CIRCULAR

REGULATIONS ON CONTENT OF TRAINING, EXAMINATION, ISSUANCE AND RECOGNITION OF CERTIFICATES FOR INSURANCE SUPPORT

Pursuant to the Insurance Business Law No. 24/2000/QH10 dated December 9, 2000;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Insurance Business Law No. 61/2010/QH12 dated November 24, 2010;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Insurance Business Law and the Intellectual Property Law No. 42/2019/QH14 dated June 14, 2019;

Pursuant to the Government Decree No. 73/2016/NĐ-CP dated July 1, 2016 detailing the implementation of the Insurance Business Law and the Law Amending and Supplementing Certain Provisions of the Insurance Business Law;

Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Insurance Management and Supervision Department,

The Minister of Finance issues this Circular on the content of training, examination, issuance and recognition of certificates for insurance support.

Chapter I:

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular stipulates the content of training, examination, issuance of certificates for insurance support for domestic training institutions; it also stipulates the recognition of certificates for insurance support issued by foreign training institutions.

2. This Circular does not regulate the training, examination, issuance and recognition of actuarial certificates.

Article 2. Applicability

The objects subject to this Circular include:

1. The Insurance Management and Supervision Department (Ministry of Finance); the Insurance Research and Training Center (under the Insurance Management and Supervision Department).

2. Domestic training institutions established and operating legally in Vietnam with functions of training in insurance (hereinafter referred to as training institutions).

3. Individuals taking the examination for certificates for insurance support (hereinafter referred to as candidates).

4. Individuals holding certificates for insurance support issued by foreign training institutions who request recognition in Vietnam.

Organizations and individuals related to the training, organization of examinations, issuance and recognition of certificates for insurance support.

Chapter II

CONTENT OF TRAINING, EXAMINATION, ISSUANCE OF CERTIFICATES FOR INSURANCE SUPPORT FOR DOMESTIC TRAINING INSTITUTIONS

Article 3. Types of certificates for insurance support

1. Certificate for insurance support stipulated in this Circular includes:

aa) Insurance advisory certificate.

bb) Insurance risk assessment certificate.

c) Insurance loss appraisal certificate..

d) Insurance claim settlement support certificate..

2. The certificates specified in point a, b, For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%; Clause 1 Article hereof shall be detailed according to life insurance, health non-life insurance, health health insurance.

3. The certificate specified in point specialized agency under the People's Committee of the province/city. Clause 1 Article hereof shall be detailed according to: Non-life insurance (excluding marine insurance, aviation insurance); marine insurance; aviation insurance.

Article 4. Training for certificates for insurance support

1. Forms of training:

a) Training at training institutions.

b) Self-study.

2. Content of training for certificates for insurance support includes:

a) Common knowledge section:

- Legal provisions of Vietnam on insurance business;

- Basic principles of insurance.

b) Specialized knowledge section:

- For the insurance advisory certificate: Knowledge about the insured object; knowledge about insurance conditions and terms; procedures for advising on insurance programs, products, risk management, and loss prevention.

- For the insurance risk assessment certificate: Knowledge about the insured object; knowledge about risk management; procedures for assessing risks.

- For the insurance loss appraisal certificate: Knowledge about the insured object; knowledge about insurance conditions and terms; procedures for appraising insurance losses.

- For the insurance claim settlement support certificate: Knowledge about the insured object; knowledge about insurance conditions and terms; procedures for settling insurance claims.

Article 5. Examination Organization

1. The Insurance Research and Training Center (hereinafter referred to as the Center) is the unit organizing the examination for insurance auxiliary certificates as stipulated in Clause 1, Article 3 of this Circular.

2. Examination format: centralized examination.

3. The organization of examinations for insurance auxiliary certificates shall be conducted monthly. Before December 31 of each year, the Center shall announce on its electronic information website the specific time and location for organizing the examination for insurance auxiliary certificates of the following year.

Article 6. Procedures for Registration to Take the Examination for Insurance Auxiliary Certificates

1. Registration for the examination shall be conducted online on the Center’s electronic information website at the address: https://irt.mof.gov.vn at least ten days before the examination date.

The training institution is responsible for registering candidates who are students of that institution. Independent candidates shall directly register with the Center. The registration dossier for the examination shall comply with the provisions of Clause 2 of this Article.

2. The registration dossier includes:

a) Personal information of the candidate;

b) Name of the examination for insurance auxiliary certificates;

c) Type of insurance auxiliary certificate intended to be registered for the examination;

d) Date and location of the examination;

e) Other relevant information about the examination period.

3. Examination fees:

Candidates are responsible for paying the examination fee. The amount of the examination fee shall be announced by the Center. Candidates registered by the training institution shall pay the examination fee through the institution to the Center, while independent candidates shall pay the examination fee directly to the Center.

4. Three working days prior to the examination date, the Center shall announce the list of candidates participating in the examination on its electronic information website (for cases where all required documents and examination fees have been submitted). Article 7. Examination Question Preparation

1. The examination questions for insurance auxiliary certificates shall be in multiple-choice format. Each examination consists of a general knowledge section and a specialized knowledge section. Questions related to the general knowledge section account for 40% of the total number of questions, while those related to the specialized knowledge section account for 60%.

2. The examination questions for insurance auxiliary certificates shall be drawn from the question bank established by the Insurance Supervision and Management Department. The question bank shall be developed according to the types of insurance auxiliary certificates specified in Article 3 of this Circular and based on the training content stipulated in Clause 2, Article 4 of this Circular.

Article 8. Announcement of Examination Results

1. Based on the examination results, the Center is responsible for approving the examination results for insurance auxiliary certificates. Candidates achieving 70% or more of the total score of the examination will be considered to have passed the examination for insurance auxiliary certificates. The Center shall issue a Decision approving the examination results in accordance with the model prescribed in Appendix 1 attached to this Circular.

2. Within five working days from the end of the examination period, the examination results shall be announced on the Center's electronic information website and the electronic information website of the Insurance Supervision and Management Department.

Article 9. Issuance of Insurance Auxiliary Certificates

1. Based on the Decision approving the examination results for insurance auxiliary certificates issued by the Center:

a) The training institution shall issue the insurance auxiliary certificate to candidates who have passed the examination and are students of that institution.

b) The Center shall issue the insurance auxiliary certificate to independent candidates who have passed the examination.

2. The issuance of certificates shall be carried out within ten days from the effective date of the Decision approving the examination results.

3. The model of the insurance auxiliary certificate is prescribed in Appendix 2 attached to this Circular.

Article 3. The model of the insurance auxiliary certificate is specified in Appendix 2 attached to this Circular.

Article 10. Review and handling of review results

1. Candidates taking the examination have the right to request a review of their examination scores. The review request form must be submitted to the Center according to the model specified in Appendix 3 issued together with this Circular within twenty days from the date of the official announcement of examination results on the Center's electronic website.

2. The Center will conduct the review marking and issue a written response regarding the review results to the candidate within five working days from the date of receipt of the candidate’s review request.

3. Based on the review results, the Center shall approve adjustments to the examination results for the insurance auxiliary certificate (if applicable). Training institutions and the Center shall issue the insurance auxiliary certificate in accordance with Article 9 of this Circular or revoke the insurance auxiliary certificate in accordance with Article 11 of this Circular.

Article 11. Revocation and issuance of replacement certificates for insurance auxiliary certificates

1. Training institutions and the Center shall carry out the revocation and issuance of replacement certificates for insurance auxiliary certificates that they have issued in cases stipulated in Clause 2 of this Article.

2. Cases where the insurance auxiliary certificate is revoked or replaced:

a) The insurance auxiliary certificate is invalid and shall be revoked in the following cases:

- An individual who has been granted the certificate but did not participate in the insurance auxiliary certificate examination organized by the Center as prescribed in this Circular or did not pass the examination;

- An individual who has been granted the certificate has falsified or misrepresented information as required at point a, Clause 2, Article 6 of this Circular;

- An individual who has been granted the certificate had someone else take the examination on their behalf;

- The review result of the candidate's examination does not meet the passing score as prescribed in this Circular;

- An individual who has been granted the certificate has provided the certificate to another person for use.

b) An individual whose insurance auxiliary certificate has been revoked in accordance with point a, Clause 2, Article 11 of this Circular (except for revocation due to review results) shall not be eligible to sit for examinations on insurance auxiliary certificates for a period of twelve months from the date of the Decision revoking the certificate.

c) The insurance auxiliary certificate shall be replaced if there is an error or mistake in any of the personal information of the certificate holder:

- Last name/Middle name/First name;

- Date of birth;

- Citizen Identification Card number/Identity Card number/Passport number;

- Issuance date and place of the Citizen Identification Card/Identity Card/Passport.

3. The issuing entity shall carry out the revocation of the issued insurance auxiliary certificate according to the Decision revoking the insurance auxiliary certificate. The model of the Decision revoking the insurance auxiliary certificate is specified in Appendix 4 issued together with this Circular.

4. Within ten days from the date of the Decision revoking the certificate, the issuing entity shall be responsible for announcing the list of invalid and revoked insurance auxiliary certificates on its electronic information website and notify the Center. Information about the invalid and revoked certificates shall be publicly posted on the Center's electronic information website and the Insurance Supervision and Management Bureau's electronic information website.

Chapter III

RECOGNITION OF INSURANCE AUXILIARY CERTIFICATES ISSUED BY FOREIGN TRAINING INSTITUTIONS

Article 12. Principles for Recognizing Insurance Support Certificates Issued by Foreign Training Institutions

Individuals holding insurance support certificates issued by foreign training institutions to be recognized in Vietnam must meet the following requirements:

1. Possess an insurance support certificate:

a) A certificate issued by a training institution after the individual has passed an examination organized by the insurance regulatory authority of a foreign country or a unit established by the state agency to organize such examinations; or

b) A certificate issued by international insurance training organizations: The Australian and New Zealand Institute of Insurance and Finance (ANZIIF), The Chartered Insurance Institute (CII), The Canadian Institute of Actuaries (CIA), The Institute of Risk Management (IRM), The Risk Management Institute Australia (RMIA), The Chartered Institute of Loss Adjusters (CILA), The Australian Institute of Loss Adjusters (AICLA), Lloyd's Maritime Academy; or

c) A certificate issued by training organizations from countries that have mutual recognition agreements on insurance support certificates with Vietnam.

2. The content of the insurance support certificate training program provided by foreign training institutions must correspond to each type of insurance support certificate proposed for recognition in Vietnam.

3. The application dossier for recognizing insurance support certificates as stipulated in Clause 2 of Article 13 of this Circular.

Article 13. Procedures for Recognizing Insurance Support Certificates Issued by Foreign Training Institutions

1. Individuals holding insurance support certificates issued by foreign training institutions to be recognized in Vietnam must submit one set of the application dossier for recognizing insurance support certificates to the Ministry of Finance (Insurance Supervision and Management Department) in accordance with the provisions of Clause 2 of this Article.

2. The application dossier for recognizing insurance support certificates issued by foreign training institutions includes:

a) An application form for recognizing insurance support certificates issued by foreign training institutions according to the model prescribed in Appendix No. 5 attached to this Circular;

b) One (01) notarized certified translation into Vietnamese of the certificate proposed for recognition;

c) The curriculum framework or list of subjects of the insurance support certificate training program studied at the foreign training institution;

d) Proof that the individual has passed the insurance support certificate examination organized by the insurance regulatory authority of a foreign country or a unit established by the state agency to organize such examinations (for certificates specified in point a, Clause 1 of Article 12 of this Circular); organized by international insurance training organizations specified in point b, Clause 1 of Article 12 of this Circular (for certificates specified in point b, Clause 1 of Article 12 of this Circular); organized by training organizations from countries that have mutual recognition agreements on insurance support certificates with Vietnam (for certificates specified in point c, Clause 1 of Article 12 of this Circular);

đ) A copy of the citizen identification card/residence registration certificate/passport of the person applying for recognition of the insurance support certificate issued by a foreign training institution (certified true copy).

3. Within 14 days from the date of receiving the complete dossier as stipulated in Clause 2 of this Article, the Insurance Supervision and Management Department shall issue a certificate recognizing the insurance support certificate issued by a foreign training institution according to the model prescribed in Appendix No. 6 attached to this Circular. In case of refusal, the Insurance Supervision and Management Department must provide a written explanation of the reasons. The list of individuals holding insurance support certificates issued by foreign training institutions recognized in Vietnam will be publicly announced on the website of the Insurance Supervision and Management Department and the Center.

Chapter IV:

IMPLEMENTATION

Article 14. Responsibilities of the Insurance Management and Supervision Department

1. Issue the Regulations on the Examination for Insurance Support Certificates.

2. Develop the Question Bank for the Examination for Insurance Support Certificates in accordance with this Circular.

3. Inspect and supervise the organization of examinations, issuance, and revocation of Insurance Support Certificates.

4. Recognize Insurance Support Certificates issued by overseas training institutions and publicly announce the list of individuals holding recognized Insurance Support Certificates from overseas training institutions on the electronic information website of the Insurance Management and Supervision Department.

5. Store records of the recognition of Insurance Support Certificates in accordance with the laws on recordkeeping.

Article 15. Responsibilities of the Insurance Research and Training Center

1. Announce the examination time, examination venue, list of candidates participating in the examination, examination results for Insurance Support Certificates, and the list of individuals whose Insurance Support Certificates are invalid and have been revoked on the electronic information website of the Center.

2. Prepare examination questions, organize examinations, and approve examination results for Insurance Support Certificates.

3. Conduct re-examination of examination results for Insurance Support Certificates.

4. Issue and revoke Insurance Support Certificates for independent candidates.

5. Store records related to the organization of examinations, issuance, and revocation of Insurance Support Certificates within the scope of responsibility of the Center in accordance with the laws on recordkeeping.

Article 16. Responsibilities of Training Institutions

1. Training institutions shall conduct training for Insurance Support Certificates in accordance with the content stipulated in Article 4 of this Circular.

2. Register the list of candidates participating in the examination with the Center (for candidates who are students of the training institution).

3. Issue, renew, and revoke Insurance Support Certificates.

4. Announce the list of individuals whose Insurance Support Certificates are invalid and have been revoked on the electronic information website of the training institution.

5. Comply with the regulations on training, examination, issuance, renewal, and revocation of Insurance Support Certificates as stipulated in this Circular. In case of violation of the regulations on issuance, renewal, and revocation of Insurance Support Certificates, the training institution shall not be allowed to issue Insurance Support Certificates.

6. Store records related to the issuance and revocation of Insurance Support Certificates within the scope of responsibility of the training institution in accordance with the laws on recordkeeping.

Article 17. Responsibilities of Candidates Participating in Examinations, Invigilators, and Graders

1. Responsibilities of Candidates Participating in Examinations:

a) Bear responsibility for the completeness, truthfulness, and accuracy of information in the examination application form;

b) Pay the examination fee for Insurance Support Certificates;

c) Adhere to the Regulations on the Examination for Insurance Support Certificates.

2. Responsibilities of Invigilators and Graders: Adhere to the Regulations on the Examination for Insurance Support Certificates.

Article 18. Effectiveness of the Circular

1. This Circular takes effect from November 1, 2019.

2. During implementation, if there are difficulties or obstacles, they are requested to be promptly reported to the Ministry of Finance for consideration and resolution./.
