Regulations on the establishment; tasks, powers of the advisory unit
for specialized transport inspection work

Pursuant to Circular No. 05/2014/TT-TTCP dated October 16, 2014 of the Government Inspectorate on organization, operation, work relations of Inspection Teams and procedures and formalities for conducting inspections;1At the proposal of the Director of the Legal Department of the Government Inspectorate, this Circular stipulates regulations on the Inspection Team's Logbook.
Pursuant to DecreeNo. 57/2013/NĐ-CP dated May 31, 2013 of the Government stipulates on organization and activities of specialized transport inspection in the Transport Industry;
Pursuant to DecreeNo. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Chapter I
GENERAL PROVISIONS

This Circular applies to agencies assigned to perform specialized transport inspection functions, including: Vietnam Highway Administration, Vietnam Railway Administration, Vietnam Inland Waterway Administration, Vietnam Civil Aviation Administration, Vietnam Maritime Administration, Regional Highway Management Units under Vietnam Highway Administration, Civil Aviation Port Control, Maritime Port Control, Inland Waterway Port Control under Vietnam Inland Waterway Administration, Inland Waterway Control Branches and related organizations and individuals.

ADVISORY UNIT FOR SPECIALIZED TRANSPORT INSPECTION WORK
Chapter II
Article 3. Advisory Unit
1. Advisory unit for specialized railway transport inspection work:
a) Legal Affairs - Inspection Department under Vietnam Railway Administration;
b) Inspection - Safety Department I located in the Northern region;
c) Inspection - Safety Department II located in the Central region;
d) Inspection - Safety Department III located in the Southern region;
e) Inspection - Safety Teams No. 1, No. 2, No. 3, No. 4, No. 5, No. 6, No. 7, No. 8, No. 9, and No. 10 under Vietnam Railway Administration.
2. Advisory unit for specialized inland waterway transport inspection work:
a) Legal Affairs - Inspection Department under Vietnam Inland Waterway Administration;
b) Inspection - Safety Department under Inland Waterway Port Control;
c) Inspection - Safety Team under Inland Waterway Control Branch.
3. Advisory unit for specialized civil aviation transport inspection work:
a) Vietnam Civil Aviation Administration assigns the Vietnam Civil Aviation Administration Inspectorate to carry out advisory tasks for specialized transport inspection work;
b) Legal Affairs - Inspection Department under Civil Aviation Port Control.
4. Advisory unit for specialized maritime transport inspection work:
a) Vietnam Maritime Administration assigns the Vietnam Maritime Administration Inspectorate to carry out advisory tasks for specialized transport inspection work;
b) Inspection - Safety Department under Maritime Port Control.
5. Advisory unit for specialized road transport inspection work:
a) Legal Affairs - Inspection Department under Vietnam Highway Administration;
b) Inspection - Safety Team under Highway Management Bureau I;
c) Inspection - Safety Team under Highway Management Bureau II;
d) Inspection - Safety Team under Highway Management Bureau III;
e) Inspection - Safety Team under Highway Management Bureau IV.
6. Highway Management Bureaus I, II, III, and IV assign specialized transport inspectors to work at subordinate Highway Management Branches to perform specialized transport inspection work within their delegated management scope.
6. The Highway Administration Bureaus I, II, III, and IV shall arrange for specialized inspection officials to work at the affiliated Highway Management Branches to carry out specialized inspection work within the scope of their分级管理权限。
Article 4. Establishment decision; tasks and powers of the advisory unit l职能;参谋部门的职责、权限
1. Tasks and powers of the advisory unit:
a) Advise the head of the agency entrusted with the function of specialized inspection to perform the tasks and powers prescribed in Decree No. 57/2013/ND-CP dated May 31, 2013 of the Government on the organization and operation of specialized inspection in the Transport sector;
b) Carry out inspections according to plans, regular inspections, and spot inspections as decided by the competent authority; detect and impose administrative penalties for violations in accordance with the law;
c) Assist the head of the agency entrusted with the function of specialized inspection in guiding, urging, and inspecting the implementation of laws on specialized inspection and laws on administrative penalty enforcement by subordinate levels;
d) Perform other tasks assigned by the head of the agency entrusted with the function of specialized inspection.
2. Based on the provisions of this Circular, the Director General of Vietnam Highway Administration, the Director General of Vietnam Railway Administration, the Director General of Vietnam Inland Waterway Administration, the Director General of Vietnam Maritime Administration, and the Director General of Vietnam Civil Aviation Administration shall issue decisions to establish the advisory unit, specify its tasks and powers, and those of the head of the advisory unit; define the working relationships among advisory units regarding specialized inspection work; inspect and impose administrative penalties.
Chapter III
IMPLEMENTING PROVISIONS
Article 5. Effective dateệu OF THIS CIRCULARfor implementation
1. This Circular takes effect from April 1, 2014.
2. This Circular replaces:
a) Decision No. 01/2005/QĐ-BGTVT dated January 4, 2005 of the Minister of Transport on the functions, tasks, powers, and organizational structure of the Inspectorate of Vietnam Railway Administration;
b) Decision No. 02/2005/QĐ-BGTVT dated January 4, 2005 of the Minister of Transport on the functions, tasks, powers, and organizational structure of the Inspectorate of Vietnam Riverway Administration;
c) Decision No. 05/2005/QĐ-BGTVT dated January 4, 2005 of the Minister of Transport on the functions, tasks, powers, and organizational structure of the Inspectorate of Vietnam Highway Administration.
Article 6. Responsibility for Implementation
The Head of the Ministry's Office, the Head of the Ministry's Inspectorate, the Heads of the Ministry's Departments, the Director General of Vietnam Highway Administration, the Director General of Vietnam Railway Administration, the Director General of Vietnam Inland Waterway Administration, the Director General of Vietnam Civil Aviation Administration, the Director General of Vietnam Maritime Administration, relevant agencies, organizations, and individuals are responsible for implementing this Circular.
The Director General of Vietnam Highway Administration, the Director General of Vietnam Railway Administration, the Director General of Vietnam Inland Waterway Administration, the Director General of Vietnam Maritime Administration, and the Director General of Vietnam Civil Aviation Administration are responsible for formulating specific organizational schemes to arrange and reassign civil servants currently engaged in specialized inspection work in accordance with the laws on inspection and laws on civil servant management.
During the implementation process, if there are any difficulties, the heads of the agencies and units shall report them to the Ministry of Transport for consideration and decision.
