Regarding the allowance system for workers and officials in certain special industries and occupations in enterprises

Regulations on the application of the allowance system for workers and officials in certain special industries and occupations in enterprises are hereby stipulated as follows:

Pursuant to the Law on the Organization of the Government dated September 30, 1992;

On the basis of Decree No. 26/CP dated May 23, 1993 of the Government temporarily regulating the new wage system in enterprises;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

DECISION:

Article 1. 1. Fixed meal allowance: The level of meals and the subjects eligible for the fixed meal allowance are specified in the appendix attached to this Decision.

The cost of the fixed meal allowance is accounted for at 70% in the enterprise's production cost or circulation fee. Subjects benefiting from the fixed meal allowance pay 30% of the fixed meal allowance amount and do not receive the heavy and hazardous work allowance in kind.

2. For regions truly lacking fresh water seasonally, enterprises may account for the cost of purchasing and transporting fresh water for workers' and officials' daily use in their production cost or circulation fee, after deducting the portion of fresh water costs included in salaries.

3. In the aviation industry, workers and officials directly serving flights and airport services temporarily receive an air safety bonus equivalent to 20% of their rank or position salary.

4. For divers working at depths of 3 meters or more, allowances based on actual diving hours are applied according to depth levels ranging from 10% to 100% of the minimum wage.

The Minister of Labor, Invalids and Social Affairs, the Minister of Finance, the Minister of Transport, and the Director of the Civil Aviation Administration of Vietnam shall establish the foreign currency payment system for seamen and aircraft crews when working abroad.

Article 2. The Minister of Labor, Invalids and Social Affairs, the Minister of Finance shall provide guidance on implementing this Decision.

Article 3. This Decision takes effect from the date of issuance and abolishes previous regulations that conflict with it.

Article 4. The Minister, the Head of Ministries equivalent to a Ministry, the Head of Government Agencies, the Chairman of Provincial People's Committees under the Central Government are responsible for enforcing this Decision.
