Regarding amendments and supplements to certain articles of Decree No. 178/2024/NĐ-CP dated December 31, 2024 of the Government on policies and treatment for cadres, civil servants, public officials, workers, and armed forces in implementing organizational restructuring of the political system

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 178/2024/NĐ-CP dated December 31, 2024 on policies and treatment for cadres, civil servants, public officials, workers, and armed forces in implementing organizational restructuring of the political system.
Article 1. Amendments and supplements to certain articles of Decree No. 178/2024/NĐ-CP dated December 31, 2024 of the Government on policies and treatment for cadres, civil servants, public officials, workers, and armed forces in implementing organizational restructuring of the political system
1. Amend and supplement Article 1 as follows:
"Article 1. Scope of Regulation
This Decree stipulates policies and treatment, including: Policies and treatment for those who retire (early retirement and voluntary resignation); policies for those elected or appointed to leadership positions with lower position allowances or those who resign from leadership positions; policies encouraging cadres, civil servants, and public officials to strengthen their work at grassroots levels; policies valuing individuals with outstanding qualities and abilities; policies for training and upgrading the qualifications of cadres, civil servants, and public officials after restructuring; responsibilities for implementing policies and treatment for cadres, civil servants, and workers in agencies, organizations, public service units of the Party, State, Vietnam Fatherland Front, political-social organizations, and associations assigned tasks from central to district level, cadres and civil servants at commune level, and armed forces (including the Vietnam People's Army, the Public Security Force, and cryptographic units) in implementing organizational restructuring, administrative unit restructuring at all levels, reducing staff establishment, restructuring, and improving the quality of cadre, civil servant, and public official teams in the political system, including:
1. Agencies of the Communist Party of Vietnam, State, Vietnam Fatherland Front, and political-social organizations at the central, provincial, and district levels (hereinafter referred to as agencies and organizations from the central to district levels) and armed forces.
2. Administrative organizations of agencies and organizations from the central to district levels directly implementing organizational restructuring or not directly implementing organizational restructuring but implementing staff reduction, restructuring, and improving the quality of civil servants.
3. Public service units directly implementing organizational restructuring or not directly implementing organizational restructuring but implementing staff reduction, restructuring, and improving the quality of public officials, including:
a) Units under the organizational structure of agencies and organizations from the central to district levels and administrative organizations of agencies and organizations from the central to district levels;
b) Units under the provincial party committees, city party committees directly under the central government, and county party committees, town party committees, district party committees, and city party committees under provinces and centrally-administered cities; under provincial people's councils and district people's councils; under political-social organizations at the provincial level.
4. Other public service units remaining (not covered by Clause 3 of this Article) complete organizational restructuring within 12 months from the date of the competent authority's decision on restructuring.
5. Agencies, organizations, and units due to administrative unit restructuring at all levels.
6. Associations assigned tasks at the central, provincial, and district levels that implement restructuring, consolidation, and merger of organizational structures."
2. Amending and supplementing Article 2 as follows:
"Article 2. Applicability
1. Cadres, civil servants, public officials, and workers under labor contracts in agencies, organizations, and units specified in Article 1 of this Decree and armed forces directly affected by the implementation of organizational restructuring, administrative unit restructuring at all levels (hereinafter referred to as organizational restructuring), including:
a) Civil servants and public officials not holding leadership or management titles;
b) Cadres and civil servants at commune level;
c) Workers under labor contracts for certain types of work in administrative agencies and public service units according to laws before January 15, 2019 and workers under labor contracts applying civil servant policies (hereinafter referred to as workers);
d) Officers, professional military personnel, defense workers, and contractual employees receiving state budget salaries belonging to the Vietnam People's Army;
đ) Officers, non-commissioned officers receiving salaries, public security workers, and contractual employees receiving state budget salaries belonging to the Public Security Force;
e) Workers in cryptographic organizations;
g) Leaders and managers in agencies, organizations, and units specified in Clauses 1, 2, 3, and 5 of Article 1 of this Decree, who wish to retire to facilitate the reduction in the number of leaders and managers according to the law in implementing organizational restructuring of the political system.
2. Cadres, civil servants, public officials, workers receiving state budget salaries according to laws before January 15, 2019 and armed forces still having five years or less until retirement age in agencies, organizations, and units specified in Article 1 of this Decree not directly affected by organizational restructuring but must implement staff reduction, restructuring, and improve the quality of cadres, civil servants, and public officials.
3. Persons working within the quota of establishment and receiving salaries from the state budget at associations assigned tasks by the Party and State at central, provincial, and district levels are directly affected by the implementation of organizational restructuring, consolidation, and merger.
4. Cadres who do not meet the age requirement for re-election and reappointment as stipulated in Clauses 1, 2, and 3 of Article 2 of Decree No. 177/2024/NĐ-CP dated December 31, 2024 of the Government on the system and policies for cases not eligible for re-election and reappointment; cadres meeting the age requirements for re-election and reappointment to the same-level party committee, with a period of service from the day the congress begins ranging from 2.5 years (30 months) to 5 years (60 months) until the retirement age specified in Clause 4 of Article 2 of Decree No. 177/2024/NĐ-CP; and cadres participating in committees of party organizations that must cease operations and streamline their organizational structures with less than 5 years (60 months) until retirement age, who wish to retire early to create conditions for arranging personnel for the party committees at all levels leading up to the 14th National Congress of the Party and have been approved by the competent authority.
1. The application file for investigation of transitional safeguard measures (referred to in this Chapter as the application file) includes relevant papers, documents, and evidence as stipulated in Article 63 of Decree No. 86/2025/NĐ-CP.
"6. The current monthly salary is the most recent monthly salary before ceasing work, including: the level of salary according to rank, grade, level of position, title, profession, or the agreed salary in the labor contract; salary allowances (including: leadership position allowance; seniority allowance exceeding the framework; occupational seniority allowance; professional preference allowance; occupational responsibility allowance; public service allowance; allowance for political and social organizations; special allowance for armed forces) and the retention wage differential coefficient (if applicable) as prescribed by laws on wages."
4. Amend and supplement the name of Article 6 as follows:
"Article 6. Criteria for evaluating cadres, civil servants, officials, and employees to implement organizational restructuring, reduction in staffing, and restructuring and improving the quality of cadres and civil servants and resolving policies and systems.".
5. Amend and supplement the name and introductory clause of Article 7 as follows:
"Article 7. Policies for those retiring early due to organizational restructuring.
Those specified in Clauses 1 and 3 of Article 2 of this Decree who retire early shall enjoy the following benefits:"
6. Amend and supplement Points a, b, and c of Clause 2 of Article 7 as follows:
"2. Enjoy early retirement policy based on the number of years worked with mandatory social insurance contributions and the number of years retired early as follows:
a) In cases where the remaining age until the statutory retirement age specified in Appendix I attached to Decree No. 135/2020/NĐ-CP is between 2 and 5 years, and having sufficient time working with mandatory social insurance contributions to be entitled to a pension under the law on social insurance, in addition to enjoying the retirement benefits stipulated by the law on social insurance, they will also enjoy the following benefits:
Not subject to a reduction in the pension rate due to early retirement;
A lump sum payment of five months' current salary for each year retired early compared to the statutory retirement age specified in Appendix I attached to Decree No. 135/2020/NĐ-CP;
A lump sum payment of five months' current salary for the first 20 years of work with mandatory social insurance contributions. For each additional year beyond 20 years, a lump sum payment of half a month's current salary is provided.
In cases where there are at least 15 years of work with mandatory social insurance contributions and belong to the category entitled to a pension under the law on social insurance at the time of early retirement, a lump sum payment of four months' current salary is provided for the first 15 years of work; for each additional year beyond 15 years, a lump sum payment of half a month's current salary is provided.
b) In cases where the remaining age until the statutory retirement age specified in Appendix I attached to Decree No. 135/2020/NĐ-CP is between 5 and 10 years, and having sufficient time working with mandatory social insurance contributions to be entitled to a pension under the law on social insurance, in addition to enjoying the retirement benefits stipulated by the law on social insurance, they will also enjoy the following benefits:
Not subject to a reduction in the pension rate due to early retirement;
A lump sum payment of four months' current salary for each year retired early compared to the statutory retirement age specified in Appendix I attached to Decree No. 135/2020/NĐ-CP;
A lump sum payment of five months' current salary for the first 20 years of work with mandatory social insurance contributions. For each additional year beyond 20 years, a lump sum payment of half a month's current salary is provided.
In cases where there are at least 15 years of work with mandatory social insurance contributions and belong to the category entitled to a pension under the law on social insurance at the time of early retirement, a lump sum payment of four months' current salary is provided for the first 15 years of work; for each additional year beyond 15 years, a lump sum payment of half a month's current salary is provided.
c) In cases where the remaining age until the statutory retirement age specified in Appendix II attached to Decree No. 135/2020/NĐ-CP is between 2 and 5 years, and having sufficient time working with mandatory social insurance contributions to be entitled to a pension under the law on social insurance, including at least 15 years of work in heavy, hazardous, dangerous, or extremely heavy, hazardous, dangerous jobs listed by the government agency responsible for labor management, or at least 15 years of work in areas with particularly difficult economic and social conditions as determined by the government agency responsible for labor management, including time spent working in places with regional allowances of 0.7 or higher before January 1, 2021, in addition to enjoying the retirement benefits stipulated by the law on social insurance, they will also enjoy the following benefits:
Not subject to a reduction in the pension rate due to early retirement;
A lump sum payment of five months' current salary for each year retired early compared to the statutory retirement age specified in Appendix II attached to Decree No. 135/2020/NĐ-CP;
A lump sum payment of five months' current salary for the first 20 years of work with mandatory social insurance contributions. For each additional year beyond 20 years, a lump sum payment of half a month's current salary is provided.
In cases where there are at least 15 years of work with mandatory social insurance contributions and belong to the category entitled to a pension under the law on social insurance at the time of early retirement, a lump sum payment of four months' current salary is provided for the first 15 years of work; for each additional year beyond 15 years, a lump sum payment of half a month's current salary is provided."
7. Supplement Article 7a as follows:
"Article 7a. Policy for persons retiring early due to streamlining, restructuring, and improving the quality of the cadre, civil servant, and public official workforce.
The subjects specified in Clause 2, Article 2 of this Decree who retire early shall enjoy the benefits stipulated in Clause 2, Article 7 of this Decree. Additionally, they shall be entitled to a one-time retirement allowance for the early retirement period as follows:
1. For those who retire within a period of 12 months from March 15, 2025, they shall receive an allowance equal to one month's current salary multiplied by the number of months retired early compared to the retirement age specified in Appendix I and Appendix II issued together with Decree No. 135/2020/NĐ-CP.
2. For those who retire from the 13th month onwards from March 15, 2025, they shall receive an allowance equal to half the amount stipulated in Clause 1 of this Article.
8. Supplement Article 7b as follows:
"Article 7b. Policy for early retirement for cadres who are not eligible for re-election or re-appointment or meet the age criteria for re-election or re-appointment.
The subjects specified in Clause 4, Article 2 of this Decree who retire early shall enjoy the benefits stipulated in Clause 2, Article 7 of this Decree. Additionally, they shall be entitled to a one-time retirement allowance for the early retirement period equal to one month's current salary multiplied by the number of months retired early compared to the retirement age specified in Appendix I and Appendix II issued together with Decree No. 135/2020/NĐ-CP.
9. Amend and supplement the name and introductory clause of Article 9 as follows:
"Article 9. Policy for voluntary resignation for cadres, civil servants, and personnel working at associations specified in points a, b, and g, Clause 1 and Clause 3, Article 2 of this Decree.
Cadres and civil servants aged two years or more up to the retirement age specified in Appendix I and Appendix II issued together with Decree No. 135/2020/NĐ-CP, and who do not meet the conditions for the policy on early retirement stipulated in Articles 7, 7a, and 7b of this Decree, if they resign voluntarily, shall enjoy the following benefits:
10. Amend and supplement the name and introductory clause of Article 10 as follows:
"Article 10. Policy for voluntary resignation for public officials and workers specified in points a, c, and g, Clause 1 of Article 2 of this Decree.
Public officials and workers aged two years or more up to the retirement age specified in Appendix I and Appendix II issued together with Decree No. 135/2020/NĐ-CP, and who do not meet the conditions for the policy on early retirement stipulated in Articles 7, 7a, and 7b of this Decree, if they resign voluntarily, shall enjoy the following benefits:
11. Amend and supplement Article 11 as follows:
"Article 11. Policy for leaders and managers of cadres, civil servants, and public officials who cease holding leadership positions or are elected or appointed to hold leadership positions with lower position allowances due to organizational restructuring.
Leaders and managers of cadres, civil servants, and public officials who cease holding leadership positions or are elected or appointed to hold leadership positions with lower position allowances or leadership position subsidies due to organizational restructuring shall retain their previous position allowances or leadership position subsidies until the end of their election term or appointment period. In cases where the remaining time of the leadership position held according to the election term or appointment period is less than six months, they shall retain it for six months.
12. Amend the title of Clause 2, Article 12 as follows:
"2. For cadres, civil servants, and public officials from central agencies who are dispatched to work at Party, State, political-social organizations, and public service units at provincial level, the policies shall be as follows:"
13. Amend and supplement the name of Article 15 and Clause 1, Article 15 as follows:
"Article 15. Policies and benefits for subjects belonging to the armed forces
1. Subjects specified in points a, d, đ, e, and g of Clause 1 and Clause 2 of Article 2 of this Decree who belong to the armed forces shall implement the policies stipulated in Articles 7, 7a, 7b, 8, 9, 10, 11, and 14 of this Decree.
14. Amend and supplement point a of Clause 2 of Article 16 as follows:
"2. For civil servants and workers in public service units:
a) For public service units that self-finance regular expenses and investment costs; public service units that self-finance regular expenses: The funding for implementing policies and benefits comes from the operating revenue of the unit and other lawful sources of income.
In cases where public service units do not have sufficient funds to implement policies and benefits, they may use funds allocated according to the regulations of public service units to implement policies and benefits.
In cases where public service units that self-finance regular expenses through government orders via service prices but the service prices do not fully cover the factors necessary to implement policies and benefits, the funding for implementing policies and benefits will be supplemented by the state budget."
15. Supplement Clauses 5 and 6 of Article 16 as follows:
"5. For individuals working within the staffing quota and receiving salaries from the state budget at associations assigned tasks by the Party and State at central, provincial, and district levels directly affected by the implementation of organizational restructuring, mergers, and consolidations: The funding for implementing policies and benefits will be provided by the state budget.
6. For administrative organizations ending the special financial mechanism like public service units starting from January 1, 2025, the funding for implementing policies and benefits will be provided by the state budget."
16. Amend and supplement Article 17 as follows:
"Article 17. Responsibilities of heads of agencies, organizations, and units directly managing and using cadres, civil servants, and civil employees
1. Implement policies and benefits as prescribed in this Decree.
2. Based on guidance from competent authorities regarding the evaluation of cadres, civil servants, civil employees, and workers, and specific evaluation criteria according to the guidance of the competent authority, the head of the agency, organization, or unit shall seek opinions from the leadership collective of the same-level party committee and administration to establish evaluation criteria, conduct a comprehensive review of the quality of cadres, civil servants, civil employees, and workers under their management, consider voluntary resignation requests from cadres, civil servants, and civil employees; identify those who must resign due to organizational restructuring, streamlined staffing, and improved quality of the cadre corps; prepare lists and budgets for implementing policies for each case, submit them to the competent authority for examination and approval.
3. After obtaining approval from the competent authority, promptly implement payments for policies and benefits for cadres, civil servants, and civil employees in accordance with the provisions of the law.
17. Delete Clause 6 of Article 19 and amend Clause 7 of Article 19 to become Clause 6 of Article 19.
18. Supplement Clause 3 of Article 24 as follows:
"3. The provision of a lump-sum allowance of five months' current salary for the first twenty years of service and half a month's current salary for each year of service from the twenty-first year onwards, as stipulated in points a, b, and c of Clause 2 of Article 7 of this Decree, shall remain effective until the day before the Social Insurance Law of 2024 takes effect.
The provision of a lump-sum allowance of four months' current salary for the first fifteen years of service and half a month's current salary for each year of service from the sixteenth year onwards, as stipulated in points a, b, and c of Clause 2 of Article 7 of this Decree, shall apply to female civil servants at commune level from January 1, 2025."
19. Amend and supplement Article 25 as follows:
"Article 25. Transitional Provisions
1. Cases currently implementing policies and benefits due to organizational restructuring, county, and commune administrative units as prescribed in Decree No. 29/2023/NĐ-CP but the competent authority has not yet issued a decision on policies and benefits shall apply the policies and benefits stipulated in this Decree.
2. Cases currently implementing policies and benefits due to organizational restructuring of county and commune administrative units, which have been resolved according to Decree No. 29/2023/NĐ-CP by the competent authority but the date of retirement is after January 1, 2025, shall apply the policies and benefits stipulated in this Decree.
3. Cases stipulated in Clause 4 of Article 2 of this Decree, which have been resolved according to Decree No. 177/2024/NĐ-CP by the competent authority, if the policies and benefits are lower than those stipulated in this Decree, shall apply the policies and benefits stipulated in this Decree.
4. Cases resolved according to Decree No. 178/2024/NĐ-CP by the competent authority, if the policies and benefits are lower than those stipulated in this Decree, shall be supplemented according to the policies and benefits stipulated in this Decree.
5. Cases due to organizational restructuring or changes in organizational structure or staffing quotas decided to retire early before January 1, 2025, in accordance with the Government's guidelines for implementing the Law on Officers of the Vietnam People's Army, the Law on Professional Military Personnel, Civil Servants, and Defense Workers, and the Law on Cryptographic Services, but the competent authority has not yet issued a decision on policies and benefits by January 1, 2025, shall apply the policies and benefits stipulated in this Decree.
6. Cases resolved by the competent authority to provide additional support from local budgets according to Clause 6 of Article 19 of Decree No. 178/2024/NĐ-CP before March 15, 2025, shall continue to enjoy this additional support policy.
Article 2. Effective Date
This Decree takes effect from the date of issuance.
Article 3. Responsibility for Implementation
1. Central Organization Department, National Assembly's Committee on Social Affairs and Supervision, OfficeThe President, the Supreme People's Procuracy, the Supreme People's Court, and the State Audit Organization shall guide agencies, organizations, and units under their jurisdiction to implement policies and待遇制度的处理情况,涉及其管辖范围内的干部、公务员、职员和劳动者。
2. The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial and central city People's Committees, and related agencies, organizations, units, and individuals are responsible for implementing this Decree./.
