Pursuant to the State Budget Law on June 25, 2015;
Pursuant to Decree No. 45/2012/NĐ-CP dated May 21, 2012, of the Government on promoting industry;
Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016, of the Government detailing certain provisions of the Law on State Budget;
Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Administrative and Public Service Financial Department;
The Minister of Finance issues this Circular amending and supplementing some articles of Circular No. 28/2018/TT-BTC dated March 28, 2018, of the Minister of Finance guiding the preparation, management, and use of funds for promoting industry.
Article 1. Amending and supplementing some articles of Circular No. 28/2018/TT-BTC dated March 28, 2018, of the Minister of Finance guiding the preparation, management, and use of funds for promoting industry (hereinafter referred to as Circular No. 28/2018/TT-BTC)
1. Amend and supplement Clause 1 of Article 9 as follows:
"1. Based on the provisions of Decree No. 45/2012/NĐ-CP dated May 21, 2012, of the Government on promoting industry and the guidance levels provided in this Circular, the People's Committee of the province shall establish specific expenditure levels for local industrial promotion activities to be submitted to the People's Council of the province for decision in accordance with the provincial budget balance capacity."
2. Amend and supplement Article 10 as follows:
Article 10. Preparation, execution, and settlement
The preparation, execution, and settlement of state budget funds allocated for industrial promotion activities shall be carried out in accordance with the provisions of the Law on State Budget, the Law on Investment, guiding documents implementing these laws, and the provisions of this Circular.
3. Amending and supplementing Article 11 as follows:
"Article 11. Preparation and allocation of budget estimates
1. For national industrial promotion funds
a) Annually, based on the approved industrial promotion program, and current standards, norms, and rates, the Ministry of Industry and Trade shall prepare the estimate of national industrial promotion funds and incorporate it into the Ministry's state budget estimate, sending it to the Ministry of Finance (for regular expenses) and the Ministry of Planning and Investment (for investment development expenses) for consolidation and submission to the competent authority in accordance with the laws on state budget and investment.
b) Based on the state budget estimate assigned by the competent authority and the approved tasks, the Ministry of Industry and Trade shall allocate the state budget estimate to units using the budget to implement the national industrial promotion program in accordance with current laws.
2. For local industrial promotion funds
a) Annually, based on the approved local industrial promotion program, current expenditure standards and rates, and the unit responsible for implementing the local industrial promotion task shall prepare the estimate of local industrial promotion funds and submit it to the Department of Industry and Trade for consolidation into the Department's state budget estimate, sending it to the Department of Finance (for regular expenses) and the Department of Planning and Investment (for investment development expenses) for consolidation and reporting to the competent authority in accordance with the laws on state budget and investment.
b) Based on the assigned budget estimate, the Department of Industry and Trade shall allocate the funds for implementing the local industrial promotion program to budget-using units in accordance with current regulations.
c) Regarding the preparation, allocation, and assignment of local district and commune-level industrial promotion fund budgets, such matters shall be decided by the respective level People's Councils in accordance with local industrial promotion organization and the laws on state budget."
4. Amending and supplementing Clause 2 of Article 12 as follows:
"2. The Treasury shall control and settle payments for projects and tasks related to industrial promotion in accordance with current regulations."
Article 2. Provisions on Implementation and Transitional Provisions
1. This Circular takes effect from October 18, 2024.
2. For the expenditure items and expenditure levels of local industrial promotion activities that have been decided or approved according to the laws before this Circular takes effect, they shall continue to be implemented according to the existing regulations until the People's Council of the province makes a resolution on the expenditure items and expenditure levels of local industrial promotion activities, but not exceeding the fiscal year 2024 and ensuring compliance with the provisions of the State Budget Law and this Circular.
3. During the implementation process, if there are difficulties or obstacles, it is requested that agencies, organizations, and individuals report them to the Ministry of Finance for timely resolution./.
