Article 24regulating special health standards and health examinations

for the People's Public Security Forces

Pursuant to the Law on Military Service dated June 19, 2015;

Pursuant to the Labor Safety and Health Law dated June 25, 2015;

Pursuant to the Law on the Public Security Organs dated November 20, 2018; the Law Amending and Supplementing Certain Articles of the Law on the Public Security Organs dated June 22, 2023;

Pursuant to the Labor Code on November 20, 2019;

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 70/2019/NĐ-CP dated August 23, 2019 of the Government on the implementation of the duty to participate in the People's Public Security Force;

Upon the proposal of the Director of the Health Bureau;

The Minister of Public Security shall prescribe special health standards and health examinations for the People's Police force.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the following contents:

1. Special health standards and health examinations for new recruits and selected citizens joining the People's Police, including examination for transfer to professional service status for conscript non-commissioned officers who have completed their term of compulsory military service in the People's Police, comprising: Health standards, preliminary examination, health examination, re-examination, classification of health status, and responsibilities of agencies, organizations, and individuals in conducting health examinations for new recruits and selected citizens joining the People's Police, and examination for transfer to professional service status for conscript non-commissioned officers who have completed their term of compulsory military service in the People's Police.

2. Special health standards and health examinations for citizens performing compulsory service in the People's Police, including: Standards, inspection, preliminary examination, health examination, re-examination, appraisal, and classification of health status for selecting citizens to perform compulsory service in the People's Police, and responsibilities of local police units in conducting health examinations for selecting citizens to perform compulsory service in the People's Police. Health examination for early discharge from compulsory service for conscript non-commissioned officers and soldiers who are not fit for continued service in the People's Police.

3. Regular health examinations, monitoring, care, hierarchical management, and health communication and education for officers and soldiers of the People's Police.

Article 2. Applicability

This Circular applies to:

1. The subjects are Vietnamese citizens registering for new recruitment and selection into the People's Police and conscript non-commissioned officers who have completed their term of compulsory military service in the People's Police and are being considered for transfer to professional service status (excluding contractual workers in the People's Police); conscript non-commissioned officers and soldiers in the People's Police discharged before the end of their term of compulsory military service.

2. Subjects for health examinations for selection to perform compulsory service in the People's Police include:

a) Male Vietnamese citizens within the age range for conscription who have registered for compulsory military service in accordance with the Law on Military Service;

b) Female Vietnamese citizens within the age range for conscription who have registered for compulsory military service in accordance with the Law on Military Service, having appropriate professional qualifications required by the People's Police, if they voluntarily and the People's Police have a need, may be considered and selected to perform compulsory service in the People's Police.

3. Subjects for regular health examinations and health management include: Officers and non-commissioned officers of the People's Police; conscript non-commissioned officers and soldiers; police workers; students studying general secondary education at Cultural Schools; students of the People's Police studying at schools inside and outside the People's Police receiving living expenses; students who are police officers and soldiers sent to study at schools of the People's Police or other schools; contractual workers receiving salaries from the State budget (hereinafter referred to collectively as police officers and soldiers).

4. Local police units and related organizations and individuals.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. Health examination refers to the process of asking about illness, collecting medical history, physical examination, and conducting certain tests to determine the health status of the person being examined.

2. Preliminary health examination for recruitment refers to the process of checking and evaluating the health of citizens participating in recruitment to police schools before each recruitment period.

3. Selection health examination refers to the health examination conducted for citizens participating in the selection process to join the People's Police force.

4. Regular health examination refers to the repeated health examination carried out at regular intervals.

5. Re-examination of health for recruitment refers to the process of conducting health examinations, classifying, and concluding the health status of citizens who have been admitted when processing admission procedures to police schools.

9. Re-examination Health Examination Board for Recruitment is a specialized board operating on a part-time basis established by the Chairman of the Recruitment Boards of the Police Academies and Police Colleges (hereinafter referred to as Police Colleges), responsible for conducting health examinations, classifying, and concluding the health status of citizens who have been admitted when processing admission procedures at Police Colleges.

10. Selection Health Examination Board, Health Examination Board for Transfer to Professional Service Status is a specialized organization operating on a part-time basis established by the Director of Hospital 19-8, Hospital 30-4, or Hospital 199 (for health examinations for selection and transfer to professional service status in units under the Ministry).

13. Health examination for citizens fulfilling their duty to participate in the People's Public Security is the use of means, techniques, and expertise to examine and conclude on the health status of citizens registering to fulfill their duty to participate in the People's Public Security when there are complaints about their health.

14. Health file for admission and selection into the People's Public Security is documentation regarding the health condition of citizens participating in admission and selection processes into the People's Public Security and related health documents.

15. Health file for citizens fulfilling their duty to participate in the People's Public Security is documentation regarding the health condition of citizens registering to fulfill their duty to participate in the People's Public Security, including the Health Examination Form concluded by the District Health Examination Board and the Provincial Police Health Re-examination Board, along with other relevant documents from authorized healthcare facilities.

16. Health record for management and monitoring of health conditions of officers and soldiers is a collection of results from regular health examinations, medical consultations, and treatments for each individual, either in paper form or electronic format.

17. Health Examination Form is a medical document summarizing basic information about the current health status of the person applying for a health examination.

18. Health care is the implementation of preventive measures against diseases for officers and soldiers; medical consultations and treatments for officers and soldiers who are injured or ill, and the implementation of recuperation programs to restore health.

19. Healthcare facilities of the People's Public Security include hospitals, infirmaries, general clinics, specialized clinics, medical teams, office medical services, and unit medical services.

Chapter II

SPECIAL HEALTH STANDARDS AND HEALTH EXAMINATIONS FOR NEW ADMISSIONS, SELECTION OF CITIZENS INTO THE PEOPLE'S PUBLIC SECURITY, AND TRANSFER TO PROFESSIONAL SERVICE REGIME FOR VOLUNTEER NON-COMMISSIONED OFFICERS WHO HAVE COMPLETED THEIR SERVICE PERIOD IN THE PEOPLE'S PUBLIC SECURITY, SELECTION OF CITIZENS TO PERFORM DUTIES IN THE PEOPLE'S PUBLIC SECURITY VOLUNTEER NON-COMMISSIONED OFFICERS WHO HAVE COMPLETED THEIR SERVICE PERIOD IN THE PEOPLE'S PUBLIC SECURITY, SELECTION OF CITIZENS TO PERFORM DUTIES IN THE PEOPLE'S PUBLIC SECURITY

Section 1

SPECIAL HEALTH STANDARDS

Article 4. Special health standards for new admissions, selections of citizens into the People's Public Security, and transfer to professional service regime for volunteer non-commissioned officers who have completed their service period in the People's Public Security

1. General Standards

Citizens participating in new admissions, selections into the People's Public Security, and volunteer non-commissioned officers who have completed their service period in the People's Public Security and are being considered for transfer to a professional service regime shall be recognized as meeting the health requirements if they meet the following criteria:

b) Height ranging from 1.64 meters to 1.95 meters for males, and from 1.58 meters to 1.80 meters for females, except in specific cases where height standards may be reduced as specified in Clause 2 and Clause 3 of this Article;

d) Meeting special indicators as prescribed in Article 6 of this Circular.

2. Special health standards for new admissions of citizens into the People's Public Security

Citizens participating in new admissions into the People's Public Security must meet the standards set out in Clause 1 of this Article and the following standards:

a) Citizens applying for admission to public security universities as volunteer non-commissioned officers serving in the People's Public Security: Height standards apply as at the time of selection to perform duties in the People's Public Security;

c) Citizens applying for admission to public security universities as Vietnamese citizens who have graduated from bachelor's degree programs at domestic and foreign universities: Citizens who have graduated from natural science, engineering, computer science, and information technology majors can apply the height standard of 1.62 meters to 1.95 meters for males, and 1.56 meters to 1.80 meters for females;

d) Citizens applying for cultural education at the secondary level as direct admission candidates and those eligible for admission: Height must be 1.55 meters or more for males, and 1.50 meters or more for females;

e) Citizens with multiple priority categories can only enjoy the highest priority category;

3. Special health standards for the selection of citizens into the People's Public Security and transfer to a professional service regime for volunteer non-commissioned officers who have completed their service period in the People's Public Security

Citizens selected into the People's Public Security and volunteer non-commissioned officers who have completed their service period in the People's Public Security and are being considered for transfer to a professional service regime must meet the common standards set out in Clause 1 of this Article and the following standards:

a) For volunteer non-commissioned officers who have completed their service period in the People's Public Security and are being considered for transfer to a professional service regime: The height standard applies as at the time of selection to perform duties in the People's Public Security;

b) For citizens with scientific and technical qualifications assigned to work in technical operations, criminal technical, information technology, cryptographic, cybersecurity, electronic warfare; those with qualifications such as Specialist I, Specialist II, Resident Doctor, Specialist I Pharmacist, Specialist II Pharmacist, Master's degree, Doctorate in Medicine or Pharmacy; holding the title of Professor or Associate Professor; ethnic minority individuals: Height from 1.62 meters to 1.95 meters for males, 1.56 meters to 1.80 meters for females; if myopia or hyperopia exists, each eye shall not exceed 05 diopters, astigmatism shall be physiological or each eye under 01 diopter, visual acuity through glasses for one eye must reach at least 09/10, total visual acuity for both eyes must be 19/10 or higher.

Article 5. Health Standards and Classification for Selecting Citizens to Fulfill Obligations in Participating in the People's Police

2. Only citizens who meet the health standards below will be recognized as having sufficient health to be selected to fulfill obligations in participating in the People's Police:

a) Ensuring specific indices as prescribed in Article 6 of this Circular;

b) Citizens with Health Class 1 and Class 2 for units such as the Mobile Force Command, the Security Guard Command, local mobile police forces, fire prevention, firefighting, rescue and disaster relief forces; in cases of recruitment difficulties, local public security units may select citizens with Health Class 3 to be assigned to other units, except for citizens with Health Class 3 due to height issues, Health Class 3 affecting appearance or movement, or eyes with refractive errors (myopia over 1.5 diopters, hyperopia of all degrees, astigmatism over 01 diopter). The proportion of citizens with Health Class 3 shall not exceed 20% of the recruitment quota in the entire province or centrally-administered city.

Article 6. Specific Indices

1. Citizens participating in new admissions, selections into the People's Police and non-commissioned officers completing their mandatory service term in the People's Police and being considered for transfer to professional service must meet the following specific indices:

b) Normal hair color and style (as per the People's Police Regulations);

c) No skin pigmentation disorders, except for localized facial sunspots (cheek freckles);

d) No piercings in the nose or other body parts for wearing jewelry. For males, no ear piercings or ear piercings that have healed into scars; for females, no more than two piercings on one ear or only one ear piercing, with other ear piercings having healed into scars;

đ) No raised scars that pull or contract in the head, face, neck, forearm, hand, foot areas;

e) No tattoos or markings on the skin, including cosmetic tattooing, except for eyebrow and lip cosmetic tattooing for females;

2. Citizens fulfilling obligations in participating in the People's Police must meet the following specific indices:

a) Meeting the requirements stipulated in points a, b, c, d, đ of Clause 1 of this Article;

b) Not selecting individuals whose bodies have tattoos or markings on the skin, including cosmetic tattooing, containing offensive, anti-regime, divisive, bizarre, sexually stimulating, or violent content; tattoos or markings causing offense on visible areas such as the face, head, neck, lower half of the arm, lower third of the thigh; tattoos or markings covering half the back, chest, abdomen or more. In cases where tattoos or markings, including cosmetic tattooing, are visible but the area does not exceed 02 square centimeters, the number does not exceed one tattoo and is not offensive, or has been removed or is cosmetic eyebrow or lip tattooing for females, they may be considered for selection to fulfill obligations in participating in the People's Police.

The health classification method for health examinations in recruitment and selection of new recruits and citizens to the People's Public Security, and for transferring to a professional service regime for conscript non-commissioned officers who have completed their term of military service in the People's Public Security

1. Health classification shall be based on the health standards set out in Appendix I attached to this Circular.

2. Scoring method

For each criterion, after the doctor's examination, even points from 1 to 6 shall be entered into the "Points" column, specifically:

Point 1: Only indicates very good health status.

Point 2: Indicates good health status.

Point 3: Indicates fairly good health status.

Point 4: Indicates average health status.

Point 5: Indicates poor health status.

Point 6: Indicates very poor health status.

3. Health Classification Categories

Category 1: All criteria achieve Point 1.

Category 2: At least one criterion achieves Point 2.

Category 3: At least one criterion achieves Point 3.

Category 4: At least one criterion achieves Point 4.

Category 5: At least one criterion achieves Point 5.

Category 6: At least one criterion achieves Point 6.

Section 2

HEALTH EXAMINATION FOR RECRUITMENT AND SELECTION OF NEW RECRUITS AND CITIZENS INTO THE PEOPLE'S PUBLIC SECURITY, AND TRANSFER TO A PROFESSIONAL SERVICE REGIME FOR CONSCRIPT NON-COMMISSIONED OFFICERS WHO HAVE COMPLETED THEIR TERM OF MILITARY SERVICE IN THE PEOPLE'S PUBLIC SECURITY

Article 8. Content of Health Examination and Health Conclusion for Recruitment and Selection of New Recruits and Citizens into the People's Public Security, and Transfer to a Professional Service Regime for Conscript Non-Commissioned Officers Who Have Completed Their Term of Military Service in the People's Public Security

1. Health Examination Content

a) Physical examination and clinical examination according to the criteria specified in Appendix I attached to this Circular;

Blood test: Blood formula; blood group, glucose, AST, ALT, urea, creatinine, HIV, HBsAg, anti-HCV; urine test including total urine analysis, drugs and precursors; chest X-ray; general abdominal ultrasound; electrocardiogram.

If necessary, other paraclinical examinations may be prescribed to serve the health conclusion at the request of the Board or Health Examination Team.

2. Health Conclusion

a) The person conducting the clinical and paraclinical examination for the examinee must clearly record the examination results, classify the health status of each specialty, sign and bear legal responsibility for the examination and its results;

b) Based on the examination results of each specialty, the Board or Health Examination Team shall implement the health classification conclusion as stipulated in Articles 4 and 6 of this Circular;

c) After classifying health status, the Chairman of the Board or Head of the Health Examination Team shall be responsible for signing, clearly recording their full name, and affixing the stamp of the medical facility on the Health Examination Form. In the health conclusion of the Board or Health Examination Team, it must clearly state whether the citizen meets or does not meet the health standards for recruitment and selection into the People's Public Security or conscript non-commissioned officers who have completed their term of military service in the People's Public Security and are eligible for transfer to a professional service regime.

3. Points to Note

a) In cases where the examinee is currently suffering from an acute illness, an illness that may improve or worsen over time or after treatment, the point must be accompanied by the letter "T" next to it (meaning "temporary"). The examiner must briefly record the name of the disease in Vietnamese next to it (it can be recorded in international terms between parentheses). When concluding, if the letter "T" is next to the criterion with the highest point, the letter "T" must be written in the health classification section;

b) In cases where there is doubt about scoring or making a conclusion, the Board or Health Examination Team shall refer the citizen to a specialized examination at another medical facility meeting the required conditions to obtain an accurate conclusion. The maximum time limit for obtaining a conclusion is 10 days and this should only be done when necessary;

c) For cases where the health form has the letter "T" recorded, the Board or Health Examination Team shall be responsible for guiding the citizen to medical facilities for treatment;

d) In cases where the citizen suffers from diseases not classified in Table 2 of Appendix I attached to this Circular, the Health Examination Board shall comprehensively assess the function of the affected organ; the degree of impact on exercise, work, and daily life; predict the progression of the disease to conclude the health classification.

Article 9. Medical Examination Board for Initial Recruitment Health Screening and Re-examination Medical Examination Board for Recruitment Health Screening

1. Medical Examination Board for Initial Recruitment Health Screening

The Chairman of the Initial Recruitment Examination Council decides to establish, define tasks and powers of the Medical Examination Board for Initial Recruitment Health Screening. The composition of the Medical Examination Board for Initial Recruitment Health Screening includes:

a) One Chairperson: Director of the hospital, Head of the Health Department or Medical Officer of the Public Security units and localities;

b) One Deputy Chairperson: Deputy Director of the hospital or Deputy Head of the Health Department or Deputy Medical Officer of the Public Security units and localities;

c) Member: Representative of leadership and personnel working in organizational affairs of the unit; representative of leadership and personnel working in health affairs of the Public Security units and localities;

d) Secretary: Hospital staff, Health Department staff or medical officer with expertise in medical practice;

đ) The Medical Examination Board for Initial Recruitment Health Screening shall have from three to five doctors, including at least one internist and one surgeon.

2. Medical Examination Board for Re-examination Recruitment Health Screening

The Chairman of the Recruitment Examination Council of the People's Public Security Schools decides to establish, define tasks and powers of the Medical Examination Board for Re-examination Recruitment Health Screening. The composition of the Medical Examination Board for Re-examination Recruitment Health Screening includes:

a) One Chairperson: Head of the Health Department or Medical Officer of the People's Public Security Schools;

b) One Deputy Chairperson: Deputy Head of the Health Department or Deputy Medical Officer of the People's Public Security Schools;

c) Member: Representative of the Logistics Department leadership, representative of the Training and Advanced Training Department leadership or equivalent department responsible for recruitment training work, team leader or personnel directly involved in recruitment training work, staff of the Health Department or medical officer with expertise in medical practice of the People's Public Security Schools;

d) Secretary: Staff of the Health Department or medical officer with expertise in medical practice;

đ) The Medical Examination Board for Re-examination Recruitment Health Screening shall have from three to five doctors, including at least one internist and one surgeon.

3. Content of re-examination, health conclusion for new recruitment candidates shall be implemented according to the provisions of Article 8 of this Circular. Utilize the results of clinical tests conducted during initial recruitment health screening, only proceed with re-examination on clinical test contents not included in the health examination file or those requiring clarification.

4. In case there is a discrepancy between the results of the initial recruitment health screening and the re-examination health screening results, the People's Public Security School shall notify the Public Security unit or locality where the initial screening was conducted, or send the candidate for training to reach a consensus on the examination results in writing between the two units.

If consensus cannot be reached, the People's Public Security School shall request the establishment of a Re-examination Health Screening Examination Board by Hospital 19-8, Hospital 30-4, or Hospital 199 (depending on the region); the conclusion of the Re-examination Health Screening Examination Board must clearly state whether the citizen meets or does not meet the health standards for recruitment into the People's Public Security; the conclusion of the Re-examination Health Screening Examination Board is the final result and serves as the basis for the People's Public Security School to accept enrollment or return the candidate to the Public Security unit or locality where the initial screening was conducted.

Article 10. Medical examination for selecting citizens into the People's Police and transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police

1. Classification of medical examinations for selecting citizens into the People's Police and transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police

a) Provincial Public Security hospitals and clinics shall organize medical examinations for citizens selected into the People's Police and non-professional warrant officers completing their mandatory service term in the People's Police who are considered for transfer to professional service status within their own units and detention centers, compulsory educational facilities, and rehabilitation schools located within their jurisdiction; they shall also conduct medical examinations for non-professional warrant officers completing their mandatory service term in the People's Police who are considered for transfer to professional service status within subordinate units of the Mobile Police Command located within their jurisdiction, except in cases stipulated in point b of Clause 1 of this Article;

b) The Health Department of the Mobile Police Command shall be responsible for organizing medical examinations for non-professional warrant officers completing their mandatory service term in the People's Police who are considered for transfer to professional service status within units under the Mobile Police Command located in Hanoi City;

a) The Chairman of the Board for selecting citizens into the People's Police and the Chairman of the Board for transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police at the provincial level shall issue decisions to establish the Medical Examination Board for selecting citizens into the People's Police and the Medical Examination Board for transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police, specifying principles of operation, tasks, authorities, and responsibilities of board members. The composition of the Medical Examination Board shall comply with the provisions of Clause 1, Article 9 of this Circular;

b) The Chairman of the Board for transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police at the Mobile Police Command shall issue decisions to establish the Medical Examination Board for transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police, specifying principles of operation, tasks, authorities, and responsibilities of board members. The composition of the Medical Examination Board shall comply with the provisions of Clause 1, Article 9 of this Circular.

3. Medical examination boards for selecting citizens into the People's Police and for transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police at Hospitals 19-8, 30-4, and 199

a) The Directors of Hospitals 19-8, 30-4, and 199 shall issue decisions to establish the Medical Examination Board for selecting citizens into the People's Police and for transferring non-professional warrant officers to professional service status upon completion of their mandatory service term in the People's Police, specifying principles of operation, tasks, authorities, and responsibilities of board members;

b) Composition of the Medical Examination Board:

01 Chairman of the Board: 01 leader of the hospital.

01 Deputy Chairman of the Board: Head or Deputy Head of the Planning and General Affairs Department of the hospital.

Member: Head or Deputy Head of the Outpatient Department.

Secretary: staff member of the Planning and General Affairs Department.

Other members: representatives of leaders of specialized departments of the hospital.

The Medical Examination Board has the authority to requisition doctors from specialized departments to serve the medical examination process;

Article 11. Conditions for healthcare facilities organizing health examinations for new student admissions, selecting citizens to join the People's Public Security Forces, and reviewing transfers to professional service systems for conscript non-commissioned officers completing their mandatory service terms in the People's Public Security Forces.

Healthcare facilities of the People's Public Security Forces participating in health examinations must ensure the following conditions:

1. Being a medical examination and treatment facility that has been granted an operating license in accordance with the law.

2. Having all clinical and paraclinical departments, personnel holding medical practice licenses in accordance with the law, suitable for the content of health examinations and the information recorded on the health examination form issued together with Appendix III of this Circular.

3. Possessing minimum medical equipment and organizing examination rooms in accordance with the provisions set out in Appendix IX issued together with this Circular.

4. In cases where healthcare facilities of the People's Public Security Forces do not have sufficient specialist doctors to conduct clinical and paraclinical examinations, they shall enter into contracts with individuals holding medical practice licenses in accordance with the Law on Medical Examination and Treatment and the Labor Code.

5. In cases where healthcare facilities of the People's Public Security Forces do not meet the conditions for conducting health examinations as stipulated in Clauses 1, 2, and 3 of this Article, such facilities shall take the lead in coordinating with other healthcare facilities of the People's Public Security Forces or state-owned healthcare facilities outside the Public Security sector that meet the required conditions. During coordination with healthcare facilities outside the Public Security sector, it is necessary to ensure regulations concerning the protection of state secrets; particularly ensuring confidentiality regarding the organizational structure, staffing, and personnel numbers of Public Security units, as well as personal information of officers and soldiers.

Article 12. Health Examination Forms for New Student Admissions, Re-examinations for New Student Admissions, Selection of Citizens to Join the People's Public Security Forces, and Review Transfers to Professional Service Systems for Conscription Non-Commissioned Officers Completing Their Mandatory Service Terms in the People's Public Security Forces.

1. The health examination form is printed on white A4 paper (21 x 29.7 cm) according to the model specified in Model 01 of Appendix III issued together with this Circular.

2. The health examination form consists of three parts:

a) Part I - Brief Personal History and Medical History;

b) Part II - Health Examination: Recorded by the Health Examination Board (Committee);

c) Part III - Summary Table: Recorded by the Health Examination Board (Committee).

3. Management of Health Examination Forms

a) When conducting preliminary health examinations for new student admissions, the health examination forms are managed by the Public Security unit or local authority responsible for the preliminary examination.

b) When conducting re-examinations for new student admissions, the health examination forms are managed by the Public Security training institutions where the admitted students enroll.

c) When conducting health examinations for the selection of citizens to join the People's Public Security Forces and reviewing transfers to professional service systems for conscription non-commissioned officers completing their mandatory service terms in the People's Public Security Forces, the health examination forms are managed by the organizational personnel department responsible for the selection process along with the candidate's personnel file.

4. The health examination form is valid only when:

a) It is filled out according to the prescribed model;

b) Written with blue ink pen or ballpoint pen, not with pencil;

c) The handwriting is clear, without erasures or abbreviations;

đ) Not exceeding six months from the date of the health examination conclusion, except in cases of special health developments.

Section 3

HEALTH EXAMINATIONS FOR THE SELECTION OF CITIZENS TO PERFORM DUTIES WITH THE PEOPLE'S PUBLIC SECURITY FORCES

The health examination, preliminary health screening, medical examination, health appraisal, and requirements for citizens during preliminary health screening in the selection of citizens to fulfill their duty to join the People's Public Security Force shall be carried out in accordance with the provisions of Circular Joint No. 16/2016/TTLT-BYT-BQP dated June 30, 2016, issued by the Ministry of Health and the Ministry of National Defense on the implementation of military service health examinations.

The health examination form for citizens fulfilling their duty to join the People's Public Security Force shall be printed on white A4 paper (21 x 29.7 cm) according to the model prescribed in Model 1a of Appendix IV attached to this Circular.

Article 14. Re-examination of health for citizens fulfilling their duty to join the People's Public Security Force

2. The Re-examination Health Examination Council for citizens fulfilling their duty to join the People's Public Security Force

b) The composition of the Re-examination Health Examination Council includes:

01 Chairman: Director of the hospital, Head of the Health Department, or Medical Station Chief.

01 Deputy Chairman: Deputy Director of the hospital, Deputy Head of the Health Department, or Deputy Medical Station Chief.

Other members: Representatives from the leadership of the organizational personnel department, the inspectorate of the Provincial Public Security, and representatives from the leadership and medical staff of units receiving troops under the Ministry (for units with medical staff) or recruitment officers (for units without medical staff).

The Council shall consist of 03 to 05 doctors, including at least 01 internist and 01 surgeon;

The content of re-examination of health shall be carried out in accordance with the provisions of Circular Joint No. 16/2016/TTLT-BYT-BQP dated June 30, 2016, issued by the Ministry of Health and the Ministry of National Defense on the implementation of military service health examinations. Utilize the results of clinical tests already conducted by the Military Service Health Examination Council at the district level, only re-examine the clinical test contents not included in the health examination file or those that need clarification.

The re-examination health examination form for citizens fulfilling their duty to join the People's Public Security Force shall be printed on white A4 paper (21 x 29.7 cm) according to the model prescribed in Model 1b of Appendix IV attached to this Circular.

4. Organization of re-examination health examination rooms for citizens fulfilling their duty to join the People's Public Security Force

a) The examination rooms must be arranged in a one-way, closed system, convenient for the examinees and ensuring the minimum conditions required for examination in each specialty;

b) The number of examination rooms shall be determined based on the number of medical personnel in the Re-examination Health Examination Council and the actual situation, including:

Physical examination room, movement examination room, eye examination room, ear-nose-throat examination room, dental examination room;

Endocrine examination room, urinary-genital examination room, dermatology examination room, oncology examination room;

Circulatory system examination room, respiratory system examination room, digestive system examination room, mental health examination room, neurological examination room;

Laboratory room equipped to conduct laboratory tests according to the health examination items stipulated in Article 13 of this Circular;

X-ray room (if available);

Gynecological examination room (if available);

Conclusion room;

There must be sufficient basic medical equipment and organize examination rooms according to the regulations set forth in Appendix IX attached to this Circular.

c) For cases where the health record indicates "T" (temporary), the Re-examination Health Examination Council must clearly conclude: If the illness or health issue has recovered, remove the letter "T" and change the health classification; If the illness or health issue has not improved or shows a worsening trend, it is necessary to organize another examination and conclude whether the citizen is fit or unfit to fulfill their duty to join the People's Public Security Force, and return them to their place of origin if they are found unfit.

5. Time for organizing re-examination of health for citizens fulfilling their duty to join the People's Public Security Force

b) Units receiving troops under the Ministry shall unify in writing with the Provincial Public Security regarding the composition of participants in the Council, time, and results of re-examination of health for citizens recruited by the Provincial Public Security for units receiving troops under the Ministry.

Article 15. Medical Examination for Early Discharge from Military Service for Non-Commissioned Officers and Conscripts Serving in the People's Public Security Force

1. The Medical Appraisal Council of the Ministry of Public Security shall conduct medical examinations and issue conclusions on the health status of non-commissioned officers and conscripts serving in the People's Public Security Force, determining whether they have sufficient health (reaching Class 1, Class 2, or Class 3) or insufficient health to continue their service in the People's Public Security Force.

Chapter III

REGULAR MEDICAL EXAMINATIONS AND HEALTH MANAGEMENT AND CARE FOR PUBLIC SECURITY OFFICERS AND SOLDIERS

Section 1

REGULAR MEDICAL EXAMINATIONS AND HEALTH RECORDS

Article 16. Organization of Regular Medical Examinations

1. Regular medical examinations shall be conducted in a centralized manner, and in certain cases, individual examinations may be carried out, all under the main organization of public security medical facilities.

2. Conditions for regular medical examination facilities

Public security medical facilities participating in regular medical examinations must ensure the following conditions:

a) They must be healthcare facilities that have been granted a license to operate according to the provisions of the law;

b) They must have all clinical and paraclinical departments, and appropriate human resources corresponding to the content of regular medical examinations and the information recorded in the medical examination forms prescribed in Appendices VI, VII, and VIII issued together with this Circular;

c) They must have minimum medical equipment and organize examination rooms according to the regulations set forth in Appendix IX issued together with this Circular.

3. Public security medical facilities that meet the conditions for regular medical examinations as stipulated in Clause 2 of this Article shall be responsible for organizing regular medical examinations for the subjects specified in Clause 3 of Article 2 of this Circular.

4. In cases where healthcare facilities of the People's Public Security Forces do not have sufficient specialist doctors to conduct clinical and paraclinical examinations, they shall enter into contracts with individuals holding medical practice licenses in accordance with the Law on Medical Examination and Treatment and the Labor Code.

5. In case public security medical facilities do not meet the conditions for regular medical examinations as stipulated in Clause 2 of this Article

Public security medical facilities that do not meet the conditions for regular medical examinations shall report to the head of the unit to coordinate with other public security medical facilities that meet the conditions for regular medical examinations, either partially or fully, as prescribed; or sign partial or full contracts with civilian or military medical facilities that meet the conditions as prescribed by the Ministry of Health; prioritizing coordination with other public security medical facilities. During the coordination with non-public security medical facilities, it is necessary to ensure the regulations concerning state secrets protection work, especially ensuring confidentiality regarding the organizational structure, staffing, personnel strength, and personal information of public security officers and soldiers.

6. The number of regular medical examinations is defined as follows

a) Organize regular medical examinations every six months for: Leaders at the department level and above, officers with the rank of Senior Lieutenant Colonel and above; officers and soldiers engaged in particularly arduous, hazardous, or dangerous occupations; officers and soldiers suffering from occupational diseases;

b) Organize regular medical examinations annually for the remaining subjects.

7. Content of regular medical examinations

a) Clinical examination: Inquiry about symptoms, personal and family medical history; physical examination including general physical and comprehensive body examination; internal medicine examination including cardiovascular, respiratory, digestive, renal-urinary, musculoskeletal, endocrine, neurological; mental health examination; surgery examination; ophthalmology examination; otolaryngology examination; stomatology examination; dermatology examination; gynecological examination for women as prescribed in Appendix VIII issued together with this Circular, and urological examination for men;

b) Paraclinical examination: Imaging diagnosis (X-ray, ultrasound); functional tests; laboratory tests including blood tests (hematology, biochemistry, immunology, microbiology), urine tests; cell tests, stool tests (if necessary);

c) Clinical and paraclinical examinations according to the doctor's instructions or other cases outside the provisions of points a and b of Clause 7 of this Article shall be carried out in accordance with the groups of subjects specified in Item 3 of Table 2 in Appendix IV of Decree No. 01/2021/NĐ-CP dated October 21, 2021 of the Government on standards and material quotas for logistics support in the People's Public Security Force;

d) Conclusion:

After conducting the medical examination, doctors must classify the health status according to each specialty, sign and clearly write their names on the Regular Medical Examination Form and bear responsibility for their conclusions;

Those responsible for concluding the medical examination must conclude: primary diseases (if any); treatment follow-up recommendations; health classification in the Regular Medical Examination Forms prescribed in Appendices VI, VII, and VIII issued together with this Circular.

8. The conclusion of the medical examination includes the following contents:

a) Health classification: Implemented according to the regulations of the Ministry of Health;

b) Clearly record any diseases or disabilities (if any) and propose treatment plans, rehabilitation measures, referral to specialized clinics for treatment, and occupational disease examinations.

9. Those responsible for concluding the medical examination must sign the Regular Medical Examination Form and bear responsibility for their conclusions. The Regular Medical Examination Form shall be kept at the public security medical facility that organizes the examination.

10. After regular medical examinations for the subjects specified in Clause 3 of Article 2 of this Circular, public security medical facilities must evaluate the post-examination health status as follows:

a) Evaluate the rate of medical examinations, the rate of health status by category, and compare the results with previous examinations;

b) Evaluate the impact of training, exercise, living habits, nutrition, and working environment on the health of the subjects specified in Clause 3 of Article 2 of this Circular;

c) Evaluate the strengths and limitations in the organization of regular medical examinations for the subjects specified in Clause 3 of Article 2 of this Circular;

d) Prepare a list for the subjects specified in Clause 3, Article 2 of this Circular who have health classification Type IV, V, or Type C, D depending on the regular health examination as prescribed by the Ministry of Health, suffering from diseases requiring long-term treatment, occupational diseases to guide and advise on nutrition, exercise, treatment, and recuperation; propose that the unit managing officers and soldiers take measures to address factors affecting the health of officers and soldiers; recommend to the competent authority to assign appropriate duties for officers and soldiers.

đ) Update the results of regular health examinations into the health record.

Article 17. Health Record

1. The health record includes:

a) The health examination form for selection or screening to join the People's Public Security;

b) The regular health examination form as stipulated in this Circular;

c) Personal health records as prescribed by the Ministry of Health;

d) Occupational health examination records (if applicable) as prescribed by the Ministry of Health.

2. The health record shall be established, updated, and stored in paper or electronic format at public security medical facilities in accordance with legal provisions on storage and other relevant regulations; in cases where the information in the health record falls within the scope of state secrets, it shall be handled in accordance with legal provisions on protecting state secrets. For electronic health records, they shall be connected, synchronized, and centrally managed based on the public security medical database as prescribed by the Ministry of Public Security.

Section 2

MANAGEMENT AND CARE OF OFFICERS' AND SOLDIERS' HEALTH

Article 18. Principles of Management and Care of Health

1. Conduct proactively, regularly, promptly, with clear hierarchical division, and strictly adhere to technical regulations in the management and care of health.

2. The health record must be fully, accurately recorded, regularly updated, and strictly managed at the unit.

3. Actively coordinate with military and civilian medical facilities in the health care work for officers and soldiers.

4. Maintain confidentiality regarding health status and personal information of officers and soldiers recorded in the health record.

5. Health management and care activities shall be carried out comprehensively and continuously, including regular health monitoring; management of diseases requiring long-term treatment, occupational diseases (if applicable); necessary health checks; health education; regular health examinations, and establishment of health records.

6. Regular health examinations for all officers and soldiers must be conducted compulsorily by public security medical facilities as the main organizer according to the provisions of this Circular.

Article 19. Continuous Health Monitoring for Officers and Soldiers

1. Continuous health monitoring work is carried out as follows

Public security medical facilities conduct initial health checks, establish health records, monitor health conditions, and provide timely emergency treatment and therapy for those who fall ill, get injured, or suffer accidents during work, combat, and daily life; particularly focusing on individuals with health classifications Type IV, V, or Type C, D; those with diseases requiring long-term treatment; occupational diseases or changes in health due to age, exposure to harmful factors with a risk of occupational diseases, or engaging in heavy, toxic, dangerous, or extremely heavy, toxic, dangerous jobs; and those working in remote areas to implement appropriate preventive and therapeutic measures.

2. Public security medical facilities base their recommendations on the results of continuous health monitoring to determine exercise routines, training methods, preventive measures; propose job assignments suitable for the health condition of the subjects specified in Clause 3, Article 2 of this Circular.

3. When officers and soldiers seek medical treatment at medical facilities inside and outside the public security sector, they are responsible for providing the results of their medical treatment to the public security medical facility under their management.

Article 20. Management of long-term treatable diseases and occupational diseases for officers and soldiers

1. The unit managing officers and soldiers shall establish a list of officers and soldiers suffering from long-term treatable diseases and occupational diseases (if any) within their unit for management and monitoring the development of such diseases, while periodically checking and evaluating the health of officers and soldiers with long-term treatable diseases and occupational diseases (if any). Health care facilities under the police, according to their level of management, shall be responsible for leading and advising on the management and monitoring of officers and soldiers with long-term treatable diseases and occupational diseases.

2. Work related to the management of long-term treatable diseases and occupational diseases:

a) Providing guidance on living habits, work, physical training, and nutrition suitable for each officer and soldier;

b) Regularly promoting and educating knowledge about methods to prevent and combat long-term treatable diseases and occupational diseases among officers and soldiers;

c) Periodically checking the health status based on the disease conditions of officers and soldiers.

3. The results of monitoring long-term treatable diseases and occupational diseases must be recorded in the health file. Health care facilities under the people's public security must promptly compile, analyze, and report to the head of the unit, higher-level health authorities, and at the same time propose policies and measures to protect and improve the health of officers and soldiers.

In cases where necessary, health care facilities under the police shall conduct health check-ups for the following subjects:

1. Officers and soldiers after a hospitalization period at a higher-level hospital to understand their current health status; determine subsequent preventive treatment measures and issue specialized instructions.

2. Officers and soldiers working or coming into contact with epidemic factors related to infectious diseases or coming into contact with harmful factors that may lead to occupational diseases or performing heavy, toxic, dangerous, and particularly heavy, toxic, dangerous jobs.

3. Officers and soldiers classified as health category IV, V, or C, D.

4. Officers and soldiers participating in training sessions, sports competitions, and as required by work.

5. Officers and soldiers before retiring to enjoy pension benefits.

Heavy, toxic, dangerous, and particularly heavy, toxic, dangerous jobs are those defined by the Ministry of Labor, Invalids, and Social Affairs in Circular No. 11/2020/TT-BLĐTBXH dated November 12, 2020, promulgating the list of heavy, toxic, dangerous, and particularly heavy, toxic, dangerous jobs.

Article 22. Health Care System

1. Comrades under the management of the Politburo and the Secretariat shall be provided with health care according to the regulations of the Central Office for Security and Health Care of Cadres.

2. Leaders at the Bureau level and equivalent shall be provided with health care according to the regulations of the High-Ranking Cadre Security and Health Care Office of the Ministry of Public Security.

3. The remaining subjects shall implement the health care system as follows:

a) Normal health: medical units shall guide cadres and soldiers to self-monitor and take care of their health;

b) Weak and very weak health: medical units need to have specific monitoring systems and propose preventive and treatment measures suitable for each case (admitting for treatment, convalescence).

4. For leaders at the Department level and equivalent, officers with the rank of Senior Lieutenant Colonel and above shall be allocated rooms for treatment and enjoy health care benefits at the Advanced Departments of public security hospitals.

Article 23. Health Education Communication

1. Public security medical facilities shall be responsible for health education communication for the subjects specified in Clause 3 of Article 2 of this Circular.

2. The content and forms of communication and health education (including direct and indirect methods) shall be appropriate for each subject.

Chapter IV

AUTHORITY, RESPONSIBILITY OF PUBLIC SECURITY UNITS AND LOCALITIES AND FUNDS TO ENSURE HEALTH CHECKS

Article 24. Authority and responsibility of public security units and localities in conducting health checks for new admissions, selecting citizens to join the People's Public Security, and reviewing non-commissioned officers' service terms for transfer to professional service in the People's Public Security

1. The Health Service Bureau shall direct, guide, inspect, and supervise the work of health checks and rechecks for new admissions, selecting citizens to join the People's Public Security, and reviewing non-commissioned officers' service terms for transfer to professional service in the People's Public Security as prescribed.

2. The Cadre and Personnel Organization Bureau shall coordinate with the Health Service Bureau to guide public security units and localities in implementing the work of health checks for selecting citizens to join the People's Public Security and reviewing non-commissioned officers' service terms for transfer to professional service in the People's Public Security.

3. The Training Bureau shall coordinate with the Health Service Bureau to guide public security units and localities in implementing the work of health checks and rechecks for new admissions to public security schools.

5. Hospital 19-8, Hospital 30-4, Hospital 199

a) Organize health checks in accordance with point c, Clause 1, Article 10 of this Circular;

b) Support public security units' and localities' hospitals and clinics in conducting health checks for new admissions and selections (if required).

6. Public security units and localities

a) Organize health check activities for new admissions, selections of citizens to join the People's Public Security, and reviews of non-commissioned officers' service terms for transfer to professional service in the People's Public Security as prescribed in this Circular, and organize rechecks (for public security schools) for admitted citizens before they start their studies as prescribed;

b) Summarize and report the results of health checks for new admissions, selections of citizens to join the People's Public Security, and reviews of non-commissioned officers' service terms for transfer to professional service in the People's Public Security as prescribed.

1. Health Department

a) Directing medical services of local public security units to receive conscripts, thoroughly understand the health records of citizens called upon to fulfill their duty to join the People's Public Security Force, and guide the re-examination of new recruits' health according to regulations;

b) Directing and organizing inspections on the work of re-examining health for citizens fulfilling their duty to join the People's Public Security Force;

c) Compiling and reporting the results of health examinations for citizens fulfilling their duty to join the People's Public Security Force according to regulations.

2. Units receiving conscripts under the Ministry shall send representatives to participate in the Re-examination Health Board at the provincial level and reach a consensus with the provincial-level Public Security Force regarding the re-examination results for citizens selected by the provincial-level Public Security Force to fulfill their duty to join the People's Public Security Force for units receiving conscripts under the Ministry, in writing.

3. The Department of Planning and Finance shall be responsible for guiding local public security units in preparing budgets, managing, using, and settling accounts for health examination and re-examination expenses for selecting citizens to fulfill their duty to join the People's Public Security Force.

4. Provincial-level Public Security Force

a) Cooperating with military agencies and health agencies at the same level to direct, organize, and inspect the implementation of health examinations for citizens fulfilling their duty to join the People's Public Security Force according to the plan of the Provincial Military Service Council;

b) Preparing the budget and organizing re-examinations according to regulations;

c) Organizing agreements with each receiving unit regarding health standards, quantity, time, location, and method of transferring and receiving personnel;

d) Cooperating with the provincial health agency to consider and resolve issues and complaints related to health examinations for citizens fulfilling their duty to join the People's Public Security Force;

đ) Compiling and reporting the results of health examinations and re-examinations for citizens fulfilling their duty to join the People's Public Security Force according to regulations, using the report form 4 attached as Appendix IV of this Circular;

e) Directing the health agency of the provincial-level Public Security Force to advise on implementing re-examination tasks and reporting the results of re-examination work for citizens fulfilling their duty to join the People's Public Security Force to the Health Department according to the regulations of the Ministry of Public Security.

5. County-level Public Security Force

a) Cooperating with military agencies and health agencies at the same level to propose members to participate in the County-level Military Service Health Examination Board, drafting plans for health examinations for citizens eligible to fulfill their duty to join the People's Public Security Force;

b) Summoning citizens eligible to fulfill their duty to join the People's Public Security Force for health examinations or health checks according to the plan of the County-level Military Service Council;

c) Cooperating with relevant county-level agencies in organizing health examinations for citizens fulfilling their duty to join the People's Public Security Force according to the plan; monitoring the number and quality of health of citizens attending the examinations;

d) Managing health certificates for citizens fulfilling their duty to join the People's Public Security Force handed over by the County-level Military Service Health Examination Board;

đ) Taking the lead and cooperating with the county-level health agency to organize the handover of health records for citizens called upon to fulfill their duty to join the People's Public Security Force to receiving units according to the plan;

e) Cooperating with the health agency and other relevant county-level units to resolve complaints related to health examinations for citizens fulfilling their duty to join the People's Public Security Force;

g) Compiling and reporting to the provincial-level Public Security Force the results of health examinations, the situation of transferring and receiving new recruits after each selection and call-up of citizens to fulfill their duty to join the People's Public Security Force, using forms 2 and 3 attached as Appendix IV of this Circular;

h) Directing the health agency of the county-level Public Security Force to proactively advise on implementing health examination tasks.

6. Commune-level Public Security Force

a) Leading and cooperating with the commune-level health agency to organize preliminary health screenings; compiling lists of citizens fit for health to fulfill their duty to join the People's Public Security Force, through the Commune-level Military Service Council, and reporting to the county-level Public Security Force and the County-level Military Service Council;

b) Urging citizens eligible to fulfill their duty to join the People's Public Security Force to attend health examinations according to the plan of the County-level Military Service Council;

c) Announcing the results of health examinations according to the conclusions of the County-level Military Service Health Examination Board.

Article 26. Authority and Responsibilities of Local Public Security Units in分级管理健康和报告官兵健康状况制度

a) Units responsible for health management and care for officers and soldiers include: The High-Ranking Cadres Health Protection Board of the Ministry of Public Security; medical facilities within the Public Security force;

b) Health management, care, and regular health check-ups for leaders at the Bureau level and above: The High-Ranking Cadres Health Protection Board of the Ministry of Public Security shall cooperate with central hospitals under the Ministry of Health, Ministry of National Defense, and Ministry of Public Security to organize regular health check-ups and manage health;

c) Health management, care, and regular health check-ups for officers and soldiers of units directly under the Ministry (without infirmaries or general clinics): Hospitals 19-8, 30-4, and 199 shall organize regular health check-ups and manage health for officers and soldiers directly under the Ministry according to their assigned areas. The Traditional Medicine Hospital shall organize regular health check-ups and manage health for its own officers and soldiers;

d) Health management, care, and regular health check-ups for students who are officers and soldiers from local public security units sent to study at police colleges or non-police institutions: Such tasks shall be carried out by the managing unit;

đ) Health management, care, and regular health check-ups for other subjects as stipulated in Clause 3, Article 2 of this Circular: Medical facilities under the Public Security force shall organize regular health check-ups and manage health;

2. Reporting System After Regular Health Check-Ups: After regular health check-ups, the medical facility conducting the check-up shall compile the results and report them to higher-level health authorities and the head of the unit. The results of regular health check-ups shall be statistically compiled and stored at the medical facility under the Public Security force;

3. Reporting and Continuous Health Monitoring System for Officers and Soldiers

The Public Security Station at the commune level shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the unit, report to the leadership of the unit, and report to the policy department of the Public Security Station at the county level for consolidation;

The Public Security Station at the county level and departments/bureaus under the Public Security Station at the provincial level: Medical staff or policy staff (for units without medical staff) shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the unit, report to the leadership of the unit, and report to the Public Security Station at the provincial level (through the provincial Public Security hospital or infirmary) for consolidation;

Provincial Public Security hospitals and infirmaries shall compile the number of officers on sick leave and the number of sick days of officers and soldiers in the provincial Public Security station and report to the leadership of the provincial Public Security station;

The Public Security Station at the provincial level shall consolidate and send to the Health Bureau;

b) Reporting Responsibility of Military Commands

Medical staff at the regimental, battalion levels, and subordinate units of the Military Command shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the unit, report to the leadership of the unit, consolidate, and report to the Military Command (through the Military Command's Medical Department or infirmary) for consolidation;

The Medical Department or infirmary of the Military Command shall compile the number of officers on sick leave and the number of sick days of officers and soldiers in the Military Command and report to the leadership of the Military Command;

The Military Command shall consolidate and send to the Health Bureau;

c) Reporting Responsibility of Police Colleges: Infirmary of the Police College shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the college and report to the leadership of the college;

The Police College shall consolidate and send to the Health Bureau;

d) Reporting Responsibility of Units at the Bureau Level: Medical staff or policy staff of the unit (for units without medical staff) shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the unit, report to the leadership of the unit, consolidate, and send to Hospitals 19-8, 30-4, and 199 according to the assigned area for consolidation;

đ) Reporting Responsibility of Hospitals 19-8, 30-4, and 199: Functional Departments shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the hospital and the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in subordinate units of the Ministry according to the assigned area, report to the leadership of the hospital;

Hospitals 19-8, 30-4, and 199 shall consolidate and send to the Health Bureau;

e) Reporting Responsibility of the Traditional Medicine Hospital: Functional Departments shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the hospital and report to the leadership of the hospital;

The Traditional Medicine Hospital shall consolidate and send to the Health Bureau;

g) Reporting Responsibility of Prisons, Compulsory Education Facilities, and Rehabilitation Schools:

Infirmary of prisons, compulsory education facilities, and rehabilitation schools shall compile the number of officers and soldiers on sick leave and the number of sick days of officers and soldiers in the unit, report to the leadership of the unit, consolidate, and report to the Prison Administration Bureau, Compulsory Education Facilities, and Rehabilitation Schools (through the Medical Department);

The Prison Administration Bureau, Compulsory Education Facilities, and Rehabilitation Schools shall consolidate and send to the Health Bureau;

h) Reporting Periods

Regular reports include semi-annual and annual reports. Local public security units shall submit reports to the Health Bureau for consolidation and report to the Ministry leadership as prescribed;

Ad hoc Reports: For cases where officers and soldiers suffer serious accidents, injuries, or death, immediate reports shall be made to the Health Bureau for consolidation and report to the Ministry leadership as prescribed;

i) Reporting Time

For regular reports: Data for the semi-annual report shall be counted from December 15 of the previous year to June 14 of the reporting year; data for the annual report shall be counted from December 15 of the previous year to December 14 of the reporting year. The deadline for submitting reports is before the 20th day of the last month of the reporting period;

For ad hoc reports within 24 hours from the time of occurrence;

k) Provincial hospitals (once a week) and hospitals, infirmaries of local public security units (once a month) have the responsibility to report to the Health Bureau the list of Bureau-level cadres and above who are admitted for emergency treatment or hospitalized (if any).

Article 27. Funding for conducting preliminary health examinations for new admissions, re-examinations for new admissions, health examinations for selecting citizens to join the People's Police, and health examinations for transferring to professional service status for conscripted non-commissioned officers who have completed their service term in the People's Police.

1. Budget Standards

a) Citizens applying for preliminary health examinations for new admissions and selection to join the People's Police shall be responsible for paying according to the health examination fee framework prescribed by the Ministry of Health and the healthcare facility conducting the examination;

b) The budget standard for health examinations to transfer to professional service status for conscripted non-commissioned officers who have completed their service term in the People's Police, and re-examinations for new admissions shall be implemented according to item b point 3 Table 2 Appendix IV accompanying Government Decree No. 01/2021/NĐ-CP dated October 21, 2021 on standards and material support quotas in the People's Police;

c) The consumption quota and funding for health examinations shall be regulated as stipulated in Appendix V issued together with this Circular.

2. The preparation of budgets, management, utilization, and settlement of accounts for funding for health examinations for new admissions and selection of citizens to join the People's Police, and for transferring to professional service status for conscripted non-commissioned officers who have completed their service term in the People's Police shall be carried out in accordance with the State Budget Law and detailed regulations and implementation guidelines; it will be allocated within the annual budget of local police units.

Article 28. Funding for conducting health examinations for citizens performing compulsory service in the People's Police

1. Funding for conducting health examinations for selecting citizens performing compulsory service in the People's Police shall be implemented according to the Ministry of National Defense's regulations on health examinations for compulsory military service.

2. Funding for re-examinations shall be allocated within the annual budget of local police units. The budget standard for re-examination activities shall be applied according to item b point 3 Table 2 Appendix IV accompanying Government Decree No. 01/2021/NĐ-CP dated October 21, 2021 on standards and material support quotas in the People's Police.

3. The consumption quota and funding for re-examinations for citizens performing compulsory service in the People's Police shall be regulated as stipulated in Appendix V issued together with this Circular.

4. The preparation of budgets, management, utilization, and settlement of accounts for funding for re-examinations for citizens performing compulsory service in the People's Police shall be carried out in accordance with the State Budget Law and detailed regulations and implementation guidelines.

Article 29. Regular health examination funding and health management and care

1. Funding for health management and care work shall be provided from the state budget and allocated within the annual budget of the Ministry of Public Security.

2. The preparation of budgets, management, utilization, and settlement of accounts for funding for health management and care for public security officers and soldiers shall be carried out in accordance with the State Budget Law and detailed regulations and implementation guidelines.

a) The budget standard for regular health examinations (including funds for specialized examinations, imaging diagnostics, and other necessary tests as prescribed by specialists) shall be implemented according to item a point 3 Table 2 Appendix IV accompanying Government Decree No. 01/2021/NĐ-CP dated October 21, 2021 on standards and material support quotas in the People's Police;

b) Funding for regular health examinations for contractual employees receiving salaries from the state budget shall be implemented according to the consumption quota and funding specified in Appendix V issued together with this Circular (ensuring that it does not exceed the regular health examination budget for officers with ranks from Lieutenant Colonel downwards, non-commissioned officers, soldiers, and public security workers as stipulated in item a point 3 Table 2 Appendix IV accompanying Government Decree No. 01/2021/NĐ-CP dated October 21, 2021 on standards and material support quotas in the People's Police);

c) Funding for transporting equipment, means of transportation, and other expenses serving regular health examination teams shall be implemented according to current regulations guaranteed by the Ministry of Public Security's budget;

d) The consumption quota and funding for health examinations shall be regulated as stipulated in Appendix V issued together with this Circular.

Article 30. Appendices

The following Appendices are promulgated along with this Circular:

1. Appendix I. Classification based on physical health, diseases, and health issues.

2. Appendix II. Guidelines for conducting health examinations.

3. Appendix III. Sample Health Examination Forms, Re-examination Forms, and Reports for health examinations and re-examinations for new recruitments, selections of citizens to join the People's Police, and transfers to professional service systems for conscripted non-commissioned officers who have completed their term of service in the People's Police.

4. Appendix IV. Sample Health Examination Forms, Re-examination Forms, and Reports for health examinations and re-examinations for citizens performing their duty to join the People's Police.

5. Appendix V. Consumption quotas and funding for health examinations and re-examinations for new recruitments, selections of citizens to join the People's Police, transfers to professional service systems for conscripted non-commissioned officers who have completed their term of service in the People's Police, re-examinations for citizens performing their duty to join the People's Police, and regular health examinations within the People's Police.

Article 31. Effectiveness and Transitional Provisions

1. This Circular takes effect from January 1, 2024.

2. This Circular replaces Decision No. 693/1999/QĐ-BCA(H11) dated November 5, 1999, issued by the Minister of Public Security on the issuance of health standards for recruitment and selection of personnel to join the People's Police; Circular No. 45/2019/TT-BCA dated October 2, 2019, issued by the Minister of Public Security on health standards and health examinations for the selection of citizens to perform their duty to join the People's Police; and Circular No. 55/2010/TT-BCA dated December 13, 2010, issued by the Minister of Public Security on management and care of the health of officers and soldiers in the People's Police.

3. This Circular abolishes the health standards set out in point g, Clause 2, Article 6, point d, Clause 2, Article 7, Clause 2, Article 11, point d, Clause 2, and point b, Clause 3, Article 14 of Circular No. 50/2021/TT-BCA dated May 11, 2021, issued by the Minister of Public Security on recruitment in the People's Police; Clause 5, Article 5 of Circular No. 21/2023/TT-BCA dated June 22, 2023, issued by the Minister of Public Security on the selection of citizens to join the People's Police.

4. The health standards for re-examinations of citizens selected to perform their duty to join the People's Police in 2024 shall apply the health standards at the time of the initial health examination for the selection of citizens to perform their duty to join the People's Police.

5. In cases where it is necessary to meet work, combat, and force-building requirements of the People's Police, the Personnel Organization Department shall take the lead, in coordination with the Health Department, to report cases that do not meet the health standards for selection into the People's Police and transfers to professional service systems for conscripted non-commissioned officers who have completed their term of service in the People's Police as stipulated in this Circular. The Training Department shall take the lead, in coordination with the Health Department, to report cases that do not meet the health standards for recruitment as stipulated in this Circular to the Minister of Public Security for consideration and decision before the heads of public security units and localities issue decisions on recruitment and selection of citizens to join the People's Police and decisions on transferring to professional service systems for conscripted non-commissioned officers who have completed their term of service according to their authority.

6. In cases where referenced documents in this Circular are amended, supplemented, replaced, or newly issued, the contents referenced in this Circular shall also be implemented according to the amended, supplemented, replaced, or newly issued documents.

Article 32. Responsibility for Implementation

1. Heads of units under the Ministry, Provincial Public Security Directors, and related organizations and individuals are responsible for implementing this Circular.

2. The Health Department is responsible for guiding, urging, and inspecting the implementation of this Circular.

3. During the implementation of this Circular, if there are difficulties or obstacles, public security units and localities shall report to the Ministry (through the Health Department) for timely guidance./.
