVEMBER 2007

On November 29, 2007, the Council of Ministers held its regular monthly meeting to discuss and adopt the following issues:

1. The Council of Ministers heard the proposal on the restructuring of enterprises under the Ministry of National Defense and the Ministry of Public Security in accordance with the spirit of Resolution No. 4 of the Central Committee, presented by the Ministry of Planning and Investment.

For many years, defense and security enterprises have made significant contributions to building a strong national defense and public security force, ensuring readiness and high combat preparedness. However, currently, many defense and security enterprises have small scales, overlapping industries, and low operational efficiency. Restructuring defense and security enterprises is necessary to implement Resolution No. 4 with the goal of building a regular, efficient, and gradually modernized military and public security force, thereby enhancing the operational effectiveness of defense and security enterprises. The Council of Ministers agreed to approve the proposal. The Ministry of National Defense and the Ministry of Public Security are instructed to lead, in coordination with the Office of the Government, the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs, the Ministry of Natural Resources and Environment, and related agencies, to incorporate the opinions of Council members into specific plans, to be submitted to the Prime Minister in the first quarter of 2008. These plans must include:

- Improving the organizational structure and operations, and enhancing production and business efficiency of defense and security enterprises directly serving national defense and public security managed by the Ministry of National Defense and the Ministry of Public Security;

- Implementing shareholding for enterprises solely engaged in economic activities, transferring state capital in shareholding enterprises to the State Capital Investment Corporation;

For military personnel and officers working in shareholding enterprises, policies shall be implemented according to the Law on Officers of the Vietnam People's Army and the Law on Public Security Officers; at the same time, special policies shall be considered for military personnel and officers who have not yet reached retirement age in compliance with the law;

- Land managed by the Ministry of National Defense and the Ministry of Public Security shall be handled in accordance with the law on land. Revenue from land rental shall be balanced into the annual budget of the Ministry of National Defense and the Ministry of Public Security. For unused land managed by the Ministry of National Defense and the Ministry of Public Security, the purpose of use shall be changed according to planning, and the revenue obtained shall be used to upgrade facilities in accordance with the law.

2. The Council of Ministers heard the draft Decree on the sale and transfer of state-owned enterprises with full state capital contribution, presented by the Ministry of Planning and Investment; the Chairman of the Office of the Government reported on the consolidated opinions of Council members. Decree No. 80/2005/NĐ-CP dated June 22, 2005 on the transfer, sale, lease, and management contracting of state-owned enterprises was based on the State Enterprise Law 2003 and the Enterprise Law 1999. To date, these two laws have been amended, thus making many provisions of the Decree no longer consistent with current laws, necessitating amendments and supplements to concretize the transformation of state-owned enterprises in accordance with the requirements of the new Enterprise Law and the Investment Law; simultaneously, abolishing the form of management contracting and leasing of state-owned enterprises; amending regulations causing difficulties and obstacles to accelerate the sale and transfer of state-owned enterprises.

The Ministry of Planning and Investment is instructed to lead, in coordination with the Office of the Government, the Ministry of Justice, and related agencies, to incorporate the opinions of Council members, complete the draft Decree, and submit it to the Prime Minister for consideration and issuance.

3. The Council of Ministers heard reports on: the socio-economic situation in November and the first eleven months of 2007, presented by the Ministry of Planning and Investment; the domestic market situation in November 2007, presented by the Ministry of Industry and Trade; anti-corruption efforts in November 2007, presented by the General Inspectorate of the Government; administrative reform implementation, presented by the Minister of Home Affairs; flood prevention, mitigation, and recovery efforts in central Vietnam, presented by the Minister of Agriculture and Rural Development.

The socio-economic situation in November and the first eleven months of 2007 continued to develop positively. Industrial production maintained a high growth rate; the total retail sales of goods and service revenue increased significantly; export turnover continued to rise; foreign direct investment attracted reached the highest level ever; disbursement of credit investment funds was higher than the same period last year; the total value of disbursed ODA funds reached a high level; state budget revenue met the schedule. Many activities in the cultural and social sectors achieved good results; disease prevention, health care for the people were given attention, especially in flooded areas. The spread of severe cholera outbreaks caused by bacteria was contained. Rescue and disaster relief efforts were timely and effective. The Council of Ministers commends the military, police, healthcare, local authorities, and other forces for their vigorous measures to prevent and mitigate disasters, diseases, and assist the people recently.

Nhiều hoạt động trong lĩnh vực văn hoá - xã hội đạt kết quả tốt; công tác phòng, chống dịch bệnh, chăm sóc sức khoẻ nhân dân được quan tâm, nhất là ở các vùng bị lũ lụt. Đã ngăn chặn được việc lây lan rộng dịch bệnh tiêu chảy cấp nguy hiểm có nguyên nhân từ vi khuẩn tả. Công tác cứu trợ và khắc phục hậu quả thiên tai được thực hiện kịp thời và có hiệu quả. Chính phủ biểu dương quân đội, công an, y tế, chính quyền địa phương các cấp và các lực lượng đã thực hiện quyết liệt nhiều biện pháp phòng chống và khắc phục hậu quả thiên tai, dịch bệnh và cứu trợ nhân dân trong thời gian vừa qua. Trong tháng cuối năm 2007, tình hình kinh tế-xã hội vẫn còn nhiều khó khăn: giá cả thị trường thế giới tiếp tục tăng cao, đặc biệt là giá dầu thô và các sản phẩm từ xăng dầu; trong nước tình hình thời tiết, dịch bệnh còn diễn biến phức tạp, nhu cầu tiêu dùng, nhất là trong Tết nguyên đán tăng cao dễ tạo sức ép tăng giá nhiều mặt hàng... In order to fulfill the 2007 plan tasks, the Government requests ministries, sectors, and localities to: strictly direct to stabilize macro balances, focus on implementing the Government's resolutions at regular meetings, directives, and telegrams issued by the Prime Minister, especially measures to control price increases as stated in Directives No. 18/2007/CT-TTg and No. 23/2007/CT-TTg; prepare well the supply of goods, organize distribution to ensure market stability and prices during the end-of-year period, without causing shortages; accelerate the restructuring and shareholding of state-owned enterprises to implement the Political Bureau's conclusions on the situation of state-owned enterprise shareholding and directions, tasks, and solutions for the 2007-2010 period, taking into account the year 2015. Continue to implement the work of reviewing administrative procedures assigned, focusing on reviewing and amending administrative procedures related to basic construction investment from state budget funds, land, establishment of enterprises; review again the programs and projects assigned, strengthen inspection and supervision, not allowing loose management; concentrate on resolving hotspots of complaints and petitions; draw lessons from disaster prevention and disease control work in recent times to better carry out disaster prevention, control, and aftermath mitigation work in the future, helping people in flood-stricken areas quickly stabilize their lives, promote agricultural production, restore essential infrastructure, have plans for debt moratoriums and extensions; ensure conditions for students' study in flooded areas. Ministries and sectors should conduct serious summaries and reviews of the implementation of Resolution No. 03/2007/NQ-CP of the Government on key measures to guide and manage the implementation of the socio-economic plan and state budget for 2007, while organizing the implementation of tasks and solutions for socio-economic development in 2008 according to the National Assembly's resolution.

The Ministry of Agriculture and Rural Development shall take the lead, in coordination with the Ministry of Industry to develop operational procedures for water reservoirs in the Central region to ensure flood control and delay; based on the approved program, have plans to repair and reinforce coastal dykes from the North to the South; summarize and closely direct the restructuring of livestock and crops to ensure disease prevention and control.

The Ministry of Construction shall take the lead in researching and developing a national program for safe coexistence with floods in Central provinces. The Ministry of Natural Resources and Environment shall take the lead, in coordination with relevant ministries and sectors to develop a national target program to respond to global climate change, call for international community support for this program, and submit it to the Prime Minister in the second quarter of 2008.

The Ministry of Foreign Affairs shall take the lead, in coordination with the Ministry of Defense and the Ministry of Agriculture and Rural Development to resolve issues related to our fishermen violating foreign border waters.

The Ministry of Labor, Invalids, and Social Affairs shall propose policies and solutions regarding labor strikes at enterprises and strengthen inspection and supervision of the implementation of proposed measures.
