DECREE
On the organization of labor agencies in Vietnam
CHAIRMAN OF THE COUNCIL OF MINISTERS OF THE DEMOCRATIC REPUBLIC OF VIETNAM
Pursuant to Decree No. 36 dated March 27, 1946 organizing the Ministry of Social Affairs;
At the request of the Minister of Social Affairs;
After deliberation by the Council of Ministers.
ISSUES THE DECREE
Article 1: The Central Labor Office established within the Ministry of Social Affairs pursuant to the aforementioned Decree No. 36 shall have the following responsibilities:
- Ensuring and defending the rights and interests of workers;
- Balancing the interests of employers and employees to consolidate and expand the national economy;
- Supervising the implementation of labor laws and regulations;
- Providing workers with means to improve their qualifications in all aspects: intellectual, material, professional;
- Allocating manpower for commerce, industry, agriculture;
- Organizing international labor relations;
- Resolving labor issues.
Article 2: The Central Labor Office shall be under the control of a Director and shall consist of departments designated by the Minister of Social Affairs.
Article 3: A Labor Inspection Office will be established in each province, headed by an Inspector.
These Inspectors will be appointed by the Minister of Social Affairs after consultation with the Provincial Administrative Committee.
The provincial labor inspectors work under the supervision of the Ministry of Social Affairs, the Central Labor Office, and the Provincial Administrative Committee. They may have one or two Deputy Inspectors as well as supervisors and labor commissioners to assist them.
Article 4: The Provincial Labor Inspection Offices shall be responsible for:
- Supervising the implementation of labor laws and regulations in their respective provinces;
- Proposing improvements to labor laws and regulations;
- Resolving disputes between employers and employees;
- Preparing reports on labor conditions in their respective provinces;
- Directing and supervising labor agencies within their respective provinces.
Article 5: The Minister of Social Affairs, upon the recommendation of provincial administrative committees, may establish Labor Departments in provinces deemed significant for labor relations.
These departments will be headed by an Inspector, supervisor, or labor commissioner. They will be appointed by the Minister of Social Affairs and work under the direct supervision of the Provincial Labor Inspection Office and the Provincial Administrative Committee.
A Labor Inspector may concurrently hold this position in multiple provinces forming a region designated by the Minister of Social Affairs.
In provinces without separate Labor Departments or not under any Labor Inspector, the Chairman or an official of the Provincial Administrative Committee will concurrently serve as Inspector or Labor Commissioner.
Article 6: The Provincial Labor Office shall be responsible for:
- Supervising the enforcement of labor laws;
- Monitoring workers in the province;
- Implementing orders from superiors;
- Proposing solutions to labor issues within the province;
- Mediating disputes arising between employers and employees.
Article 7: The Director of the Central Labor Bureau, Inspectors, supervisors, labor commissioners, Chairmen or administrative committee members who concurrently serve as inspectors or labor commissioners, and other labor officials authorized to supervise must take an oath not to disclose manufacturing secrets and professional organizational methods that they become aware of while performing their duties.
The Director shall swear before the Minister of Social Affairs, whereas Inspectors, Supervisors, and Labor Commissioners shall swear before the Chairman of the Administrative Committee.
Article 8: Any regulations conflicting with this Decree are hereby abolished.
Article 9: The Ministers of Interior and Social Affairs are entrusted with enforcing this Decree.
