AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE CIRCULARS OF THE MINISTER OF NATIONAL DEFENSE ON AGE CALCULATION FOR MILITARY SERVICE; ISSUANCE, MANAGEMENT, USE OF ID CARDS AND CARDS; SELECTION AND RECRUITMENT OF PROFESSIONAL SOLDIERS, DEFENSE WORKERS AND DEFENSE CIVIL SERVANTS; PROMOTION, RANK ADVANCEMENT, DEMOTION, APPOINTMENT, REMOVAL FROM OFFICE, AND IMPLEMENTATION OF DISCHARGE FOR NON-COMMISSIONED OFFICERS AND SOLDIERS; FORMS, CONTENT, AND TIMES OF ACTIVITIES OF RESERVE SOLDIERS

On the basis of Law on Military Service dated June 19, 2015;

On the basis of Law on Officers of the Vietnam People's Army dated December 21, 1999; amended and supplemented on June 3, 2008, November 27, 2014, November 28, 2024;

On the basis of Law on Professional Soldiers, Defense Workers, and Defense Civil Servants dated December 8, 2015;

On the basis of Law on Reserve Mobilization Forces dated November 26, 2019;

On the basis of Law Amending and Supplementing Certain Provisions of 11 Laws on Military Affairs and National Defense dated June 27, 2025;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing certain provisions of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Chief of General Staff;

The Minister of National Defense issues this Circular amending and supplementing certain articles of the Circulars of the Minister of National Defense on age calculation for military service; issuance, management, use of ID cards and cards; selection and recruitment of professional soldiers, defense workers, and defense civil servants; promotion, rank advancement, demotion, appointment, removal from office, and implementation of discharge for non-commissioned officers and soldiers; forms, content, and times of activities of reserve soldiers.

Article 1. Amend and supplement certain articles of Circular No. 18/2012/TT-BQP dated February 29, 2012 of the Minister of National Defense stipulating age calculation for military service in the Vietnam People's Army

1. Amend and supplement Point c Clause 2 Article 7 as follows:

“c) In cases where military personnel have transferred out of the military and no longer retain relevant documents related to their time of active service, the application for confirmation of military age must include one of the following certificates:

- A copy of the decision on discharge, retirement, transfer, or resignation, or a certificate of time served in the military before leaving active service;

- A work history statement in the military with confirmation by the People's Committee of the commune, ward, special zone, and the Regional Defense Command regarding the time of enlistment, discharge, retirement, or transfer.”

2. Amend and supplement Clause 4 of Article 8 as follows:

“4. The Commander of the Regional Defense Command shall confirm the military age for military personnel who have transferred out of the military and reside permanently in the locality under his/her jurisdiction based on the file specified in Clause 2 Article 7 of this Circular.”

Article 2. Amend and supplement certain articles of Circular No. 218/2016/TT-BQP dated December 27, 2016 of the Minister of National Defense stipulating the issuance, management, and use of Officer ID Cards; Professional Soldier, Worker, and Civil Servant ID Cards; Non-Commissioned Officer and Soldier Cards during active service; Reserve Officer Cards; Reserve Professional Soldier and Non-Commissioned Officer and Soldier Cards

1. Amend and supplement Point c Clause 1 Article 8 as follows:

“c) Data printed on Reserve Professional Soldier and Non-Commissioned Officer and Soldier Cards is managed by the provincial military authority.”

2. Amend and supplement Point đ Clause 6 Article 10 as follows:

“đ) The Regional Defense Command specified in Point b Clause 1 Article 24 of this Circular shall recover and cancel Reserve Professional Soldier and Non-Commissioned Officer and Soldier Cards; compile and report the results to the provincial military authority.”

3. Amend and supplement Clause 5 Article 12 as follows:

“5. The Commander of the Regional Defense Command shall issue Reserve Professional Soldier and Non-Commissioned Officer and Soldier Cards after receiving the decision of the Commander of the Hanoi Military Command, the Commander of the Ho Chi Minh City Military Command, or the Commander of the Provincial Military Command.”

4. Amend and supplement certain points of Article 17 as follows:

a) Amend and supplement Points c and d Clause 2 as follows:

“c) Place of origin: Record commune, ward, special zone (hereinafter referred to collectively as commune level); province, centrally governed city (hereinafter referred to collectively as province level);

d) Place of permanent residence: Is the place registered as permanent residence of the officer; if not registered as permanent residence, record according to the place of permanent residence of spouse, children, parents, or legal guardian.”

b) Amend and supplement point b of Clause 4 as follows:

“b) Place of permanent residence: Is the place of permanent residence of the reserve officer;”

c) Amend and supplement Point h Clause 4 as follows:

“h) Initial registration: Record the name of the Military Command of the commune.”

5. Amend and supplement certain points of Article 21 as follows:

a) Amend and supplement Points a and b Clause 2 as follows:

“a) Place of origin: Record commune level, province level;

b) Place of permanent residence: Is the place registered as permanent residence of the professional soldier, worker, and civil servant; if not registered as permanent residence, record according to the place of permanent residence of spouse, children, parents, or legal guardian.”

b) Amend and supplement Points b and c Clause 4 as follows:

“b) Place of origin: Record commune level, province level;

c) Place of permanent residence: Record the place of permanent residence of the non-commissioned officer and soldier during active service.”

6. Amend and supplement certain points and clauses of Article 24 as follows:

a) Amending and supplementing Point b Clause 1 as follows:

“b) The Regional Defense Command shall take photos, compare declarations, process the issuance of Reserve Professional Soldier and Non-Commissioned Officer and Soldier Cards within its jurisdiction; report to the authorized person specified in Clause 5 Article 12 of this Circular; laminate, return to the unit; compile and report to the Provincial Military Command; the processing period shall not exceed 10 working days from the date of completing the procedures;”

b) Amend and supplement Clause 2 as follows:

“2. Replacement and reissue of Reserve Professional Soldier and Non-Commissioned Officer and Soldier Cards

a) In cases of replacement as stipulated in Point a Clause 2 Article 23 of this Circular, individuals fill out the declaration form according to the model and submit it to the Regional Defense Command specified in Point b Clause 1 of this Article;

b) In cases of replacement and reissue as stipulated in Points c and b Clause 2 Article 23 of this Circular, individuals submit a request for replacement and reissue, with confirmation from the head of the directly managing unit, fill out the declaration form according to the model, and submit it to the Regional Defense Command specified in Point b Clause 1 of this Article;

c) The Command Board for Defense of the Area shall follow the procedures and formalities for issuing, replacing, and reissuing as prescribed in point b, clause 1 of this Article.

7. Amend and supplement some points of Article 25 as follows:

a) Amend and supplement point a, Clause 1 as follows:

“a) Number: Consists of 13 digits managed by the provincial military authority;"

b) Amend and supplement point d and point e of clause 2 as follows:

“d) Place of permanent residence: Record the place of permanent registration of reserve professional soldiers;

e) Citizen Identity Card number or Citizen Identity Card number.”

c) Amend and supplement point a of clause 3 as follows:

“a) Number: Consists of 13 digits managed by the provincial military authority;"

d) Amend and supplement point d and point e of clause 4 as follows:

“d) Place of permanent residence: Record the place of permanent residence of reserve non-commissioned officers and soldiers;

e) Citizen Identity Card number or Citizen Identity Card number.”

8. Amend and supplement point d of clause 1 of Article 26 as follows:

“d) The Military Health Department under the General Logistics and Technical Department shall direct the military health agencies to provide blood group results to be recorded on Officer Identification Cards, Professional Soldier Identification Cards, Civilian Worker and National Defense Employee Identification Cards; Non-commissioned Officer and Soldier Identification Cards at service;"

9. Replace Model 3a, Model 3b, and Model 3c issued pursuant to Circular No. 218/2016/TT-BQP with Model 3a, Model 3b, and Model 3c in Appendix I accompanying this Circular.

Article 3. Amend and supplement some articles of Circular No. 241/2017/TT-BQP dated September 29, 2017, issued by the Minister of National Defense regarding the selection and recruitment of professional soldiers, civilian workers, and national defense employees

1. Amend and supplement some points and clauses of Article 8 as follows:

a) Amend and supplement point a and point b, Clause 1 as follows:

“a) Political quality and morality shall be implemented according to the provisions of Circular No. 05/2019/TT-BQP dated January 16, 2019, issued by the Minister of National Defense stipulating the political standards of officers, professional soldiers, civilian workers, and national defense employees in the Vietnam People's Army; Article 10 of Circular No. 263/2013/TT-BQP dated December 31, 2013, issued by the Minister of National Defense stipulating about units and positions of importance and confidentiality within the Vietnam People's Army, and having the ability and responsibility to complete assigned tasks, ready to fight and sacrifice to protect the Party, State, People, and socialist regime, national independence, sovereignty, territorial integrity, and national security.

b) Health:

Meeting the health standard types 1, 2, and 3 as prescribed in Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense stipulating health standards and health examinations for subjects under the management of the Ministry of National Defense.”

b) Amend and supplement Clause 2 as follows:

“2. Do not select professional soldiers, civilian workers, and national defense employees for persons falling under any of the cases prescribed in Article 8 of Circular No. 05/2019/TT-BQP; Article 11 of Circular No. 263/2013/TT-BQP.”

2. Amend and supplement Clause 8 of Article 11 as follows:

“8. Select and transfer to serve under the professional soldier reserve system for non-commissioned officers and soldiers currently serving in the reserve ranks of the Army, organized by the Command Board for Defense of the Area in coordination with the Military Committee of the commune and the mobilization reserve unit, following the provisions of clauses 1, 2, 3, and clause 4 of this Article.”

3. Amend and supplement point a and point b of clause 2 of Article 15 as follows:

“a) Persons falling under any of the cases prescribed in Article 8 of Circular No. 05/2019/TT-BQP; Article 11 of Circular No. 263/2013/TT-BQP.

b) Not meeting the health standards as prescribed in Circular No. 105/2023/TT-BQP.”

4. Amend and supplement point b of clause 1 of Article 17 as follows:

“b) A self-written resume form Model 3 attached to this Circular, confirmed by the People's Committee of the commune, ward, or special zone where the person resides permanently within thirty days from the date of submission of the application file as prescribed.”

5. Replace Model 03 Appendix issued together with Circular No. 241/2017/TT-BQP with Model 03 Appendix II issued together with this Circular.

Article 4. Amending and supplementing some articles of Circular No. 07/2016/TT-BQP dated January 26, 2016, issued by the Minister of National Defense, stipulating the conferring, promotion, demotion of military ranks; appointment to positions, demotion, removal from positions; equivalent positions and highest military rank corresponding to the positions of non-commissioned officers and soldiers of the Vietnam People's Army.

1. Amending and supplementing some points of Article 5 as follows:

a) Amending and supplementing Point b Clause 1 as follows:

“b) The Commandant of the Defense Mobilization Committee decides to confer the rank of Private Second Class for citizens registered to serve in the reserve cadre of the Vietnam People's Army who have been assigned and appointed to reserve mobilization units.”

b) Amend and supplement Point a of Clause 4 as follows:

“a) The Commandant of the Defense Mobilization Committee decides to promote or demote the military rank up to Corporal for non-commissioned officers and soldiers registered to serve in the reserve cadre of the Vietnam People's Army who have been assigned and appointed to reserve mobilization units.”

2. Amending and supplementing point a of Clause 2, Article 9 as follows:

“a) The Commandant of the Defense Mobilization Committee decides to appoint positions, demote, or remove from positions of Platoon Leaders and equivalent positions for non-commissioned officers and soldiers in the reserve who have been registered to serve in the reserve cadre and have been assigned and appointed to reserve mobilization units;”

3. Amending and supplementing point a and point c of Clause 2, Article 13 as follows:

a) Amend and supplement Point a Clause 2 as follows:

“a) The Commandant of the Military Command of the province, the Commandant of the Defense Mobilization Committee, and the Commandant of the Village Defense Mobilization Committee within their respective jurisdictions shall take the lead and coordinate with receiving units, units under various Ministries and sectors responsible for building specialized reserve units with reservists registered for military service at the local level (if any) to organize the implementation of conferring, promoting, and demoting military ranks and appointing positions, demoting, and removing from positions for non-commissioned officers and soldiers in the reserve according to the provisions of this Circular;”

b) Amend and supplement Point c Clause 2 as follows:

“c) Decisions on conferring, promoting, and demoting military ranks and appointing positions, demoting, and removing from positions must be notified to receiving units and units under various Ministries and sectors; simultaneously, authorizing the Village Military Command or the Military Command of agencies and units under various Ministries and sectors to announce before the reserve mobilization unit or invite reservists with decisions to the Military Command office to hand over the decision; supplementing into files to ensure the benefits enjoyed by reservists according to current regulations.”

Article 5. Amending and supplementing some articles of Circular No. 279/2017/TT-BQP dated October 31, 2017, issued by the Minister of National Defense, stipulating the implementation of discharge from active duty for non-commissioned officers and soldiers serving in the Vietnam People's Army.

1. Amending and supplementing points a, b, and c of Clause 3, Article 4 as follows:

“a) The Health Assessment Board at division level and above or the Medical Examination Board with authority concludes that they do not meet the health standards for active service as prescribed in Circular No. 105/2023/TT-BQP dated December 6, 2023, issued by the Minister of National Defense, stipulating health standards and medical examinations for subjects under the management of the Ministry of National Defense.”

b) The People's Committee of the commune confirms that the family has difficult circumstances falling under the category of temporary deferment from conscription as prescribed in point b, c of Clause 1, Article 41 of the Law on Military Service 2015, as follows:

- Being the only laborer directly supporting dependent relatives who are unable to work or have not reached working age; in families severely affected by casualties and property damage due to accidents, natural disasters, or dangerous epidemics recognized by the People's Committee of the commune;

- A child of a disabled veteran or a person suffering from Agent Orange with reduced working capacity between 61% and 80%.

c) The People's Committee of the commune confirms that the family has difficult circumstances falling under the category of exemption from conscription as prescribed in point a, b, c of Clause 2, Article 41 of the Law on Military Service 2015, as follows:

- A child of a烈士牺牲者;

- One brother or sister of a烈士牺牲者;

- A child of a二等残疾军人;一个因接触橙剂而致残,劳动能力降低至81%及以上的人的孩子。

2. Amend and supplement some points and clauses of Article 5 as follows:

a) Amend and supplement Point đ Clause 1 as follows:

“d) Discharge decision: five copies (the unit handling discharge retains one copy; the financial department of the unit handling discharge retains one copy; the Defense Mobilization Committee of the area where the non-commissioned officer or soldier is discharged retains one copy; the non-commissioned officer or soldier retains two copies, one of which is used to submit to the vocational training institution where the non-commissioned officer or soldier will study).”

b) Amend and supplement Clause 2 as follows:

“2. In cases of discharge before the term, the file includes:

a) Non-commissioned officers and soldiers who have served in active duty for at least one month, if they do not meet the conditions for active duty, then the discharge procedures shall be carried out according to the provisions of Clause 1 of this Article (the discharge decision clearly states the reason for discharge) and accompanied by one of the following documents:

- The health assessment report of the Health Assessment Board at division level and above or the medical examination report of the Medical Examination Board with authority concluding that they do not meet the health standards for active duty as prescribed in point a of Clause 3, Article 4 of this Circular.

- A certificate from the People's Committee of the commune confirming that the family has difficult circumstances as prescribed in point b, c of Clause 3, Article 4 of this Circular.

- A document from the competent authority concluding that they do not meet the political standards as prescribed in point d of Clause 3, Article 4 of this Circular.”

b) Non-commissioned officers and soldiers who have served in active duty for less than one month, if they do not meet the conditions for active duty, the commander of the unit at brigade level and above shall notify in writing and specify the reasons why they do not meet the conditions for active duty, accompanied by the enlistment file returned to the Defense Mobilization Committee of the area where the recruitment took place according to regulations.”

3. Amending and supplementing Clause 4, Article 6 as follows:

“4. Within twelve months from the date of issuing the decision for non-commissioned officers and soldiers to return to their home areas, if individuals are accepted to work at state agencies, organizations, economic entities belonging to various forms of ownership and express a willingness to apply for transfer procedures to the place of acceptance for employment, then the Commandant of the Defense Mobilization Committee shall consider and handle according to regulations.”

4. Amending and supplementing Clauses 1, 2, 3, and 4, Article 7 as follows:

“1. The commander of the unit at brigade level and above is responsible for:

a) Implement the discharge process for each non-commissioned officer and soldier under their jurisdiction; organize a farewell meeting before discharge; organize a send-off ceremony and escort the non-commissioned officers and soldiers to hand them over to the Local Defense Command Board where they will return to their place of origin according to regulations.

b) Notify the non-commissioned officers and soldiers and the Local Defense Command Board or agency, organization where the non-commissioned officers and soldiers will return to their place of origin at least thirty days prior to discharge.

2. Relevant agencies and units according to their functions and tasks shall be responsible for assisting the unit commander in completing all procedures, files, benefits, and policies for non-commissioned officers and soldiers before discharge; prepare a list of discharged non-commissioned officers and soldiers to send to the Local Defense Command Board where they will return to for management and registration into the reserve cadre according to the provisions of the Military Service Law 2015.

3. The Local Defense Command Board where the non-commissioned officers and soldiers will return to shall be responsible for organizing the reception of discharged non-commissioned officers and soldiers back to their place of origin and handing them over to the People's Committee of the commune; simultaneously, coordinate with the People's Committee of the commune and relevant agencies and units to resolve benefits and policies according to the provisions of Clause 3, Article 50 of the Military Service Law 2015.

4. The Commander of the Local Defense Command Board where the non-commissioned officers and soldiers will return to shall be responsible for examining and resolving the discharge of non-commissioned officers and soldiers according to the provisions of Clause 4, Article 6 of this Circular."

Article 6. Amend and supplement some articles of Circular No. 84/2020/TT-BQP dated June 30, 2020, issued by the Minister of National Defense, stipulating the form, content, and time of activities of reservists.

1. Amend and supplement Clause 2 and Clause 3 of Article 4 as follows:

"2. The Local Defense Command Board organizes activities for cadre of Group B. In cases where the area is wide or there are many cadres of Group B, organize activities by clusters of communes.

3. The People's Committee of the commune directs the Military Command Board at the same level to organize activities for reservists who have been assigned to reserve mobilization units."

2. Amend and supplement some points and clauses of Article 5 as follows:

a) Amend and supplement Clause 1 as follows:

"1. For cadre of Group B

a) The Local Defense Command Board takes the lead in organizing activities, including: Checking the number of cadre of Group B; informing about political security situations, social order and safety, and socio-economic development of the locality; emphasizing local defense and military tasks and related contents to the construction of reserve forces; evaluating the performance of cadre of Group B in managing their units.

b) Units of the People's Army with quotas to accept reserve military personnel:

After the Regional Defense Command has organized the activity as prescribed in point a of this clause, Category A cadres shall host the activity for Category B cadres under their unit's establishment, including:

- Category A cadres inform about the situation and results of completing tasks in the quarter and the direction of tasks for the next quarter of the unit.

- Category B cadres report the overall situation of the reserve mobilization unit they manage according to Model No. 01 attached to this Circular.

- Category A cadres coordinate with the Regional Defense Command and the Military Command at the commune level to evaluate and assess the results of managing the reserve mobilization unit by Category B cadres.

c) The minutes of the activity shall be recorded by the Regional Defense Command according to Model No. 02 attached to this Circular.

d) Payment of responsibility allowance for Category B cadres:

- After organizing activities as prescribed in Point a and Point b of this clause, the Local Defense Command Board implements the payment of responsibility allowances to cadre of Group B. The issuance of responsibility allowances is carried out according to Model No. 03 and Model No. 04 promulgated together with this Circular.

- Payment of responsibility allowances must be accurate to the target and standards as prescribed and must be confirmed by the competent authority that the task has been completed in the monthly or quarterly unit reserve mobilization situation summary book.

- In cases where cadre of Group B meet the conditions to receive responsibility allowances but do not directly collect them due to valid reasons, they may authorize another person to collect on their behalf; the authorization letter must be confirmed by the People's Committee of the commune where the cadre of Group B reside or the agency or organization where they work, study, or operate; the authorization cannot exceed two consecutive times."

b) Amending and supplementing Point b Clause 2 as follows:

"b) Payment of allowances to reservists assigned to reserve mobilization units:

- After organizing activities as prescribed in Point a of this clause, the Local Defense Command Board organizes the payment of allowances to reservists assigned to reserve mobilization units. The issuance of allowances is carried out according to Model No. 06 promulgated together with this Circular.

- In cases where reservists meet the conditions to receive allowances but do not directly collect them due to valid reasons, they may authorize another person to collect on their behalf; the authorization letter must be confirmed by the People's Committee of the commune where the reservist resides or the agency or organization where they work, study, or operate."

c) Amending and supplementing Clause 3 as follows:

"3. Report on the results of activities and payment of allowances to reservists:

a) The Local Defense Command Board reports to the provincial military office the results of activities and payment of responsibility allowances to cadre of Group B according to Model No. 07 promulgated together with this Circular.

b) The Military Command Board of the commune reports to the Local Defense Command Board the results of activities of reservists assigned to reserve mobilization units according to Model No. 08 promulgated together with this Circular."

3. Amend and supplement Article 6 as follows:

Article 6. Time for Reserve Military Personnel Activities

1. Once every quarter (in the last month of the quarter), the Local Defense Command Board organizes activities for cadre of Group B, with the activity time not exceeding half a day.

2. In December each year, the Military Command Board of the commune organizes activities for reservists assigned to reserve mobilization units, with the activity time not exceeding half a day."

4. Replace Models No. 02, 03, 04, 05, 06, and 07 of the Appendix promulgated along with Circular No. 84/2020/TT-BQP with Models No. 02, 03, 04, 05, 06, and 07 of Appendix III promulgated together with this Circular.

Article 7. Implementation Provisions

1. This Circular takes effect from July 1, 2025.

2. Transitional provisions: Types of Officer Identity Cards; Professional Military Personnel Identity Cards, Workers, and Civil Servants of National Defense; Non-Commissioned Officers and Soldiers' Cards while on duty; Reserve Officer Cards; Professional Military Personnel and Non-Commissioned Officers and Soldiers' Reserve Cards issued before the effective date of this Circular shall continue to be valid until their expiration date; in cases of reissue or replacement after the effective date of this Circular, the provisions of this Circular shall apply.

3. The Deputy Chief of General Staff, Heads of agencies, organizations, units, and individuals concerned are responsible for implementing this Circular./.

- Officer Category B must carry this Booklet and the Summary of the Reserve Mobilization Unit Situation when claiming duty allowance. In case Officer Category B meets the conditions to claim duty allowance but does not directly collect it due to valid reasons, they may authorize another person to collect on their behalf; the authorization letter must be confirmed by the People's Committee of the locality where the Officer Category B resides or the organization where the Officer Category B works, studies, or serves; such authorization shall not exceed two consecutive times.

- When issuing allowances, the person issuing must compare the Appointment Decision with the Responsibility Allowance Ledger of Level B cadres, clearly recording the name and signing in the ledger.
