DECREE
On the functions, tasks, powers, and organizational structure of the Civil Aviation Administration of Vietnam
THE GOVERNMENT
BASED ON THE Law on Government Organization dated September 30, 1992;
Pursuant to the Civil Aviation Law of Vietnam dated December 26, 1991; the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam dated April 20, 1995;
BASED ON Decree No. 15/CP dated March 2, 1993 of the Government regarding tasks, authorities, and responsibilities for state management of ministries and ministerial-level agencies; Decree No. 32/CP dated May 22, 1995 of the Government concerning the transfer of the Civil Aviation Administration of Vietnam under the Government;
Considering the proposal of the Director of the Civil Aviation Administration of Vietnam and the Minister, Head of the Organizational and Cadre Affairs Board of the Government,
DECREE:
Article 1. The Civil Aviation Administration of Vietnam is an agency under the Government with the function of managing the civil aviation industry nationwide.
Article 2. The Civil Aviation Administration of Vietnam shall be responsible for performing state management tasks as prescribed in the Civil Aviation Law of Vietnam dated December 26, 1991, the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam dated April 20, 1995, Article 21 of Decree No. 15/CP dated March 2, 1993 of the Government, and the following specific tasks and authorities:
1. Submit to the Government draft laws, ordinances, strategies, plans, policies for the development of the civil aviation industry, regulations of the Government on managing the civil aviation industry and organizing the implementation of such matters.
2. Submit to the Government proposals for establishing and allowing the operation of air routes, restricted or prohibited airspace areas, participation in and signing international aviation treaties; signing cooperation documents with other countries and international organizations on civil aviation as prescribed by the Government.
3. Issuing technical procedures and standards for civil aviation operations, safety, and participating in the establishment of tax, fee, and charge regimes for civil aviation activities.
4. Organize and manage the operation of civil air routes, flight information regions, and air traffic control; plan and manage the technical information system serving civil aviation. Coordinate with relevant agencies to manage airspace, protect national security.
5. Take the lead and coordinate with the Ministry of National Defense, the Ministry of Public Security, relevant state management agencies, and local authorities to ensure aviation security and safety, special aircraft flights, civilian airports, joint-use military-civilian airports. Organize coordination with related sectors and localities in search and rescue operations and investigations of civil aviation accidents.
6. Submit to the Prime Minister proposals for establishing and dissolving air transport enterprises, foreign investment cooperation projects in the civil aviation sector, establishment and operation of civil airports.
Manage domestic air transport enterprises according to the law and government regulations; manage the activities of foreign airlines operating within the territory of Vietnam according to Vietnamese law and international practices.
7. Manage the registration of civil aircraft; coordinate with the Ministry of Trade to manage the import and export of aircraft, equipment, and materials serving civil aviation; manage and supervise the repair and maintenance of aircraft and engines, production of aircraft equipment, and specialized equipment serving civil aviation activities.
8. Issuing, suspending, extending, amending, and revoking certificates, licenses, and permits related to civil aviation activities as prescribed by the Government.
9. Manage scientific and technological activities in the civil aviation sector; organize research and application of scientific and technological advancements in the civil aviation sector; coordinate with the Ministry of Science and Technology and Environment in environmental protection in civil aviation activities.
10. Manage organizational structure, personnel, training, recruitment, and human resource development in the civil aviation sector; coordinate with the Ministry of Education and Training in training cadres for the civil aviation sector.
11. Managing assets and land granted by the State.

Article 3. The Civil Aviation Administration of Vietnam is headed by the Director, assisted by Deputy Directors. The Director and Deputy Directors are appointed and relieved of their duties by the Prime Minister. 2. Civil Aviation Port Authorities:
BASED ON Article 27 of the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam, the Director of the Civil Aviation Administration of Vietnam shall submit to the Government regulations on the organization, tasks, and authorities of the Air Traffic Control Office and the coordination rules among state management agencies at airports.
3. Public Service Units:
Civil Aviation Magazine.
Civil Aviation Air Traffic Management Center (self-financing public service unit).
The Director of the Civil Aviation Administration of Vietnam shall prescribe the tasks, powers, and organizational structures of the organizations mentioned above in points 1 and 3.
Article 5. This Decree takes effect from the date of issuance. Decree No. 242-HĐBT dated June 30, 1992 of the Council of Ministers (now the Government) on the establishment of the Civil Aviation Administration of Vietnam, Decision No. 36/TTg dated February 6, 1993 of the Prime Minister on the Charter of Organization and Operation of the Civil Aviation Administration of Vietnam, and other previous regulations inconsistent with this Decree are hereby abolished.
Article 6. The Director of the Civil Aviation Administration of Vietnam, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
