CIRCULAR

Regulations on monitoring the implementation of decisions prohibiting contact as prescribed by the Law on Prevention and Control of Domestic Violence

pursuant to the Law on Prevention and Combating Domestic Violence

Pursuant to the Law on Prevention and Control of Domestic Violence No. 13/2022/QH15 dated November 14, 2022;

Pursuant to the Government Decree No. 76/2023/NĐ-CP dated November 1, 2023 detailing certain provisions of the Law on Prevention and Control of Domestic Violence;

BASED ON DECREE NO. 02/2025/ND-CP DATED FEBRUARY 18, 2025 OF THE GOVERNMENT ON FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF PUBLIC SECURITY;

Pursuant to the Government Decree No. 11/2025/NĐ-CP dated July 1, 2025 amending and supplementing some articles of the Government Decree No. 02/2022/NĐ-CP dated December 28, 2022 detailing certain provisions of the Law on Mobile Police; the Government Decree No. 06/2024/NĐ-CP dated November 15, 2024 on policies for the Security Guard Force and security guard work; the Government Decree No. 02/2025/NĐ-CP dated February 18, 2025 on the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Department of Legal Affairs and Administrative Reform and Justice;

The Minister of Public Security issues this Circular regulating the monitoring of the implementation of decisions prohibiting contact as prescribed by the Law on Prevention and Control of Domestic Violence.

Article 1. Scope of Regulation

This Circular regulates the monitoring of the implementation of decisions prohibiting contact as prescribed at point a, Clause 6, Article 49 of the Law on Prevention and Control of Domestic Violence.

Article 2. Contents to be implemented immediately upon receipt of the Decision Prohibiting Contact

1. Immediately after receiving the Decision Prohibiting Contact from the Chairman of the People's Committee of communes, wards, or special urban areas directly under provincial level (hereinafter referred to collectively as the People's Committee of communes), or the Decision Prohibiting Contact from the People's Court handling or resolving civil cases between the person subjected to domestic violence and the person committing domestic violence, the Head of the Police Station of communes, wards, or special urban areas (hereinafter referred to collectively as the Police Station of communes) must immediately assign someone to carry out the monitoring in the fastest manner possible, contacting the Village Chief, Ward People's Group Leader, and local forces participating in maintaining public security and order to coordinate in carrying out the monitoring during the time of assigning the monitor; simultaneously, within one hour, issue the Decision Assigning the Monitor for Implementing the Decision Prohibiting Contact and the Monitoring Plan as prescribed in Articles 3 and 4 of this Circular.

2. Announce the monitoring through the fastest means of communication (by phone) to the Village Chief, Ward People's Group Leader, and local forces participating in maintaining public security and order of the person being monitored and the person subjected to domestic violence; simultaneously, implement as prescribed in Article 5 of this Circular.

3. The assigned monitor may immediately apply the prohibition contact monitoring measures based on the actual conditions and circumstances.

Article 3. Assignment of Monitors to Implement the Decision Prohibiting Contact

1. The assignment of monitors to implement the Decision Prohibiting Contact shall be carried out as follows:

a) The Police Station of communes shall issue the Decision Assigning the Monitor for Implementing the Decision Prohibiting Contact according to Model No. 01 attached to this Circular after discussing with the Village Chief, Ward People's Group Leader, and related organizations at the grassroots level.

b) Issuing the decision to assign the monitor must be based on the personal background, conditions, and circumstances of the person being monitored; based on the personal background, conditions, circumstances, capacity, and workload of the person assigned to monitor. One person may be assigned to monitor multiple people but not more than three people at the same time.

c) The Decision Assigning the Monitor must be immediately sent directly to the person assigned to monitor, the person being monitored, and the parents of the person being monitored, and a record must be made and kept in the monitoring implementation file.

In case the person being monitored does not comply with receiving the Decision Assigning the Monitor, a record must be made, witnessed by the person assigned to monitor or the parents of the person being monitored, and kept in the monitoring implementation file.

2. The person assigned to monitor must have credibility in the community, good morals, the necessary conditions, and the ability to monitor the implementation of the Decision Prohibiting Contact and perform the task voluntarily, selected from one of the following groups: Ward People's Group Leader, Village Chief, ấp, bản; member of the Organization for Maintaining Public Security and Order at the grassroots level; member of the Vietnam Fatherland Front; member of the Women's Union, Executive Board of the Women's Association at the commune level; member of the Management Board of apartment buildings or collective housing; credible person in the community.

3. During the monitoring process, if the monitor cannot continue to perform the task or fails to complete the assigned task, the Head of the Police Station of communes must promptly assign another person to replace them.

Article 4. Construction, approval, and issuance of the Implementation Supervision Plan

1. The person assigned to supervise shall construct the implementation supervision plan according to Model No. 02 attached to this Circular. During the construction of the plan, the person assigned to supervise shall seek opinions and wishes from the supervised individual and that individual's parents; actively investigate and contact local service providers and relevant agencies and organizations to ensure the appropriateness and feasibility of the plan.

2. The Implementation Supervision Plan includes the following basic contents:

a) Specific measures for supervision aimed at educating and addressing risk factors, causes, and conditions leading to law violations of the supervised individual;

b) Individuals responsible for implementing supervision; agencies, organizations, and individuals responsible for coordination;

c) Start time and end time of supervision;

d) Specific supervision measures requiring guidance and assistance from provincial-level agencies and organizations;

đ) Anticipated situations arising during the implementation of supervision (if any) and anticipated solutions to address them.

3. The Implementation Supervision Plan must be approved by the Chief of the Police Station at the commune level and sent to the supervised individual, the parents of the supervised individual, and related agencies, organizations, and individuals for implementation.

In cases where the supervisor does not have the conditions to continue performing the assigned task or fails to complete the assigned task, the replacement supervisor continues to perform the task according to the Implementation Supervision Plan already approved by the Chief of the Police Station at the commune level.

4. The Implementation Supervision Plan must be kept in the supervision implementation file.

Article 5. Notification of Supervision

1. Within one hour from the decision assigning a supervisor to implement the decision prohibiting contact, the Police Station at the commune level shall convene the supervised individual, invite family members of the supervised individual, invite victims of domestic violence, invite family members of victims of domestic violence, invite the Village Head, Ward People's Group Leader, security forces participating in maintaining public safety and order at the grassroots level in the place of residence of the supervised individual and victims of domestic violence, and invite the supervisor to notify about the implementation of supervision.

2. The content of the notification on the implementation of supervision includes:

a) Announcing the period of supervision according to the Decision Prohibiting Contact;

b) Introducing the supervisor; responsibilities of the supervisor, responsibilities of the Village Head, Ward People's Group Leader, security forces participating in maintaining public safety and order at the grassroots level, and other related organizations;

c) Responsibilities of the family in coordinating with the implementation of supervision;

d) Supervisor's phone number, information and phone number of agencies, organizations, and individuals responsible for coordinating supervision.

3. The notification on the implementation of supervision must be recorded in a protocol and immediately sent to the assigned supervisor, the supervised individual, and the parents of the supervised individual, and kept in the supervision implementation file.

Article 6. Supervision Implementation File

1. The Police Station at the commune level establishes and manages the supervision implementation file for the supervised individual.

2. The supervision implementation file includes:

a) Decision Prohibiting Contact issued by the People's Committee at the commune level or the People's Court, and the Decision Assigning a Supervisor as stipulated in Clause 1, Article 3 of this Circular;

b) The Implementation Supervision Plan approved by the Chief of the Police Station at the commune level;

c) Protocol for transferring the Decision Assigning a Supervisor as stipulated in Point c, Clause 1, Article 3 of this Circular;

d) Protocol for notifying the implementation of supervision as stipulated in Clause 3, Article 5 of this Circular;

đ) Commitment of the supervised individual to comply with the supervision measures as stipulated in Article 8 of this Circular;

e) Protocol for reporting as stipulated in Clause 3, Article 9 of this Circular;

g) Comprehensive report on supervision results submitted to the Chief of the Police Station at the commune level; Report concluding the implementation of supervision;

h) Other related documents (if any).

Article 7. Content and form of supervision

1. Content of supervision:

a) Popularizing and educating the law on the rights and obligations of the person under supervision as prescribed by relevant laws;

b) Informing the person under supervision about their right to education and support for changing violent behavior within the family as stipulated in Article 31 of the Law on Prevention and Control of Domestic Violence and their obligation to perform community service work as stipulated in Article 33 of the Law on Prevention and Control of Domestic Violence;

c) Monitoring the person under supervision's compliance with the decision prohibiting contact issued by the Chairman of the People's Committee at the commune level or the decision prohibiting contact issued by the People's Court currently handling or resolving civil cases.

2. Forms of supervision:

a) Requesting the person under supervision to commit to strictly implementing the decision prohibiting contact and the supervision process;

b) Informing representatives of the family of the person under supervision and representatives of the family affected by domestic violence about their compliance situation;

c) Requesting the person under supervision to appear before the competent authority.

Article 8. Commitment of the person under supervision

1. The person under supervision must make a commitment immediately after being notified about the supervision process as prescribed in Article 5 of this Circular.

2. The content of the commitment includes:

a) Strictly complying with laws, local regulations where they reside, and the decision prohibiting contact; fully performing civic duties; seriously correcting mistakes;

b) Participating in education and support for changing violent behavior within the family provided by the domestic violence prevention and control facility suitable to their conditions and circumstances;

c) Participating in performing community service work decided and organized by the Chairman of the People's Committee at the commune level where the person committing domestic violence resides;

d) Appearing when requested.

3. In cases where the person under supervision is under 18 years old, the commitment of the person under supervision must include the opinion of their parents or guardian.

Article 9. Fulfillment of the duty to appear of the person under supervision

1. During the supervision period, if the person under supervision violates their obligations or shows signs of violating the law, upon the supervisor's request, the Chief of Public Security at the commune level may require the person under supervision to appear.

2. When there is a request for appearance from the Chief of Public Security at the commune level, the supervisor must inform the person under supervision or their guardian about the location and time of appearance.

3. The appearance must be recorded in a protocol and kept in the file.

Article 10. Handling when the person under supervision violates the decision prohibiting contact

1. Upon discovering that a person committing domestic violence has violated the decision prohibiting contact, the assigned supervisor has the right to request such person to strictly implement the decision prohibiting contact; immediately report (by phone) to the Ward People's Group Leader or the nearest Public Security at the commune level, and the force participating in maintaining public security and order at the grassroots level will dispatch personnel to intervene and stop the violation of the decision prohibiting contact; if the violation continues, immediately report to the Public Security at the commune level to conduct inspection, verification, and record the incident.

2. If the person under supervision violates the prohibition on contact as stipulated in Article 19 of Decree No. 76/2023/NĐ-CP dated November 1, 2023 of the Government detailing certain provisions of the Law on Prevention and Control of Domestic Violence, administrative detention measures shall be applied according to the law on handling administrative violations to prevent domestic violence.

3. If the person under supervision violates the prohibition on contact, depending on the nature and severity of the violation, they may be subject to disciplinary action, administrative handling, or criminal prosecution, and if damage is caused, they must compensate according to the law.

Article 11. Termination of supervision

1. When the period of prohibition on contact prescribed in Clause 4, Article 25 or Clause 5, Article 26 of the Law on Prevention and Control of Domestic Violence, or the decision prohibiting contact issued by the Chairman of the People's Committee of the commune or the decision prohibiting contact issued by the People's Court handling or resolving civil cases between the person subjected to domestic violence and the person committing acts of domestic violence expires, the supervisor shall prepare a comprehensive report on the results of supervision and submit it to the Head of the Police Station at the commune level and report on the termination of the supervision implementation.

2. Within two working days from the date of receipt of the comprehensive report on the results of supervision, the Head of the Police Station at the commune level shall issue a notification to the Chairman of the People's Committee of the commune or the People's Court handling or resolving civil cases between the person subjected to domestic violence and the person committing acts of domestic violence regarding the termination of supervision.

Article 12. Responsibilities of the Supervisor

1. Closely coordinate with relevant agencies, organizations, and the family of the supervised person in monitoring the implementation of the decision prohibiting contact.

2. Coordinate with the Police Station at the commune level in organizing the implementation of supervision.

3. Monitor, supervise, and urge the implementation of supervision.

4. Timely notify the Head of the Police Station at the commune level about any manifestations or violations of the law by the supervised person to take appropriate preventive and management measures.

Article 13. Responsibilities of the Family of the Supervised Person

1. Encourage and motivate the supervised person to comply with the law, fulfill their obligations, and commit to rectifying mistakes.

2. Implement specific measures to manage, educate, and assist the supervised person in daily life and work; encourage and create conditions for the supervised person to participate in community movements and activities (if applicable) at their place of residence.

3. Closely coordinate with the People's Committee of the commune, the supervisor, and local organizations and associations to manage and assist the supervised person.

Article 14. Responsibilities of the Police Station at the Commune Level

1. Take the lead and coordinate with the assigned supervisor, Village Chief, Ward Chief, and related organizations at the grassroots level to organize the implementation of supervision.

2. Assign supervisors; organize meetings to announce the implementation of supervision.

3. Coordinate with the family of the supervised person, the supervisor, and other agencies and organizations in managing and assisting the supervised person.

4. Guide and assist the supervised person in completing registration procedures for residence; issuing new, replacing, or reissuing identity cards; monitor absence from the place of residence and changes in the place of residence of the supervised person.

Receive the supervised person who has moved to reside temporarily or permanently from another location during their absence from the place of residence and evaluate their compliance with the law and the implementation of the decision prohibiting contact while residing temporarily or permanently in the locality.

5. Take the lead and coordinate with agencies, organizations, and individuals to handle situations where the supervised person violates the Decision Prohibiting Contact.

6. Establish files for the supervision implementation.

7. When requested, compile data, assess the situation and results of supervision within their authority, and report to competent authorities.

Article 15. Responsibilities of Agencies, Organizations, and Individuals Cooperating in the Implementation of Supervision

1. Assist and provide conditions for the supervised person to fulfill their obligations.

2. Evaluate the compliance and effectiveness of supervision they directly implement for the supervised person and propose solutions (if any) to be consolidated by the supervisor.

Article 16. Implementation expenses

1. Expenses to ensure supervision of the implementation of decisions prohibiting contact include:

a) Expenses for printing and distributing forms in the supervision work;

b) Expenses for purchasing equipment, means, and materials serving printing and using forms.

2. Provincial Public Security Departments and Municipalities directly under the Central Government shall be responsible for ensuring funds for the supervision of the implementation of decisions prohibiting contact. The source of these funds shall be drawn from the regular state budget of the Provincial Public Security Department and Municipalities directly under the Central Government.

Article 17. Effective Date

This Circular takes effect from September 4, 2025.

Article 18. Responsibility for Implementation

1. Heads of units under the Ministry, Directors of Provincial Public Security Departments and Municipalities directly under the Central Government, and Heads of agencies, units, and individuals related to the supervision of the implementation of decisions prohibiting contact within their functional and task scope shall be responsible for organizing the implementation of this Circular.

2. The Legal System Reform and Administrative Justice Bureau shall be responsible for organizing guidance, inspection, and urging strict implementation of this Circular according to its assigned functions and tasks.

3. In the course of implementing this Circular, if there are any difficulties, local public security units shall report to the Ministry of Public Security (through the Legal System Reform and Administrative Justice Bureau) for timely guidance./.
