Decree No. 108/2012/ND-CP stipulates the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology (VAST). VAST is an agency under the Government, conducting scientific research, technological development, training high-level human resources, and managing finances and assets. This Decree replaces Decree No. 62/2008/ND-CP.

DECREE
Regulations on functions, tasks, powers, and organizational structure
of the Vietnam Academy of Science and Technology
________________
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the proposal of the President of the Vietnam Academy of Science and Technology;
The Government promulgates this Decree to stipulate the functions, tasks, powers, and organizational structure of the Vietnam Academy of Social Sciences.
Article 1. Position and Functions
1. The Vietnam Academy of Science and Technology is an agency under the Government, performing the function of basic research in natural sciences and technological development; providing scientific grounds for science and technology management work, policy-making, strategy, planning for economic and social development; training high-level scientific and technological human resources in accordance with the provisions of the law.
2. The Vietnam Academy of Science and Technology has the international trade name in English as: Vietnam Academy of Science and Technology, abbreviated as VAST.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Vietnam Academy of Science and Technology shall perform the specific tasks and powers as follows:
1. Submit to the Government draft Decrees prescribing, amending, and supplementing the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology; strategies, plans, long-term programs, five-year plans, annual plans, important projects, and proposals of the Vietnam Academy of Science and Technology.
2. Submit to the Prime Minister for decision on establishing new organizations, changing names, reorganizing, and dissolving subordinate organizations of the Vietnam Academy of Science and Technology within the Prime Minister's authority.
3. Regarding scientific and technological research:
a) Basic research in natural sciences and technological development in the fields of mathematics; physics; chemistry; biology; biotechnology; information technology; electronics and automation; space technology; materials science; biodiversity and bioactive substances; earth sciences; marine science and technology; environment and energy; disaster prediction, prevention, mitigation, and response;
b) Synthesizing natural resources, natural conditions, and the environment;
c) Implementing, applying, and transferring research results in science and technology;
d) Proposing and leading the implementation of national key science and technology programs according to the division of labor by competent state agencies.
4. Training high-level scientific and technological human resources; organizing postgraduate education in natural sciences and technology in accordance with the provisions of the law.
5. Reporting and providing earthquake information and tsunami warnings to authorized agencies as prescribed by law.
6. Promoting and disseminating knowledge and results of scientific research and technological development to meet the requirements of the science and technology market.
7. Participating in assessing technological levels, reviewing economic and technical feasibility studies of major national and local projects according to the division of labor by competent state agencies.
8. Deciding on investment projects of the Vietnam Academy of Science and Technology in accordance with the provisions of the law.
9. Managing organization, staffing, civil servant positions, job structures, personnel composition by profession and number of staff in public service units; deciding on rotation, transfer, appointment, dismissal, commendation, disciplinary action; policies, training, and development of cadres, civil servants, and personnel within their authority as prescribed by law.
10. Regarding finance and assets:
a) Preparing the annual budget estimate of the Vietnam Academy of Science and Technology for submission to competent state agencies for approval in accordance with the State Budget Law;
b) Deciding on plan allocation indices, monitoring expenditure, and being responsible for settlement;
c) Managing finance and assets in accordance with the provisions of the law.
11. Implementing international cooperation in science and technology in accordance with the provisions of the law.
12. Performing other tasks and powers assigned by the Government and the Prime Minister.

In this Article, units specified from Clause 1 to Clause 6 are working units assisting the President of the Academy, established with departments; units specified from Clause 7 to Clause 33 are research scientific public service units; units specified from Clause 34 to Clause 38 are other public service units.
Based on development needs, the President decides on establishing, renaming, reorganizing, merging, and dissolving other subordinate organizations of the Vietnam Academy of Science and Technology in accordance with the law.
Article 4. Leadership of the Academy
1. The Vietnam Academy of Science and Technology has a President and not more than four Vice Presidents. The President of the Vietnam Academy of Science and Technology is appointed and relieved of duty by the Prime Minister, accountable to the Government and the Prime Minister for all activities of the Vietnam Academy of Science and Technology.
2. The Vice Presidents are appointed and relieved of duty by the Prime Minister upon the recommendation of the President and are accountable to the President for the tasks assigned by the President.
3. The President issues individual documents, regulations on the organization and operation of subordinate units of the Vietnam Academy of Science and Technology; decides on appointments, dismissals, rotations, commendations, disciplinary actions, implementation of policies and systems for cadres, civil servants, and personnel, and exercises other authorities as prescribed by law.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decree takes effect from February 19, 2013, and abolishes Decree No. 62/2008/NĐ-CP dated May 12, 2008, of the Government prescribing the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology.
Article 2. Abolish previous provisions that conflict with this Decree.
3. The President of the Vietnam Academy of Science and Technology, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government; Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
