DECREE

PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL COMMITTEE

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and Decree No. 101/2020/ND-CP dated August 28, 2020 of the Government amending and supplementing certain articles of Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 05/2011/ND-CP dated January 14, 2011 of the Government on Ethnic Affairs;

At the proposal of the Minister, Head of the Committee for Ethnic Minorities;

The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the National Committee.

Article 1. Position and Functions

The National Committee is a ministerial-level agency under the Government, performing state management functions over ethnic affairs throughout the country; managing state services within its jurisdiction according to the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The National Committee performs the tasks and powers prescribed in Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies; Decree No. 101/2020/ND-CP dated August 28, 2020 of the Government amending and supplementing certain articles of Decree No. 123/2016/ND-CP, and the following specific tasks and powers:

1. Submitting to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, and draft decrees of the Government according to the annual legislative program of the Government and other resolutions, projects, and plans assigned by the Government and the Prime Minister.

2. Submitting to the Government and the Prime Minister for approval long-term, medium-term, and annual development strategies, plans, and important national projects and programs within the National Committee's jurisdiction.

3. Submitting to the Government and the Prime Minister for submission to the National Assembly for issuance of ethnic policies; criteria for identifying ethnic groups, the list of Vietnamese ethnic groups; special policies, programs, projects, and plans for socio-economic development in communes, villages, and hamlets with difficult socio-economic conditions in ethnic minority and mountainous areas, border communes, safe area communes; investment and support policies to stabilize the lives of ethnic minorities; policies and projects to support people in particularly difficult areas; policies and projects for the conservation and development of very small ethnic minority groups and ethnic minorities facing many difficulties with special challenges.

4. Submitting to the Government and the Prime Minister for issuance of policies towards respected individuals among ethnic minorities; coordinating with relevant ministries and sectors to submit to competent authorities for issuance of human resource development policies, attracting and strengthening cadres, civil servants, and public officials working in ethnic minority and mountainous regions; policies to improve literacy, training, and utilization of ethnic minority cadres, special policies for cadres and civil servants in ethnic affairs agencies; policies for ethnic minorities to exercise their right to use their languages, scripts, maintain their ethnic identity, customs, traditions, and culture; investment and development policies for educational institutions to meet the needs of education and training in ethnic minority and mountainous regions.

5. Submitting to the Prime Minister for approval draft decisions, directives, and other documents on ethnic affairs according to the division of labor.

6. Submitting to competent authorities for issuance or issuing within its authority criteria for defining ethnic minority and mountainous regions based on their level of development, lists of communes, villages in ethnic minority and mountainous regions based on their level of development; criteria for identifying ethnic minorities facing many difficulties with special challenges.

7. Issuing circulars, decisions, and directives within the National Committee’s state management jurisdiction; inspecting normative legal documents issued by ministries, provincial People's Councils, and municipal People's Councils directly under the central government related to ethnic affairs; participating in drafting normative legal documents related to ethnic policies according to regulations on issuing normative legal documents and current relevant regulations.

8. Taking the lead in summarizing, concluding, and evaluating the implementation of the Party's guidelines, policies, and state laws related to ethnic affairs, reporting regularly and urgently to the Government and the Prime Minister as prescribed; being the unified focal point for monitoring, consolidating ethnic policies, reviewing, and urging the implementation of ethnic policies in ministries, ministerial-level agencies, government agencies, and localities; proposing competent authorities to issue, amend, and supplement ethnic policies to be consistent with actual circumstances and the requirements and tasks of ethnic affairs work of the Party and State.

9. Cooperating with relevant ministries and agencies in planning and allocating resources for socio-economic development and other resources for ethnic minority and mountainous regions; proposing and participating in the review of programs, projects, plans, and policies related to ethnic minority and mountainous regions according to the law.

10. Directing, guiding, and being responsible for organizing the implementation of normative legal documents, strategies, plans, policies, programs, projects, plans, national target programs, important national works, decisions, and directives already issued or approved within the National Committee’s state management jurisdiction.

11. Directing and guiding the establishment of exemplary models as outstanding collectives and individuals, and respected individuals among ethnic minorities; rewarding according to its authority or proposing competent authorities to reward outstanding collectives and individuals with excellent achievements in labor, production, economic and social development, maintaining security and order, and setting examples in implementing the Party's guidelines and state laws in ethnic minority and mountainous regions.

12. Direct, guide the implementation and inspect the organization of the Provincial and District-level Ethnic Minority Delegates Congresses; organize exchange activities and experience sharing among ethnic minority delegates, reputable individuals among ethnic minorities, and other events related to ethnic work aimed at strengthening the solidarity among ethnic groups in Vietnam.

13. Direct, organize propaganda and mobilize ethnic minority communities to implement Party guidelines, State policies, and laws, promote good customs, traditions of ethnic groups; propagate, disseminate, and educate laws within the scope of management of the National Ethnic Committee; coordinate with relevant ministries and sectors to build and implement projects and programs to strengthen communication work, provide information to ethnic minority and mountainous regions through online broadcasting of ethnic radio and television channels on the Internet; coordinate to implement legal aid policies for ethnic minority communities.

14. Organize and direct scientific research on strategic, fundamental, and urgent issues concerning ethnic minorities and ethnic policies; study theoretical and practical aspects of ethnic work; apply, transfer science and technology, and protect the environment in ethnic minority and mountainous regions; activities implementing the application of information technology and digital transformation; build infrastructure for information sharing and data within the scope of ethnic work under the National Ethnic Committee and outside the Committee.

15. International cooperation in fields under the State management of the National Ethnic Committee as prescribed by law; attract resources to support investment development in ethnic minority and mountainous regions, areas with difficult socio-economic conditions according to law; manage, direct, or participate in implementing programs and projects funded and invested by foreign countries and international organizations in ethnic minority and mountainous regions as prescribed by law.

16. Carry out management tasks for specialized schools and other educational institutions when assigned by competent authorities as prescribed by law.

17. Build statistical indicators and databases on ethnic work within the scope of State management; build a database on ethnic minorities in Vietnam.

18. Conduct surveys, studies, and compile reports on the socio-economic development of ethnic groups, ethnic components, names, customs, and traditions of ethnic minorities, and other issues related to ethnicity.

19. Inspect and check the implementation of policies and laws in the field of ethnic work; resolve complaints, denunciations, and citizen recommendations; prevent and combat corruption and malpractice, and handle violations of law in fields under the State management of the National Ethnic Committee as prescribed by law.

20. Monitor, inspect, and compile reports on the situation in ethnic minority and mountainous regions, the implementation of ethnic work tasks by ministries, ministerial-level agencies, government agencies, and localities; propose and recommend solutions to competent authorities for issues related to ethnic work and ethnic minority communities.

21. Receive, visit, and coordinate with ministries, sectors, and localities to address the wishes of ethnic minority communities according to regulations and policies.

22. Decide and organize the implementation of administrative reform plans, disclose administrative procedures within the scope of ethnic work; carry out other administrative reform tasks as prescribed by law.

23. Manage public services within the scope of ethnic work; implement public services in the field of State management of the National Ethnic Committee as prescribed by law.

24. Manage organizational structure, civil servant quotas, number of staff positions, job titles, cadre training, and incentive policies for cadres, civil servants, staff, and workers under the National Ethnic Committee as prescribed by law.

25. Develop annual budget estimates; coordinate with the Ministry of Planning and Investment and the Ministry of Finance to prepare and consolidate revenue and expenditure budgets by sector and field under its jurisdiction to submit to the Government; manage, organize, and settle the national budget; perform other tasks related to national budget management, finance, and assets as prescribed by law.

26. Perform other tasks and powers delegated by the Government and the Prime Minister and as prescribed by law.

In this Article, units from Clause 1 to Clause 11 assist the Minister, Chairman of the National Ethnic Committee in performing State management functions; units from Clause 12 to Clause 16 are public service establishments serving the State management functions of the National Ethnic Committee.

The Local Ethnic Work Department has branches responsible for areas where their headquarters are located in Dak Lak Province and Can Tho City.

The Minister, Chairman of the National Ethnic Committee shall submit to the Prime Minister for issuance the list of other public service establishments directly subordinate to the National Ethnic Committee as prescribed.

Article 4. Effective date

1. This Decree takes effect from October 1, 2022.

2. This Decree replaces Decree No. 13/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the National Ethnic Committee.

Article 5. Responsibilities for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
