RESOLUTION

Regulations on reducing and simplifying administrative procedures based on data

                                       

Pursuant to Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Electronic Transactions No. 20/2023/QH15;

Pursuant to the Law on Digital Data No. 60/2024/QH15;

Pursuant to Resolution No. 206/2025/QH15 of the National Assembly on special mechanisms for handling difficulties and obstacles caused by legal provisions;

At the proposal of the Minister of Justice;

The Government issues this Resolution on reducing and simplifying administrative procedures based on data.

Article 1. Scope of Regulation

This Resolution stipulates the replacement or reduction of components in administrative procedures by exploiting or using corresponding information from national databases or specialized databases (hereinafter referred to as databases).

Article 2. Principles of Reduction and Simplification

1. The replacement or reduction of components in administrative procedures shall be carried out according to the degree of exploitation and utilization of databases; there shall be no requirement to provide components of administrative procedure files where the information contained in such components already exists in databases announced by the managing agencies of the databases.

2. Administrative agencies receiving and processing administrative procedures shall exploit and utilize existing information in databases to replace components of administrative procedure files.

In cases where information cannot be exploited or the exploited information is incomplete or inaccurate, the administrative agency or person with authority to receive and process administrative procedures shall request individuals or organizations to supplement the components of the file to resolve the administrative procedure; at the same time, they shall propose that individuals or organizations update or adjust information in the databases in accordance with the law.

3. The replacement or reduction of components of administrative procedure files by exploiting information from databases when resolving administrative procedures for Vietnamese citizens residing abroad, foreign individuals or organizations residing or operating in Vietnam shall be implemented based on the level of database availability.

4. Individuals logging into the National Public Service Portal or the National Identity Application (VNeID) to request resolution of administrative procedures do not need to perform electronic signature on interactive forms.

Article 3. Administrative Procedures with Reduced or Replaced File Components Based on Data

1. Replace various types of documents that are components of administrative procedure files with corresponding information obtained from databases for administrative procedures specified in Appendix I issued together with this Resolution.

2. The replacement of documents as stipulated in Article 4 of this Resolution also applies to administrative procedures not specified in Appendix I of this Resolution.

3. Reduce various types of documents within the components of files for resolving administrative procedures specified in Appendix II issued together with this Resolution.

Article 4. Components of Administrative Procedure Files Replaced by Using Information in Databases

1. Information from the National Population Database can be exploited and used to replace the following documents:

a) Identity card or Citizen Identification Card or Citizen Card, Certificate of Citizen Identification;

b) Residency information.

2. Information from the Electronic Civil Status Registry can be exploited and used to replace the following documents:

a) Birth certificate or Extract of Birth Registration;

b) Marriage certificate;

c) Certificate of marital status;

d) Death certificate or Death Registration or Extract of Death Registration.

3. Information from the National Social Insurance Database can be exploited and used to replace the following documents:

a) Health insurance card;

b) Social insurance book.

4. Information from the Driver's License Database can be exploited and used to replace the Driver's License.

5. Information from the National Enterprise Registration Database can be exploited and used to replace the following documents:

a) Business registration certificate or business license (for enterprises established under the Law on Enterprises);

b) Business registration certificate for individual households;

c) Cooperative registration certificate.

6. Information from the Vehicle Registration Database can be exploited and used to replace the vehicle registration certificate.

7. Information from the National Land Database can be exploited and used to replace land use right certificates and property ownership certificates attached to land (initial application for residential land).

8. Information from the Judicial Record Database can be exploited and used to replace the Judicial Record Form.

9. Information from the Electronic Health Record Platform Database can be exploited and used to replace the Health Examination Certificate.

10. Components of administrative procedure files that are documents not covered by the provisions of Clauses 1, 2, 3, 4, 5, 6, 7, 8, and 9 of this Article shall be replaced by data when complete information is available in the databases stipulated in this Article and other national or specialized databases.

Article 5. Exploitation and use of information in databases

1. Individuals and organizations are entitled to exploit and use information to request administrative procedures to be processed and to update and adjust information in accordance with the provisions of the law.

2. Administrative procedure processing agencies shall be responsible for exploiting and using information to replace various types of information and components of administrative procedure files.

Article 6. Updating, publishing, connecting, and sharing data

The managing agencies of databases shall be responsible for:

1. Organizing timely and comprehensive updates of information in the database and announcing the scope of information in the database that can be exploited and used to replace paper documents in the components of administrative procedure files on the National Public Service Portal according to the level of completion of the database; simultaneously notifying the Ministers, Heads of ministerial-level agencies, Chairpersons of provincial People's Committees to review and restructure administrative procedure processing procedures in accordance with Article 7 of this Resolution.

2. Guiding ministries, ministerial-level agencies, provincial People's Committees to connect for exploitation and use of the database, clearly identifying necessary information fields for exploitation and use; issuing guidelines and coordinating implementation of connections for exploitation and use of information in the database, completing before January 1, 2026.

3. Completing the review, correction of errors, updating to ensure the accuracy, completeness, and consistency of data; sharing data and publishing information in the database that can be exploited and used to replace components of administrative procedure files before January 1, 2026; issuing guidelines and coordinating implementation of connections for exploitation and use of information in the database, completing before January 1, 2026.

Article 7. Restructuring administrative procedure processing procedures based on data

1. Ministers and Heads of ministerial-level agencies shall be responsible for:

a) For administrative procedures with file components replaced by published data as stipulated in Clause 1 of Article 6 of this Resolution, they must complete restructuring the administrative procedure processing procedures within 15 days from the date of publication;

b) Completing and publishing the restructuring of administrative procedure processing procedures for administrative procedures with file components replaced by information in databases as stipulated in Article 4 of this Resolution before January 1, 2026;

c) Ensuring conditions regarding technological infrastructure for connecting, exploiting, and using information in databases. Corrections of errors, synchronization of data, system upgrades must not affect the connection and exploitation of data for administrative procedure processing;

d) Issuing or submitting to competent authorities for issuance of normative legal documents as set out in Appendix III attached to this Resolution to reduce and simplify administrative procedures based on data, ensuring effectiveness before March 1, 2027;

đ) Publishing the administrative procedure processing procedures specified in points a and b of this clause after restructuring on the National Public Service Portal.

2. Chairpersons of provincial People's Committees shall be responsible for:

a) Completing the restructuring of administrative procedure processing procedures and publishing on the provincial administrative procedure processing information system for local administrative procedures with file components replaced by information in databases as stipulated in Clauses 1, 2, 3, 4, 5, 6, 7, 8, and 9 of Article 4 of this Resolution before January 1, 2026, and restructuring administrative procedure processing procedures for administrative procedures with file components replaced by information in databases according to the progress specified in point a of Clause 1 of this Article.

b) Organizing the implementation of digitization and comprehensive, accurate updates of data in accordance with regulations; ensuring conditions regarding technological infrastructure for connecting, exploiting, and using information in databases to process administrative procedures as required by organizations and individuals.

Article 8. Procedure for receiving and handling administrative procedures shall be replaced by data

The authorized person responsible for receiving and handling administrative procedures shall exploit and utilize existing information in databases to replace components of the dossier for handling administrative procedures. In cases where such exploitation is not possible or the extracted information is incomplete or inaccurate, the following actions shall be taken:

1. In cases where the administrative procedure dossier is submitted online through the National Public Service Portal or via VNeID, the authorized person responsible for receiving and handling administrative procedures must notify the individual or organization to supplement and complete the dossier within no more than eight working hours or according to the deadline specified in the specialized legal normative document from the time the Administrative Procedure Handling Information System receives the dossier. Such notification may be made through one or more methods: sending to the account of the organization or individual on the National Public Service Portal or on VNeID; sending a message or contacting via the phone number or email address provided by the individual or organization; simultaneously guiding the individual or organization to contact the competent authority to update and adjust the data.

2. In cases where the administrative procedure dossier is submitted directly or through postal services, the authorized person responsible for receiving and handling administrative procedures must send a Request Form for Supplementing and Completing the Dossier to the individual or organization within no more than one working day from the date of receipt of the dossier or according to the deadline specified in the specialized legal normative document; carry out digitization to serve the handling of administrative procedures; simultaneously guide the individual or organization to contact the competent authority to update and adjust the data.

Article 9. Implementation Organization

1. The Ministry of Public Security shall be responsible for monitoring, urging, and inspecting the construction and publication of databases, ensuring connection, exploitation, and utilization in accordance with regulations; monitoring and evaluating the situation of handling administrative procedures based on data.

2. The Ministry of Science and Technology shall be responsible for guiding the architecture of the Central and Provincial Administrative Procedure Handling Information Systems, ensuring the use of centralized and unified digital platforms, connecting with national databases and specialized databases. Evaluating the operational effectiveness of the Central and Provincial Administrative Procedure Handling Information Systems and the coordination system for handling administrative procedures and connections between components in the coordination system for handling administrative procedures.

3. The Office of the Government shall be responsible for monitoring, urging, and inspecting the implementation of this Resolution.

4. The Minister, Head of a ministry-level agency, Chairman of the People's Committee of provinces and cities shall be responsible for implementing this Resolution.

The People's Councils, councils of the People's Councils, representatives of the People's Councils, and the Vietnam Fatherland Front at all levels, within their respective duties and powers, shall strengthen supervision over the implementation of this Resolution.

Article 10. Effective Date

This Resolution shall take effect from January 1, 2026 until February 28, 2027, except for the provisions stipulated in Clause 2 and Clause 3 of this Article.

For administrative procedure handling processes that have been restructured and published in accordance with Article 7 of this Resolution before January 1, 2026, the components of the administrative procedure dossier replaced by data shall be implemented from that date.

During the period when this Resolution is effective, if laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and resolutions of the Government provide regulations on administrative procedures related to the provisions of this Resolution and are passed or issued and become effective before March 1, 2027, the corresponding provisions in this Resolution shall cease to be effective at the time these legal normative documents come into force.

During the period when the provisions of this Resolution are effective, if the regulations on administrative procedures in this Resolution differ from those in related legal normative documents, the provisions in this Resolution shall be followed.
