Decision No. 65/2001/QĐ-BKHCNMT on the issuance of the List of processed waste materials meeting environmental requirements that are permitted for import as production raw materials.

DECISION OF THE MINISTER OF SCIENCE, TECHNOLOGY AND ENVIRONMENT

Regarding the issuance of the List of waste materials that have been processed to meet environmental requirements and are permitted for import as production raw materials

Pursuant to Decree No. 22/CP of the Government dated May 22, 1993, on the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment;

MINISTER OF THE MINISTRY OF SCIENCE AND TECHNOLOGY AND ENVIRONMENT

Pursuant to Decree No. 175/CP of the Government dated October 18, 1994, guiding the implementation of the Environmental Protection Law;

Pursuant to Decision No. 46/2001/QĐ-TTg of the Prime Minister dated April 4, 2001, on the management of export and import goods during the period from 2001 to 2005;

Considering the proposal of the Director of the Environmental Department, the Head of the Legal Department, and the Director of the Ministry's Office,

Issuing this Decision, the "List of waste materials that have been processed to meet environmental requirements and are permitted for import as production raw materials" is attached hereto.

DECISION:

Article 1: Organizations and individuals are only allowed to import waste materials that have been processed to meet environmental requirements and are included in the List attached to this Decision, and they must bear responsibility under the law to ensure:

Article 2: 1. Imported waste materials do not contain toxic chemicals, radioactive substances, flammable and explosive materials, organic compounds of animal and plant origin that pose disease risks, medical waste, and other types of goods prohibited from importation according to state regulations.

2. Imported waste materials have been removed of impurities, although there may still be a negligible amount adhering that is difficult to remove during processing and sorting but does not cause environmental pollution.

3. Imported waste materials can only be used as raw materials for production.

Production facilities using imported waste materials as raw materials for production must be responsible for ensuring that the waste materials do not cause environmental pollution and must process waste products in compliance with prescribed standards.

Article 3: The local Departments of Science, Technology, and Environment shall be responsible for:

Article 4: 1. Cooperating to monitor the import of waste materials when requested by Customs authorities.

2. Cooperating with relevant agencies to inspect and supervise to ensure that imported waste materials are used for their intended purposes and comply with legal provisions.

This Decision shall take effect fifteen days from the date of signature and shall replace Decision No. 10/2001/QĐ-BKHCNMT dated May 11, 2001, issued by the Minister of Science, Technology, and Environment.

Article 5: The Director of the Environmental Department, the Head of the Legal Department, the Director of the Ministry's Office, the Directors of the Departments of Science, Technology, and Environment, and related organizations and individuals shall be responsible for implementing this Decision./.

Article 6: LIST OF WASTE MATERIALS THAT HAVE BEEN PROCESSED TO MEET ENVIRONMENTAL REQUIREMENTS AND ARE PERMITTED FOR IMPORT AS PRODUCTION RAW MATERIALS

1. Metal or alloy scraps, chips, and fragments remaining after machining processes, unused.

2. Used railway steel, scrap steel, steel sheets, round steel, shaped steel, steel pipes, wires, and various types of steel mesh.

4. The organizations and individuals proposed for selection are those with the highest ranked application files, but the average score must reach at least 70 out of 100 points, including a minimum average score of 50 out of 70 points for scientific and practical value.

3. Steel and iron recovered from dismantling and demolition of used construction projects such as bridges, towers, buildings, and workshops.

4. Steel and iron recovered from dismantling and demolition of used transportation vehicles, machinery, and other items made of steel and iron.

5. Copper and copper alloys in sheet, fragment, bar, pipe, or other forms recovered from dismantling and demolition of used machinery, equipment, and items.

6. Aluminum and aluminum alloys in sheet, fragment, bar, pipe, or other forms recovered from dismantling and demolition of used machinery, equipment, and items.

7. Zinc and zinc alloys in sheet, fragment, bar, pipe, or other forms recovered from dismantling and demolition of used machinery, equipment, and items.

8. Nickel and nickel alloys in sheet, fragment, bar, pipe, or other forms recovered from dismantling and demolition of used machinery, equipment, and items.

9. Used copper or aluminum electrical cables with plastic, rubber, or other insulating material coatings removed.

10. Used electrical wire (copper wire coated with enamel, cotton, or paper insulation).

11. Paper waste and cardboard waste.

12. Plastic scraps, chips, and strands remaining after production processes, unused./.

12. Various forms of plastic scraps, trimmings, sheets, and fibers remaining after the production process, not yet used./.
