Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Handling Administrative Offenses dated June 20, 2012;
At the proposal of the Minister of Justice;
At the proposal of Decree amending and supplementing certain articles of decrees on administrative penalties in areas under state management related to acts of posting, broadcasting, providing, disseminating, and publishing false information
Article 1. Supplement Clause 6 to Article 2 of Government Decree No. 79/2013/NĐ-CP dated July 19, 2013, on administrative penalties in the field of statistics as follows:
"6. The provisions of Clause 3, Article 14 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Government Decree No. 159/2013/NĐ-CP dated November 12, 2013, on administrative penalties in the field of journalism and publishing."
Article 2. Supplement Clause 3 to Article 1 of Government Decree No. 107/2013/NĐ-CP dated September 20, 2013, on administrative penalties in the field of atomic energy as follows:
"3. The provisions of Point c, Clause 1, Article 38 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Government Decree No. 159/2013/NĐ-CP dated November 12, 2013, on administrative penalties in the field of journalism and publishing."
Article 3. Supplement Clause 4 to Article 2 of Government Decree No. 109/2013/NĐ-CP dated September 24, 2013, on administrative penalties in the field of price, fee, tax, and invoice management as follows:
"4. The provisions of Clause 1, Article 14 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Government Decree No. 159/2013/NĐ-CP dated November 12, 2013, on administrative penalties in the field of journalism and publishing."
Article 4. Supplement Clause 3 to Article 2 of Government Decree No. 138/2013/NĐ-CP dated October 22, 2013, on administrative penalties in the field of education as follows:
"3. The provisions of Clause 2, Article 13 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Government Decree No. 159/2013/NĐ-CP dated November 12, 2013, on administrative penalties in the field of journalism and publishing."
Article 5. Amending and supplementing Article 2 of Government Decree No. 147/2013/NĐ-CP dated October 30, 2013, on administrative penalties in the field of civil aviation
"Article 2. Subjects subject to administrative penalties in the field of civil aviation Individuals and organizations from Vietnam and foreign individuals and organizations who commit administrative violations in the field of civil aviation within the territory of Vietnam, on aircraft registered with Vietnamese nationality, and in airspaces managed by Vietnam. The provisions of Point d, Clause 4, and Point b, Clause 7, Article 24 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Government Decree No. 159/2013/NĐ-CP dated November 12, 2013, on administrative penalties in the field of journalism and publishing."
Article 6. Supplement Clause 3 to Article 2 of Decree No. 148/2013/NĐ-CP dated October 30, 2013 of the Government on administrative penalties in the vocational training sector as follows:
"3. The provisions at Point b, Clause 5, Article 18 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Decree No. 159/2013/NĐ-CP dated November 12, 2013 of the Government on administrative penalties in the press and publication activities."
Article 7. Amend and supplement Article 2 of Decree No. 173/2013/NĐ-CP dated November 13, 2013 of the Government on administrative penalties in the meteorology, hydrology, surveying, and cartography sector as follows:
"Article 2. Scope of Application Organizations and individuals from Vietnam, organizations and individuals from foreign countries who commit administrative violations in the meteorology, hydrology, surveying, and cartography sector; persons authorized to issue administrative violation records and impose administrative penalties; other related organizations and individuals. The provisions at Point b, Clause 2, Article 6 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Decree No. 159/2013/NĐ-CP dated November 12, 2013 of the Government on administrative penalties in the press and publication activities."
Article 8. Supplement Clause 3 to Article 2 of Decree No. 176/2013/NB-CP dated November 14, 2013 of the Government on administrative penalties in the health sector as follows:
"3. The provisions at Point a, Clause 2, Article 5, Point a, Clause 2, Article 17, and Point b, Clause 2, Article 81 of this Decree shall not be applied to impose administrative penalties on press agencies. Administrative penalties against press agencies shall be carried out in accordance with Article 8 of Decree No. 159/2013/NĐ-CP dated November 12, 2013 of the Government on administrative penalties in the press and publication activities."
Article 9. Implementation Provisions
1. This Decree takes effect from October 1, 2015.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the central government, and related organizations and individuals are responsible for implementing this Decree.
