JOINT CIRCULAR

Guidelines for Implementing Funding to Support Short-term Vocational Training for Rural Labor

Based on the State Budget Law and guiding documents for implementing the State Budget Law;

To ensure uniform organization and management, as well as the use of funding to support short-term vocational training for rural labor, the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs provide the following guidelines:

I. SCOPE AND APPLICABLE SUBJECTS

b) In cases where funds from organizations and individuals within and outside Vietnam are used for victim support work and victim support benefits, such activities shall be carried out in accordance with the regulations of the Ministry of Finance and the donor; in cases where there is no agreement between the donor or their authorized representative and the Ministry of Finance regarding the expenditure level, the expenditure level prescribed in this Circular shall apply.

These Circulars apply to the funding allocated annually in the local budgets aimed at promoting the restructuring of the labor force, reducing the proportion of agricultural labor, addressing employment for farmers, and serving the economic and social development of the locality.

The subjects eligible for funding support for vocational training are those who have not yet received vocational training and are selected according to the following priority order:

- Belonging to ethnic minority groups, highland communes, and particularly difficult communes as decided by the Prime Minister.

- Being entitled to preferential policies under Article 66 of Decree No. 28/CP dated April 29, 1995 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs, and Their Families, War Invalids, War Veterans, and Those Who Have Contributed to the Revolution.

- Belonging to traditional craft villages included in projects to restore and develop traditional crafts where the project does not have separate funding for vocational training.

- Belonging to households whose agricultural land has been expropriated due to urbanization or construction of public works, industrial zones, export processing zones, and other national defense projects for the benefit of the country and require vocational training to change their professions.

- Belonging to specialized farming areas requiring a change of profession.

- Other agricultural workers who wish to receive vocational training.

II. ORGANIZATION OF SHORT-TERM VOCATIONAL TRAINING FOR RURAL LABOR

1. Vocational training programs and certificates.

- Short-term vocational training programs for rural labor must be developed, reviewed, and approved in accordance with Decision No. 212/2003/QD-BLDTBXH dated February 27, 2003 of the Minister of Labor, Invalids, and Social Affairs regarding the issuance of regulations on the principles of program development and implementation.

- The minimum duration of a training course is one month.

- Trainees who complete the training course must be examined and evaluated; if they meet the requirements, they will be issued a vocational certificate in accordance with Decision No. 1012/1998/QD-BLDTBXH dated October 9, 1998 of the Minister of Labor, Invalids, and Social Affairs regarding the issuance of vocational diplomas and certificates, and Decision No. 1536/1998/QD-BLDTBXH dated December 1, 1998 of the Minister of Labor, Invalids, and Social Affairs regarding the temporary regulations on the issuance and management of vocational diplomas and certificates.

2. Trades.

The trades for training are determined based on the needs for labor restructuring, job creation, and economic and social development of the locality as decided by the People's Committee of the province or centrally-administered city.

The organization of short-term vocational training for rural labor is carried out by vocational training institutions and other training institutions of the locality and central level within the area. Mobile training forms are encouraged to facilitate conditions and reduce costs for trainees.

III. USE AND MANAGEMENT OF FUNDS FOR SHORT-TERM VOCATIONAL TRAINING FOR RURAL LABORERS

- Central budget support.

- Mobilizing other resources in cash and kind.

- Local budget.

- Contributions from trainees.

- Integrating National Target Programs and other central and local projects in the area.

Central budget support for vocational training is calculated based on the actual number of trainees, with a maximum of VND 200,000 per trainee per month.

2. Content and expenditure levels:

- Expenditure on enrollment, opening, closing ceremonies, and issuing vocational certificates.

3. Content and Levels of Expenditure

- Expenditure on hiring teachers for theoretical instruction and practical guidance.

- Expenditure on supporting materials for vocational training.

b. Expenditure on developing programs and textbooks (for trades without existing programs or textbooks) shall be applied according to the expenditure level for secondary vocational education as stipulated in Circular No. 87/2001/TT-BTC dated October 30, 2001 of the Ministry of Finance guiding the content and expenditure levels for building framework programs for higher education, college, and secondary vocational education, and compiling subject textbooks.

- Remuneration for theoretical instructors and practical guidance instructors;

- Management costs for the class.

3. Management of funding:

- Funding to support short-term vocational training for rural labor is supplemented with specific objectives for provinces and centrally-administered cities and implemented through participating vocational training institutions.

- Funding to support short-term vocational training for rural labor is allocated to units organizing vocational training; it is not directly provided to trainees.

- The management, use, and settlement of accounts for funding are carried out in accordance with the State Budget Law.

- Guide the preparation and approval of short-term vocational training projects for rural labor;

IV. IMPLEMENTATION

1. Ministry of Labor, Invalids and Social Affairs

- Summarize and evaluate the implementation of short-term vocational training for rural labor; propose annual resource needs to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and submission to the Government for consideration and the National Assembly;

- Take the lead, coordinate with the Ministry of Finance, to inspect and supervise the implementation of localities, monitor and urge effective project implementation.

2. Provincial People's Committees: Direct and inspect the organization and implementation of vocational training for rural labor in their respective areas.

3. Departments of Labor, Invalids, and Social Affairs:

- Lead in preparing plans for short-term vocational training for rural labor to be submitted to the provincial People's Committee for approval; implement the plan after approval;

- Inspect, supervise, urge implementation; compile and report results regularly to the provincial People's Committee and the Ministry of Labor, Invalids, and Social Affairs.

4. Departments of Finance: Coordinate with the Department of Labor, Invalids, and Social Affairs to inspect, supervise, and manage vocational training funding according to assigned functions and tasks.

5. Institutions participating in vocational training for rural labor:

- Develop detailed plans for vocational training for rural labor in accordance with the guidance of the Department of Labor, Invalids, and Social Affairs;

- Develop a detailed plan for vocational training for rural laborers in accordance with the guidelines of the Department of Labor - Invalids and Social Affairs;

- Implement vocational training correctly for the intended recipients and in accordance with the assigned content and plan;

- Utilize funds for their intended purposes effectively, without loss; be responsible for the use and settlement of the assigned funds;

- Report on the implementation results in accordance with regulations.

6. This Circular shall take effect fifteen days from the date of publication in the Official Gazette. Any difficulties encountered during implementation should be reported to the relevant ministries for consideration and resolution./.
