PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Article 33 of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government on organization, operation, and management of associations;

Considering the proposal of the Minister of Home Affairs,

 DECIDES:

Article 1. Basis for determining associations with special characteristics

1. For political-social organizations, political-social-professional organizations:

a) Recognized by the competent authority of the Party as a political-social organization or a political-social-professional organization;

b) Have been allocated personnel quotas and supported financially and provided conditions for operation by the State before the effective date of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government on organization, operation, and management of associations.

2. For social-professional organizations, economic organizations:

a) Play an important role in contributing to the development of the national economy and society;

b) Face difficulties in mobilizing financial resources to serve their operations;

c) Have been allocated personnel quotas and supported financially and provided conditions for operation by the State before the effective date of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government on organization, operation, and management of associations.

3. For social organizations:

a) Operate for social and humanitarian goals;

b) Are associations of individuals facing many difficulties and disadvantages requiring attention, assistance, and support from society and the State to operate;

c) Have been supported financially and provided conditions for operation by the State before the effective date of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government on organization, operation, and management of associations.

Based on the provisions of Article 1 of this Decision, associations with special characteristics operating nationwide are listed in the Appendix attached to this Decision.

Article 3. Associations with special characteristics operating within a locality

Based on the provisions of Article 1 of this Decision and local budget conditions, the Chairman of the People's Committee of provinces and centrally-administered cities shall determine the list of associations with special characteristics operating within a locality.

Article 4. Effectiveness

This Decision takes effect from December 20, 2010.

Article 5. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-administered cities, and related organizations and individuals are responsible for implementing this Decision./.
