Article 24stipulating functions, tasks, powers
and organizational structure of Vietnam Academy of Science and Technology

Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to Decree No. 10/2016/NĐ-CP dated February 1, 2016 of the Government on agencies under the Government;
Pursuant to the proposal of the Minister of Science and Technology;
The Government promulgates this Decree to stipulate the functions, tasks, powers, and organizational structure of the Vietnam Academy of Social Sciences.
Article 1. Position and Functions
1. The Vietnam Academy of Science and Technology is an agency under the Government, performing the function of basic research in natural sciences and technological development; providing scientific grounds for science and technology management work and policy, strategy, and planning for economic and social development; training high-level scientific and technological human resources in accordance with the provisions of the law.
2. The Vietnam Academy of Science and Technology has the international trade name in English as: Vietnam Academy of Science and Technology, abbreviated as VAST.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. On strategy, programs, planning, and planning:
a) Submitting to the Government and the Prime Minister the strategies, plans for development, programs, annual plans, long-term and five-year plans, important projects and proposals of the Vietnam Academy of Science and Technology, and organizing their implementation after approval;
b) Participating in reviewing the technological level and examining the economic and technical feasibility of major national construction works and projects according to the division of labor by competent state agencies;
c) Deciding on investment projects within the authority of the Vietnam Academy of Science and Technology in accordance with the law.
2. On scientific research and technological development:
a) Conducting fundamental research in natural sciences and developing technology in fields such as mathematics; physics; chemistry; biology; biotechnology; information technology; electronics and automation; space technology; materials science; biodiversity and bioactive substances; earth sciences; marine science and technology; environment and energy; forecasting, prevention, mitigation, and reduction of natural disasters;
b) Synthesizing natural resources, natural conditions, and the environment;
c) Implementing, applying, and transferring research results in science and technology;
d) Proposing and leading the implementation of key national science and technology tasks assigned by competent state agencies;
đ) Promoting and disseminating knowledge, research results in science and technology to meet the requirements of the science and technology market development;
3. On public service provision:
Point a. Organizing the implementation of public services assigned by the Government according to the provisions of the law;
Point b. Inspecting the organization and implementation of public services by subordinate units according to the provisions of the law.
4. Deciding and directing the implementation of administrative reform programs in accordance with the goals and contents of the State administrative reform program approved by the Prime Minister.
5. Training high-level scientific and technological human resources; organizing undergraduate and postgraduate education in natural sciences and technology within the scope of functions and tasks assigned in accordance with the law.
6. Advising on strategic plans, policies, programs, and projects for important science and technology development within the scope of functions assigned upon request of the Government.
7. On international cooperation:
a) Implementing international cooperation in science and technology in accordance with the law;
b) Proposing the signing, amendment, supplementation, extension, termination of effect, and temporary suspension of implementation of international treaties in accordance with the law;
c) Organizing the implementation of international treaties according to the division of labor by the Government;
d) Signing, amending, supplementing, extending, terminating the effect, and temporarily suspending the implementation of international agreements on behalf of the Vietnam Academy of Science and Technology in accordance with the law;
đ) Organizing the implementation and monitoring the implementation of international funded programs and projects in accordance with the law;
e) Organizing and participating in international conferences, seminars, cooperation programs, and plans in accordance with the law;
g) Organizing research collaboration and joint training in science and technology with international organizations, foreign research institutes, and universities in accordance with the law.
8. On information and reporting systems:
Point a. Organizing information work, propaganda, and dissemination of political tasks, policies, systems, and laws of the State in the assigned sector and field;
b) Implementing the information and reporting system with the Government and the Prime Minister on the results of the agency's activities in accordance with the law;
c) Reporting and providing earthquake and tsunami warning information to competent authorities in accordance with the law.
9. On organizational structure:
a) Cooperating with the Ministry of Science and Technology to submit to the Prime Minister decisions on establishing new, restructuring, dissolving, renaming subordinate organizations and units of the Vietnam Academy of Science and Technology in accordance with the law;
b) Managing organization, staffing, civil servant positions, number of employees, job positions, civil servant and staff structure by rank and profession; deciding on rotation, transfer, appointment, dismissal, commendation, and disciplinary actions; systems, policies, training, and development of cadres, civil servants, staff, and workers within the authority in accordance with the law.
10. On financial and asset management:
a) Preparing annual budget estimates and three-year financial and budgetary plans for submission to competent state agencies for approval in accordance with the law on state budget;
b) Managing the finances and assets allocated to the Institute in accordance with the law.
11. Performing other tasks and powers assigned by the Government and the Prime Minister.

The units specified from Clause 1 to Clause 6 of this Article are specialized units assisting the President of the Vietnam Academy of Science and Technology. The Office shall be organized into ten departments.
The units specified from Clause 7 to Clause 34 of this Article are public scientific and technological organizations.
The units specified from Clause 35 to Clause 42 of this Article are other public service units.
The President of the Vietnam Academy of Science and Technology shall specify the functions, tasks, powers, and organizational structure of the subordinate units.
Article 4. Leadership of the Academy
1. The Vietnam Academy of Science and Technology has a President and not more than four Vice Presidents.
2. The President of the Vietnam Academy of Science and Technology is appointed and relieved of duty by the Prime Minister; he/she is responsible for all aspects of the Academy's activities before the Government, the Prime Minister, and under the law.
3. The Vice Presidents of the Vietnam Academy of Science and Technology are appointed and relieved of duty by the Prime Minister upon the recommendation of the President of the Vietnam Academy of Science and Technology; they are responsible to the President of the Vietnam Academy of Science and Technology and under the law for the tasks assigned to them.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decree takes effect from July 17, 2017, and replaces Decree No. 108/2012/NĐ-CP dated December 15, 2012 of the Government on the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology.
2. The President of the Vietnam Academy of Science and Technology, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and municipal People's Committees directly under the central government are responsible for implementing this Decree./.
