CIRCULAR

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 148/2018/TT-BQP DATED OCTOBER 4, 2018 ISSUED BY THE MINISTER OF NATIONAL DEFENSE ON THE SELECTION AND CALLING UP OF CITIZENS FOR MILITARY SERVICE

Pursuant to the Law on Military Service dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Certain Provisions of 11 Laws on Military and National Defense dated June 27, 2025;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing certain articles of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Chief of General Staff;

The Minister of National Defense issues this Circular to amend and supplement certain articles of Circular No. 148/2018/TT-BQP dated October 4, 2018 of the Minister of National Defense stipulating the selection and calling up of citizens for military service.

Article 1. Amendments and supplements to certain articles of Circular No. 148/2018/TT-BQP dated October 4, 2018 of the Minister of National Defense stipulating the selection and calling up of citizens for military service

1. Amend and supplement Points a and c Clause 3 Article 4 as follows:

Amend and supplement point a as follows:

"a) Select citizens who meet health standards of Type 1, Type 2, and Type 3 as prescribed in Article 5 and Article 6 of Circular No. 105/2023/TT-BQP dated December 6, 2023 of the Minister of National Defense on health standards and health examinations for individuals under the management of the Ministry of National Defense."

b) Amend and supplement Point c as follows:

"c) Do not call up for military service citizens suffering from myopia greater than 1.5 diopters or hyperopia at any level; body mass index less than 18.0 or greater than 29.9."

2. Amend and supplement certain points and clauses of Article 5 as follows:

a) Amending and supplementing Point b Clause 1 as follows:

"b) Is the sole worker directly supporting dependent relatives who are no longer capable of working or have not yet reached working age; in families heavily affected by casualties and property damage caused by accidents, natural disasters, or dangerous epidemics, confirmed by the People's Committee of the commune, ward, or special administrative region (hereinafter referred to collectively as commune)."

b) Amend and supplement Clause 4 as follows:

"4. The list of citizens eligible for temporary deferment or exemption from being called up for military service must be publicly disclosed on the commune’s electronic portal and posted publicly at the People's Committee office of the commune, agencies, organizations, and community living areas such as villages, neighborhoods, residential zones, hamlets, villages, phums, and socs (hereinafter referred to collectively as village) within twenty days from the date the Chairman of the Provincial People's Committee signs the Decision."

3. Amend and supplement Article 6 as follows:

"Article 6. Responsibilities of localities in conscription

1. Responsibilities of People's Committees at all levels:

a) Effectively carry out propaganda, dissemination, and education to enhance public awareness and responsibility in implementing the Law on Military Service, particularly among citizens of conscription age; direct conscription work according to regulations, meeting assigned quotas, ensuring quality;

b) Establish a Military Service Council with the required number of members and appropriate composition; assign tasks and clearly define responsibilities for organizations and individuals involved in implementation. Fully leverage the roles and responsibilities of the entire political system at the local level; the advisory role of military agencies at all levels and the responsibility of village chiefs in conscription;

c) Allocate recruitment quotas suitable to the conditions of each locality and unit, linked to mobilization areas; ensure that all communes, wards, and special administrative cities have citizens enlisting;

d) Ensure thorough conscription, selecting individuals with certainty; create favorable conditions for receiving units to study files, finalize troop numbers, and conduct three meetings and four knowings as specified by the Ministry of National Defense. Coordinate with receiving units to replace those conscripts who do not meet requirements upon joining the military unit if necessary; the replacement ratio shall not exceed 2% of the locality's assigned quota; bear responsibility for the quality of conscripts;

đ) Direct the Military Service Council and related departments to monitor, guide, urge, and inspect the effective implementation of conscription work; annually organize coordination meetings to deploy conscription work, and conduct reviews, mid-term summaries, and final evaluations of conscription work as prescribed;

e) Promptly address complaints and denunciations, strictly handle violations in conscription according to the law; widely publicize to educate and foster public consensus, preventing negative phenomena.

2. Responsibilities of the Provincial People's Committee:

a) Fulfill responsibilities as stipulated in Clause 1 of this Article and direct the Military Service Council, relevant departments, and commune-level People's Committees to implement conscription according to regulations, ensuring sufficient quotas and conscript quality;

b) Personally implement and direct conscription work; accurately grasp the number of citizens subject to conscription present and absent in the locality; organize training for conscription staff; direct the strict preliminary screening, medical examination, and review process, ensuring democracy, fairness, transparency, and efficiency; facilitate citizens' quick and compliant preliminary screening and medical examination; assign Military Service Council members to oversee and direct conscription in specific communes, agencies, and organizations, sharing responsibility for conscription quotas and quality;

c) Establish regional Military Service Medical Examination Boards and medical examination teams suitable for each area and assigned quota, ensuring adequate composition and equipment as prescribed; organize convenient medical examination sites, ensuring conditions for specialized examinations, clearly assigning responsibilities to individuals involved in the medical examination process to ensure quality, accurate conclusions, and accountability for results;

d) Direct the examination and approval of temporary deferment from and exemption from military service strictly, democratically, fairly, publicly, and have the Decision signed and issued by the Chairman of the Provincial People's Committee;

đ) Direct the scheduling of Military Service Medical Examinations suitable for each locality; the number of examinations shall not exceed four times the conscription quota. Finalize troop numbers and decisions on conscription calls by commune-level authorities, with a reserve ratio not exceeding 5% of the conscription quota, and complete all necessary procedures and files (including party member and youth league member files) for conscripts handed over to receiving units and organize the handover ceremony at the Regional Defense Command Post or cluster commune designated by the Provincial People's Committee.

3. Responsibilities of the Commune People's Committee:

a) Fulfill responsibilities as stipulated in Clause 1 of this Article and direct the Military Service Council, related departments, and villages to implement conscription according to regulations, ensuring sufficient quotas and conscript quality;

b) Direct the villages to organize elections, propose male citizens within the age for military service to undergo preliminary recruitment examinations in accordance with regulations, ensuring democracy, fairness, transparency, quality, and effectiveness;

c) Organize preliminary recruitment examinations; establish a list of individuals called for health check-ups for military service to hand over to the Health Examination Board and the Defense Command of the region; call for health check-ups for military service (the number of calls for check-ups shall not exceed four times the conscription quota); review citizens for enlistment;

d) Report to the Military Service Council at the provincial level through the Provincial Military Command the list of citizens meeting the conditions for enlistment, temporary deferral of enlistment, and exemption from enlistment. Establish and complete all military service files and related procedures for citizens meeting the conditions for enlistment to hand over to the Defense Command of the region;

đ) Publicize on the commune's electronic information portal and post at the commune People's Committee office, agencies, organizations, and community venues of the villages according to regulations the following contents:

- The provincial recruitment quota assigned to the commune;

- Recruitment conditions and standards; cases of temporary deferral of enlistment and exemption from enlistment; - List of citizens subject to enlistment;

- List of citizens temporarily deferred from and exempted from military service;

- List of citizens meeting the conditions for enlistment;

- Preliminary health screening results and health classification according to the conclusion of the preliminary health screening team for military service and the Medical Examination Board for military service in the region;

- List of citizens successfully recruited for military service ready for enlistment.

e) Coordinate with the Defense Command of the region and the receiving units to coordinate the handover of recruits, unify the number of troops; decide on calling citizens for enlistment;

g) Direct the Commune Military Command to cooperate with relevant departments to guide citizens who have received the decision to be called for enlistment, fill out the health insurance registration form (according to the model), with confirmation from the Commune People's Committee to hand over to the Defense Command of the region along with the military service file;

h) Direct the Military Service Council, when conducting health checks, to register uniform sizes for each citizen and inform the receiving unit to ensure issuance according to regulations; organize the distribution of some items of uniforms for new soldiers three to five days before the handover ceremony to ensure uniformity, compliance with regulations according to each branch and the weather and climate conditions of the region;

i) Coordinate with the Defense Command of the region to implement the Handover Ceremony in accordance with regulations;

k) Regularly exchange information about the situation of citizens called for enlistment; coordinate with the Defense Command of the region and the receiving units to implement replacement at the unit (if necessary) to ensure quality and the prescribed time;

l) Direct the Commune Military Command to cooperate with the Commune Police Station and relevant departments to grasp political criteria, morality, and new issues of citizens preparing for enlistment, promptly provide information and supply to the Defense Command of the region and the receiving units for management. Coordinate with the receiving units and families to resolve desertion cases according to the law.";

4. Amend and supplement some clauses of Article 7 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Coordinate with localities to hand over troops to unify recruitment quotas, the time to study files and confirm troop numbers with localities ten days prior to the day the Chairman of the Commune People's Committee decides to call citizens for enlistment; coordinate with the Provincial Military Command, the Defense Command of the region, and the Commune People's Committee to organize and attend the Handover Ceremony at the Defense Command of the region or cluster of communes; receive troops and transfer them to units by bus or train to ensure absolute safety; do not keep troops in localities for long periods; prepare well in all aspects to receive and train new soldiers according to plan.";

b) Amend and supplement Clause 3 and Clause 4 as follows:

"3. Within ten days from the date of receiving troops, organize a recheck of new soldier standards and complete replacements (if necessary).

In case it is necessary to wait for results of verification regarding politics, morality, or health examination, promptly notify and coordinate with the Defense Command of the region and the Commune People's Committee to proactively manage replacement numbers. The replacement period shall not exceed fifteen days from the date of handover; the replacement ratio shall not exceed two percent compared to the handover quota of the locality with the unit.
4. Be responsible for the results of the recheck, unify with the Defense Command of the region and the Commune People's Committee to establish documents and implement replacement handovers (if necessary) at the unit. Annually organize experience sharing, mid-term reviews, and final summaries of recruitment work according to regulations.";

5. Amending and supplementing Article 10 as follows:

"Article 10. Organization of Handover of Troops

1. The Provincial People's Committee takes the lead in organizing coordination between localities and receiving units to unify recruitment quotas and timeframes: studying files, implementing "three meetings, four knowledges" (for units specified to implement), confirming troop numbers, methods of handing over troops as follows:

a) The Provincial People's Committee coordinates with division, brigade, and equivalent levels (directly subordinate units under the Ministry).

b) The Provincial Military Command directs the Defense Command of the region to coordinate with the Commune People's Committee to coordinate with battalion-level and equivalent units (directly subordinate to division-level and equivalent units).

2. The Provincial People's Committee and Commune People's Committee direct military agencies and public security agencies at the same level to closely coordinate in selecting and calling citizens for enlistment and performing duties to join the People's Public Security; military agencies and public security agencies at the commune level unify recruitment quotas and personnel for citizens to be called for enlistment and performing duties to join the People's Public Security.

3. Localities and units closely coordinate in the process of recruiting and managing troops. Receiving units assign command officers as prescribed to coordinate recruitment with the Provincial People's Committee, Commune People's Committee, and the Defense Command of the region and are responsible for the contents of the coordination.";

6. Amend and supplement Clause 2 of Article 11 as follows:

"2. The Provincial People's Committee directs the Provincial Military Command to coordinate with provincial departments to organize the Handover Ceremony at the Defense Command of the region or cluster of communes within the area determined by the Provincial People's Committee to ensure compliance with regulations, solemnity, efficiency, safety, economy, and create a festive atmosphere for the handover ceremony; the handover and receipt records between the locality and the unit are signed at the end of the ceremony program.";

Article 2. Implementation clause

1. This Circular takes effect from July 1, 2025.

2. The Chief of General Staff, Chairmen of the People's Committees of provinces and centrally governed cities, and heads of relevant agencies and units are responsible for implementing this Circular./.
