Providing for certain points on implementation
The Constitution of the Socialist Republic of Vietnam
OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM
On the basis of the Constitution of the Socialist Republic of Vietnam;
At the proposal of the Standing Committee of the National Assembly;
RESOLUTION:
Article 1
The Constitution of the Socialist Republic of Vietnam was adopted at the sixth session of the Thirteenth National Assembly on November 28, 2013, and shall be promulgated no later than fifteen days from the date of adoption.
The Constitution of the Socialist Republic of Vietnam shall take effect from January 1, 2014.
Article 2
1. The Thirteenth National Assembly and its agencies shall continue their activities until the first session of the Fourteenth National Assembly convenes.
The State President, the Government, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Office shall continue their activities until the new agencies are elected by the Fourteenth National Assembly in accordance with the Constitution of the Socialist Republic of Vietnam.
People's Councils and People's Committees shall continue their activities until they are established in accordance with the Law on the Organization of Local Administration in conformity with the Constitution of the Socialist Republic of Vietnam.
2. The state agencies specified in Clause 1 of this Article shall perform their functions, tasks, and powers as prescribed in the Constitution from the date the Constitution of the Socialist Republic of Vietnam takes effect.
Matters being handled by state agencies under the provisions of the 1992 Constitution, which are to be transferred to other state agencies according to the provisions of the Constitution of the Socialist Republic of Vietnam, must be handed over to those agencies to continue handling from the date the Constitution of the Socialist Republic of Vietnam takes effect.
Article 3
1. Laws, ordinances, and other legislative acts issued before the Constitution of the Socialist Republic of Vietnam takes effect must be reviewed to amend, supplement, or issue anew in compliance with the Constitution of the Socialist Republic of Vietnam.
2. Amendments and supplements to the Law on the Organization of the National Assembly, the Law on the Organization of the Government, the Law on the Organization of the People's Courts, the Law on the Organization of the People's Procuracies, the Law on State Audit, the Law on the Election of National Assembly Deputies, the Law on the Election of People's Council Members, and the issuance of a new Law on the Organization of Local Administration must be submitted to the National Assembly for consideration and approval no later than the tenth session (October 2015).
Article 4
The Standing Committee of the National Assembly, The State President, the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, and other relevant state agencies within their functions, tasks, and powers have the responsibility to organize the implementation of the Constitution of the Socialist Republic of Vietnam; promptly amend or abolish legislative acts that contravene the Constitution; adjust organizational structures, functions, tasks, and powers in accordance with the Constitution; and implement necessary measures to ensure the enforcement of the Constitution.
2. Central and local state agencies, the Vietnam Fatherland Front, member organizations of the Vietnam Fatherland Front, and other relevant agencies and organizations have the responsibility to organize extensive propaganda and dissemination of the contents of the Constitution of the Socialist Republic of Vietnam within their agencies, organizations, and localities; raise awareness about the Constitution and enhance compliance with it; and ensure that the Constitution is observed and strictly enforced in all areas of social life.
