Amending and supplementing Circular No. 41/2005/TT-BTC dated May 26, 2005 of the Ministry of Finance guiding certain provisions of Decree

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 10/2005/NĐ-CP dated October 31, 2005 of the Government stipulating traditional flags, insignia, symbols, customs insignia, badges, rank badges, uniforms, and customs identification cards;

The Ministry of Finance hereby guides the amendment and supplementation of certain points of Circular No. 41/2005/TT-BTC dated May 26, 2005 of the Ministry of Finance guiding certain provisions of Decree No. 10/2005/NĐ-CP dated October 31, 2005 of the Government stipulating traditional flags, insignia, symbols, customs insignia, badges, rank badges, uniforms, and customs identification cards as follows:

Article 1. Amending and supplementing certain points of Circular No. 41/2005/TT-BTC dated May 26, 2005 of the Ministry of Finance as follows:

1. Point g Clause 1 Section II of the Circular is amended as follows:

g) Leather shoes, canvas shoes: 01 year/1 pair.

2. Clause 3 Section II is amended and supplemented as follows:

"3. Uniform standards for personnel working under labor contracts (for one person) as prescribed by Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing the system of labor contracts for certain types of work in administrative agencies and public institutions (hereinafter referred to as Decree No. 68/2000/NĐ-CP):

a) Personnel working in the Customs sector under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP who are directly related to specialized and professional tasks equivalent to those performed by civil servants, officials, and employees, including information technology officers, import-export goods classification analysts, drivers, laboratory staff, maritime patrol anti-smuggling crew members, and canine trainers, shall be provided with annual uniform standards similar to those for customs officials, including the following types of uniforms:

- Spring-summer and autumn-winter uniforms, ceremonial uniforms (different from customs uniforms);

- Other items: cap, soft hat, formal cap, tie, leather shoes, raincoat, socks, belt, woolen coat, sweater;

- Badges, rank badges, customs insignia: replace when damaged (rank badges different from customs officials);

b) Personnel working in the Customs sector under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP such as ship mechanics, security guards, receptionists, electricians, water supply and sanitation workers, and other service staff; shall be provided with annual uniform standards similar to those for customs officials, including the following types of uniforms:

- Spring-summer and autumn-winter uniforms, ceremonial uniforms (different from customs uniforms);

- Other items: leather shoes, raincoat, socks, belt, woolen coat, sweater.

c) For personnel working in the Customs sector under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP who regularly perform special tasks, in addition to the common uniform standards, they will be provided with additional uniform standards similar to those for customs officials performing similar special tasks as stipulated in Clause 2 Section II."

3. Amending Clause 1 and Clause 2 Section III as follows:

a) Paragraph 2, Clause 1 Section III is amended and supplemented as follows:

"Funds for making customs uniforms shall be guaranteed by the General Department of Customs within the budget for ensuring the operation of the General Department of Customs."

b) Point b, Clause 2 Section III is amended and supplemented as follows:

"b. The Director of the Customs Departments of provinces and cities, the Office of the General Department, the Anti-Smuggling Investigation Department, the Post-Clearance Control Department, the Information Technology and Statistics Department, the Center for Import-Export Goods Classification Analysis, the Customs Research Institute, the Vietnam Customs College, and the Customs Newspaper shall be responsible for organizing the making of customs uniforms for officials and personnel under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP under their units according to the prescribed model."

Article 2. Implementation:

1. This Circular takes effect from July 1, 2011.

2. The Director of the General Department of Customs shall be responsible for deciding the models and styles of uniforms and managing and using the uniforms prescribed in Clause 2 Article 1 of this Circular./.
