Pursuant to the Law on Protection, Care, and Education of Children dated June 15, 2004;
Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;
Pursuant to Resolution No. 35/2009/QH12 dated June 19, 2009 of the XIIth National Assembly regarding the policy orientation for financial mechanism reform in education and training from the 2010-2011 academic year to the 2014-2015 academic year;

Article 1. Scope of Regulation and Applicability
1. This Decision stipulates certain policies for early childhood education development during the period 2011-2015, including policies for children, policies for teachers, and policies for early childhood education institutions.
2. This Decision applies to children in early childhood education institutions, early childhood teachers, early childhood education institutions, and related organizations and individuals.
Article 2. Certain policies for early childhood education development
1. For Children
a) Children aged five in kindergarten shall enjoy support policies as prescribed in Decision No. 239/QD-TTg dated February 9, 2010 of

c) Children aged three and four whose parents are permanent residents in border communes, mountainous areas, islands, extremely difficult communes and villages, or who belong to poor households as defined or are orphaned without support or have disabilities and economic difficulties, shall be supported by the state budget at a rate of 120,000 dong per month and shall benefit according to actual attendance time, but not exceeding nine months per academic year to maintain lunch at school.
2. Regarding teachers
a) Teachers (including principals and deputy principals) working under labor contracts in public and private early childhood education institutions shall be supported by the state budget to implement salary payments according to the early childhood teacher salary scale, receive periodic salary increases, participate in social insurance, unemployment insurance, health insurance, and other policies equivalent to those of teachers with the same level of education working under contracts in public early childhood education institutions.
b) Teachers working in private early childhood education institutions shall be supported by the state to cover costs for political theory and professional skill enhancement training.
3. Regarding early childhood education institutions
a) People's Committees at all levels shall ensure land area planning and apply various methods of land allocation, land leasing, and leasing of facilities to develop a network of early childhood education institutions, meeting the increasing demand for childcare, nurturing, and early childhood education, suitable to the characteristics of each locality.
b) The State shall invest through the Program for Strengthening Kindergarten Classrooms and Teacher Housing, while integrating with national target programs in education and other funding sources to build infrastructure for public kindergartens towards strengthening, standardizing, and modernizing, ensuring sufficient classrooms, functional rooms, playgrounds, and equipment, toys, and teaching aids according to current standards and regulations. Priority shall be given to establishing and building new public early childhood education institutions in rural areas, extremely difficult communes and villages, mountainous, border, remote, and low-income urban and town areas.
c) Implement preferential policies on land, credit, and tax to encourage the development of non-public kindergartens, especially in industrial zones, export processing zones, and densely populated areas.
4. Funding Implementation
- The state budget plays a leading role in implementing early childhood education development policies during the period 2011-2015, including regular education and training expenditure, concentrated construction investment capital, national target program funds, government bond funds, and ODA funds.
- Tuition revenue.
- Donations and grants from domestic and foreign organizations and individuals.
- Capital contributions from organizations and individuals for new construction, expansion, and upgrading of early childhood education institution infrastructure.
- Loans from banks and preferential credit organizations with favorable interest rates.
- Other lawful sources of capital.
Article 3. Implementation Organization
1. Responsibilities of Ministries and sectors
||| a) Ministry of Education and Training
- Take the lead and coordinate with the Ministry of Finance, the Ministry of Home Affairs, and the Ministry of Natural Resources and Environment to guide localities in implementing the contents of this Decision.
- Take the lead and coordinate with the Ministry of Planning and Investment and the Ministry of Finance to develop plans for strengthening kindergarten classrooms and teacher housing from 2012 to 2015, prioritizing investment in kindergarten infrastructure; developing investment projects for early childhood education under the national education target program for the period 2011-2015, and submitting them to the Ministry of Planning and Investment for review and approval by the Prime Minister.
- Annually balance and prioritize the budget for early childhood education.
- Organize, inspect, evaluate, and compile results of implementation of this Decision, and report annually to the Prime Minister.
b) The Ministry of Labor- Invalids and Social Affairs
- Coordinate with the Ministry of Education and Training, central ministries and agencies, and localities to strengthen communication and mobilize society to implement children's rights and early childhood education development policies, protecting children's right to care and education according to the early childhood education curriculum.
- Lead and coordinate with the Ministry of Education and Training to direct and supervise the implementation of social insurance and health insurance policies and other social policies for teachers and preschool-aged children.
c) The Ministry of Home Affairs
- Coordinate with the Ministry of Education and Training and relevant ministries and agencies to study and amend policies for teachers and educational management staff in various types of schools.
- Coordinate with the Ministry of Education and Training to establish and issue documents on job position determination in kindergartens and work regulations for kindergarten teachers in accordance with the Law on Public Servants, consistent with current regulations.
d) The Ministry of Finance
- Lead and coordinate with the Ministry of Education and Training to ensure funding for the implementation of early childhood education development policies during the period 2011-2015.
- Coordinate to guide localities in implementing the contents of this Decision.
đ) The Ministry of Planning and Investment
- Chair and coordinate with the Ministry of Education and Training, the Ministry of Finance, and relevant agencies to appraise projects implementing preschool education development policies for inclusion in the National Target Program for the 2011-2015 period, and submit to the Prime Minister for approval.
- Chair and balance the allocation and develop plans for distributing investment capital for preschool education development for localities in accordance with regulations; implement measures to encourage and mobilize domestic and foreign investors to invest in the preschool education sector.
e) The Ministry of Natural Resources and Environment
Chair and coordinate with the Ministry of Education and Training and related ministries to direct localities to allocate land funds for building and expanding preschool schools in compliance with current regulations.
g) The State Bank of Vietnam
Chair and coordinate with the Ministry of Education and Training to develop and implement preferential credit policies for preschool schools, organizations, and individuals constructing educational infrastructure for preschool education.
Related ministries and sectors shall be responsible for coordinating to implement preschool education development policies based on their assigned functions and tasks.
2. Responsibilities of Provincial People's Committees and Municipal People's Committees under Central Government
a) Direct the completion of the preschool school network planning to ensure maximum enrollment of preschool children according to Decision No. 239/QD-TTg dated February 9, 2010 of the Prime Minister. Allocate land areas sufficient to meet the minimum requirements stipulated in the Kindergarten Regulations to ensure preschool education development.
b) Ensure staffing standards for teachers and staff in preschool education institutions, and implement teacher benefits in accordance with current state regulations.
c) Ensure balance and develop plans for allocating state budget capital to preschool schools according to approved plans, while developing measures to encourage and mobilize investors and economic sectors to participate in preschool education investment.
d) Issue local policies to promote preschool education development within their jurisdiction. Direct and supervise the quality of preschool education within their jurisdiction.
Article 4. Effective date
This Decision takes effect from December 15, 2011. This Decision replaces Decision No. 161/2002/QĐ-TTg dated November 15, 2002 of the Prime Minister regarding certain preschool education development policies. All existing preschool education policies that conflict with this Decision are hereby abolished.
Article 5. Responsibilities for Implementation
THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
