JOINT CIRCULAR
On the management and use of funds from selling tender documents for foreign BOT projects
Pursuant to Decree No. 87/CP dated November 23, 1993 of the Government promulgating the Investment Regulation under the Build-Operate-Transfer Contract form.
Pursuant to Decree No. 43/CP dated July 16, 1996 of the Government promulgating the Tendering Regulation and Circular No. 02/TTLB dated February 25, 1997 of the Ministry of Planning and Investment - Ministry of Construction - Ministry of Trade guiding the implementation of the Tendering Regulation.
Pursuant to the Prime Minister's decisions assigning the Ministry of Industry as the competent state agency to implement and deploy BOT electricity sector projects.
To facilitate the implementation and effective deployment of BOT electricity sector projects, the Ministry of Finance and the Ministry of Industry have agreed to stipulate the main contents regarding the management and use of funds from selling tender documents for BOT electricity sector projects as follows:
1. These regulations guide the screening of HIV testing for blood transfusion, blood product transfusion, and the implementation of assisted reproductive techniques and organ transplantation at state-owned, private, and public health facilities (hereinafter referred to as health facilities).
1. Activities serving the tendering and evaluation of foreign BOT projects managed by the Ministry of Industry shall be carried out on the principle of self-financing. The Ministry of Finance will not allocate budget funds to cover the costs of these activities.
2. Depending on the nature and scale of each tender package, the tenderer (the Ministry of Industry) may set the fee for each tender document. This price is established based on reasonable expenses as specified in Point 2, Section II of this Circular.
Funds received from selling tender documents shall be retained by the Ministry of Industry to cover activities related to tendering and evaluation.
3. Activities related to tendering and evaluation must be implemented in accordance with current regulations.

1. Revenue from selling tender documents:
The Ministry of Industry must deposit into the account opened at the State Treasury by the Ministry.
2. Expenses are defined as follows:
Costs for project inspection and review work including food, accommodation, and travel expenses;
Costs for project implementation work: renting or purchasing working equipment, office supplies, purchasing documents. Training, guiding business operations, printing, translating documents, office supplies...
Hiring consultants to participate in researching and evaluating projects.
Hiring lawyers to advise on legal issues.
Incentives for members of the tender evaluation committee.
III. IMPLEMENTATION:
1. Based on specific stages, workload, and according to the progress of the signed BOT contract, each quarter the Ministry of Industry shall prepare expenditure requirements to be allocated by the State Treasury according to the project schedule.
2. Annually, the Ministry of Industry must settle financial revenues and expenditures related to tendering and evaluation activities and report to the Ministry of Finance.
Upon completion of the project, if the revenue from selling tender documents exceeds the expenses specified in Point II, Part 2, the Ministry of Industry shall be responsible for depositing the excess amount into the state budget.
This Circular takes effect from January 1, 1998. Any difficulties encountered during implementation shall be further studied and amended by the two Ministries./.
