Pursuant to Decree No. 86/2002/ND-CP dated November 4, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 60/2003/ND-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;
Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 17/2001/ND-CP dated May 4, 2001 of the Government on the issuance of regulations governing the management and use of Official Development Assistance funds;

Article 1. Issued together with this Decision are "Provisions on Certain Expenditure Standards Applicable to Projects/Programs Using Official Development Assistance (ODA) Funds."
Article 2. The expenditure standards issued together with this Decision are the maximum ceilings. Within the scope of the expenditure standards prescribed in this Decision and within the permissible budget for project/program management, the directors of ODA project/program management boards shall determine specific expenditure levels applicable to the project/program in a suitable manner.
Article 3. The subjects to which this Decision applies are ODA loan projects (expenditures from foreign loans and domestic counterpart funds) and non-reimbursable ODA aid projects (expenditures from domestic counterpart funds).
For non-reimbursable ODA aid projects funded from aid sources, the expenditure levels shall be applied according to the standards set by the donor as specified in the funding agreements, or determined by representatives of the donor, the Ministry of Finance, and the project’s supervising agency in cases where the donor does not specify such standards in the funding agreements.
Article 4. This Decision shall take effect fifteen days after its publication in the Official Gazette. Previous provisions and guidelines on various types of expenditure standards for different spending items, as directed in this Decision, issued by the Ministry of Finance, or agreed upon by the Ministry of Finance for the competent ministries to issue for certain ODA projects, shall cease to be effective upon the entry into force of this Decision.
Ministries, ministerial-level agencies, central-level agencies, and People's Committees of provinces and centrally-administered cities have the responsibility to direct the implementation and guide subordinate units and ODA projects under their jurisdiction to comply with this Decision.
