CIRCULAR
REGULATIONS ON THE LEVEL OF COLLECTION OF CERTAIN FEES AND CHARGES IN THE FIELD OF VETERINARY MEDICINE TO SUPPORT AND RESOLVE DIFFICULTIES FOR ENTITIES AFFECTED BY THE COVID-19 PANDEMIC
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Resolution No. 124/2020/QH14 dated November 11, 2020 of the National Assembly on the Plan for Socio-Economic Development in 2021;
To implement Resolution No. 01/NQ-CP dated January 1, 2021 of the Government on key tasks and solutions to implement the Plan for Socio-Economic Development and State Budget Estimates for 2021, and Resolution No. 129/NQ-CP dated September 11, 2020 of the Government on the Regular Meeting in August 2020;
To implement Directive No. 11/CT-TTg dated March 4, 2020 of the Prime Minister on urgent tasks and solutions to resolve difficulties for production and business operations and ensure social welfare in response to the COVID-19 pandemic, and the instructions of the Prime Minister in Circular No. 10344/VPCP-KTTH dated December 10, 2020 regarding the review to reduce fees and charges to resolve difficulties for entities affected by the COVID-19 pandemic;
At the request of the Director of the Tax Policy Department;
The Minister of Finance promulgates this Circular stipulating the level of collection of certain fees and charges in the field of veterinary medicine to support and resolve difficulties for entities affected by the COVID-19 pandemic.
Article 1. Level of Collection of Certain Fees and Charges in the Field of Veterinary Medicine to Support and Resolve Difficulties for Entities Affected by the COVID-19 Pandemic
1. From August 6, 2021 to December 31, 2021, the level of collection of certain fees and charges in the field of veterinary medicine shall be as follows:

At 50% of the charge level prescribed at Point 1 Item I Fee and Charge Table in Circular No. 101/2020/TT-BTC dated November 23, 2020 of the Minister of Finance stipulating the level of collection, payment, management of fees and charges in the field of veterinary medicine. |

Charge for issuing certificates of practice in veterinary services |
At fifty percent of the service fee level prescribed in point 2, Section I of the Veterinary Work Fee and Service Fee Schedule issued together with Circular No. 101/2020/TT-BTC. |

Inspection fee for clinical examination of poultry |
At fifty percent of the fee level prescribed in point 1.4, Section III of the Veterinary Work Fee and Service Fee Schedule issued together with Circular No. 101/2020/TT-BTC. |
2. From January 1, 2022 onwards, the level of collection of the above fees and charges shall be implemented according to the provisions in the Fee and Charge Table in the field of veterinary medicine issued together with Circular No. 101/2020/TT-BTC.
Article 2. Effectiveness
1. This Circular takes effect from August 6, 2021 to December 31, 2021.
2. Matters concerning the scope of regulation, applicable subjects; organization of fee and charge collection; declaration, payment of fees and charges; management and use of fees and charges and other related matters not stipulated in this Circular shall be implemented according to the provisions in Circular No. 101/2020/TT-BTC.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report them to the Ministry of Finance for further study and supplementary guidance.

Repeals Circular No. 146/2014/TT-BTC dated October 6, 2014 issued by the Minister of Finance guiding financial regulations for securities companies and fund management companies.
Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Legislative Regulatory Documents.
At the proposal of the Director of the Department of Financial Affairs of Banks and Financial Institutions
Based on the Law on Enactment of Legislative Acts dated June 22, 2015;
Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;
Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;
1. Securities companies, fund management companies, and foreign fund management company branches licensed to operate in Vietnam shall organize their operations and financial management in accordance with the Securities Law 2019, Decree No. 155/2020/NĐ-CP dated December 31, 2020 of the Government detailing some provisions of the Securities Law, Circular No. 121/2020/TT-BTC dated December 31, 2020 of the Minister of Finance on the activities of securities companies, Circular No. 99/2020/TT-BTC dated November 16, 2020 of the Minister of Finance guiding the activities of fund management companies, Circular No. 91/2020/TT-BTC dated November 13, 2020 of the Minister of Finance on financial safety indicators and measures to address securities trading organizations that do not meet financial safety indicators, Circular No. 48/2019/TT-BTC dated August 8, 2019 of the Minister of Finance guiding the establishment and handling of inventory write-down reserves, investment losses, bad debts, and product warranty costs at enterprises, and any subsequent amendments, supplements, or replacements.
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Department of Banking and Financial Institutions;
1. Securities companies, fund management companies, and foreign fund management company branches licensed to operate in Vietnam shall organize their operations and manage finances in accordance with the Securities Law 2019, Decree No. 155/2020/NĐ-CP dated December 31, 2020 of the Government detailing implementation of certain provisions of the Securities Law, Circular No. 121/2020/TT-BTC dated December 31, 2020 of the Minister of Finance on the operation of securities companies, Circular No. 99/2020/TT-BTC dated November 16, 2020 of the Minister of Finance on the operation of fund management companies, Circular No. 91/2020/TT-BTC dated November 13, 2020 of the Minister of Finance on safe financial expenditures and measures to handle securities business organizations that fail to meet safe financial expenditure requirements, Circular No. 48/2019/TT-BTC dated August 8, 2019 of the Minister of Finance on the establishment and handling of inventory reserve reductions, investment losses, difficult-to-collect receivables, and product, goods, service, and construction project warranties at enterprises, and any subsequent amendments, supplements, or replacements thereof.
Article 1. Repeal Circular
2. As for the surplus of the additional paid-in capital reserve fund established according to Circular No. 146/2014/TT-BTC, securities companies, fund management companies, and foreign fund management company branches licensed to operate in Vietnam shall increase their registered capital according to the Securities Law No. 54/2019/QH14, guiding documents, and the charter of organizational and operational activities of enterprises.
Article 2. Transitional Provisions
2. As for the surplus reserve funds and risk operation reserve funds established in accordance with Circular No. 146/2014/TT-BTC before the effectiveness of this Circular, securities companies, fund management companies, and foreign fund management company branches licensed to operate in Vietnam shall increase their registered capital in accordance with the Securities Law 2019, relevant guidance documents, and the Articles of Association of the enterprise.
2. With regard to the surplus of the additional paid-in capital reserve fund and the financial risk reserve fund established in accordance with Circular No. 146/2014/TT-BTC prior to the effectiveness of this Circular, securities companies, fund management companies, and foreign fund management company branches licensed to operate in Vietnam shall increase their paid-in capital in accordance with the Securities Law 2019, guiding documents, and the Articles of Organization and Operation of the enterprise.
Article 3. Effectiveness and Implementation
1. This Circular takes effect from the date of January 2021 and applies to the fiscal year 2021.
2. The Director of the Office of the Ministry of Finance, the Head of the Department of Banking and Financial Organization Finance, the Heads of relevant units under the Ministry of Finance, securities companies, fund management companies, foreign fund management company branches licensed for establishment and operation in Vietnam, and related organizations and individuals are responsible for implementing this Circular./.
