DIRECTIVE

ON ENFORCING MANAGEMENT OF THE HARVEST AND CONSUMPTION OF SUGI WOOD

Sugi wood (local name: Trắc thối, Huỳnh đàn, Huê mộc vàng), scientific name Dalbergia tonkinensis Prain, belongs to the rare and precious species group IA as stipulated in Decree No. 32/2006/NĐ-CP dated March 30, 2006 of the Government on management of endangered forest plants and animals; this type of wood is strictly prohibited from being harvested and used for commercial purposes by the State. Recently, in some localities such as Gia Lai, Kon Tum, Quang Ngai, Quang Nam, Quang Binh..., illegal harvesting of this type of wood (including roots, trunks, branches, twigs, and fragments) from natural forests has been very complex; illegal transportation of sugi wood has been difficult to control; in some other localities, people have planted this rare and precious tree species themselves, and when they learned of its high value, they requested permission to harvest the trees before they reached the required age for harvesting.

To rectify and address these issues, and to conserve the sugi wood tree species that has been planted by the people, the Minister of Agriculture and Rural Development requests the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities to immediately implement the following contents:

1. Management of sugi wood originating from natural forests

- Strictly enforce regulations and prohibit the harvesting, utilization, and collection of roots, trunks, branches, twigs, and fragments of sugi wood originating from natural forests in all forms.

- Report to the People's Committee of the province (hereinafter referred to as the Provincial People's Committee) to implement the following tasks:

+ Organize an assessment of the status of endangered and precious forest plants at the locality level to develop management and protection plans according to Decree No. 32/2006/NĐ-CP of the Government. Coordinate with relevant agencies at the provincial and municipal levels to effectively manage and protect areas with sugi wood trees.

+ Direct the Forest Protection Service to cooperate with the Provincial Police to focus on investigating individuals specializing in illegally harvesting, purchasing, selling, and transporting sugi wood, and resolutely handle violations, with serious cases being prosecuted criminally according to the law. Statistics on the volume of various types of sugi wood as evidence in administrative violation cases and criminal cases (up to the present time) within the locality should be reported to the Provincial People's Committee and the Ministry of Agriculture and Rural Development.

+ Propose temporarily suspending the sale and consumption of sugi wood as evidence in administrative violation cases and criminal cases until order is restored in the management and protection of sugi wood forests.

2. Management of sugi wood originating from planted forests

Direct the Forest Protection Service of the province to immediately conduct statistics on the species and area of planted forests (for concentrated plantations) of endangered and precious forest plants group IA (including the sugi wood tree species) planted by organizations, individuals, and households over the years at the locality, record and compile reports to the Provincial People's Committee and the Ministry of Agriculture and Rural Development. Registration of artificial cultivation bases for endangered and precious forest plants shall be carried out according to current state regulations. In the short term, temporarily suspend the harvesting of sugi wood originating from self-planted sources until guidelines from the Ministry of Agriculture and Rural Development are issued.

3. The Forest Protection General Department is assigned to lead coordination with relevant agencies of the Ministry to advise the Minister on specific regulations regarding the management of harvesting and consumption of endangered and precious forest plants group IA planted by organizations, individuals, and households; monitor the implementation of this Directive, compile and report to the Minister of Agriculture and Rural Development for guidance and resolution.
