RESOLUTION

Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;
Pursuant to the Urban and Rural Planning Law No. 47/2025/QH15;
Pursuant to Resolution No. 206/2025/QH15 of the National Assembly on special mechanisms for handling difficulties and obstacles caused by legal provisions;
Pursuant to Resolution No. 76/2025/UBTVQH15 of the Standing Committee of the National Assembly on the reorganization of administrative units in 2025;
At the proposal of the Minister of Construction;
The Government issues this Resolution on regulations for handling difficulties and obstacles regarding the establishment, adjustment, and approval of district planning for areas forming urban zones when implementing the reorganization of administrative units at all levels and organizing local government with two levels.
Article 1. Scope of Regulation
This Resolution stipulates the establishment, adjustment, and approval of district planning when implementing the reorganization of administrative units at all levels and organizing local government with two levels; it applies to areas forming urban zones that play a role in promoting economic and social development of the locality, with a forecasted population within ten years reaching 45,000 people or more for centrally-administered cities; 15,000 people or more for provinces formed after reorganization in mountainous, highland, and border regions; 21,000 people or more for other provinces formed after reorganization.
Article 2. Principles and requirements for establishing, adjusting, and approving district planning
1. District planning for areas forming urban zones may be established anew, adjusted simultaneously with the process of establishing and adjusting provincial planning or overall urban planning, and approved before the approval of provincial planning and overall urban planning.
After approval, the district planning will be updated and integrated into provincial planning and overall urban planning to ensure consistency and synchronization.
2. The content of district planning for areas expected to form urban zones shall comply with the provisions of laws on urban and rural planning and meet the following requirements:
a) Boundaries and area scale for establishing district planning as determined in the decision approving the planning assignment based on a review and determination of the nature, function, role in promoting economic and social development, and the ability to connect technical infrastructure and social infrastructure of the area intended for planning;
b) Compliance with standards and regulations on urban and rural planning and relevant legal provisions.
Article 3. Competence, procedures, and processes for establishing, adjusting, and approving district planning
1. The Provincial People's Committee assigns tasks to subordinate agencies and units to establish planning assignments and district planning.
2. The specialized agency on urban and rural planning at the provincial level organizes the examination of planning assignments and district planning.
3. The Provincial People's Committee considers and approves planning assignments and district planning based on the examination report and dossier submitted by the specialized agency on urban and rural planning at the provincial level.
4. The Provincial People's Committee reports to the Provincial People's Council for decision-making before approval in cases where the establishment of district planning for areas forming urban zones exceeds provincial land use indicators under the Land Law.
5. The Provincial People's Committee reports to the Provincial People's Council for decision-making before organizing the establishment and adjustment in cases where the forecasted population is lower than the level specified in Article 1 of this Resolution.
6. Procedures and processes for soliciting opinions, examining, and approving planning assignments and district planning as stipulated in Clauses 1, 2, and 3 of this Article shall follow the provisions of laws on urban and rural planning.
Article 4. Effective date
2. In cases where a law of the National Assembly is amended, supplemented, or newly issued and becomes effective after the date of this Resolution but before March 1, 2027, the corresponding provisions in this Resolution shall cease to be effective.
2. In cases where laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly are amended, supplemented, or newly issued and come into effect after the date of this Resolution but before March 1, 2027, the corresponding provisions in this Resolution shall cease to be effective.
3. During the period when the provisions of this Resolution are in effect, if the provisions on competence, responsibilities for state management, procedures, and processes in this Resolution differ from related legal documents, they shall be implemented according to the provisions of this Resolution.
Article 5. Responsibilities for Implementation
1. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for enforcing this Resolution.
2. The Ministry of Construction, within its functions and tasks, is responsible for reviewing and proposing amendments and supplements to Point b Clause 1 Article 7 and related contents of the Urban and Rural Planning Law No. 47/2024/QH15 to ensure consistency and synchronization.
3. People's Councils, Committees of People's Councils, representatives of People's Councils, and Vietnam Fatherland Front at all levels, within their tasks and powers, strengthen supervision over the implementation of the establishment, adjustment, and approval of district planning as prescribed in this Resolution.
