DECREE OF THE GOVERNMENT
issued on December 25, 2001;
To enhance the effectiveness of state management, toincrease the responsibility of agencies and organizations for the work of people'sair defense, to raise vigilance and readiness to prevent and counter enemy airinvasions, contributing to protecting the Socialist Republic of Vietnam;
At the proposal of the Minister of National Defense,
DECREE:
Chapter to implement the work of people's air defense in key areas.
1. AT Provincial, district, and commune levels within thekey areas of people's air defense shall organize the People's Air Defense WorkCommittee located at the local military authority, headed by a Deputy Chairmanof the People's Committee, the Deputy Commander-in-Chief of the local militaryauthority serving as the Vice Chairman in charge, and members being representativesof relevant specialized departments: Members of the People's Air Defense WorkCommittee shall serve concurrently. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).In cases where key areas of people's air defense fallwithin the jurisdiction of multiple communes, districts, or provinces, thePeople's Air Defense Work Committee or
the higher-level People's Committee of thoseadministrative units shall be responsible for directing coordination andcooperation to implement the work of people's air defense. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. The People's Air Defense Work Committee
in key areas shall have the following tasks andpowers: a) Develop plans for people's air defense;
b) Organize the building of people's air defense forces;
c) Organize implementation and manage activities ofpeople's air defense;
d) Guide and inspect the implementation of people'sair defense work at
their own level and subordinate units stationed in thelocality. The specific tasks of the People's Air Defense WorkCommittee shall be decided by the Chairman

4. Establishing and issuing economic-technicalnorms, product and service standards, wage rates in accordance with Stateprovisions. a) The specialized force of people's air defense isorganized from existing professional organizations of specialized agencies andcombat forces of self-defense militia;
b) They are organized into people's air defense teamsand squads to perform observation, damage control, combat support, and people'sair defense security tasks;
c) The Chairmen
of People's Committees at all levels and heads ofagencies and organizations using the specialized force of people's air defenseshall decide to establish people's air defense teams and squads; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).d) The specialized force of people's air defense inkey areas is the core force to carry out specialized tasks related to people'sair defense. Agencies and organizations are responsible for organizing andmobilizing the people to participate together.
Training for the specialized force of people's airdefense shall be regulated by the Ministry
of National Defense. Ministry of Science and Technology PREPARATION AND IMPLEMENTATION OF PEOPLE'S AIRDEFENSE WORK
Article 9. III
The Ministry of National Defense and relevantministries and sectors shall develop comprehensive plans for people's airdefense.
Section I. Study and promulgate regulations and organize forcesand means to ensure order and security when implementing the plan for people'sair defense in various situations; organize training and inspection ofcompliance with regulations on ensuring security in people's air defense work.
2. Ministry of Public Security: Take the lead in researching and submitting tocompetent authorities for issuance or issuing according to their authoritydocuments on management and use of the budget for implementing people's airdefense work; develop plans and direct the reserve of food, supplies, and othernecessary means to ensure people's air defense work.
3. Ministry of Finance: 4. The Ministry of Construction:
Direct the construction of projects and investmentprojects according to requirements and standards for air defense safety.Direct the organization of construction of key shelters. Develop plans, ensure equipment and direct,organize the transportation of people, means, and assets to implement people'sair defense work.
5. The Ministry of Transport: 6. The Ministry of Health:
Direct the organization of emergency medical care andtreatment for injured persons, training for self-defense militia and specializedpeople's air defense forces in emergency rescue techniques. Coordinate with theMinistry of Science and Technology and the Environment toorganize prevention and control of diseases, radiation protection, decontamination,cleaning, and environmental sanitation. 7. The General Post Office Corporation:
Plan to ensure priority use of communication meansfor the task of reporting and sounding the alarm for people's air defense andimplementing people's air defense work. 3. Commitment to comply with declared quality standards. People's Committees at all levels:

Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Direct and organize the construction of forces,plans, and implementation of people's air defense work in their localities. a) Direct the organization of construction of forces,plans, and implementation of contents of people's air defense work;
b) Implement all policies and regulations on people'sair defense work according to the分级授权;
c) Manage and use funds allocated by the State andensure local government financial resources to implement people's air defensework;
d) Timely report to the Military Region Command orthe Ministry of National Defense any planning and development projects of thelocal economy and society that relate to people's air defense work beforesubmitting them to competent authorities for approval.
GUARANTEES AND POLICIES FOR PEOPLE'S AIR DEFENSEWORK
SectionIV
1. Funding guarantee.
Article 191. Funding for people's air defense work in ministries,equivalent ministries, and agencies under the Government and localities shallbe included in the annual regular budget according to the regulations on thedivision of responsibilities for state budget expenditures.
2. Funding for people's air defense work in economic organizations shall be guaranteed by theireconomic organizations themselves.
2. Equipment guarantee.The Ministry of National Defense shall ensure weaponsand technical equipment for combat forces and some specialized equipment anddevices for people's air defense work. Agencies and organizations shall ensuremeans and equipment for specialized people's air defense teams under theirmanagement according to mission requirements.
Article 203. Policy guarantee.
AND 1. Those who do not receive salaries from the statebudget, during the time they are mobilized to participate in people's airdefense work and training exercises, shall enjoy benefits as stipulated in thecurrent regulations for militia cadres and soldiers who do not receive salaryfrom the state budget according to the Ordinance on Militia Self-Defense.
Article 212. Those directly participating in the people's airdefense force who are wounded or killed in combat shall enjoy benefits asprovided in the Ordinance on Militia Self-Defense.
1. Persons not receiving salaries from the State budget, during the time they are mobilized to participate in civil air defense work and training exercises, shall be entitled to benefits as prescribed under the current regulations for civilian self-defense militia personnel who do not receive salaries from the State budget pursuant to the Ordinance on Civil Self-Defense Militia.
2. Persons directly participating in the civil air defense force who are wounded or killed in combat shall be entitled to benefits as prescribed under the Ordinance on Civil Self-Defense Militia.

REWARD AND VIOLATION HANDLING
Article 22. Disciplinary Measures.
Credit organizations on ||| Individuals with achievements in civil air defense work shall be rewarded in accordance with the State's regulations.
Article 23||| Handling violations.
Credit organizations on ||| Individuals who commit acts violating civil air defense work, depending on the severity and nature of the violation, shall be dealt with in accordance with the law.
Chapter ||| VI
IMPLEMENTING PROVISIONS
"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country."Effectiveness:
||| This Decree takes effect fifteen days from the date of signature, replacing Decree No. 112/CP dated July 25, 1963 of the Council of Ministers on the organization and implementation of civil air defense work.
||| All previous provisions concerning civil air defense work that conflict with this Decree are hereby abolished.
Article 25||| Responsibility for guiding the implementation of the Decree.
||| The Minister of National Defense shall coordinate with the heads of relevant agencies to guide the implementation of this Decree.
Article 26||| Responsibility for implementing the Decree.
