Issuing Amendment 1:2015 QCVN 68:2013/BGTVT

National Technical Regulation on Electric Bicycles

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.

The Minister of the Ministry of Transport issues this Circular to amend the National Technical Regulation on Electric Bicycles for the first time in 2015.

Article 1. This Circular amends and supplements the National Technical Regulation on Electric Bicycles, Amendment 1:2015 QCVN 68:2013/BGTVT.

Code: Amendment 1:2015 QCVN 68:2013/BGTVT.

Article 2. This Circular takes effect from April 1, 2016.

Article 3. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Vehicle Inspection Agency, Heads of agencies and units under the Ministry of Transport, relevant organizations and individuals are responsible for implementing this Circular./.

NATIONAL TECHNICAL REGULATION ON ELECTRIC BICYCLES

National Technical Regulation on Electric Bicycles

Foreword

Amendment 1:2015 QCVN 68:2013/BGTVT amends and supplements certain provisions of QCVN 68:2013/BGTVT.

Amendment 1:2015 QCVN 68:2013/BGTVT was developed by the Vietnam Vehicle Inspection Agency, reviewed by the Ministry of Science and Technology, and issued by the Minister of the Ministry of Transport through Circular No. 66/2015/TT-BGTVT dated November 6, 2015.

NATIONAL TECHNICAL REGULATION ON ELECTRIC BICYCLES

National Technical Regulation on Electric Bicycles

1. Supplement and amend Clause 1.3 as follows:

"1.3. Definitions

1.3.1. Electric bicycle - Electric bicycles or E-bikes (hereinafter referred to as the Bicycle): is a two-wheeled bicycle that can be operated by an electric motor or assisted by an electric motor while pedaling, with the maximum motor power not exceeding 250 W, the maximum design speed (when operated by the electric motor) not exceeding 25 km/h, and the gross weight (including battery) not exceeding 40 kg.

1.3.2. Motor-driven bicycle: is a type of bicycle that can be operated solely by an electric motor without the need for pedal operation.

1.3.3. Pedal-assist bicycle: is a type of bicycle that can be operated by pedaling with assistance from an electric motor. When pedaling stops, the electric motor also stops.

2. Supplement Clause 1.4 as follows:

"1.4. Classification Indicators

To visually identify and quickly classify electric bicycles, the following characteristics must be considered:

a) Presence of pedals;

b) The bicycle must be operable by using the pedal mechanism (with a system or structure transmitting force from the pedals to the wheels).

The visual identification and quick classification characteristics mentioned above are only used for identifying and quickly classifying bicycles circulating in the market and on roads; they are not applicable for inspecting and certifying production, assembly, and imported bicycles. Two-wheeled electric vehicles without the characteristics mentioned in points a and b will be classified as electric motorcycles or electric scooters."

3. Supplement Clause 1.5 as follows:

"1.5. Referenced Documents

- QCVN 75:2014/BGTVT - National Technical Regulation on motors used for electric bicycles.

- QCVN 76:2014/BGTVT - National Technical Regulation on batteries used for electric bicycles."

4. Supplement Clause 2.1.1.7 as follows:

"2.1.1.7. Seating and footrests for passengers must be securely and comfortably installed. The available length of the saddle for each seating position must be at least 200 mm and not more than 350 mm. The center of the driver's seating position (point H) must be located behind the vertical plane passing through the middle axis (pedal shaft) of the bicycle (plane F).

Point H is determined through LH as follows:

+ LH = 1/2 LRe for bicycles with detachable saddles (illustrated in Figure 1 a);

+ LH = 1/4 LRe for bicycles with integrated saddles (illustrated in Figure 1 b).

Where LH is the distance from the front end of the saddle to point H. Lv is the available length of the saddle.

5. Supplement Clause 2.1.1.8 as follows:

"2.1.1.8. The frame must meet the following requirements:

- It must be sturdy, free of cracks, and coated with paint that adheres firmly without blistering or peeling off;

- The frame must have a chassis number. The chassis number must be placed in a visible and hard-to-damage location; the characters of the chassis number must be clear and not altered or erased; the content of the chassis number must comply with the manufacturer's regulations."

6. Supplement and amend Clause 2.1.3 as follows:

"2.1.3. Electric motor of the bicycle

2.1.3.1. The motor used on the bicycle must comply with the requirements specified in QCVN 75:2014/BGTVT - National Technical Regulation on motors used for electric bicycles (not applicable to imported bicycles).

2.1.3.2. The rated power of the electric motor must match the technical documentation and must not exceed 250 W.

2.1.3.3. The rated voltage of the motor must not exceed 48 V.

2.1.3.4. The surface of the motor must not rust, crack, or peel; the fixing parts must be secure. There must be a motor number, which must be clear and not altered or erased."

7. Amend Clause 2.1.4 as follows:

"2.1.4. The maximum speed of the bicycle when operated by the electric motor must match the technical documentation and must not exceed 25 km/h."

8. Supplement and amend Clause 2.1.8 as follows:

"2.1.8. Battery of the bicycle

2.1.8.1. The battery used on the bicycle must comply with the requirements specified in QCVN 76:2014/BGTVT - National Technical Regulation on batteries used for electric bicycles (not applicable to imported bicycles).

2.1.8.2. The total rated voltage of the battery must not exceed 48 V. The battery voltage must not be less than the rated voltage and must not exceed 15% of the rated voltage.

2.1.8.3. The casing of the battery must not deform or crack, and the battery must be securely mounted on the bicycle."

9. Supplement and amend Subpoint d of Clause 2.1.9.4 as follows:

"d) The product brand, model symbol, manufacturer, and operating voltage must be clearly marked on the control unit."

10. Amend Clause 2.1.11 as follows:

"2.1.11. After traveling 10 km at full load, at the maximum possible speed for motor-driven bicycles, or at the maximum speed but not exceeding 25 km/h for pedal-assist bicycles, the electric control unit of the bicycle must maintain a stable and reliable speed. All components of the bicycle must ensure technical performance and must not show signs of damage, cracking, or breaking. Leakage of battery fluid or lubricant at joints is not allowed."

11. Supplement and amend Section 2.2.1. as follows:

"2.1. The general requirements specified in Section 2.1.1 shall be tested through observation and specialized equipment. The permissible error for size measurements is 30 mm along the length and height, and ± 20 mm along the width.

The frame inspection as stipulated in Section 2.1.1.8 shall be conducted by observation following the road operation test as prescribed in Section 2.2.11."

12. Amend Section 2.2.9.2 as follows:

Replace the phrase "Figure 1" with "Figure 2".

13. Amend Point b of Section 2.2.10 as follows:

"b) Conduct the test:

+ Drive the vehicle at its maximum speed for electric motor-driven vehicles or up to 25 km/h for assisted electric bicycles, using a speed measuring device to determine this speed;

+ Apply both front and rear brakes simultaneously (stop pedaling for assisted electric bicycles). Record the braking distance from the moment the driver applies the brake mechanism until the vehicle comes to a stop.

Conduct three consecutive tests. The test result is the average value of the braking distances from the three tests."

14. Amend Point b of Section 2.2.11 as follows:

"b) Conduct the test:

Drive the vehicle over a distance of 10 km at its maximum speed for electric motor-driven vehicles or up to 25 km/h for assisted electric bicycles."

15. Replace Section 4. as follows:

"4.1. Implementation schedule

4.1.1. For types of vehicles that have been certified before the effective date of this Standard, apply the provisions of Amendment 1:2015 QCVN 68:2013/BGTVT twelve months after the effective date of this Standard.

4.1.2. The identification marks and rapid classification of electric bicycles as specified in Section 1.4 shall be applied fifteen days after the issuance of Amendment 1:2015 QCVN 68:2013/BGTVT.

4.2. Responsibilities

4.2.1. Responsibilities of the Vietnam Motor Vehicle Inspection Center

The Vietnam Motor Vehicle Inspection Center is responsible for organizing and implementing this Standard in quality safety technical inspections for electric bicycles produced, assembled, and imported.

4.2.2. Responsibilities of testing facilities

- Equip all necessary conditions to conduct inspections and tests according to the provisions of this Standard and related legal regulations.

- Conduct inspections and tests and prepare Test Result Reports in accordance with the regulations and bear responsibility for the results of inspections and tests.

4.2.3. Responsibilities of production facilities and importers

- Bear responsibility for the accuracy and honesty of the documents provided to the Vietnam Motor Vehicle Inspection Center.

- Have the responsibility to deliver sample vehicles for testing to the designated testing site.

- Comply with relevant provisions of the Product Quality Law regarding the quality assurance of products and goods produced and imported for circulation in the market."

16. Replace the ANNEX with a new Annex as follows:

: Calculated weight for one person is determined according to the manufacturer's regulations but not less than 65 kg. In case the vehicle has only one seat, the calculated weight for one person is 75 kg.
