Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Legislative Regulatory Documents No. 64/2025/QH15;

Pursuant to the Consumer Protection Law No. 19/2023/QH15;

Pursuant to Decree No. 40/2025/NĐ-CP detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 78/2025/NĐ-CP detailing certain provisions and measures to organize and guide the implementation of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 146/2025/NĐ-CP on decentralization and delegation of authority in the industry and trade sector;

At the proposal of the Chairman of the National Competition Commission;

The Minister of Industry and Trade issues the Circular guiding internal administrative procedures in the coordination work between the state management agency for consumer rights protection and the authority managing the industry, sector on contract control based on templates, general transaction conditions.

Article 1. Scope of Regulation and Applicability

1. This Circular specifies detailed internal administrative procedures in the coordination work between the state management agency for consumer rights protection and the authority managing the industry, sector on contract control based on templates, general transaction conditions as prescribed in Clause 4, Article 28 of Law No. 19/2023/QH15 on the basis of the authority granted in Clause 5, Article 28 of Law No. 19/2023/QH15 and Article 44 of Decree No. 146/2025/NĐ-CP.

2. The subjects to which this Circular applies include: the state management agency for consumer rights protection under the Ministry of Industry and Trade; People's Committees of provinces and centrally governed cities; authorities managing the industry, sector; other organizations and individuals related.

Article 3. Cooperation in providing lists of organizations and individuals engaged in business using standard contracts and general transaction conditions

1. In response to urgent requirements for protecting consumer rights, the state management agency for consumer rights protection under the Ministry of Industry and Trade may request the authority managing the industry, sector to cooperate in providing a list of organizations and individuals conducting business using contracts based on templates, general transaction conditions in transactions with consumers.

2. The implementation of such requests shall be carried out through one of the following methods: direct submission, postal service, or online via electronic environment, with one set sent to the authority managing the industry, sector.

Point 3. The request dossier includes: a request letter for providing lists of organizations and individuals using standard contracts and general transaction conditions according to Form No. 01 attached to this Circular.

Point 4. The request shall be processed in the following sequence:

a) State management agencies for protecting consumer rights under the Ministry of Industry and Trade prepare the dossier and send it to the industry and sector management agency.

b) The authority managing the industry, sector shall accept the dossier and send a reply letter along with a list of organizations and individuals conducting business using contracts based on templates, general transaction conditions within their managed industry, sector according to Form No. 02 attached hereto within five working days from the date of receipt of the request letter.

Point 5. Industry and sector management agencies have the responsibility to provide the requested information accurately and timely in accordance with the request of state management agencies for protecting consumer rights under the Ministry of Industry and Trade.

6. Based on the economic and social situation and the need for state management to protect consumer rights at the local level, if necessary, the Provincial People's Committee shall consider establishing and issuing regulations on cooperation regarding the provision of lists of organizations and individuals conducting business using contracts based on templates, general transaction conditions between the state management agency for consumer rights protection and the authority managing the industry, sector.

Article 3. Effectiveness

This Circular shall take effect from January 1, 2025./.
