Regulations on functions, tasks, powers, and organizational structure of the Securities Market Inspectorate

THE MINISTER OF CULTURE AND INFORMATION

Pursuant to the Inspection Ordinance dated April 1, 1990;

Pursuant to Decree No. 63/2003/NĐ-CP dated June 11, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;

Pursuant to Decision No. 345/TTg dated May 27, 1995 of the Prime Minister on the organization of State Inspection in the Ministry of Culture and Information;

At the proposal of the Inspector General and the Director of the Cadre and Civil Servant Department,

DECISION:

Article 1. The position and functions of the Inspectorate are an organ of the Ministry of Culture and Information, with the function of assisting the Minister in exercising inspection powers within the scope of the Ministry's state management according to the laws on inspection; managing inspection work for subordinate agencies and units of the Ministry; inspecting compliance with laws and examining and resolving complaints and denunciations and anti-corruption activities as prescribed.

The Inspectorate has its own seal and an account at the National Treasury.

Article 2. Duties and powers of the Inspectorate implement duties and powers stipulated in the Inspection Ordinance dated April 1, 1990 and the following specific tasks:

1. Submit to the Minister draft normative legal documents, systems, and policies on cultural and information inspection. Organize information dissemination, education, and popularization of laws on cultural and information inspection; handle complaints and denunciations; prevent and combat corruption in activities under the Ministry of Culture and Information's state management;

2. Develop annual plans and programs on inspection, complaint resolution, prevention, and anti-corruption efforts and organize their implementation after approval by the Minister;

3. Inspect and check the implementation of laws and state policies; the execution of tasks, plans, and work programs approved by the Ministry; and inspection, complaint resolution, and anti-corruption efforts in subordinate agencies and units of the Ministry;

4. Inspect and check the implementation of policies and laws by agencies, organizations, armed forces units, and Vietnamese citizens; organizations and individuals from foreign countries operating within the scope of the Ministry of Culture and Information's state management;

5. Exercise administrative penalty authority as prescribed in the Administrative Violation Handling Ordinance dated July 2, 2002 and related legal documents in the field of culture and information;

6. Inspect and check cases assigned by the Minister and the State Inspector General;

7. Verify, conclude, and recommend the Minister to resolve complaints and denunciations when assigned by the Minister;

8. Resolve complaints and denunciations in the field of culture and information within the authorized jurisdiction;

9. Recommend the Minister to resolve complaints and denunciations that have been resolved by the heads of subordinate agencies and units but still have complaints; review conclusions of complaints and denunciations resolved by the heads of agencies and units if they violate the law, requiring the heads of agencies and units to resolve them again;

10. Verify, conclude, and recommend about complaints in the field of culture and information that have been resolved by the People's Committee Chairmen of provinces and centrally-administered cities but still have complaints, reporting to the Minister for decision;

11. Receive and process letters of complaints and denunciations within the authorized jurisdiction; maintain the Ministry's reception office for citizens;

12. Assist the Minister in guiding, urging, and inspecting subordinate agencies and units in preventing and combating corruption and negative practices. Regularly report to the Minister and the State Inspector General on prevention and anti-corruption efforts in subordinate agencies and units;

13. Guide and train inspection skills for provincial Cultural and Information Inspectors; guide and train complaint resolution and denunciation handling skills for heads, people's inspectors, and inspection collaborators of subordinate agencies and units;

14. Recommend the Minister on issues related to inspection work; complaint resolution; prevention and anti-corruption efforts in subordinate agencies and units;

15. Assist the Minister in organizing coordination with relevant sectors and levels to conduct inspections, prevent, and handle violations within the Ministry of Culture and Information's state management scope;

16. Manage organizational structure, staffing; implement salary systems and incentive policies; training and development; rewards and disciplinary actions for civil servants under the Inspectorate's management according to state regulations and the Minister's delegated management;

17. Manage finances and assets allocated and organize the implementation of the budget allocated according to the law;

18. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Inspector General and Deputy Inspector Generals.

2. Functional Departments:

+ Department of Cultural and Art Inspection;

+ Department of Press and Publishing Inspection;

+ Administrative and General Department.

The Inspector General is responsible for arranging and deploying civil servants and inspectors according to the job title structure and professional standards; developing the operational rules of the Inspectorate for approval by the Minister.

Article 4. Effectiveness

This Decision takes effect 15 days after its publication in the Official Gazette, replacing Decision No. 1346/TC-QĐ dated June 19, 1996 of the Minister of Culture and Information on the functions, duties, powers, and organizational structure of the Inspectorate of the Ministry of Culture and Information.

Article 5. Responsibility for Implementation The Office Director, the Director of the Cadre and Civil Servant Department, the Director of the Planning and Finance Department, the Inspector General, and the Heads of subordinate agencies and units of the Ministry are responsible for implementing this Decision.
