WHEREAS,ứ Government Decree No. 12/201the Director of the General Department of Roads of Vietnam;the Minister of Transport issues this Circular amending and supplementing some articles of Circular No. 6/2016/TT-BGTVT dated March 13, 2016 of the Minister of Transport regulating the maximum service charge for using roads in road construction projects for business purposes under the management of the Ministry of Transport: "This Circular regulates the maximum service charge when collecting money for using roads from projects investing in road construction for business purposes under the management of the Ministry of Transport, including national highways, expressways, and road tunnels; cases where vehicles are exempted from paying the service charge for using roads, or have reduced charges for using roads (if applicable) in projects investing in road construction for business purposes;"u2. Clause 3 of Article 2 is amended as follows: BASED"3. A toll station is a place where the service charge for using roads is collected from vehicles participating in traffic." organizational structure 3. THEin accordance with "7. The entity collecting the service charge for using roads (hereinafter referred to as the collection entity) is the Project Investor, Project Enterprise, or an entity authorized or assigned by the Project Investor or Project Enterprise to carry out the sale, control, and collection of tickets for the service charge for using roads."a V||| 4. Article 3 is amended as follows:to"Article 3. Subjects and vehicle owners required to pay the service charge for using roadsto TMinister;1. Vehicles using road services that are subject to payment of the service charge for using roads include:2. The maritime area of the coastal port of Qu2. Vehicle owners who fall within the category specified in Clause 1 of this Article must pay the service charge for using roads, except in the cases provided for in Article 4 of this Circular.", amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP5. The title of Article 4 is amended as follows:

"Article 4. Categories Exempt from Paying the Service Charge for Using Roads"ng6. A flexible power plant is a thermal power plant using reciprocating internal combustion engines (RICE) or aeroderivative gas turbines (Aero-GT) with fast start-up capabilities, designed in modular form to generate electricity for balancing capacity and maintaining power system stability.""Article 5. Conditions for Collecting the Service Charge for Using Roads1. Completion of the construction of the road project according to the provisions of the project contract signed between the competent state authority and the Project Investor or Project Enterprise, or completion of the construction of the road project according to the approved project plan; number 2. The entity collecting the service charge for using roads has prepared all types of tickets and completed the regulations regarding the establishment, organization, and operation of the toll station as prescribed."concerning the classification and determination of state management authority in the field of crop production "7. Point c of Clause 1 of Article 6 is supplemented as follows: 11 For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.amendc) The maximum price for tunnel usage services per trip as stipulated in Appendix III attached to this Circular;ng8. Article 7 is amended as follows:"Article 7. Specific Prices for Using Road Services the supervision1. Specific prices for using road services for each project and type of vehicle are agreed upon between the competent state authority and the Project Investor or Project Enterprise in the project contract on the principle that the collection does not exceed the maximum price for the group of vehicles as stipulated in Article 6 of this Circular.2. For toll stations charging per trip, based on the economic and social conditions of the locality where the toll station is located during each period, the parties signing the BOT contract agree on specific prices for using road services lower than those stipulated in Clause 1 of this Article (if applicable), on the principle of ensuring the financial feasibility of the project, balancing the interests of the State, investors, users, and compliance with the law."No.9. Article 8 is amended as follows:This Resolution takes effect from the date it is adopted by the National Assembly."Article 8. Road Service Usage Ticketsia) Trip tickets are printed with face values corresponding to the amount charged for one-time use of the service for each type of vehicle;°b) Monthly tickets are issued for a period of 30 days from the date they become valid and are printed with face values corresponding to the monthly charge for each type of vehicle. The face value of a monthly ticket is thirty times the face value of a trip ticket. Monthly tickets are used to collect the service charge for using roads for vehicles passing through the toll station within the specific period indicated on the ticket from the date it becomes valid until its expiration date;° c) Quarterly tickets are issued for a period of 90 days from the date they become valid and are printed with face values corresponding to the quarterly charge for each type of vehicle. The face value of a quarterly ticket is three times the face value of a monthly ticket with a 10% discount. Quarterly tickets are used to collect the service charge for using roads for vehicles passing through the toll station within the specific period indicated on the ticket from the date it becomes valid until its expiration date.° 2. Trip tickets are sold according to the face value printed on the ticket, without recording the vehicle registration number.n lFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract. 3. Monthly and quarterly tickets are sold according to the face value printed on the ticket, clearly indicating the usage period and the vehicle registration number. Monthly and quarterly tickets must be used at the designated toll station and within the period indicated on the ticket."

10. Article 9 is amended as follows:

1. Clause 1 of Article 1 shall be amended and supplemented as follows:

"Article 9. Management of Road Service Usage Tickets

2. Tickets issued for a toll station can only be used at that toll station.

3. When purchasing monthly or quarterly tickets, the purchaser must present the original or copy of the vehicle registration certificate to purchase tickets according to the charge level corresponding to the type and designed load capacity of the vehicle.

4. Road service usage tickets serve both as a control document when vehicles pass through the toll station and as a payment receipt."

"7. The unit collecting road usage service fees (hereinafter referred to as the collection unit) is the Investor, Project Enterprise, or the unit authorized and assigned by the Investor or Project Enterprise to carry out the sale, control, and collection of tickets for road usage service fees."

4. Article 3 shall be amended as follows:

"Article 3. Objects and vehicle owners required to pay road usage service fees

1. Vehicles using road services that fall within the category required to pay road usage service fees, including:

b) Group 2 includes the following types of vehicles: Passenger cars with 12 to 30 seats; trucks with a load capacity of 2 to less than 4 tons;

c) Group 3 includes the following types of vehicles: Passenger cars with 31 seats or more; trucks with a load capacity of 4 to less than 10 tons;

d) Group 4 includes the following types of vehicles: Trucks with a load capacity of 10 to less than 18 tons; 20-foot container trucks;

e) Group 5 includes the following types of vehicles: Trucks with a load capacity of 18 tons or more; 40-foot container trucks.

2. Vehicle owners belonging to the objects required to pay fees for using road infrastructure as stipulated in Clause 1 of this Article must pay fees for using road infrastructure, except for cases specified in Article 4 of this Circular."

2. Vehicle owners who fall within the category required to pay road usage service fees as stipulated in Clause 1 of this Article must pay road usage service fees, except for cases specified in Article 4 of this Circular."

5. The title of Article 4 shall be amended as follows:

"Article 4. Categories exempt from paying road usage service fees"

6. Article 5 shall be amended as follows:

"Article 5. Conditions for collecting road usage service fees

1. Completion of construction of the road project according to the provisions of the project contract signed between the competent state agency and the Investor or Project Enterprise, or completion of construction of the road project according to the approved project by the competent authority;

2. The unit collecting road usage service fees has prepared all types of tickets and completed the regulations on establishment, organization, and operation of toll stations as prescribed."

7. Supplement Point c of Clause 1 of Article 6 as follows:

c) The maximum price level for tunnel road usage services per trip as specified in Appendix III attached to this Circular;

8. Article 7 shall be amended as follows:

"Article 7. Specific pricing levels for road usage services

1. The specific pricing level for road usage services for each project applicable to each type of vehicle is agreed upon between the competent state agency and the Investor or Project Enterprise in the project contract based on the principle that the implementation of collection does not exceed the maximum price level for the group of vehicles as stipulated in Article 6 of this Circular.

2. For toll stations collecting per trip, based on the socio-economic situation of the locality where the station is located during each period, the parties signing the BOT contract agree on a specific pricing level for road usage services lower than the level specified in Clause 1 of this Article (if applicable), based on the principle of ensuring the financial feasibility of the project, balancing the interests of the State, Investors, users, and compliance with the law.

9. Article 8 shall be amended as follows:

"Article 8. Road usage service tickets

1. Road service usage tickets apply to vehicles participating in traffic through toll stations, including: single-trip tickets, monthly tickets, and quarterly tickets.

a) Per-trip tickets are printed with face value according to the collection amount for one-time use of the service corresponding to each type of vehicle;

b) Monthly tickets are issued with a validity period of thirty days from the date of use and are printed with a fixed face value according to the monthly collection amount corresponding to each type of vehicle. The face value of monthly tickets equals thirty times the face value of per-trip tickets. Monthly tickets are used to collect road usage service fees for vehicles participating in traffic through the station within the specific period indicated on the ticket from the date of use until the end of the specific period indicated on the ticket;

c) Quarterly tickets are issued with a validity period of ninety days from the date of use and are printed with a face value according to the quarterly collection amount corresponding to each type of vehicle. The face value of quarterly tickets equals three times the face value of monthly tickets with a ten percent discount. Quarterly tickets are used to collect road usage service fees for vehicles participating in traffic through the station within the specific period indicated on the ticket from the date of use until the end of the specific period indicated on the ticket.

2. Per-trip tickets are sold according to the vehicle corresponding to the face value printed on the ticket, without recording the vehicle registration number.

3. Monthly and quarterly tickets are sold according to the vehicle corresponding to the face value printed on the ticket, clearly indicating the usage period and the vehicle registration number. Monthly and quarterly tickets must be used at the correct station and within the period indicated on the ticket."

10. Clause 1 of Article 9 shall be amended as follows:

"Article 9. Management of road usage service tickets

1. The printing, issuance, management, use, and refund of tickets (if applicable) shall be carried out in accordance with the law on the management of sales invoices and service provision invoices.

2. Road usage service tickets issued for a station can only be used at that station.

3. When purchasing monthly or quarterly tickets, the purchaser must present the vehicle registration certificate (original or copy) to purchase tickets according to the collection amount corresponding to the type of vehicle and its designed load capacity.

4. Road usage service tickets serve both as a control document when the vehicle passes through the station and as a payment receipt."

11. Clause 1 of Article 10 shall be amended as follows:

"1. The Vietnam Road Administration shall be responsible for inspecting and supervising the collection of road usage service fees by the collecting units and reporting to the Ministry of Transport in accordance with the prescribed regulations."

12. Point a Clause 2 Article 10 shall be amended as follows:

"2. The collecting unit shall be responsible for:

a) Publicly announcing and posting information on pricing levels and exemptions from payment of road usage service fees at ticket sales locations and toll stations in accordance with the prescribed regulations;"

Article 2. Effective Date

"This Circular shall take effect from February 3, 2019."

2. The Heads of the Ministry's Office, the Inspectorate, the Directors of Departments, the Director General of the Vietnam Highway Administration, and the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
