Article 1. The State budget shall support interest rates on commercial loans for long-term, medium-term, and short-term loans in Vietnamese dong for purchasing machines and equipment to reduce losses in agriculture as follows:
1. The beneficiaries are enterprises, cooperatives, cooperative groups, households, and individuals.
2. The list of machines and equipment includes:
a) Various types of land preparation machines, paddy leveling machines, transplanting machines, planting, maintenance, harvesting machines for rice, corn, coffee, tea, sugar cane; agricultural and aquatic product drying machines; salt production machines and equipment; animal husbandry machines and equipment;
b) Water-saving irrigation systems in agricultural production;
c) Machines and equipment for producing, breeding, and harvesting aquatic products;
d) Various types of fish detection, fishing net deployment, communication, freezing chamber, cold storage container, ice production, seawater desalination machines and equipment for use on fishing vessels and service vessels for distant-water fishing;
đ) Machines and equipment for processing agricultural and aquatic waste and by-products;
e) Storage facilities and equipment for household-scale rice and corn storage;
g) Tractors and diesel engines used in agriculture and aquaculture.
3. Conditions for receiving support:
a) Cooperatives, cooperative groups, households, and individuals must be confirmed by the People's Committee of the commune as direct producers of crop cultivation, animal husbandry, aquatic farming, fishing, and agricultural and aquatic product processing; agricultural mechanization services;
b) Enterprises must have signed contracts to implement production linkage and consumption agreements with cooperative groups, cooperatives, or farmers;
c) The machines and equipment specified in Clause 2 of this Article must be new and meet quality standards as prescribed by laws on product and commodity quality.
4. Loan amount, interest rate support level, and duration of support:
a) The maximum loan amount for purchasing the machines and equipment specified in Clause 2 of this Article is 100% of the value of the goods;
b) Support 100% of the interest rate on the loan for the first two years, 50% in the third year.
Article 2. The State budget shall support the difference between the commercial interest rate on long-term and medium-term loans denominated in Vietnamese dong and the interest rate on state development credit to implement investment projects for machine and equipment chains to reduce losses in agriculture (including factories); manufacturing projects for agricultural machinery as follows:
1. The beneficiaries are enterprises, cooperatives, cooperative groups, households, and individuals.
2. List of investment projects includes:
a) Silo warehouses for storing rice and corn; agricultural product drying systems; rice milling, polishing, and grading machine and equipment chains;
b) Greenhouse and net house systems for production; vegetable, flower, and fruit preservation and processing machines and equipment;
c) Industrial livestock and poultry slaughtering and processing machine and equipment chains; aquatic product processing (cold storage, freezing, re-freezing equipment; ice production equipment; drying equipment...);
d) Coffee, tea, cashew nut, black pepper processing machine and equipment chains;
đ) Salt processing machine and equipment chains;
e) Manufacturing projects for agricultural machinery.
3. Conditions for receiving support:
a) Organizations and individuals must have investment projects approved by competent authorities;
b) Investment projects not yet benefiting from other policy supports.
4. The maximum loan amount is 70% of the project value.
5. The loan term is determined based on the project's capital recovery ability and the borrower's repayment capacity, consistent with the project's production and business characteristics but not exceeding 12 years.
Article 3. Principles for determining the lending interest rate of commercial banks and state budget interest rate support and interest rate subsidy are as follows:
1. The commercial lending interest rate of banks for purchasing machines and equipment is the lowest interest rate in the agricultural and rural sector during the same period and the same term as the bank implementing the loan and publicly announced.
2. The state budget will only support interest rates and subsidize interest rate differences for loans that are repaid on time. Loans transferred to overdue status will not be eligible for support from the date of becoming non-performing.
3. The state budget will only support interest rates and subsidize interest rate differences for loans contracted with commercial banks before December 31, 2020.
Article 4. Implementation
1. The Ministry of Agriculture and Rural Development shall be responsible for:
a) Take the lead and coordinate with the Ministry of Industry and Trade to announce domestic and imported machine and equipment types within the list of machines and equipment eligible for support under Clause 2 of Article 1 of this Decision;
b) Guide technical assessment conditions for machines and equipment of investment projects specified in Clause 2 of Article 2 of this Decision;
c) Take the lead and coordinate with provincial and centrally-administered city People's Committees, relevant ministries, and sectors to inspect and supervise the implementation of this Decision.
2. The Ministry of Industry and Trade shall coordinate with the Ministry of Agriculture and Rural Development to unify the machines and equipment eligible for support under Clause 2 of Article 1 of this Decision.
3. The State Bank of Vietnam shall guide and inspect commercial banks' implementation of loans according to this Decision.
4. The Ministry of Finance shall take the lead in guiding the implementation of interest rate support and interest rate subsidy for loans as stipulated in this Decision.
5. Provincial People's Committees under the central government:
a) Direct the implementation of programs and projects to reduce losses in agriculture in their locality; guide and monitor the quantity and types of machines and equipment supported to be appropriate with the actual needs of each field and area to maximize the effectiveness of the support policy.
b) Based on the actual demand for investment in machines and equipment to reduce losses in agriculture and the local budget capacity, provinces and cities should study and consider additional support policies outside those stipulated in this Decision;
c) Report annually to the Ministry of Agriculture and Rural Development on the results of policy implementation in their jurisdiction.
Article 5. Effectiveness
1. This Decision shall take effect from January 1, 2014, and replace Decision No. 63/2010/QĐ-TTg dated October 15, 2010, and Decision No. 65/2011/QĐ-TTg dated December 2, 2011, of the Prime Minister on policies to support post-harvest loss reduction for agricultural and aquatic products.
2. Organizations and individuals implementing support policies under Decision No. 63/2010/QĐ-TTg dated October 15, 2010, and Decision No. 65/2011/QĐ-TTg dated December 2, 2011, of the Prime Minister before this Decision takes effect shall continue to enjoy those support policies.
Article 6. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, and related agencies and units shall be responsible for implementing this Decision./.
