||| Pursuant to the Law on Government Organization dated June 19, 2015;

||| Pursuant to the Cultural Heritage Law dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;

Pursuant to the Urban Planning Law dated June 17, 2009;

Pursuant to the Construction Law dated June 18, 2014;

||| Pursuant to the Investment Law dated November 26, 2014;

||| At the proposal of the Minister of Culture, Sports and Tourism;

||| The Government promulgates this Decree stipulating the conditions for business in antique appraisal and the practice of preservation, repair, and restoration of historical-cultural heritage sites and scenic spots.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

||| This Decree stipulates the conditions for business in antique appraisal and the practice of preservation, repair, and restoration of historical-cultural heritage sites and scenic spots.

Article 2. Applicability

||| This Decree applies to organizations and individuals participating in the activity of antique appraisal; organizations and individuals practicing the preservation, repair, and restoration of historical-cultural heritage sites and scenic spots (hereinafter referred to collectively as the practice of repairing heritage sites) within the territory of Vietnam and other related organizations and individuals.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. ||| Antique appraisal is an activity carried out by an organization authorized under the law on cultural heritage to determine the age, historical, cultural, scientific, aesthetic value, and other scientific issues related to the appraised objects.

2. ||| The practice of repairing heritage sites includes:

1. ||| The practice of planning for the repair of heritage sites;

2. ||| The practice of preparing projects for the repair of heritage sites, economic-technical reports on the repair of heritage sites, and designs for the repair of heritage sites;

3. ||| The practice of construction work for the repair of heritage sites;

4. ||| The practice of supervising construction work for the repair of heritage sites.

Chapter II

||| BUSINESS IN ANTIQUE APPRAISAL

||| Article 4. Conditions for business in antique appraisal

||| An enterprise engaged in antique appraisal must meet the following conditions:

1. ||| Having a warehouse for storing and preserving appraised objects.

2. ||| Having equipment and means suitable for conducting appraisals in accordance with the registered field.

3. ||| Having sources of information about antiques for reference and service to the activity of antique appraisal.

4. ||| Having at least three experts in antique appraisal from various specialties as guided by the Ministry of Culture, Sports and Tourism.

||| Article 5. Authority to issue, reissue, and revoke the Certificate of Compliance with Business Conditions for Antique Appraisal

||| The Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports has the authority to issue, reissue, and revoke the Certificate of Compliance with Business Conditions for Antique Appraisal for enterprises engaged in antique appraisal located within their jurisdiction.

||| Article 6. Procedures and formalities for issuing the Certificate of Compliance with Business Conditions for Antique Appraisal

1. ||| An enterprise engaged in antique appraisal shall submit directly or send by mail one set of documents to the competent authority as stipulated in Article 5 of this Decree. The dossier includes:

1. ||| A request form according to Form No. 01 attached to this Decree;

2. ||| A copy of the decision on establishment or business registration certificate or business license having legal validity;

3. ||| A list accompanied by scientific resumes according to Form No. 02 attached to this Decree and copies of diplomas and certificates of the experts;

4. ||| A copy of the recruitment decision or labor contract between the enterprise engaged in antique appraisal and the experts;

||| e) A list of equipment and means for conducting appraisals;

5. ||| A list of sources of information about antiques for service to the activity of appraisal.

2. ||| Within fifteen working days from the date of receipt of the complete dossier as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for examining and deciding to issue the Certificate of Compliance with Business Conditions for Antique Appraisal according to Form No. 03 attached to this Decree, while reporting to the Minister of Culture, Sports and Tourism. In case of refusal, a written response with clear reasons must be provided.

Article 7. Reissuing the Certificate of Eligibility for Business in Antique Appraisal

1. The Certificate of Eligibility for Business in Antique Appraisal shall be reissued in the following cases:

1. Lost or damaged;

2. There is a change in information that has been recorded in the previously issued Certificate of Eligibility for Business in Antique Appraisal.

2. Procedures for reissuing the Certificate of Eligibility for Business in Antique Appraisal:

1. The antique appraisal business entity shall submit directly or send via postal service one set of documents to the authority specified in Article 5 of this Decree. The dossier includes:

• Request form according to Form No. 04 attached to this Decree;

• Original Certificate of Eligibility for Business in Antique Appraisal already issued with the case where the Certificate is damaged or there is a change in information;

In the case of changes in information recorded in the previously issued Certificate of Eligibility for Business in Antique Appraisal, a copy of related documents must be sent along with the change in information.

2. Within five working days from the date of receiving the complete dossier as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports will examine and decide on reissuing the Certificate of Eligibility for Business in Antique Appraisal, while reporting to the Minister of Culture, Sports and Tourism. If refused, a written response must be provided with clear reasons.

Article 8. Revocation of the Certificate of Eligibility for Business in Antique Appraisal

1. The Certificate of Eligibility for Business in Antique Appraisal shall be revoked in the following cases:

1. The antique appraisal business entity no longer meets the conditions stipulated in this Decree;

2. The antique appraisal business entity is dissolved or voluntarily ceases its antique appraisal activities;

3. The antique appraisal business entity engages in violations of the law during antique appraisal activities and is proposed by competent state agencies to revoke the Certificate of Eligibility for Business in Antique Appraisal in accordance with the law on administrative violation handling;

4. Other revocation cases as prescribed by law.

2. Within five working days, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports who issued the Certificate of Eligibility for Business in Antique Appraisal shall notify the antique appraisal business entity of the Decision to Revoke, while reporting to the Minister of Culture, Sports and Tourism.

3. An antique appraisal entity whose Certificate of Eligibility for Business in Antique Appraisal has been revoked may only be considered for issuance of the Certificate of Eligibility for Business in Antique Appraisal after six months from the date of revocation, except in cases where the law provides otherwise. The procedures and requirements for requesting issuance of the Certificate of Eligibility for Business in Antique Appraisal after revocation shall be carried out as prescribed for new issuance.

Chapter III

PROFESSIONAL CERTIFICATE FOR REPAIRING HERITAGE SITES

Section 1

PROFESSIONAL CERTIFICATE FOR REPAIRING HERITAGE SITES

Article 9. Conditions for Issuing the Professional Certificate for Repairing Heritage Sites

The Professional Certificate for Repairing Heritage Sites (hereinafter referred to as the Professional Certificate) shall be issued to individuals who meet the specific conditions for each case as follows:

1. Professional Certificate for Planning the Repair of Heritage Sites:

1. Hold a Professional Certificate for Designing Construction Plans;

2. Have completed a training program on heritage site repair knowledge as prescribed by the Minister of Culture, Sports and Tourism.

2. Professional Certificate for Drafting Repair Projects of Heritage Sites, Economic and Technical Reports on Heritage Site Repairs, and Designing Heritage Site Repairs:

1. Hold a Professional Certificate for Designing Construction Projects;

2. Have completed a training program on heritage site repair knowledge as prescribed by the Minister of Culture, Sports and Tourism.

3. Professional Certificate for Implementing Heritage Site Repairs:

1. Hold a Professional Certificate for Designing Construction Projects or have a bachelor's degree or higher in construction-related fields;

2. Have completed a training program on heritage site repair knowledge as prescribed by the Minister of Culture, Sports and Tourism.

4. Professional Certificate for Supervising the Implementation of Heritage Site Repairs:

1. Hold a Professional Certificate for Supervising the Implementation of Construction Projects.

2. Have completed a training program on heritage site repair knowledge as prescribed by the Minister of Culture, Sports and Tourism.

Article 10. Authority to Issue, Reissue, and Revoke the Professional Practice Certificate

The Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports has the authority to issue, reissue, and revoke the Professional Practice Certificate as stipulated in Article 9 of this Decree.

Article 11. Procedures and Formalities for Issuing the Professional Practice Certificate

1. An individual shall submit directly or send via postal service one set of application documents to the person with the authority as specified in Article 10 of this Decree. The application includes:

a) Application form according to Form No. 05 attached to this Decree;

b) A copy of the Professional Practice Certificate in design planning construction, design construction practice, construction supervision practice for construction works, or a graduation certificate from a university or higher in relevant majors such as construction and architecture related to the activities proposed for issuance of the Professional Practice Certificate as stipulated in Clause 1, Point a, Clause 2, Point a, Clause 3, Point a, and Clause 4, Point a of Article 9 of thisDecree; A copy of the certificate or certification of participation in a training program on restoration of cultural relics;

3. Two color photographs measuring 3x4 cm taken within the year of application.

4. Within five working days from the date of receipt of the application documents as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for reviewing and requesting additional documents if they are missing or not valid.

2. Within five working days from the date of receiving complete and valid documents, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for examining and deciding to issue the Professional Practice Certificate according to Form No. 06 attached to this Decree, while reporting to the Minister of Culture, Sports and Tourism. In case of refusal, a written response must be provided with clear reasons.

3. The Professional Practice Certificate is valid for a period of five years.

4. Article 12. Reissuance of the Professional Practice Certificate

The Professional Practice Certificate may be reissued in the following cases:

1. Supplementing the scope of practice;

1. Expiration of validity;

2. Loss or damage.

3. Procedures and formalities for reissuing the Professional Practice Certificate:

2. An individual shall submit directly or send via postal service one set of application documents to the person with the authority as specified in Article 10 of this Decree. The application includes:

1. Application form according to Form No. 07 attached to this Decree;

• The original Professional Practice Certificate already issued for the case of supplementing the scope of practice or when the Professional Practice Certificate has expired or been damaged;

• Two color photographs measuring 3x4 cm taken within the year of reapplication;

• In the case of supplementing the scope of practice already recorded in the previously issued Professional Practice Certificate, copies of certificates and certifications as stipulated in Points b and c, Clause 1 of Article 11 of this Decree must be submitted along with the application.

For the case of reissuing the Professional Practice Certificate due to expiration or damage, within five working days from the date of receiving complete and valid documents, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall examine and decide to reissue the Professional Practice Certificate, simultaneously reporting to the Minister of Culture, Sports and Tourism. In case of refusal, a written response must be provided with clear reasons.

2. For the case of reissuing the Professional Practice Certificate due to loss or supplementing the scope of practice, the issuance period shall be carried out as prescribed for new issuance.

3. The content and validity period of the reissued Professional Practice Certificate are as follows:

3. For the case of supplementing the scope of practice, the scope of practice will be supplemented according to the validity period of the previous Professional Practice Certificate;

1. For the case of expiration, the content and validity period in the Professional Practice Certificate will be carried out as prescribed for new issuance;

2. For the case of loss or damage, it will be issued according to the content and validity period of the previous Professional Practice Certificate.

3. In case of loss or damage, record according to the content and deadline of the old Practice Certificate.

Article 13. Revocation of Professional Practice Certificate

1. The Professional Practice Certificate shall be revoked in the following cases:

1. Conducting preservation, restoration, and repair activities of cultural heritage sites beyond the scope permitted by the Professional Practice Certificate;

2. Failure to comply with laws on cultural heritage, construction, and other relevant laws;

3. Renting, lending, or allowing others to use the Professional Practice Certificate;

4. Unauthorized alteration or modification of the Professional Practice Certificate;

Other cases for revocation as prescribed by law.

2. Within five working days from the date of issuance, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports who issued the Professional Practice Certificate shall notify the decision to revoke the certificate to the organization or individual in violation, and simultaneously report to the Minister of Culture, Sports and Tourism.

3. An individual whose Professional Practice Certificate has been revoked may only be considered for reissuance of the Professional Practice Certificate after six months from the date of revocation, except where otherwise provided by law. The procedures and formalities for requesting issuance of the Professional Practice Certificate after revocation shall be carried out in accordance with the provisions applicable to new issuance.

Section 2

CERTIFICATE OF ELIGIBILITY FOR PRACTICE IN THE REPAIR OF CULTURAL HERITAGE SITES

Article 14. Conditions for Issuance of Certificate of Eligibility for Practice in the Repair of Cultural Heritage Sites

The Certificate of Eligibility for Practice in the Repair of Cultural Heritage Sites (hereinafter referred to as the Practice Certificate) shall be issued to organizations that meet the conditions stipulated for each specific case as follows:

1. Practice Certificate for Planning the Repair of Cultural Heritage Sites:

1. Established in accordance with the law;

2. Possessing the conditions for practicing design of construction planning as prescribed by the law on construction;

3. Having at least two individuals holding the Practice Certificate for Planning the Repair of Cultural Heritage Sites.

2. Practice Certificate for Preparing Repair Projects of Cultural Heritage Sites, Economic and Technical Reports on the Repair of Cultural Heritage Sites, and Design of Repair of Cultural Heritage Sites:

1. Established in accordance with the law;

2. Possessing the conditions for practicing construction design as prescribed by the law on construction;

3. Having at least three individuals holding the Practice Certificate for Preparing Repair Projects of Cultural Heritage Sites, Economic and Technical Reports on the Repair of Cultural Heritage Sites, and Design of Repair of Cultural Heritage Sites.

3. Practice Certificate for Construction of Repair of Cultural Heritage Sites:

1. Established in accordance with the law;

2. Possessing the conditions for organizational capacity in construction as prescribed by the law on construction;

3. Having at least three individuals holding the Practice Certificate for Construction of Repair of Cultural Heritage Sites.

4. Practice Certificate for Consulting Supervision of Construction of Repair of Cultural Heritage Sites:

1. Established in accordance with the law;

2. Possessing the conditions for organizational capacity in consulting supervision of construction as prescribed by the law on construction;

3. Having at least two individuals holding the Practice Certificate for Supervision of Construction of Repair of Cultural Heritage Sites.

Article 15. Authority to Issue, Reissue, and Revoke the Practice Certificate

The Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports has the authority to issue, reissue, and revoke the Practice Certificate for organizations engaged in the repair of cultural heritage sites with headquarters within their jurisdiction.

Article 16. Procedures and Formalities for Issuing the Practice Certificate

1. Organizations requesting issuance of the Practice Certificate shall submit directly or send via postal service one set of application documents to the person authorized under Article 15 of this Decree. The application includes:

1. Application form according to Form No. 08 attached to this Decree;

2. List of individuals holding the Practice Certificate as specified in Point c Clause 1, Point c Clause 2, Point c Clause 3, and Point d Clause 4 of Article 14 of this Decree, accompanied by copies of the Practice Certificates;

3. Copy of the Decision on Establishment or Business Registration Certificate or Business License.

2. Within five working days from the date of receipt of the application documents as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for reviewing and requesting supplementary documents if they are incomplete or invalid.

3. Within ten working days from the date of receipt of complete and valid application documents, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for examining and deciding to issue the Practice Certificate according to Form No. 09 attached to this Decree, while simultaneously reporting to the Minister of Culture, Sports and Tourism. In case of refusal, a written response must be given with clear reasons stated.

4. The Practice Certificate is valid for a period of five years.

Article 17. Reissuing the Professional Practice Certificate

1. The Professional Practice Certificate shall be reissued in cases as provided for in the reissuance of the Professional Qualification Certificate under Clause 1 of Article 12 of this Decree.

2. Procedures and formalities for reissuing the Professional Practice Certificate:

1. An organization shall submit directly or send through postal service one set of documents to the competent authority as stipulated in Article 15 of this Decree. The documents include:

- Application form according to Form No. 07 attached to this Decree;

, - Original Professional Practice Certificate that has been issued for cases of adding practice content or when the Professional Practice Certificate has expired or become damaged;

In cases where additional practice content has already been recorded in the previously issued Professional Practice Certificate, it is necessary to attach copies as specified in Points b and c of Clause 1 of Article 16 of this Decree.

2. For cases of reissuing the Professional Practice Certificate due to expiration or damage, within five working days from the date of receiving complete and valid documents, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports will review and decide on the reissuance of the Professional Practice Certificate, while simultaneously reporting to the Minister of Culture, Sports and Tourism. If refusal is made, a written response must be given with clear reasons stated.

3. For cases of reissuing the Professional Practice Certificate due to loss or adding practice content, the issuance period shall be carried out as prescribed for new issuance cases.

3. The content and validity period of the reissued Professional Practice Certificate shall be recorded as prescribed for the Professional Qualification Certificate under Clause 3 of Article 12 of this Decree.

Article 18. Revocation of the Professional Practice Certificate

The revocation of the Professional Practice Certificate shall be carried out as prescribed for the revocation of the Professional Qualification Certificate under Article 13 of this Decree.

Chapter IV
IMPLEMENTATION PROVISIONS

Article 19. Transitional Provisions

Business operation certificates for antique appraisal, Professional Qualification Certificates, and Professional Practice Certificates issued by competent state authorities before the effective date of this Decree shall continue to be used until their expiry date.

Article 20. Effective Date

This Decree takes effect from July 1, 2016.

Article 21. Responsibility for Implementation

1. The Minister of Culture, Sports and Tourism shall guide and organize the implementation of this Decree.

2. Ministers, Heads of ministries equivalent to ministries, Heads of government agencies, and Chairpersons of provincial people's committees within their respective duties and powers shall be responsible for organizing the implementation of this Decree./.
