Guidelines for competition and reward work in the Agriculture and Rural Development sector

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government;
Pursuant to the Law on Competition and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005;
Pursuant to Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain articles of the Competition and Reward Law and the Law amending and supplementing certain articles of the Competition and Reward Law;

The Ministry of Agriculture and Rural Development guides the competition and reward work in the Agriculture and Rural Development sector as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides the implementation of competition and reward work in the Agriculture and Rural Development sector.
Article 2. Applicability
This Circular applies to collectives, individuals, agencies, units under the Ministry, the Vietnam Rubber Industry Group, the General Corporation 91, Departments of Agriculture and Rural Development, Associations, and Trade Unions operating in fields within the Agriculture and Rural Development sector, and agencies, organizations, and individuals inside and outside the country participating in competition movements and contributing to the development of agriculture and rural areas in Vietnam.
Article 3. Principles of Competition
1. Competition shall be carried out on the principle of voluntariness, self-awareness, transparency; solidarity, cooperation, and common development;
2. Collectives and individuals participating in competition movements must register for competition; those not registering for competition will not be considered or recognized with competition titles.
3. Competition must be maintained regularly. The content, objectives, targets, measures to organize competition movements must be practical, specific, and appropriate to the functions and tasks of organizations, agencies, and units, linked to the requirements of implementing political tasks of the Ministry, Sector, and each organization, agency, and unit.
Article 4. Principles for Awards
Rewards must be implemented accurately, transparently, fairly, promptly, and appropriately to achievements (achievements to what extent, rewards to that extent). One form of reward can be given multiple times to one recipient; closely combining spiritual encouragement with material incentives.
Pay attention to rewarding small collectives and direct workers.
Chapter II
COMPETITION WORK
Article 5. Objectives of Competition
To create motivation to encourage, motivate, and attract every individual and collective in each agency, unit, throughout the sector, and among all social strata to compete creatively, overcome difficulties, and complete assigned tasks well, actively participate in the development of agriculture and rural areas.
Article 6. Forms of Competition
1. Regular Competition
These are forms of competition organized and launched by the Ministry and its subordinate agencies, General Corporation 91, Vietnam Rubber Industry Group, Associations, and Departments of Agriculture and Rural Development (collectively referred to as units) based on their assigned functions and tasks, and are organized annually.
2. Competition in phases (or thematic competition)
This is a form of competition aimed at implementing key tasks, urgent matters during specific periods and timeframes; the content has a specialized nature, industry-specific.
It is launched when the purpose, requirements, content, targets, and completion timeframe of the competition are clearly defined.
It may be organized at the scale of one unit, one construction project, one field of work, or the entire Agriculture and Rural Development sector. The content of the competition movement must be practical, innovative methods, with the ability to attract collectives and individuals to actively participate. The name of the competition movement must be concise and memorable.
Reward work is only conducted when summarizing the competition movement, mainly applying reward forms at the level of the competition launch (Certificate of Merit, Commendation Certificate). Thematic competitions lasting five years or more, with outstanding achievements, may propose the Prime Minister to award a Commendation Certificate or the President to award the Labor Medal, Third Class (mainly rewarding direct production and working personnel). 1. Based on the key, regular, or urgent tasks of the sector, field, locality, or unit in each stage to launch competition movements.
Article 7. Content of Organizing Encouragement Campaigns
2. Clearly define the purpose, requirements, scope, target, and content of the competition to establish competition targets, timeframe, and organizational measures.
3. Organize the launch of competition movements suitable to the characteristics, nature of work, and participants of the locality or unit; at the launch ceremony, registration for competition and signing of competition agreements are organized.
4. Organize propaganda to maintain and promote the movement, encouraging and attracting a large number of individuals and collectives to participate, discovering and promoting new factors.
6. Organize mid-term and final reviews, evaluate results, effects, shortcomings, and draw lessons learned to continue promoting or prepare content and necessary conditions to launch new competition movements.
5. Select pilot organizations for the competition and emulation movement to draw lessons and expand them widely. Pay attention to inspection and evaluation work during the implementation of the competition and emulation movement.
6. Organize interim reviews, final summaries, evaluations of results, effects, existing shortcomings, and draw lessons learned to further promote or prepare the content and necessary conditions for launching new competitive movements.
7. Select outstanding collectives and individuals to reward, propose higher-level rewards, and focus on organizing propaganda to expand exemplary advanced models and new factors.
Article 8. Formation of Competition Groups and Clusters
Based on the functions and tasks of units in various fields of work with similar or relatively similar nature, taking into account geographical factors, the Ministry divides competition groups and clusters to organize the signing of competition agreements. Each year, each group or cluster selects from 03 to 04 leading units (for groups with more than 10 units) and from 02 to 03 leading units (for groups with 10 units or less), to propose the Minister to present the Ministry's Competition Flag, and select the top 20% outstanding units among those receiving the Ministry's Flag for the Government's Competition Flag (except for the Department of Agriculture and Rural Development group)..

Article 9. Activities of Competition Groups and Signing of Competition Agreements
The activities of Competition Groups are carried out by the Group Leader and Deputy Group Leaders on a rotational basis.
1. Organize meetings to sign competition agreements; mid-year and annual reviews of competition movements, and set directions and tasks for organizing competition movements within the group; exchange experiences, build new models, and highlight exemplary cases within the group; organize the signing of competition agreements between members and promote competition movements within the group.
2. Select and honor units with outstanding achievements in the group to propose for consideration of the presentation of the Government's Competition Flag and the Ministry of Agriculture and Rural Development's Competition Flag through the assessment of the effectiveness of organizing and operating competition movements and self-assessment and scoring according to regulations.
3. Annually, the Group Leader of the Competition Group proactively coordinates with the Deputy Leader and other members in the group to prepare content and organize the signing ceremony of competition agreements in January and the group summary at the beginning of November, score ranking, honor Departments of Agriculture and Rural Development in the group to submit to the Ministry for the proposal to present the Ministry's Competition Flag before November 30th each year (groups may also agree to combine and organize once during the group summary at the beginning of November).
4. Procedures for organizing the signing of competition agreements
a) Unit Heads (or Group Leaders in collaboration with Deputy Group Leaders) prepare content and plans to launch competitions, and host the signing of competition agreements.
b) For collectives, the competition agreement aims to exceed assigned targets, achieve the title of Outstanding Labor Collective, or Advanced Labor Collective. The scope of the competition agreement is organized between units within one competition group.
c) For individuals, the competition agreement aims to exceed assigned tasks, achieve the title of Model Worker at the grassroots level, Model Worker at the Ministry level, or National Model Worker. The scope of the competition agreement for individuals is within the internal unit (from team, squad, department, faculty, workshop... levels).
Article 10. Authority to Launch Competition Movements
1. Central Level: The Minister issues Directives, guiding documents, or directly launches regular, phased, or specialized competition movements.
2. Grassroots Level: Unit Heads base on the Minister's Directive and their assigned functions and tasks, organize the launch of competition movements within their units, set targets, solutions, and completion times for each movement, focusing on solving key and urgent tasks at the grassroots level.
Chapter III
REWARD WORK
Article 11. General Provisions on Award Work
1. General provisions:
a) The level that manages organizational structure, cadres, civil servants, public officials, employees, salary fund shall be responsible for awarding and submitting to the higher level for approval of awards.
b) For Associations and Industry Associations operating in fields under the Agriculture and Rural Development sector, the Ministry shall award or submit to the higher level for approval of awards.
c) For non-state economic organizations: the level that decides on shareholding, establishment, or issuance of business registration certificates to such organizations shall submit for awards; including all State-owned Corporations and Companies that have transferred state capital to the State Capital Investment Corporation for Management.
d) The level that initiates mass movements in batches or specialized campaigns shall award or submit to the higher level for approval of awards upon summarizing the results of the initiated campaign. Awards mainly should be self-awarded at the same level, and in cases of particularly outstanding achievements with significant impact, it should be proposed to the higher level for approval of awards.
e) In one year, no two forms of national awards shall be submitted for one individual, except for exceptional achievements. Cases proposing the conferment of Orders related to "Prime Minister's Commendation" must wait for two years since receiving the "Prime Minister's Commendation" before proposing for the conferment of Orders.
Article 2. Award Submission Process
The award submission process shall be carried out according to the principle that the higher level only organizes the examination of awards or proposes the competent authority to confer awards when receiving the application dossier from the directly subordinate level. Overstepping the hierarchical levels in submitting dossiers is not allowed.
The Ministry of Agriculture and Rural Development shall examine and propose the State to confer awards when receiving complete procedural documents from subordinate agencies and units, the Vietnam Rubber Industry Group, the General Company 91, Provincial Departments of Agriculture and Rural Development, and Associations and Industry Associations operating in agricultural and rural development fields.
Article 12. Authority to Examine, Propose, and Decide on Awards of the Minister
1. To examine and propose the Prime Minister to confer the Flag of Excellence Competition of the Government, the Prime Minister's Commendation, Orders of various types, Hero of Labor, National Model Worker to individuals and units directly under the Ministry, and Associations and Industry Associations operating in fields under the Agriculture and Rural Development sector.
2. Decide:
- To recognize the title "Outstanding Labor Collective" for units directly under the Ministry (excluding the Vietnam Rubber Industry Group and State-Owned Corporations);
- To confer the Flag of Excellence of the Ministry to units within competition groups and clusters;
- To confer the title of Ministry-Level Model Worker, the Minister's Commendation, the Commemorative Medal "For the Cause of Agriculture and Rural Development", and the Golden Rice Ear Award.
3. Agreeing to rewards upon recommendation of the Central Competition and Reward Board.
4. To delegate the heads of subordinate agencies and units, the Vietnam Rubber Industry Group, the General Company 91, and the Chairpersons of Associations and Industry Associations to decide on awards and propose awards according to the authority stipulated in the Law on Competitions and Awards; for the Departments of Agricultural Enterprise Reform and Management, the Party Committee, Trade Union, and Youth League, the authority is delegated to the unit head.
To direct and guide the Heads of competition groups to organize scoring for competitions and submit to the Ministry for conferring the Flag to units within their group.
5. To delegate the Directors of General Departments and Bureaus to review professionally, compile proposals, score competitions for Provincial Departments of Agriculture and Rural Development based on competition standards (as specified in Form No. 12, Appendix 3 of this Circular); to confirm achievements for awards within their management scope, and to examine and submit for exceptional awards to collectives and individuals with achievements in disaster prevention and mitigation, epidemic control, forest protection and firefighting, and those contributing effectively in spirit and material to the development of the sector.
6. To rotate the assignment of the Director of the Department of Agriculture and Rural Development (who is the Head of the Competition Group, Deputy Head of the Competition Group of the seven ecological regions nationwide).
Article 13. Conditions and criteria for awarding Certificates of Merit by the Minister1. For individuals: Consistently achieving the title of Outstanding Soldier at the grassroots level for outstanding performance in two consecutive years; in cases where they are unit leaders, they must also provide proof of tax payment for units subject to tax obligations as prescribed; the requesting unit must have a written recognition of initiatives, work solutions, research topics... that have been awarded the title of Outstanding Soldier at the grassroots level in two consecutive years by the grassroots initiative review council of the unit.
2. For groups: Consistently achieving the title of Excellent Labor Collective for outstanding performance in two consecutive years
, accompanied by proof of tax payment for units subject to tax obligations as prescribed. 3. Procedures and documentation: Follow Article 16 of this Circular.Article 14. Initiative Councils
At all levels (grassroots initiative councils and Ministry-level initiative councils), the task is to examine, evaluate, and decide on recognizing initiatives, work solutions, and proposals in scientific research topics from individuals within the unit.
The decision to recognize initiatives by the initiative council shall be submitted by the unit in the application file for the Ministry's Commendation Council to consider and recommend to the Minister for recognition of the title of Outstanding Soldier at the Ministry level, or to propose to the Prime Minister to award the title of National Outstanding Soldier.
1. Ministry-level Initiative Council
The Ministry-level Initiative Council is established by the Minister and consists of seven or nine members with the following components:
- Chairperson: Deputy Minister responsible for science of the Ministry or Deputy Minister responsible for commendation of the Ministry.
- Vice-Chairperson: Vice-Chairperson of the Ministry's Commendation Council;
- Members: Heads of some departments and units under the Ministry;
- Secretary: Leader of the Department of Commendation or the Personnel Organization Department.
2. Grassroots Initiative Council
The grassroots initiative council is established by the head of the agency or unit and consists of three or five members with the following components:
The Minister decides to promulgate the Operational Regulations of the Council.
- Chairperson: The head of the agency or unit;
- Members of the council include those with professional management expertise and technical skills, capable of evaluating and appraising innovations or solutions in management and organizational implementation of tasks of the agency or unit.
PROCEDURES, DOCUMENTATION FOR RECOMMENDING AWARDS AND RECOGNITION
Article 15. Examination Procedures for Awards and Recognition
The head of the unit decides to issue the operational regulations of the Council.
Chapter IV
The examination and award procedures are carried out according to:
- The operation regulations of the Ministry's Commendation Council and its Standing Committee; Regulations on awarding Commemorative Medals and Operation Regulations of the Council for Awarding the Golden Rice Ear Award of Vietnam.
- The operation regulations of the Ministry.
Article 16. Documentation for Awards
1. Regular commendations:
- Application report of the unit head (Form No. 1);
- Minutes of the unit's Commendation Council meeting (Form No. 2);
The application package includes:
- Achievement report of the individual or group recommended for commendation (Forms No. 3 and 4);
- Summary achievement report and summary table (Forms No. 11, 12, 13, 14, 15 for the Flag of Excellence recommendation); summary report on the content of research topics, initiatives, experiences, and solutions in work and management recognized by the Ministry-level, sectoral, central mass organizations, provincial, and centrally-administered city Science and Initiative Councils for the title of Outstanding Soldier at the Ministry level (one copy), National Outstanding Soldier (two copies)
- Confirmation from the Provincial Tax Bureau regarding the fulfillment of budgetary obligations for enterprises and individuals (Chairman of the Board of Directors; Chairman of the Board of Management, General Director, Director). The number of years confirmed for tax corresponds to the number of years reported in the achievement report of the collective or individual.
The data reported in the achievements must match the tax payment confirmation data from the provincial tax bureau, including: confirmation of actual tax and other revenue payments compared to registered amounts; percentage of state budget contributions compared to the previous year; timely and full payment of all types of taxes and other revenues as prescribed.2. Commendations based on campaigns or special themes: - Application report of the unit head and attached list (Form No. 1);;
- Minutes of the unit's Commendation Council meeting (Form No. 2); - Summary report on the campaign or special theme competition conducted by the unit;
- Achievement report and summary achievement report of the collective or individual achieved during the campaign or special theme (Form No. 9).

- Summary report on the outstanding achievements of the directly managing unit for the proposed commendations (Form No. 8).
4. Commendations for senior officials (from the level of Departments and equivalent positions and above) who have made long-term contributions in agencies, organizations, and mass organizations.
According to guidelines from the Central Steering Committee for Commendation, the Ministry now considers recommending commendations for senior officials who have retired or passed away after making long-term contributions at units (Departments, Inspectors General, Ministry Office, Reform and Enterprise Management Bureau, 13 Project Management Boards under the Ministry, Party Committee of the Ministry, Ministry’s Trade Union).

- Certified copy of one of the following documents: Decision appointing the leadership position recommended for commendation; salary increase decision; social insurance book or party member's resume;
- Certified copy of veteran revolutionary or pre-revolutionary confirmation (if applicable);
- Report on the contribution process and summary report on the work process of the individual (Form No. 5).

- A certified copy of one of the following documents: Decision on appointment to the leadership position proposed for award; decision on salary increase; social insurance book or party member's resume;
- Confirmation copy of revolutionary veteran or pre-revolutionary veteran status (if applicable);
- Report on the dedication process and summary report on the work process of the individual (Form No. 5).
Article 17. Number of Files to be Submitted to the Ministry
- Flag of Excellence Competition of the Ministry, Outstanding Labor Collective, Advanced Worker of the Ministry, and Certificate of Merit from the Minister: 01 set;
- Flag of Excellence Competition of the Government, Certificate of Merit from the Prime Minister: 03 sets;
- Labor Medal, Independence Medal, National Advanced Worker: 04 sets;
- Ho Chi Minh Medal, Golden Star Medal: 08 sets;
- Hero of Labor: 25 sets (05 original sets, 20 photocopied sets).
Article 18. Time for Receiving Files, Place for Receiving Files, and Announcing Results
1. Time for Receiving Files:
Each year, the Ministry receives the Summary Report on the Competition before January 30 and the Request for Awarding from units at the specified time as follows:
a) Regular Competition Awards
- Flag of Excellence Competition of the Ministry, Flag of Excellence Competition of the Government: before November 30 (if there is no official report data, please provide estimated data);
- Certificate of Merit from the Minister, Advanced Worker of the Ministry, Outstanding Labor Collective: before February 28.
- Various types of Medals, Certificate of Merit from the Prime Minister, Title of Hero of Labor, National Advanced Worker: before March 31;
b) Periodic Competition Awards, Specialized Competition Awards: The submission time corresponds to the time of summarizing the competition movement launched.
c) Outstanding Achievement Awards: No specific time limit.
d) School Group Awards: before July 15.
đ) Commemorative Medals: organized twice a year, on May 1 and November 14 (the founding day of the Ministry of Agriculture, now the Ministry of Agriculture and Rural Development): No specific time limit for receiving files.
e) Vietnam Golden Rice Ear Award: held every two years, the latest submission date is May 31 of the year of evaluation and awarding.
2. Time for Announcing Results:
a) For awards and honors granted by the Ministry:
Within five working days from the issuance of the Minister's Award Decision, the results will be publicly announced on the Ministry's electronic information website.
b) For national-level awards: Within seven working days from when the Ministry receives the Award Decision from the competent authority, the results will be publicly announced on the Ministry's electronic information website.

Chapter V
COMPETITION AND COMMENDATION FUND
Article 19. Source and Level of Fund Allocation
Sources for forming the Competition and Reward Fund: From the annual state budget allocation approved by the competent authority for agencies and units; from contributions for making Commemorative Medals, printing Certificates, and printing Certificates of Merit from units; from contributions from domestic and foreign organizations and individuals for the purpose of competition and reward; from other lawful sources permitted to establish a competition and reward fund.
For units under the Ministry's budget: Establish a common competition and reward fund of the Ministry, equivalent to 0.6% of the salary fund according to rank and grade of the number of officials and civil servants within the establishment and approved annual wages (establishment numbers paid by the office), and the contribution level from units under the Ministry's budget is 0.6% of the salary and wage funds of civil servants and staff in these units.
Article 20. Principles for managing and using the competition and reward fund
Any basic unit that proposes rewards, after receiving the reward decision from the competent authority, shall self-deduct from its own competition and reward fund to pay bonuses to the units' collectives and individuals who have been rewarded by superiors;
The competition and reward fund must be used for its intended purpose, openly and transparently, and an annual report on the use of the fund must be submitted according to current regulations;
The remaining balance at the end of the year that has not been fully utilized from the competition and reward fund shall be carried over to the next year for continued use in competition and reward activities.
Article 21. Contents of expenditures from the competition and reward fund
1. The general competition and reward fund of the Ministry:
Expenditure on tangible items for competition titles and reward forms of the Ministry;
Expenditure on cash bonuses, tangible items, or commemorative gifts accompanying competition titles and reward forms for collectives and individuals under special and extraordinary rewards decided by the Minister;
Expenditure on cash bonuses, tangible items, or commemorative gifts accompanying Commemorative Medals for overseas Vietnamese and foreigners whose rewards are decided by the Minister;
Dedicate 20% of the total general competition and reward fund of the Ministry for expenditure on organizing, guiding, and directing competition movements and reward work; training activities, propaganda, and equipment serving competition and reward work;
2. The competition and reward fund of budgetary units under the Ministry:
Expenditure on cash bonuses, tangible items, or commemorative gifts accompanying competition titles and reward forms for collectives and individuals within the reward authority of the unit's head;
Expenditure on cash bonuses, tangible items, or commemorative gifts accompanying competition titles and reward forms for collectives and individuals proposed for rewards by the unit, which have been rewarded by higher-level competent authorities;
Chapter VI
IMPLEMENTATION
Article 22. Responsibilities of Unit Heads
Complete, decide on the establishment and promulgate the operational regulations of the Competition and Reward Council of the unit; assign leadership responsibility, allocate specialized or part-time staff to handle competition and reward work;
Establish a grassroots innovation review council. The council consists of members with management expertise, technical skills, and the ability to evaluate and appraise innovations or solutions in management; organize the implementation of tasks of the agency or unit;
Implement according to the authority stipulated in Article 12 of this Circular;
Article 23. Responsibilities of the Director of the Organization and Cadres Department
Advise the Minister to implement state management tasks regarding competition and reward work throughout the sector as prescribed; propose the content of the Ministry's Competition and Reward Council's activities, the Standing Committee of the Ministry's Competition and Reward Council; advise on organizing summary meetings of competition movements and reward work, launching competition movements across the sector, in phases or on specific topics; organize propaganda, guidance, and professional training activities for cadres handling competition and reward work in subordinate units of the Ministry, economic groups, and Total Company 91; compile, monitor, inspect, and assess the implementation of competition and reward work in units;

Article 24. Implementation Provisions
1. This Circular replaces Circular No. 75/2008/TT-BNN dated June 23, 2008, on guidelines for organizing annual competition movements and reviewing rewards in the Agriculture and Rural Development sector;
Abolish Article 2 of Circular No. 22/2011/TT-BNNPTNT dated April 6, 2011, amending and supplementing certain administrative procedures in the cooperative economy and rural development, competition and reward, and scientific topic management fields according to Resolution No. 57/NQCP dated December 15, 2010;
2. This Circular takes effect 45 days after the date of issuance;
3. Heads of ministries, units directly under the Ministry, Vietnam Rubber Industry Group, Total Company 91, Departments of Agriculture and Rural Development, and related Associations strictly implement this Circular;
4. In the process of implementation, if there are issues requiring information exchange, proposals for supplementation or amendment, please report to the Ministry (through the Organization and Cadres Department) for compilation and reporting to the Minister./.
