Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004, and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Inland Waterways Administration,

The Minister of Transport issues this Circular to stipulate criteria for classifying inland waterway ports and announcing the list of inland waterway ports.

Article 1. Scope of Regulation

This Circular stipulates criteria for classifying inland waterway ports and announcing the list of inland waterway ports.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals related to the classification and announcement of the list of inland waterway ports.

Article 3. Criteria for Classifying Inland Waterway Ports

1. Criteria for classifying inland waterway ports include:

a) The location, role, and importance of the inland waterway port in the economic and social development of the region, locality, or a part of a locality;

b) The scale of the inland waterway port including: port infrastructure, the largest vessel capacity it can accommodate, and the volume of cargo and passengers passing through the port in one year.

2. The classification of inland waterway ports shall be carried out in accordance with the provisions set forth in Appendix 1 attached hereto.

Article 4. Announcing the List of Inland Waterway Ports

1. Authority to announce the list of inland waterway ports

a) The Ministry of Transport announces the list of inland waterway ports on national inland waterways, dedicated inland waterways connecting to national inland waterways, and dedicated inland waterways crossing two or more centrally governed cities or provinces;

b) People's Committees of centrally governed cities or provinces announce the list of inland waterway ports on local inland waterways and dedicated inland waterways connecting to local inland waterways.

2. Procedure for announcing the list of inland waterway ports

a) The Vietnam Directorate of Inland Waterways compiles the list of inland waterway ports on national inland waterways, dedicated inland waterways connecting to national inland waterways, and dedicated inland waterways crossing two or more centrally governed cities or provinces, and submits it to the Ministry of Transport before December 20 each year for announcement;

b) Departments of Transport compile the list of inland waterway ports on local inland waterways and dedicated inland waterways connecting to local inland waterways, and submit it to the People's Committee of the centrally governed city or province before December 20 each year for announcement;

c) The authority responsible for announcing the list of inland waterway ports as specified in points a and b of Clause 1 of this Article must announce the list of inland waterway ports before December 31 each year according to the form prescribed in Appendix 2 attached hereto;

d) After the People's Committees of centrally governed cities or provinces have announced the list of inland waterway ports, the Department of Transport sends the list of ports that have been announced to the Vietnam Directorate of Inland Waterways before January 15 each year; the Vietnam Directorate of Inland Waterways summarizes and reports to the Ministry of Transport before January 25 each year.

3. The authority responsible for announcing the list of inland waterway ports as specified in points a and b of Clause 1 of this Article must publish the list of inland waterway ports that have been announced on their managed electronic information websites annually.

Article 5. Implementation Provisions

1. This Circular takes effect from January 1, 2015.

2. The Director of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Directorate of Inland Waterways, Directors of Departments of Transport of centrally governed cities or provinces, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular.

3. During implementation, if there are any difficulties, agencies, organizations, and individuals should report them to the Ministry of Transport for consideration and resolution./.
