Directive No. 668-TTg On certain issues regarding retirement benefits for officials and civil servants

DIRECTIVE

OF THE PRIME MINISTER

On some issues regarding

the implementation of retirement policies for officials and civil servants

Currently, many high-ranking officials appointed and managed by the Prime Minister have reached retirement age but continue to work (accounting for nearly 20% of Ministers, Deputy Ministers, and equivalent positions). In Ministries, agencies at the level of Ministries, government agencies, and provincial People's Committees under the central government, there are still many officials and civil servants who have reached retirement age but are still working. Among them, many have declining health and limited work capacity, yet they must continue working, affecting the arrangement, reorganization, and rejuvenation of the cadre corps.

To implement the policy and system correctly for officials and civil servants; ensure smooth transition between systems, especially for the leadership cadre corps, the Prime Minister requests the following actions from the Ministers, Heads of agencies at the level of Ministries, government agencies, and Chairmen of provincial People's Committees under the central government:

1. At the beginning of each fourth quarter annually, compile a list of officials and civil servants reaching retirement age the following year (60 years old for men, 55 years old for women). For officials and civil servants whose retirement is decided by their respective level, the Head of that level shall notify six months in advance to prepare replacements, hand over duties, resolve benefits and policies, arrange meetings, and decide on retirement according to current policies and regulations.

For officials and civil servants appointed and managed by the Prime Minister, compile a list to be submitted to the Prime Minister for decision. In special cases where work requirements necessitate it, and the official or civil servant has good health and voluntarily continues working (especially senior cadres in science and technology, medicine, theoretical research, management...), their working time may be extended, but only for professional tasks without holding leadership positions, with an extension period not exceeding five years beyond the stipulated retirement age, and with the Prime Minister's approval.

When officials and civil servants at all levels have received a retirement decision, within three months, the agency managing officials and civil servants must complete the retirement file for the social insurance agency to pay pensions according to the regulations. The Ministry of Labor, Invalids, and Social Affairs should promptly study and submit to the Government proposals to amend unreasonable provisions of Decree No. 43-CP dated June 22, 1993, concerning temporary regulations on social insurance. The Government's Organizational-Cadre Department and the Ministry of Finance are responsible for managing staffing and salary funds in accordance with the spirit outlined above.

2. Ministers, Heads of agencies at the level of Ministries, government agencies, and Chairmen of provincial People's Committees under the central government shall immediately organize the implementation of this Directive in the fourth quarter of 1994; compile a list of officials and civil servants appointed and managed by the Prime Minister who have reached or exceeded retirement age and submit it to the Prime Minister.

The Minister and the Head of the Government's Organizational-Cadre Department are responsible for guiding, inspecting, and urging Ministries, agencies at the level of Ministries, government agencies, and provincial People's Committees under the central government to strictly implement this Directive.
