Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the High Technology Law dated November 13, 2008;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 99/2003/NĐ-CP dated August 28, 2003 of the Government promulgating the Regulation on High-Tech Zones;

At the proposal of the Minister of Science and Technology,

The Prime Minister stipulates the functions, tasks, powers, and organizational structure of the Management Board of Hoa Lac High-Tech Park under the Ministry of Science and Technology.

Article 1. Position and Functions

1. The Management Board of Hoa Lac High-Tech Park (hereinafter referred to as the Management Board) is an organization directly under the Ministry of Science and Technology, performing state management functions directly over Hoa Lac High-Tech Park (hereinafter referred to as the High-Tech Park) in accordance with the provisions of law.

2. The Management Board (equivalent to a General Department) has legal personality, uses a seal bearing the National Emblem, opens accounts at the State Treasury and banks; it is a first-level budget unit, is assigned annual plan targets and allocated operating funds from the state budget, and has its headquarters in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Drafting and submitting to the Minister of Science and Technology for submission to the Government and the Prime Minister for approval or issuance:

a) Master plans and medium- and long-term development plans for the High-Tech Park;

b) Mechanisms and preferential policies for the High-Tech Park suitable to actual development conditions during each period in accordance with the provisions of law;

c) Recruitment mechanisms and preferential policies for officials, civil servants, employees, and workers employed at the Management Board.

2. To submit to the Minister of Science and Technology for approval, decision-making, or issuance;

a) Group A projects using state budget funds, ODA projects, and funds received for investment development of the High-Tech Park in accordance with the provisions of law;

b) Legal normative documents and other documents concerning the High-Tech Zone.

3. Preparing annual investment development plans and budget estimates (for development investment and regular expenses) to be sent to the Ministry of Planning and Investment and the Ministry of Finance for consolidation in accordance with the provisions of the state budget law.

4. Organizing and supervising the implementation of legal regulatory documents, policies, master plans, plans, programs, and projects in the High-Tech Park after they have been approved or issued by competent authorities.

5. Issuing guidance documents on specialized matters, internal regulations in accordance with the provisions of law.

6. Regarding planning and construction management

a) Managing and organizing the implementation of the overall urban planning after it has been approved by the Prime Minister;

b) Directing the preparation of sectoral zoning plans and detailed plans for functional areas; reviewing and approving sectoral zoning plans and detailed plans according to delegated authority; organizing the implementation of plans and managing construction in accordance with approved plans;

c) Implementing the issuance, reissuance, adjustment, extension, revocation, and cancellation of location introduction documents, planning certificates, planning permits, and construction permits according to delegated authority; providing information on construction planning;

d) Coordinating reviews of basic design documents for construction investment projects of investors in the High-Tech Park;

đ) Recording administrative violations when discovering violations in the construction field within the High-Tech Park.

7. Regarding capital management and development plans

a) Performing the role of the main investor and directing and organizing the implementation of construction investment projects funded by the state budget that are under its management in accordance with the provisions of law;

8. Regarding cooperation and investment promotion

c) Cooperating and investing with foreign countries in high technology in accordance with regulations on cooperation and investment with foreign countries in the fields of science and technology;

d) Cooperating, joint ventures, and associations with domestic and foreign organizations and individuals in related fields to develop and manage, exploit the High-Tech Park in accordance with the provisions of law; being allowed to hire foreign consultants to provide investment promotion services, strategic consulting on investment, construction, and development of the High-Tech Park in accordance with the provisions of law.

9. Regarding the management of enterprises' operations in the High-Tech Zone

a) Compiling, statistically analyzing, monitoring, and inspecting the activities of enterprises; promptly identifying and recommending competent authorities to handle violations of laws by enterprises;

b) Issuing, reissuing, amending, supplementing, and extending Certificates of Establishment of Representative Offices of Foreign Enterprises;

c) Issuing, reissuing, amending, supplementing, and extending Permits for Trading Activities and Related Activities Directly Linked to Trading;

d) Issuing various Certificates of Origin for goods produced in the High-Tech Park.

10. Regarding investment management

a) Issuing, adjusting, and revoking Investment Certificates in accordance with the provisions of law;

b) Issuing or submitting to competent authorities for issuance measures to ensure the implementation of investment projects;

c) Inspecting, supervising, and evaluating the implementation of projects in the High-Tech Park according to Investment Certificates, Licenses, Certificates, and other legal provisions.

11. Regarding land management and use

a) Being entrusted by the provincial People's Committee to allocate land (including both land and water surfaces) for the organization of construction and development of the High-Tech Park in accordance with the approved planning by authorized state agencies;

b) Coordinating with organizations responsible for compensation and resettlement and relevant agencies to organize the implementation of compensation, support, and resettlement in the High-Tech Park;

c) Allocating land without payment of land use fees, leasing land; recovering land that has been allocated or leased in accordance with the provisions of law;

d) Determining the amount of land rental fees; exemptions and reductions in land rental fees for investment projects in the High-Tech Park to ensure encouragement of investment in accordance with the provisions of law;

đ) Agreeing on valuation for the lease of developed infrastructure land; rental prices for housing with businesses engaged in infrastructure and housing;

e) Selecting investors to implement investment projects using land in accordance with the provisions of law on bidding.

g) Prescribe the administrative procedures concerning land at the High-Tech Zone. Serve as the point of contact for receiving and delivering results of administrative procedures related to land for investors (returning land, leasing land, issuing certificates of land use rights, ownership of houses and assets attached to land) in accordance with the provisions of the law;

h) Organize the review, evaluation, and assessment of land usage needs; assess conditions for returning and leasing land for investment projects. Supervise the use of land in projects according to decisions on returning and leasing land;

12. Regarding environmental management and protection

a) Approve environmental impact assessments of investment projects; confirm environmental protection plans for entities operating within the High-Tech Zone in accordance with the provisions of the law;

b) Serve as the point of contact for guiding investors and entities operating within the High-Tech Zone to implement environmental management procedures;

c) Guide and promote awareness of environmental protection; coordinate with relevant agencies to resolve complaints, accusations, and disputes regarding the environment within the High-Tech Zone in accordance with the provisions of the law;

d) Coordinate with state management agencies responsible for environmental protection to manage, inspect, and supervise environmental protection activities within the High-Tech Zone;

đ) Implement monitoring of emissions and environmental components within the High-Tech Zone; report to state management agencies responsible for environmental protection in accordance with the provisions of the law;

e) Prepare administrative violation records when discovering violations in the field of environmental protection within the High-Tech Zone.

13. Regarding service management and ensuring security and public order

a) Manage exploitation, business, service activities, and the use of investment works; directly manage, exploit, use, and maintain infrastructure works invested by the State within the High-Tech Zone;

b) Decide on fees for using infrastructure works invested by the State, sewage treatment fees, and service charges implemented by the Management Board in accordance with the provisions of the law; negotiate prices for service charges implemented by infrastructure and housing businesses;

c) Chair and coordinate with relevant agencies to ensure security, order, fire prevention and fighting, and promote cultural practices at the High-Tech Zone.

14. Regarding the organization and management of high-tech technology incubation and high-tech enterprises

a) Decide on areas of technology incubation, incubation targets, and incubation forms in accordance with the provisions of the law;

b) Decide on support forms for organizations, individuals, and research groups participating in technology incubation in line with national preferential policies and support measures for high-tech technology incubation and high-tech enterprise incubation activities;

15. Labor management within the High-Tech Zone shall be carried out in accordance with the provisions of the law.

16. Regarding scientific and technological activity management and promotion

a) Approve and direct units under the Management Board to conduct research topics and projects applying scientific progress and technology; provide opinions on the suitability of scientific and technological development planning for research and development, innovation, transfer, application, and high-tech development tasks of organizations and individuals operating within the High-Tech Zone;

b) Guide organizations and individuals to participate in support programs and enjoy preferential policies for research and development, innovation, transfer, application, and high-tech product commercialization activities within the High-Tech Zone in accordance with the provisions of the law;

c) Organize evaluations and technical assessments of projects investing in the High-Tech Zone and monitor and inspect project implementation in accordance with the provisions of the law;

d) Organize and implement activities to receive, promote, demonstrate, and transfer technology.

17. Organize and support the training and provision of high-tech human resources within the High-Tech Zone; establish skill standards, organize examinations, and issue certificates based on these standards.

18. Coordinate with state management agencies in conducting inspections, resolving complaints and accusations, preventing corruption, waste, and negative practices, and handling violations of laws concerning planning, construction, investment, environment, land, and other fields within the High-Tech Zone in accordance with the provisions of the law.

19. Manage and utilize assigned financial resources and assets; collect and manage various fees and charges as prescribed by law.

20. Be authorized to open accounts at the Treasury to collect land rental fees, fees for using infrastructure works invested by the State, sewage treatment fees, service charges, and other revenues and reinvest them in the development of the High-Tech Zone according to the decision of the competent authority.

21. Exercise the rights, obligations, and responsibilities of the state owner towards enterprises under the Management Board pursuant to the authorization of the Ministry of Science and Technology.

22. Manage organizational structure, civil servant staffing, number of employees, and contractual labor; implement salary systems, appointments, reappointments, transfers, rotations, dismissals, resignations, removals, terminations, rewards, and disciplinary actions for civil servants, officials, and contractual labor under the Management Board's jurisdiction in accordance with the provisions of the law and the delegation of the Minister of Science and Technology; establish job positions and the structure of civil servants and officials of the Management Board for submission to the Minister of Science and Technology in accordance with the provisions.

23. Carry out state management functions over the High-Tech Zone pursuant to the delegation of relevant Ministries and agencies.

24. Regularly report to the Minister of Science and Technology and relevant Ministries and agencies on the situation of investment, construction, development, management, and operations of the High-Tech Zone.

25. Implement administrative reform at the High-Tech Zone according to the program and plan of the Ministry of Science and Technology.

26. Perform other tasks and powers delegated by the Minister of Science and Technology.

Article 3. Organizational Structure

1. Office;

2. Planning and Finance Department;

3. Investment Support Department;

4. Planning, Construction, and Environment Department;

5. Science and Technology Department;

6. Training Center;

7. High-Tech Enterprise Incubation Center;

8. Comprehensive Service Center;

9. Hoa Lac High-Tech Zone Development Joint Stock Company Limited.

The units specified from Clause 1 to Clause 5 of this Article are organizations assisting the Director of the Management Board in performing state management functions; the units specified from Clause 6 to Clause 8 of this Article are subordinate public service units of the Management Board. The Director of the Management Board decides to establish Investment and Construction Departments under the Board to implement investment projects in accordance with the provisions of the law.

The Director of the Management Board shall specify in detail the functions, tasks, powers, and organizational structure of the assisting organizations and subordinate units.

The administrative staffing of the Management Board's management machinery is assigned by the Minister of Science and Technology within the total administrative staffing of the Ministry of Science and Technology.

Article 4. Leadership

1. The Management Board has a Director and not more than three Deputy Directors.

2. The Director and Deputy Directors are appointed, dismissed, removed from office, rotated, or transferred by the Minister of Science and Technology in accordance with the provisions of the law.

3. The Director of the Management Board is responsible to the Minister of Science and Technology and to the law for all activities of the Management Board. The Deputy Directors are responsible to the Director and to the law for the areas of work assigned to them.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from February 1, 2015.

2. This Decision replaces Decision No. 98/2009/QĐ-TTg dated July 27, 2009 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the Management Board of Hoa Lac High-Tech Park.

3. The Minister of Science and Technology, the Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and the Director of the Management Board of Hoa Lac High-Tech Park are responsible for implementing this Decision./.
