Circular No. 62/2009/TT-BNNPTNT Regarding the issuance of the "Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam"

CIRCULAR

REGARDING THE ISSUANCE OF THE "SUPPLEMENTARY LIST OF FERTILIZERS PERMITTED FOR PRODUCTION, TRADING AND USE IN VIETNAM"

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, trading; and Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and trading;
Pursuant to the Law on Quality and Product Standards dated November 21, 2007;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Quality and Product Standards;
Pursuant to Decision No. 100/2008/QĐ-BNN dated October 15, 2008 of the Minister of Agriculture and Rural Development on the issuance of regulations on fertilizer production, trading, and use;

The Ministry of Agriculture and Rural Development hereby issues the Supplementary List of Fertilizers Permitted for Production, Trading and Use in Vietnam,

Article 1. Attached hereto is the Supplementary List of Fertilizers Permitted for Production, Trading and Use in Vietnam (Annex 1 attached), including 163 types, divided into:

1. Compound fertilizers 01 type;

2. Micronutrient fertilizers 02 types;

3. Organic bio-fertilizers 22 types;

4. Organic mineral fertilizers 24 types;

5. Organic microbial fertilizers 10 types;

6. Microbial fertilizers 03 types;

7. Foliar fertilizers 95 types;

8. Fertilizers with growth regulators 02 types;

9. Soil moisture retention and improvement materials 03 types;

10. Growing media 01 type.

Article 2. Organizations and individuals permitted to produce, trade and use the types of fertilizers listed in this supplementary list must meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and trading; and the provisions at Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and trading.

Article 3. This Circular shall take effect forty-five days from the date of issuance. Fifty-three types of fertilizers will be removed from the list of fertilizers permitted for production, trading and use in Vietnam (Annex 2 attached) from the date this Circular takes effect:

1. Organic bio-fertilizers 15 types;

2. Organic mineral fertilizers 08 types;

3. Foliar fertilizers 27 types;

4. Microbial fertilizers 01 type;

5. Organic microbial fertilizers 01 type;

6. Fertilizers with growth regulators 01 type.

Article 4. The Director of the Office of the Ministry, the Director of the Crop Cultivation Department, the Director of the Science, Technology and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, heads of units, organizations, and individuals related to fertilizer production, trading, and use in Vietnam are responsible for implementing this Circular./.
