Guidelines for functions, tasks, authorities, and organization of

Inspectorate of the Department of Culture and Information

Implementing Article 3 of Decision No. 345/TTg dated May 27, 1996 of the Prime Minister on the organization of State Inspection for Culture and Information; after receiving the unified opinion of the State Inspectorate in Circular No. 1231/TTNN dated August 14, 1996, and the Government's Organization and Cadre Affairs Board in Circular No. 173/TCCP-TC dated September 14, 1996.

The Ministry of Culture and Information guides the functions, tasks, authorities, and organization of the Inspectorate of the Department of Culture and Information of provinces and centrally governed cities (hereinafter referred to as provinces) as follows:

I- FUNCTIONS OF THE INSPECTORATE OF THE DEPARTMENT OF CULTURE AND INFORMATION:

The Inspectorate of the Department of Culture and Information is an agency under the Department of Culture and Information, assisting the Director of the Department of Culture and Information in performing State Inspection functions and specialized inspection in the fields of publishing, press, printing, book distribution, cinema, photography, performing arts, fine arts, libraries, cultural heritage preservation, museums, advertising, and other areas within the province.

II- TASKS AND AUTHORITIES OF THE INSPECTORATE OF THE DEPARTMENT OF CULTURE AND INFORMATION:

1/ Inspect and check the implementation of policies and laws by state agencies, economic organizations, social organizations, armed forces units, and all Vietnamese citizens; organizations and individuals from foreign countries in cultural and information activities and cultural and information services within the province; inspect and check the implementation of policies, laws, and assigned tasks by agencies, units, and individuals under the direct management of the Department.

2/ Check the implementation of policies and laws by state agencies, economic organizations, social organizations, armed forces units, and all Vietnamese citizens, organizations, and individuals from foreign countries in Vietnam within the province in cultural and information activities and cultural and information services. Propose to the Director of the Department of Culture and Information plans, measures, and organizational arrangements for inspections and checks in cultural and information activities and cultural and information services.

3/ Prevent and handle administrative violations in cultural and information activities and cultural and information services within the province according to authority; build and direct inspectors and cooperative inspectors in all areas within the province.

4/ Guide and check the implementation of regulations on inspection work and the handling of complaints and denunciations at agencies and units under the Department's state management and directly managed units. Recommend to the Director of the Department to resolve complaints and denunciations regarding matters that have been resolved but the parties still complain or where there are signs of law violations. In cases where recommendations are not accepted, report to the provincial inspectorate, the inspectorate of the Ministry for joint resolution.

5/ Carry out other authorities prescribed in Clauses 1, 2, 3, 4, 5, 8, and 9 of Article 9 of the Inspectorate Ordinance and authorities prescribed in Clause 5 of Article 5 of Decree No. 244/HĐBT dated June 30, 1990 of the Council of Ministers on the organization of the State Inspectorate system and measures to ensure inspection activities.

6/ Assist the Director of the Department of Culture and Information in organizing coordination with relevant departments and levels at the local level to check illegal acts in cultural and information activities and cultural and information services.

7/ Have the right to impose administrative penalties according to the Administrative Violation Handling Ordinance issued on July 19, 1995, Decree No. 88/CP issued on December 14, 1995, of the Government, and related regulatory documents.

8/ Have the right to use cooperative inspectors on the territory managed by the Department according to Decree No. 191/HĐBT of the Council of Ministers (now the Government) issued on June 18, 1990.

III- ORGANIZATION OF THE INSPECTORATE OF THE DEPARTMENT OF CULTURE AND INFORMATION:

1/ The Inspectorate of the Department of Culture and Information is organized based on the unified structure of the Inspectorate of the Department and existing specialized culture and information inspection units of the Department of Culture and Information.

The Inspectorate of the Department of Culture and Information has its seal and account at the National Treasury.

2/ The Inspectorate of the Department of Culture and Information has an Inspector-in-Charge, one to two Deputy Inspectors-in-Charge assisting the Inspector-in-Charge, responsible for specific sections, and has inspectors. The appointment and removal of the Inspector-in-Charge of the Inspectorate of the Department of Culture and Information are decided by the Chairman of the Provincial People's Committee upon the proposal of the Director of the Department of Culture and Information. The appointment and removal of Deputy Inspectors of the Inspectorate of the Department of Culture and Information are decided by the Director of the Department of Culture and Information upon the proposal of the Inspector-in-Charge of the Inspectorate of the Department of Culture and Information.

3/ The Inspectorate of the Department of Culture and Information has specialized inspection units including State Inspection and specialized inspection.

The staffing of the Inspectorate is based on the increasing workload, the scope of industry and societal management in the field of culture and information requiring higher standards, especially the continued implementation of Decree No. 87/CP dated December 12, 1995, of the Government... if only the previous staffing levels were maintained, it would be difficult to fulfill the assigned tasks well. Therefore, depending on the workload of each province, the Chairman of the Provincial People's Committee decides and within the total staffing of the Department of Culture and Information.

When conducting inspections, inspection teams can be established. The Cultural and Information Inspection Team is a dedicated force participating in the Interdepartmental Inspection Team according to Clause 2 of Article 1, Part III of Directive No. 814/TTg issued on December 12, 1995, of the Prime Minister. The Inspection Team is headed by the Inspector-in-Charge, Deputy Inspectors-in-Charge, and Inspectors, using cooperative inspectors on the territory of districts, towns, city districts, and centrally governed cities according to Decree No. 191/HĐBT issued on September 18, 1990. The number of cooperative inspectors depends on the inspection tasks of each locality, decided by the Chairman of the Provincial People's Committee.

Based on the contents of this Circular, the Chairman of the Provincial People's Committee coordinates with the Ministry of Culture and Information to guide the establishment and operation of the Inspectorate of the Department of Culture and Information and the performance of cultural and information inspection duties in the locality. During the implementation process, any difficulties should be reported to the Ministry of Culture and Information for appropriate amendments and supplements.
