The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

This Circular provides detailed implementation of Clause 4 Article 24, Clause 3 Article 26, Clause 3 Article 27, Clause 3 Article 28, Clause 2 Article 71, Clause 6 Article 74, Clause 2 Article 75, and Clause 6 Article 84 of the Law on Encouragement and Reward 2022 and Clause 2 Article 6 of Decision No. June 14, 2025, of the Government regarding decentralization and delegation of authority in the field of encouragement and reward; detailed implementation and guidance for certain provisions of the Law on Encouragement and Reward dated June 14, 2025, of the Government regarding decentralization and delegation of authority in the field of encouragement and reward; detailed implementation and guidance for certain provisions of the Law on Encouragement and Reward.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular applies to collectives and individuals in agencies, organizations, units under and affiliated with the Ministry of Agriculture and Rural Development; collectives and individuals in agencies, organizations, units within the sector of Agriculture and Rural Development (hereinafter referred to collectively as agencies and units); collectives and individuals outside the sector with outstanding achievements contributing to the construction and development of the sector of Agriculture and Rural Development. June 14, 2025, of the Government regarding decentralization and delegation of authority in the field of encouragement and reward; detailed implementation and guidance for certain provisions of the Law on Encouragement and Reward 1. Agencies and units directly under the Ministry of Agriculture and Rural Development are agencies and units directly managed by the Ministry of Agriculture and Rural Development, including state administrative bodies, public service establishments, enterprises where the Ministry of Agriculture and Rural Development (hereinafter referred to as the Ministry) acts as the representative owner, and other organizations.

Article 2. Applicability

2. Agencies and units under the Ministry are agencies and units within the organizational structure of agencies and units directly under the Ministry.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

3. Agencies and units in the sector are agencies and units operating in the fields of Agriculture and Rural Development.

4. Collectives eligible for consideration for awarding commendation titles are agencies and units established according to the laws by competent authorities.

Article 4. Responsibilities of agencies, units, and individuals in the work of encouragement and reward

1. Heads of agencies and units under the Ministry directly direct and are responsible for encouragement and reward work within their management authority; identify collectives and individuals with outstanding achievements to reward according to their authority or propose competent authorities to reward; promote exemplary models; evaluate the achievements of collectives and individuals and be responsible for proposing rewards.

2. Responsibilities of information and communication agencies of the Ministry

a) Propagate the Party's policies and guidelines; the State's and the Ministry of Agriculture and Rural Development's policies and laws on encouragement and reward;

b) Regularly publish slogans and contents of encouragement; publicize and set examples for collectives and individuals with outstanding achievements, exemplary models, good people and good deeds in encouragement movements; propagate and reflect the results achieved in encouragement movements and reward work; promptly reflect violations of laws on encouragement and reward.

3. Responsibilities of related agencies, units, and individuals

a) Strictly comply with the Party's policies and guidelines; all regulations of the law in the work of encouragement and reward;

b) Apply information technology in reporting achievements and managing encouragement and reward work;

c) Be responsible under the law for reporting achievements and preparing reward proposal files; have the responsibility to preserve and store reward items according to regulations.

Chapter II

AWARDS AND HONORS,

FORMS OF REWARD

Article 5. Title "Advanced Laborer"

1. The criteria for the title "Advanced Laborer" to be awarded to cadres, civil servants, public officials, and workers in agencies and units under and directly subordinate to the Ministry shall be implemented according to the provisions of Clause 1, Article 24 of the Law on Competition and Rewards and the following standards:

a) Adhering well to the Party's guidelines and policies; State policies and laws;

b) Having a spirit of self-study and improving professional qualifications.

c) Practicing thrift, combating waste; not causing harassment; preventing and combating corruption and negative practices.

2. Certain specific cases shall be implemented according to the provisions of Clause 5, Article 2 of Circular No. 15/2025/TT-BNV dated August 4, 2025, issued by the Minister of Home Affairs, detailing measures to organize and guide the implementation of the Law on Competition and Rewards and Decree No. 152/2025/NĐ-CP dated June 14, 2025, of the Government on classification and authority delegation in the field of competition and rewards; detailing and guiding the implementation of certain articles of the Law on Competition and Rewards.

Article 6. Flag of Excellence of the Ministry of Agriculture and Environment

1. The criteria for the Flag of Excellence of the Ministry to be awarded to outstanding collectives leading the competition movement in groups and clusters organized by the Ministry shall be stipulated in Clause 1, Article 26 of the Law on Competition and Rewards.

2. The criteria for the Flag of Excellence of the Ministry to be awarded to outstanding collectives leading the competition movement in groups and clusters organized by the Ministry shall be stipulated in Clause 2, Article 26 of the Law on Competition and Rewards.

3. The recipients of the Flag of Excellence of the Ministry are collectives leading the competition movement in groups and clusters established and organized by the Ministry, specifically:

a) Agencies and units under and directly subordinate to the Ministry;

b) Departments of Agriculture and Environment of provinces and centrally-administered cities.

Article 7. Title "Outstanding Labor Collective"

1. The criteria for the title "Outstanding Labor Collective" shall be implemented according to the provisions of Clause 1, Article 27 of the Law on Competition and Rewards and the following standards:

a) Actively practicing thrift, combating waste; preventing and combating corruption and negative practices.

b) Not having individuals disciplined with warnings or higher penalties.

2. The recipients of the title "Outstanding Labor Collective" are collectives of agencies and units under and directly subordinate to the Ministry.

Article 8. Title "Advanced Labor Collective"

1. The criteria for the title "Advanced Labor Collective" shall be implemented according to the provisions of Clause 1, Article 28 of the Law on Competition and Rewards and the following standards:

a) Party organizations and mass organizations being evaluated as completing tasks satisfactorily or better;

b) Actively practicing thrift, combating waste; preventing and combating corruption and negative practices.

2. The recipients of the title "Advanced Labor Collective" are collectives of agencies and units under and directly subordinate to the Ministry.

Article 9. Certificate of Merit of the Minister of Agriculture and Environment

1. The Certificate of Merit of the Minister of Agriculture and Environment is awarded to individuals who serve as models in adhering to the Party's guidelines and policies; State policies and laws, meeting one of the criteria specified in Clause 1 and Clause 2, Article 74 of the Law on Competition and Rewards and the following standards:

a) Having a spirit of self-study and improving professional qualifications.

b) Practicing thrift, combating waste; preventing and combating corruption and negative practices; not causing harassment.

2. The Certificate of Merit of the Minister of Agriculture and Environment is awarded to collectives meeting one of the criteria specified in Clause 3 and Clause 4, Article 74 of the Law on Competition and Rewards and the following standards:

a) Party organizations and mass organizations being evaluated as completing tasks satisfactorily or better;

b) Not having individuals disciplined with warnings or higher penalties.

3. The Certificate of Merit of the Minister of Agriculture and Environment is awarded to exemplary households that adhere well to the Party's guidelines and policies; State policies and laws; making significant contributions in terms of labor, land, and assets to the construction and development of the Agriculture and Environment sector.

Article 10. Commendation Certificate of the Head of the Agency or Unit

1. The Heads of agencies and units with legal personality under and subordinate to the Ministry shall decide to award Commendation Certificates to individuals with good moral qualities; exemplary in implementing the Party's guidelines and policies; State's policies and laws within their management authority and meeting one of the following criteria:

a) Completing tasks well or better;

b) Achieving outstanding results recognized in competitive campaigns.

c) Achieving outstanding and remarkable achievements contributing to building and developing the agency or unit.

2. The Heads of agencies and units with legal personality under and subordinate to the Ministry shall decide to award Commendation Certificates to exemplary collectives that implement the Party's guidelines and policies; State's policies and laws; maintaining internal unity, effectively practicing grassroots democracy; practicing thrift and combating waste; having no individual disciplined with a warning or higher, within their management authority and meeting one of the following criteria:

a) Completing tasks well or better;

b) Achieving outstanding results recognized in competitive campaigns.

c) Achieving outstanding and remarkable achievements contributing to building and developing the agency or unit.

3. The Heads of agencies and units with legal personality under and subordinate to the Ministry shall decide to award Commendation Certificates to exemplary individuals or households that implement the Party's guidelines and policies; State's policies and laws, making significant contributions in terms of labor, land, and property to build and develop the agency or unit.

Article 11. Commemorative Medal "For the Agricultural and Environmental Cause"

The Commemorative Medal "For the Agricultural and Environmental Cause" (hereinafter referred to as the Commemorative Medal) is a form of recognition by the Minister of Agriculture and Rural Development for individuals who have contributed to or made meritorious contributions to the development of the Agricultural and Environmental sector; the Commemorative Medal is awarded only once and not posthumously, specifically as follows:

1. Recipients of the Commemorative Medal

a) Individuals currently working at agencies and units in the Agricultural and Environmental sector.

b) Vietnamese individuals working outside the Agricultural and Environmental sector who have made meritorious contributions to the development of the Agricultural and Environmental sector.

c) Foreign individuals or overseas Vietnamese who have made meritorious contributions to the development of the Agricultural and Environmental sector.

2. Criteria for Awarding the Commemorative Medal

a) For individuals specified in point a, Clause 1 of this Article, having worked in the Agricultural and Environmental sector for at least 20 years for males and at least 15 years for females; specific cases are calculated as follows:

Individuals who have continuously worked for at least 3 years in mountainous areas, remote regions, border areas, islands, and regions with particularly difficult socio-economic conditions will be considered to have worked for at least 15 years for males and at least 10 years for females;

Individuals who transferred from other sectors to work in the Agricultural and Environmental sector, having continuously worked for at least 25 years for males and at least 20 years for females, including at least 10 years for males and at least 7 years for females working in the Agricultural and Environmental sector;

Individuals holding leadership positions at the department level and equivalent in agencies and units under and subordinate to the Ministry; Directors and Deputy Directors of Provincial Departments of Agriculture and Rural Development having held leadership positions for at least 5 years for heads and at least 7 years for deputies;

Individuals currently working in the Agricultural and Environmental sector who are called up for military service will have their military service time counted as continuous work time in the sector;

Leaders of the Ministry of Agriculture and Rural Development; individuals honored with the title of Labor Hero; Professors, Associate Professors; People's Teachers, Outstanding Teachers; National Model Workers are not required to meet the work duration criteria for the Commemorative Medal.

b) For individuals specified in point b, Clause 1 of this Article, meeting one of the following criteria:

Individuals with outstanding achievements in leading and directing, contributing to the development of the Agricultural and Environmental sector;

Individuals with innovative ideas, solutions, scientific works recognized by competent state authorities, with practical value, substantial and effective contributions to the development of the Agricultural and Environmental sector;

Individuals providing support and contributions in terms of labor, land, and property to the development of the Agricultural and Environmental sector.

c) For individuals specified in point c, Clause 1 of this Article, achieving outstanding achievements in establishing and consolidating international cooperation, making meritorious contributions to the development of the Agricultural and Environmental sector.

3. Individuals Not Eligible for the Commemorative Medal

a) Individuals under disciplinary review or involved in cases without conclusions from competent state authorities;

b) Individuals undergoing one of the disciplinary measures; under investigation, audit, inspection due to suspected violations or complaints and denunciations involving corruption or malpractice being verified.

Disciplinary periods are not counted towards the work duration for the Commemorative Medal.

4. Individuals Not Eligible for Consideration for the Commemorative Medal

a) Individuals who voluntarily quit their jobs;

b) Individuals disciplined with dismissal or criminal prosecution;

c) Individuals who have already been awarded a Commemorative Medal of the Agricultural and Rural Development sector or the Natural Resources and Environment sector.

Chapter III

ORGANIZATION AND ACTIVITIES

OF THE COMPETITION AND REWARD COUNCIL

AT ALL LEVELS AND THE INNOVATION COUNCIL

Article 12. The Competition and Reward Council of the Ministry of Agriculture and Rural Development

1. The Competition and Reward Council of the Ministry of Agriculture and Rural Development shall be established by the Minister's decision; the Chairman of the Council shall issue the operational regulations of the Council and shall be responsible for advising the Minister on competition and reward work.

2. Composition of the Board includes:

a) Chairman of the Council: The Minister of Agriculture and Rural Development;

b) Vice Chairmen of the Council include: The Deputy Minister in charge of competition and reward work shall be the First Vice Chairman; the Director of the Organization and Cadre Affairs Department shall be the Permanent Vice Chairman;

c) Members of the Council shall be determined by the Minister.

d) Secretary - Member of the Council: The Deputy Director of the Organization and Cadre Affairs Department in charge of competition and reward work.

3. Tasks and powers of the Council:

a) Advising the Minister to launch competitions within the Minister’s authority;

b) Periodically evaluating the results of competitions and reward work; advising on the mid-term and final reviews of competition and reward work; proposing policies and measures to promote patriotic competitions each year and during each phase; organizing competitions in accordance with the laws on competition and reward;

c) Advising the Minister to inspect competitions and implement policies and laws on competition and reward;

d) Advising the Minister to decide on awarding commendations and rewards within their authority or to submit to competent authorities for rewards according to regulations.

4. The Organization and Cadre Affairs Department shall be the permanent body of the Competition and Reward Council of the Ministry.

Article 13. The Initiative Council of the Ministry of Agriculture and Rural Development

1. The Initiative Council of the Ministry of Agriculture and Rural Development shall be established by the Minister's decision and operate according to the operational regulations issued by the Council's Chairman; the Council shall be responsible for advising the Minister on examining and recognizing the effectiveness of application, scope of influence, and potential for replication of initiatives, scientific topics, scientific projects, and science and technology works (hereinafter referred to collectively as initiatives and scientific topics) as a basis for considering commendation titles and reward forms.

2. Composition of the Board includes:

a) Chairman of the Council: The Deputy Minister in charge of competition and reward work;

b) Vice Chairmen of the Council include: The Directors of the Organization and Cadre Affairs Department and the Science and Technology Department;

c) Members of the Council shall be determined by the Minister;

d) Secretary - Member of the Council: The Deputy Director of the Organization and Cadre Affairs Department in charge of competition and reward work.

3. The Council shall organize the examination and propose to the Minister to decide on recognizing the effectiveness of application, scope of influence, and potential for replication at the ministry level and nationwide of initiatives and scientific topics.

Article 14. The Competition and Reward Councils of agencies and units under the Ministry of Agriculture and Rural Development

1. The Competition and Reward Councils of agencies and units under the Ministry shall be established by the heads of the agencies and units, who shall also determine the organizational structure and operation of the Councils; the Councils shall be responsible for advising the heads of the agencies and units on implementing competition and reward work within their management authority.

2. Composition of the Board includes:

a) Chairman of the Council: The head of the agency or unit;

b) Vice Chairman of the Council: A deputy head of the agency or unit in charge of competition and reward work in the unit or in charge of mass organizations;

c) Members of the Council shall be determined by the head;

d) Secretary - Member of the Council: The head of the unit advising on competition and reward work of the agency or unit or the focal point staff member on competition and reward work (for the Department sector).

Article 15. Initiative Councils of agencies and units under the Ministry of Agriculture and Rural Development

1. The Initiative Council of an agency or unit under the Ministry shall be established by the head of the agency or unit, responsible for advising the head of the agency or unit on the work of examining initiatives, recognizing the effectiveness of application, scope of impact, and potential for replication at the grassroots level of initiatives or scientific topics, or submitting to the competent authority for examination and recognition of the effectiveness of application, scope of impact, and potential for replication at the ministerial or national levels of initiatives or scientific topics.

2. Composition of the Board includes:

a) Chairman of the Council: The head of the agency or unit;

b) The Vice-Chairman of the Council is the deputy head responsible for the specialized field of the agency or unit;

c) Members of the Council shall be designated by the head of the agency or unit, including members with expertise in fields related to the content of initiatives or scientific topics, and other members;

d) Secretary - Member of the Council: The head of the unit advising on competition and reward work of the agency or unit or the focal point staff member on competition and reward work (for the Department sector).

Chapter IV

RECORDS AND PROCEDURES FOR CONSIDERING AWARDS OF COMPETITION TITLES AND RECOGNITION OF ACHIEVEMENT LEVELS; FORMS OF REWARD

AND RECOGNITION OF LEVELS OF TASK COMPLETION;

INDIVIDUAL AND GROUP TASK COMPLETION LEVELS

Article 16. Records and procedures for proposing consideration for awards of competition titles and forms of reward within the jurisdiction of the Ministry of Agriculture and Rural Development

1. The components of the record for proposing consideration for awards of competition titles and forms of reward shall be implemented according to the provisions of Clause 1 and Clause 2 of Article 84 of the Law on Competition Titles and Rewards, specifically as follows:

a) A proposal for considering awards of competition titles and forms of reward (in accordance with Model No. 01, 02, 02a in the Appendix attached to this Circular);

b) Minutes of the assessment of competition titles and rewards (in accordance with Model No. 03 in the Appendix attached to this Circular);

c) Reports on achievements of individuals and groups proposed for competition titles and forms of reward (in accordance with Models No. 04 to No. 12 in the Appendix issued together with this Circular);

d) Decisions recognizing, certifying, or documents confirming by authorized agencies or organizations regarding initiatives, scientific topics, scientific projects, and science and technology works in cases where the competition title or form of reward is proposed based on criteria involving initiatives or scientific topics (Certification or confirmation document in accordance with Model No. 13 in the Appendix attached to Decree No. 152/2025/NĐ-CP dated June 14, 2025 of the Government on detailed regulations and guidance on implementation of certain provisions of the Law on Competition Titles and Rewards);

đ) Other relevant documents (if any).

2. Number of records: 01 original set.

3. Regarding responsibility for compiling and submitting records:

a) Agencies and units directly under the Ministry have the responsibility to compile and submit records for rewarding groups and individuals within their management scope to the Ministry;

b) Ministries, sectors, provincial People's Committees, Departments of Agriculture and Rural Development of provinces and centrally-administered cities shall guide outstanding groups, individuals, and households in implementing competition movements initiated by the Ministry or contributing to the construction and development of the agriculture and rural development sector within their management scope, to compile and submit records for rewarding to the Ministry;

c) The Department of International Cooperation has the responsibility to advise on forms of reward for international organizations and foreign individuals, and to guide the completion of reward records in accordance with regulations.

4. Methods of receiving records:

a) Paper records: Directly sent or mailed to the Ministry of Agriculture and Rural Development;

b) Electronic records: Sent through the electronic document system of the Ministry;

c) The receipt time is calculated from when complete and valid records are received.

5. Receiving and reviewing records

a) The Department of Organization and Cadres has the responsibility to receive records, review them, and advise the Ministry to decide on rewards or submit to the competent authority for rewards;

b) The Department of International Cooperation has the responsibility to receive records for rewarding international organizations and foreign individuals, coordinate with the Department of Organization and Cadres to review and submit to the Ministry in accordance with regulations.

Article 17. Documents and procedures for proposing to award commendation titles and forms of reward within the authority of agencies and units under the Ministry

1. The components of the record for proposing consideration for awards of competition titles and forms of reward shall be implemented according to the provisions of Clause 1 and Clause 2 of Article 84 of the Law on Competition Titles and Rewards, specifically as follows:

a) A proposal for considering the award of commendation titles and forms of reward;

b) Minutes of the assessment meeting for commendation and rewards;

c) Reports on achievements of individuals and groups proposed for commendation titles and forms of reward;

d) Other related documents (if any).

2. Number of documents: One original copy (electronic version if available).

3. Place to submit documents: Reward documents shall be sent to the agency or unit directly responsible for awarding commendation titles and forms of reward.

Article 18. Documents for proposing recognition of the effectiveness of application, scope of influence, and potential for replication at the ministerial level and nationwide of initiatives and scientific topics

1. Components of the documents, including:

a) A proposal (accompanied by a summary according to Model No. 15 and 17 in the Appendix issued together with this Circular); b) Minutes of the meeting of the Initiative Council;

c) Report describing the initiative (according to Model No. 16 in the Appendix issued together with this Circular);

d) Decision recognizing the initiative or topic; đ) Other related documents (if any).

2. Number of documents: One set of paper copies (one electronic copy sent through the Ministry's electronic document system).

Article 19. Regulations on the time for receiving documents, reviewing, and announcing the results of review and rewards within the authority of the Ministry

1. Time for receiving documents for proposing rewards and documents for proposing recognition of the effectiveness of application, scope of influence, and potential for replication of initiatives and scientific topics, specifically:

a) Documents for proposing rewards sent to the Ministry: Before February 28th each year and before August 15th each year for the final school year block;

b) Documents for proposing recognition of the effectiveness of application, scope of influence, and potential for replication of initiatives and scientific topics: First round before February 28th each year; second round before August 15th each year;

c) Special, thematic, and meritorious rewards not specified in terms of time.

2. Time for reviewing documents

Within 25 working days from the date of receipt of complete documents as prescribed, the Cadre and Civil Servant Organization Department will review the documents, conditions, criteria, and implement the procedure for soliciting opinions from relevant agencies and units or submit to the Ministry’s Commendation and Award Council or Initiative Council for consideration according to regulations.

3. Time for announcing the results of review and rewards

a) In cases where the conditions and criteria for rewards are not met, within 10 working days from the date of the review result, the Cadre and Civil Servant Organization Department will notify in writing to the agency or unit proposing the reward or publish on the Ministry’s online portal.

b) In cases where the conditions and criteria for rewards are met, the Cadre and Civil Servant Organization Department will submit to the competent authority for consideration and decision on rewards according to regulations; within 10 working days from the date the Reward Decision is issued, the Cadre and Civil Servant Organization Department will notify in writing to the agency or unit proposing the reward and advise on organizing the presentation according to regulations.

Article 20. Regulations on recognizing the degree of completion of tasks by individuals and groups

1. The recognition of the degree of completion of tasks by individuals is implemented according to the provisions of the Civil Servants Law; the Public Servants Law, and other relevant regulations.

2. The recognition of the degree of completion of tasks by groups is carried out according to the Party's regulations on self-criticism and annual quality evaluation and classification of groups in the political system and the regulations of the Ministry.

1. The recognition of levels of task completion for individuals shall be carried out in accordance with the provisions of the Civil Servants Law; the Public Servants Law, and other relevant regulations.

2. The recognition of levels of task completion for groups shall be implemented in accordance with the Party's regulations on self-criticism and annual quality assessment and classification of groups within the political system, and the regulations of the Ministry.

Chapter V

PROCEDURES FOR ISSUING, REISSUING, REVOKING DECISIONS ON AWARDS, WITHDRAWING AWARDS AND PRIZE MONEY

WITHIN THE AUTHORITY OF THE MINISTRY

Article 21. Management and Distribution of Commendation Awards

1. The Cadre and Civil Servant Organization Department shall cooperate with the Ministry's Office to be responsible for purchasing, preserving, and distributing material awards within the authority of the Minister’s decision; receiving, managing, and distributing state-level material awards; guiding and inspecting the distribution of ministry-level and state-level material awards by agencies and units.

2. Heads of agencies and units under or directly subordinate to the Ministry who have the authority to decide on commendations shall be responsible for organizing the purchase, preservation, presentation, and distribution of material awards in accordance with regulations.

3. Individuals and collectives awarded commendation titles or forms of commendation shall be responsible for preserving and retaining material awards for long-term display and use in accordance with their purpose and significance.

Article 22. Replacement of Commendation Awards

1. Application Documents: A letter requesting replacement from a collective or an individual application form when material awards are damaged and no longer usable due to reasons such as natural disasters, floods, fires, or printing errors accompanying the award.

2. Replacement Procedure: Collectives submit a request letter for replacement from their agency or unit along with a list (according to Model No. 13, 13b in the Appendix attached to this Circular); individuals or households submit an application form sent to the directly managing agency (according to Model No. 14 in the Appendix attached to this Circular) and forwarded to the Ministry.

3. Based on the request for replacement of material awards from agencies and units, the Cadre and Civil Servant Organization Department will compile and submit to the competent authority for approval and implementation of the replacement of material awards, while collecting the old and damaged awards.

The replacement of material awards shall be purchased and printed by the competent authority for commendation according to the prescribed model.

4. Processing Time

Within 15 days from the date the competent authority for commendation receives the request letter or application form for replacement of material awards.

Article 23. Reissue of Commendation Awards

1. Application Documents: A letter requesting reissuance of material awards from a collective or an individual application form when material awards are lost or missing due to reasons such as natural disasters, floods, or other cases.

2. Reissuance Procedure: For collectives, submit a request letter (according to Model No. 13, 13a in the Appendix attached to this Circular); for individuals or households, submit an application form (according to Model No. 14 in the Appendix attached to this Circular) sent to the directly presenting agency, organization, or unit and forwarded to the Ministry.

3. Based on the request from agencies and units, the Cadre and Civil Servant Organization Department will review the files, confirm the commendation, and issue the reissued material awards as stipulated.

4. Processing Time

Within 15 working days from the date the competent authority for commendation receives the request letter or application form for reissuance of material awards.

Article 24. Documentation and Procedures for Revoking Decisions to Award Commendation Titles and Forms of Commendation within the Authority of the Ministry of Agriculture and Rural Development

1. Collectives, individuals, or households committing acts as specified in Clause 2 of Article 93 of the Law on Encouragement and Reward shall have their decisions to award commendation titles and forms of commendation revoked and shall have their received awards and monetary rewards confiscated.

2. Based on the conclusion of the competent authority determining that collectives or individuals have committed violations as specified in Clause 2 of Article 93 of the Law on Encouragement and Reward, the presenting agency shall be responsible for proposing to the competent authority for commendation to issue a decision revoking the decision to award commendation titles and forms of commendation and confiscating the awards and monetary rewards.

3. Application Documents: One set (original), including:

a) A report from the agency or unit requesting the recovery of each commendation title or form of commendation for individuals, collectives, or households;

b) A summary report from the directly presenting agency regarding the reasons for revoking the decision to award commendation titles and forms of commendation (accompanied by the Reward Decision).

4. The Cadre and Civil Servant Organization Department will compile the documents and submit them to the Minister for revocation of the commendation decision within 10 working days from the date of receipt of all required documents.

Article 25. Documents and procedures for revoking decisions to confer commendation titles and award forms within the authority of agencies and units under the Ministry of Agriculture and Rural Development

1. Based on the conclusion of the competent authority determining that individuals or collectives have committed violations as stipulated in Clause 2, Article 93 of the Law on Commendation and Awards, the agency proposing the award shall be responsible for requesting the competent authority to issue a decision to revoke the decision to confer commendation titles and award forms and recover the awarded items and monetary awards.

2. The application for revoking the decision to confer commendation titles and award forms consists of one set (original copy), including:

a) A proposal from the agency or unit requesting the recovery of each commendation title and award form for individuals or collectives;

b) A summary report from the agency or unit directly proposing the award regarding the reasons for revoking the decision to confer commendation titles and award forms (attached with the Award Decision).

3. The unit or person advising on commendation and award work shall compile the application and submit it to the head of the agency or unit to revoke the award decision within ten working days from the date of receiving all required documents.

Article 26. Recovery of Awarded Items and Monetary Awards within the Authority of the Ministry of Agriculture and Rural Development

1. Within fifteen working days from the date of receipt of the decision to revoke the award decision issued by the Minister of Agriculture and Rural Development or the head of the agency, organization, or unit under and affiliated with the Ministry, individuals, collectives, and households must return all awarded items and monetary awards received to the competent authority issuing the decision.

2. The agency issuing the decision to confer commendation titles and award forms shall be responsible for urging individuals, collectives, and households to return the awarded items and monetary awards received within the specified time frame and organizing their recovery according to regulations.

Chapter VI

IMPLEMENTING PROVISIONS

IMPLEMENTATION AND ENFORCEMENT

Article 27. Effective Date

1. This Circular takes effect from October 31, 2025.

2. The Circular No. 10/2023/TT-BNNPTNT dated November 15, 2023, issued by the Minister of Agriculture and Rural Development detailing certain provisions of the Law on Commendation and Awards in the agricultural sector and Circular No. 18/2023/TT-BTNMT dated November 15, 2023, issued by the Minister of Natural Resources and Environment detailing certain provisions of the Law on Commendation and Awards in the natural resources and environment sector are hereby repealed.

3. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 28. Transitional Provisions

For commendation files submitted to the Ministry before the effective date of this Circular (as evidenced by the document receipt stamp), the provisions of the documents stipulated in Clause 2, Article 27 of this Circular shall continue to apply.

Article 29. Implementation Organization

1. The Director of the Cadre and Civil Servant Organization Department, heads of agencies and units under and affiliated with the Ministry; Directors of Provincial Departments of Agriculture and Rural Development under central cities and provinces; relevant agencies, units, and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are any difficulties, agencies, units, and individuals are requested to promptly reflect them to the Ministry (through the Cadre and Civil Servant Organization Department) for consolidation and study to amend and supplement appropriately./.
